Dear Mr. Davies:
After considerable discussion, we have decided to plant two 2.5
inch diameter trees in our back yard instead of in the front yard as
mandated in the plan of development. Since we have 3 trees in the front
yard already, it seems fruitless to plant 2 more trees there when there
are no trees in the back yard.
It is agreed between the builder, Mr. John Santha and the new
owners, M. Jane and Kenneth D. Taylor, that the 2 mandated trees, as
previously mentioned, be planted in the back yard instead of the front
yard. Since this planting arrangement agrees with the spirit of
increasing the tree population of new subdivisions, we would appreciate
it if you would consent to this arrangement and release Mr. Santha- s
escrow funds once the two trees have been planted in the back yard.
