HomeMy WebLinkAboutAndreis Trail MEMORANDU .cE►vD Town of TO: Matthew Galligan, Town Manager 2 9 08 South JUL FROM: Gary K. Tyler, Chief of Police Windsor jowN pg0UTF1 WINDSOR DATE: 28-July-2008 oUce Services SUBJECT: Site Line Problem Intersection of Chief Ryan Way& Andreis Trail At one of our several meetings concerning the Bark Park, one of the residents who lives on Andreis Trail complained about vehicles on Chief Ryan Way. This individual indicated that it was difficult entering Chief'Ryan Way from Andreis Trail because of the site line problem looking westbound from Andreis trail. This resident's suggested solution was to place a stop sign southbound on Chief Ryan Way at the intersection of Andreis Trail. We do not feel that the through street of Chief Ryan Way needs a stop sign. We believe the solution to this problem is the removal of, or trimming of, trees and debris from the property at 20 Andreis Trail. Assuming the Town wants to address this problem, would you prefer that Street Services make the contact with the resident at 20 Andreis Trail, or would you prefer for the Police Department to make the contact? We have a serious problem in that everytime it rains at least a good 50% or more of our driveway is flooded with anywhere from 1/4 to 1 inch of water. We have spoken to the builder, U&R construction-Ludi, who said "This is not my problem and there is no contract written that I cannot break." I do not feel that this is a proper way to do business when dealing with such a expensive product. I have spoken to Mr. Rick Martell who sent a gentleman out to look at this problem and he agreed that this is in fact the problem of the builder to correct and there was at least 50% of the driveway covered with water. We have been more than patient with the builder in trying to correct this problem and several others and would hope that the Planning and Zoning Commission is able to help us in the correction of this problem. We would also hope that the Commission would be able to stop this from happening to future residents of South Windsor. We thank you for your anticipated help in this serious manner. EXCAVATING & GRADING 324 SOMERS ROAD ELLINGTON, CT 06029 (203)875-4217 December 12, 1985 Re: Mark & Kathy Baer To whom it may concern; Recently I became aware of a legal suit involving U & R Construction and the Baer's and because my company has performed work for both parties I would like to take the opportunity to explain to the best of my knowledge the events of the work that was performed. Initially the finish grading done in behalf of U & R Construction was such that proved adequate drainage of surface water to the rear of the property. Then at a later date I was contacted by the Baers and asked for an estimate for doing some excavating and grading work around their new swiming pool which had been installed after the final grading work done for U & R Construction. It was at this time that I noticed that the complete area to the right of the house and all but a small area in the back yard was disturbed because of the construction of the pool. It might also be noted that at this time that they were living in their home and that to my knowledge there were no complaints with reguard to any of the grading done for U & R Construction. The estimate that they requested was for the following work: A. Excavate and backfill for a retaining wall. B. Load and haul in fill and topsoil which was offered and provided free of charge by U & R Construction for around the pool. (259 cu yds. of fill-102 cu yds. topsoil) C. Provide a Bulldozer to level fill and topsoil as instructed by the Baers and their landscaper who had a sketch drawn showing approximately what was to be done. Following this I gave them the estimate and we were contracted to perform this work as stated. I also suggested their be present when work was being done for the reason that there were no detailed drawings. . 7-22-85 My backhoe operator dug out for the retaining wall under the direction of Mrs. Baer, 8-1-85 The retaining wall was backfilled. 9-30-85 & 10-7-85 The fill was hauled in and a Bulldozer was provided to grade the fill and topsoi at the direction of Mr. and Mrs. Baer and their landscaper. I would like to mention at this point the t JOHN A. LIMBERGER INC. EXCAVATING &GRADING 324 SOMERS ROAD ELLINGTON, CT 06029 (203) 875-4217 quanities of fill and topsoil provided free of charge by U & R Construction as follows: 259 cu-yds . of fill worth approximately $777.00 and 102 cu-yds. of topsoil worth approximately $714,00 totaling t1 ,491 .00) It was after this that I spoke with my bulldozer operator and was informed that the work was completed and satisfactory. Later on 10-12-85 I was contacted by the Baers and informed that an apron had been installed around the entire pool and that the grade adjacent to the apron was higher then the pool- and- they were concern- ed that surface water might drain into the pool. So I made arangments to move the bulldozer back and lower the grade on that particular area. Again there were no other complaints about anything. I was paid for the work performed on 10-30-85. The next time I heard from the Baers was an approximately 11-27-85. It was at this time that Mrs. Baer had spoken to my secretary and asked if I would come out to see them as they were having a problem with water draining int6 their neighbors property and water not draining out of their driveway. She told my secretary that the landscaper said the driveway had been put in wrong and that the driveway contractor had told her the landscaping had been done wrong and would I come and take a look at it for her. Shortly after that I stopped out to their home and these were the observations I made. I would like to mention too at this time that as I drove up and was speaking to Mrs. Baer and her neighbor, Mr. Baer came driving in and started firing questions at me and apparently didn't agree with the answers I was giving him and became very irate, hollering to the point where I felt I had to get in my truck and drive down the street to get away from him. I waited for a few minutes and went back and continued my conversation with Mrs. Baer and her neighbor who were still outside in the yard. At this point these were my observations : 1 . Because of the pool being installed very high in the back yard of the Baers it was impossible now to maintain a swale at the property line between them and their neighbors property. 2. The area adjacent to the driveway where the water had been draining apparently since the original grading work by U & R Construction was now turfed with sod and not allowing the water to drain off. I say this because there were sprinkler. heads in this area that were never disturbed since I had been there the first time I came out to give the Baers anti:estimate. JOHN A. LIMBERGER INC. EXCAVATING & GRADING 324 SOMERS ROAD ELLINGTON. CT 06029 (203) 875-4217 3. I also noticed that in one area adjacent to the pool area because of being misinformed, the bulldozer operator had gone across the property line approximately five feet and disturbed a small area on the neighbors property. At this time the area had been raged and reseeded. 4. I also made suggestions to both property owners as to what they might do to correct their drainage problems. 5. It is my opinion that the Baers problems were those created by the installation of their swiming pool and not those of U & R Construction. I also feel there was a willingness on U & R Constructions part to help the Baers which was evidenced by their providing materials free of charge worth approximately $19500.001d" Sincerely, 4hn A. G, -es yL 07 Anareis 'trail 1-7-86 South Windsor, Ct. s Dear Attorney Yules, I am writing this letter to you to explain a very serious problem which exists at 85 Andreis Trail in South Windsor; a property sold by U&R construction whom you represent. Everytime it rains we have a driveway which is covered at least a good 50% with water ranging from 1/4 to 1 inch deep. We have contacted Ludi who says "This is not my problem and there is no contract written that I cannot break." We do not feel• that this is a proper attitude to have when dealing in such expensive a product as U&R houses. In three separate opinions, which can change from day to day., we were told the following; 1 . John Limberger said that this was the responsi- bility of U&R constrution because of the improper rough grading of the house adjacent to 85 Andreis trail which leaves no swale between the two properties,2. Ray Boutin said that this driveway was put in according to the instructions of U&R and that it had to be due to the improper level of the house which is low according to the street level,3. The landscaper who did the installation of the final sod and bushes said that it was the re- sponsibility of the builder who did not have the property properely rough graded and that- a great deal of water flows onto the property from the house next door due to the fact that no swale was installed and the house next door is on a higher ground level. Three important facts should also be considered; 1 . U&R was over 4 months late on the construction of this house which caused both physical and mental anguish 2. Flooded property is not good for the image of either U&R con- struction or the beautiful town of South Windsor 3. Such practices should not be allowed in the construction of future houses in South Windsor due to the detraction from the natural beauty of such an area. We have been in contact with Mr. Rick Martell who sent a gentleman out to inspect the property and indeed agreed with us that the driveway was done improperly and was covered with at least 50% water. He also said that U&R was indeed responsible for this problem and should correct it. We have been more than patient with your client and trust that the Town of South Windsor will help us correct this problem and perhaps not let such a severe thing from happening again. cc; Rick Martell C MSB/as Dr. Marc S. It is my under- standing that the westerly neighbor would be agreeable to some re- grading on his property. I realize that your relationship with Dr. Baer is not on the best of terms . I am relying on the excellent reputation of U & R Construction to resolve this problem. Your anticipated coorporation is appreciated. Very truly yours , Richard P. I was there on April 23, 1986, at which time it was raining and had been raining at least two hours prior to my visit. I observed ponding on the right side of the driveway (facing the house) almost along the entire length of the driveway. Everybody agrees that the drive- way Was little or no pitch to the street. Prior to going to and viewing the site, I called Mr. Upenieks to request his opinion and assistance. He said that he had looked at it and further replied that he would not consider doing any driveway improvements until grading improvements were done on the right side of the driveway. This appears to be reasonable as the ponding occurs on this side of the driveway and regrading should greatly reduce the problem. The only problem with the above solution is who will be responsible for this work. Fran the correspondence that I have from both you and Mr. Upenieks, each of you claims that the other is responsible for the present grading conditions. This is a matter that I have no control over and it must be resolved among yourselves. Very truly yours, chard P. I do not believe that further intervention at this time would be productive, and I feel that this issue must be resolved by the parties. I would be pleased to provide copies of the aforementioned documents and discuss this matter further should you so desire.
