CLAPP, ET AL SUPERIOR COURT IV• JUDICIAL DISTRICT OF HARTFORD/ I f NEW BRITAIN AT HARTFORD , IZONING BOARD OF APPEALS OF I THE TOWN OF SOUTH WINDSOR : OCTOBER 21, 1981 I+ MEMORANDUM OF DECISION I I This appeal is from a decision of the South Windsor Zoning l Board of Appeals (hereinafter referred to as the "Board") granting I I a variance of the 150 foot frontage requirement to allow the use :- of backland as a residential building lot with frontage of 50.01 ; feet on Main Street. The pertinent facts are as follows: The owner of the subject property is Mrs. Marion P. Case of South Windsor. When Albro Case, the deceased husband of Marion P.' Case, purchased the tract in 1962, , it had approximately 254 feet of frontage on the easterly side of .1 Main Street and an average depth of approximately -880 :feet. Shortly - after the a purchase, Mr. Case conveyed the northerly 204 feet, to a depth of 300 'feet (now known as ) , to a third !, party. He retained title to the remaining portion consisting of 11roughly 3.8 acres with frontage on Main Street of 50.01 feet. Mr.' ') Case diedd Marion P. Case inherited title to the 3.8 : . >trls Igo lid 0 18nc 11OWUnl II 1831U 3N1 U 3U10 r Facres. Her application for a variance was granted by the Board on October 2, 1980 and it is that action which i•s the subject of 1 this appeal. i, The land is located in an A-40 Residential Zone. Section I' . 1' 5.2 of the South Windsor zoning regulations requires that a residential building lot in the stated zone have frontage of 150 ' feet on a public street. Mrs. Case had originally applied to the i IiBoard on January 10, 1979 for a variance of the front footage 11requirement to allow the construction of a single family residence I !' on the 3.8 acres. After a public hearing on that application, the 1, I' Board, on or about February 1, 1979, voted to deny the variance on the ground that the hardship was self-created. That denial of iiher request for a variance was appealed to the Superior Court, I ! Judicial District of Hartford, and the Court (Bieluch, J) •sustain d I, the appeal in a Memorandum Of Decision filed April 22, 1980. The Court found that •"the :situation falls* outside- the ' scope of the !- self-created hardship rule" since "the manner in which [Mrs. Case] Iacquired the property [by inheritance] was purely involuntary." I On June 20, 1980, Mrs. Case filed this application for a variance of Section 3. 2 to permit use of the acreage as a ; residential building lot with less than the required frontage. i 2 I i I S P hearinA public ,, on the second application was noticed for hearing ,, on 10, 1980, but, on that date, the application was tabled at the request of Mrs. Case. The public hearing was held on July 29, 1980. At the conclusion thereof, the Board's chairman inquired as i ° to whether the subject property was in a flood management area; , as neither attorney was certain, action on the application was I, deferred pending receipt of that information. Thereafter, upon (, P g being advised that no portion of the parcel was within a "flood ( control management" area, the Board voted to grant the second iapplication stating the following reasons: i "because this parcel suffers an unusual hardship in that the property cannot be II utilized for any other purpose because of the I topography of the land and the character of I the neighborhood would not be detrimentally affected .because any residence would be subject to approval by the historic' distrlct:- - Tie variance is not out of harmony with the general I purpose and intent of the zoning laws and I •. regulations since the lot size provides a more than adequate buffer or separation between j it residences, and the public health, safety, I 3 1 1 f convenience, welfare and property values are protected and not harmed. The conditions of 1 , the approval are that any building constructed would have to comply with a theoretical building I line at least 150 feet behind adjoining property . Thus, - lithe same legal and factual issues were before the Board on both Ilapplications. However, on the basis of the record now before th I, isI court, it is impossible to ascertain if all of the factual and I i , j i I i Ilegal issues being raised here were actually and finally determined by the Board on Mrs. Case's previous application and, therefore, ;! if those issues were before the Superior Court in the previous appeal. The sole reason given by the Board for the denial of the first application (according to the Superior Court's Memorandum Of .. Decision) was that "the hardship was self-created." . The Memorandum IOf Decision states that evidence was submitted to the Board that I the land in question was not suitable for any permitted use other i than the proposed building lot, and, that a denial of the variance would practically destroy the value of the property. However, on ithe present record, it is unclear whether the Board (on the first application), or the Court in the appeal from the Board' s first decision determined an issue on the requested variance other Y than that of a "self-inflicted hardship." The ordinance is consistent with the powers ' granted local zoning authorities under Section 8-6 of the General I' Statutes. Under such a provision, the Board was justified in 11 igranting the variance only (1) if the effect of the zoning iregulatfon upon the subject property has been to create an excep- I! tional and unnecessary hardship, and (2) if the Board's exercise !!' of it authorityto va permitted a use which is in harmony with s vary p y " the general 'purpose of the zoning ordinance (or comprehensive i, plan) and results in substantial justice. The 11granted reason for this is that a variance, by its very•definition, is with respect to a particular piece'of property and, thus, may be enjoyed not only by the present owner but by all subsequent owners; a variance is not a personal, exemption from the enforce- 1 I ment of the zoning regulation, it is a legal status granted to la certain iece f property without regard to ownership. The applicant' s attorney stated to the Board that Mrs. Case i ; had the property for sale; the potential purchaser wished to construct a single family residence on the parcel; the land was wooded and a certain portion thereof came under the inland-wetlands legislation; the potential buyer wished to place the residence on a portion of the land where it could not be seen from the road; the entire I property was in a historic district;. -.the-_pF-operty itself was, vastly ' in excess of the amount of land normally required for a minimum , -lot -in the area; thai the f50 foot frontage_on_Main Street^ tQuvsl._be - Tiused principally for a means of ingress and egress to the single ' family residence; and that the land had been "unproductive." The ," Board was fully aware that the pending sale of the land was conditioned upon the .obtaining of the- variance. - The Board also -- {' heard that there was no other practical use that the land could be (' put to other than a residential building lot; that it was open r - ;14 I I 1 space which produced no income, and, as the land was located ex- elusively in an area of residential homes, there existed no other i reasonable permitted use. The Board was informed that the existing 3 economic hardship was not brought about by any action of the i applicant (existingowner 2 and that the land and the proposed ) C P P : use) satisfied the zoning requirement in all respects, except as ; to the extent of frontage on Main Street. Thus, there were before I+ the Board sufficient facts of an economic hardship establishing ' that the land was not suitable for any permitted use other than y the proposed building lot and that the denial of the variance i, would result in the land, for all practical purposes, having little . or no marketable value. From such facts, the Board could reason- ;' ably conclude that the application of the zoing regulation to this 1 ., particular piece of land greatly decreased or practically destroyed its -vaitie for any permitted use, and, that the application of the ' regulation, under these circumstances, was so minimally -related to the u oee of i the A O residential zone that M--as to -tfiis land r P.. i'P the effect of the regulation was confiscatory or arbitrary.3 ii Plaintiffs argue that there was no evidence before the Board that the property could not be utilized for any other purpose "because of the topography of the land." The Board, . however, had 15 I 1 I I before it the statement of the applicant's counsel as it related ' !Ito the character of the subject land, the maps of the parcel and of the surrounding area, and it was aware of the size and dim nsions i lof the property. Additionally, the Board members were entitled to' take into account their own knowledge of the condition of the land ,, and any facts about the area learned through personal observation. The members of the Board were familiar with the zoning map and the ordinance; as their questions to the attorneys and the public indicated they were familiar with the subject land and the area in which it is located.4 Accordingly, the court , finds that the Board's conclusion regarding a peculiar and unusual hardship has reasonable support in the record. Our Supreme Court j,'has stated that a hardship resulting from a peculiar topography or condition of- the 'land constitutes the -unnecessary or unusual type- - of w_ y ._ J hardship contemplated by such zoning regulations. Plumb v. i } Board of Zoning A,Rpe ls,, supra at p. 601; Talmadge v. Board of. Zoning Appeals, 141 Conn. 639, 643-644 (1954). i Plaintiffs next-. contend that there-Is no basis in -the record for the Board's finding that the granting of the- variance would I 16 I I ' ` I I I 1 not be out of harmony with the general purpose and intent of the zoning regulations, and, that the public health; safety, conve- nience, and property values, would be protected, not harmed. Such contention overlooks the fact that the Board was aware the property that ' was located in a residential zone,/the purpose of the variance was 1. to permit the construction of a single-family dwelling permitted I I ' I Ilin the A-40 district, that the parcel far exceeded the size re- quirement for a residential building lot in that district, the Pi dimensions of the land met all the minimum lot 'requirements of the i ' district in which it was located, and the only non-conformity was the extent of frontage on Main Street. Under such circumstances, ! the Board-could reasonably conclude that the granting of a street 1 ! frontage variance, permitting the construction of one single-family . . II: r-esidencet would not- materially u set. the .com r- ehensive zoning Plan. ! With reference to public health, safety, convenience, welfare, and 11property values, plaintiffs' attorney, at the public hearing, s jalluded briefly to the relationship of the street frontage require- Iment to police and fire protection, esthetic value, and good ! community planning. However, the Board was not required to accept i ! that brief comment of counsel and, again, could only rely on its down knowledge of the area, the zoning and area maps, and the I . i !I I 17 it h ti• I . r f (proposed use of the land in concluding that the public health, !safety, and property values would not be harmed ,by the granting lof the variance. Plaintiffs also assert that the Board, in granting a variances to permit fifty feet of street frontage in a zone requi ring one- I ;hundred fifty feet, exceeded its authority under Section 11.4.1.c i to grant variances from a "literal" enforcement of the ordinance. (; Plaintiffs argue that such a substantial variance of the front I 11footage requirement constitutes far more than simply varying the i "literal" enforcement of the zoning regulation. This contention, ; however, overlooks the facts and information before the Board i. concerning the dimensions of the land and the proposed use. In 1!considering the effect of the variance, the Board was aware that , I on the residence would be constructed/backland which satisfied all the milnim m diinension requiremenAs 'for a residential building lot. -The--Board was informed that -the -fifty--€oot=VOft - i waeVoF b7e used sorely for Ingress and~egreBa*---Tr"e portioti-o-f--t-he t - ;parcel on which the 'single-family residence was to be constructed Thad a boundary facing Main Street which exceeded the minimum lot I'width requirement; however, the varianco was required simply :because that boundary did not front on the public street. Under I such circumstances, it cannot be said that the Board exceeded its r 18 I i i1 authority, or abused its discretion, in granting the variance to permit a 50-foot frontage. In this regard, the ,Board specifically found that the reduced street frontage would not detrimentally affect any adjacent properties or the residential character of the I loverall neighborhood. Plaintiffs also argue that the Board lacked authority to- place restricting conditions on the granting of the variance. Our Supreme Court has stated that the "right to attach reasonable conditions to the grant of a variance is not dependent upon express authorization from the law making body."
