McIntire 24 Carey Lane South Windsor, CT 06074 RE: TREE AND LAWN DAMAGE AT 24 CAREY LANE Dear Mr. McIntire: Mr. Melvin Stead, Superintendent of Street Services, has forwarded your letter of February 15 , 1985 to me for review, and has investi- gated your claim for damages. The Town' s Tree Warden examined the dogwood tree in question in March of this year. At that time, he treated a minor abrasion on the tree with pruning spray and has assured me that the tree has received no permanent damage. The tree was once again examined on April 4 , 1985 and showed to be budding and healthy. The lawn area did not appear gouged out but did have a deposit of sand in the area of the tree. This will be cleaned up by the Town. At this time, I cannot justify the monetary restitution as you have requested. The Town of South Windsor employs competent groundskeepers capable of replacing the dogwood tree if necessary, and of repairing any lawn damage. We will continue to monitor the condition of the tree, and if it becomes necessary, the Town would replace the tree as follows: 1. The Town would acquire the tree. 2. The Town would remove and replant the tree on other Town-owned property. 3. The Town would install a new dogwood and repair any lawn damage caused by the installation. Any bills submitted to the Town, at this time, will be denied. Very truly yours , Rob t - enault Director of Public rNorks cc: Melvin C. Stead, Jr. , Supt. of Streets r " February 15, 1985 / IA- Y Town of South Windsor Sullivan Avenue South Windsor, CT. 06074 Attn: Mel Stead Dear Mr. Stead: Pursuant to our telephone conversation of 5 February 1985 I would like to document the damages done to my property at 24 Carey Lane, South Windsor by the Town of South Windsor snow removal service on 3 February 1985. Twice the snow plow driver overshot the end of my cul-de-sac pushing the snow well up into my yard doing visible damage to the grass and a pink dogwood tree which was planted last March. On 4 February Sullivan Landscaping, who planted the dogwood (still under his warranty) and has a contract for my yard service, inspected the damages and his estimate for repairs is attached. Although no action can be taken until Spring, I would like to make arrangements for restitution as soon as possible. Please let me know when a time is convenient to discuss this matter further.
