Pamela Mahr, Chairman South Windsor Historic District Commission 1540 Sullivan Avenue South Windsor, CT 06074 RE: REQUEST FOR DETERMINATION AS TO NECESSITY OF APPLICATION FOR CERTIFICATE OF APPROPRIATENESS Dear Madam Chairman: The Porters recently submitted to the Commission detailed information regarding the installation of an inground swimming pool at their Main Street residence. The pool would be located in the back of the residence and not visible from a public street, public way, or public place. This information was provided to the Commission so that a determination could be reached as to the necessity for the filing of an Application for Certificate of Appropriateness . As the proposed alteration is not visible from a public street, public way, or public place, I do not believe that an application is required by law. To date, no determination has been rendered by the Commission. The Porters also have made request for a building permit to be issued so as to allow commencement of the referenced work. The building inspector has reviewed detailed engineering plans, and also has viewed the site and concurs that the proposed installation is not visible from a public street, public way or public place. The building inspector, however, has refused to issue a building permit because your Commission has not authorized him to do so even though a Certificate of Appropriateness is not required in this situation. LOW Offic 5 GILMAN Ty MARKS Ms . Pamela Mahr, Chairman July 19, 1989 Page 2 As such, request is hereby made for the referenced determination by the Commission, and Commission authorization for the building inspector to issue a building permit. In the absence of said determination and authorization from the Commission within ten (10) days from date, I shall assume that you have concluded that an Application for Certificate of Appropriateness is required; and further, that you have refused to authorize the issuance of a building permit, which actions are contrary to applicable law. Thank you for your attention to this request. Sincerely, GILMAN & MARKS BY Ronald P. Sherlock RPS:sea 0642s cc: John Collins, Building Inspector George and Pat Porter any. To introduce myself, I was a member of the Study Committee who wrote the Historic District Ordinance for the Town of South Windsor and am a past member of that commission. I believe I have a thorough understanding of the Connecticut State Statute which prescribes the extent and limitations of authority granted to Historic District Commissions. The land owners of the Historic District voluntarily submitted their pro- perties to the review process of an Historic District and are entitled to the protection granted them by the State Enabling Statute. (historic district designation carries with it no inherent restrictions, only a review process . . . page 1-1 of Handbook for Conn. Historic Districts.) As a representative of these landowners, I urge you to visit the site of Mrs. Porter's propossed swimming pool - 1533 Main Street, see for yourself that it is absolutely not visible from a public street and therefore does not require Hist. District Commission approval, and issue a building permit as you are entitled to do based on the following legal references: 1. Commission authority is limited to what is visible from a public street. Sec 7-147a state statute definitions Sec 7-147d - this section must be read in conjunction with the definition of its terminology set forth in 7-147a. References to this limitation are made in the 1988 Handbook for Historic Districts: Pages: iii - exterior publicly viewable changes 1-1 - visible from public street 11-27 - commission can operate- only with respect to features visible from a public street 111-4 - can review only changes visible from a public street 1V-3 - jurisdiction only over what is visible from public street 1V-4 - bldg. permits cannot be issued without H.D. approval if required. 2. Additional regulations made by any commission cannot exceed the mandate granted by state law. Reference: 11-6(e) Handbook - 1V-1, 1V-2. Sec. 7-147c(e) state statute The commission has no authority to demand to know everything that is going on on any given property. Their sphere of jurisdiction is limited by state law to that which is visible from a public street. (11-27 HANDBOOK) The state law leaves the determination of visibility to the property owner who need not apply for approval if a project is not to be visible. The commission cannot interfere with the building department issuing permits when a certificate of appropriateness is not required. I would be willing to meet with you, the Town Attorney, the Town Manager, and or the Council Members to help any of you understand the purpose, the extent and the limitations of the legislation provided to govern Historic Districts. G'llib i Doris Burgdorf C . IfsT DisT, cINI. July 12, 1989 TO: Jean Zurbrigen, Acting Town Manager FROM: John Collins, Chief Building Official RE: Porter swimming pool application 1533 Main Street I have referred Mrs. Porter to the Historic District Commision so that she may obtain a Certificate of Appropriateness, which is required under South Windsor Ordinance 13-106 (copy enclosed) before a building permit can be issued. My decision is based on the definition of "in view from a public way" as found in the Handbook for Connecticut District and Historical Properties Commissions (copy enclosed) . Please be advised that action is still pending regarding an addition that was put on her house without the proper approval from the Historic District Commission, and that the definition of "public way" seems to be the center of the issue. v, Obviously, printed statements of rules of procedure must be easily available to the public, particularly to property owners affected by commission jurisdiction. It would be advisable for a commission to distribute copies of rules to affected property owners every few years. New residents should receive a copy as soon as they move In. A visit by a commission member can contribute greatly to a property owner's understanding of the responsibilities of living in an historic district or historic property, and help ensure a coopera- tive attitude.Coordination with other government officials can aid a commission in educat- Ing the public, since a property owner's initial contact concerning commission jurisdiction and procedures will likely be through the building inspector. Copies of rules should be available in the offices of the building inspector, town clerk,or other municipal official where a certificate of appropriateness may be obtained, as well as at commission meetings. If design criteria are published, inclusion of rules of procedure would be an appropriate step. Rules of procedure should always be reviewed by the legal counsel of a municipality prior to formal adoption by a commission. In establishing a schedule of meetings, commissioners should consider the needs of potential applicants. The enabling statute mandates a public hearing for every application for a certificate of appropriateness, while the State Freedom of Information Act requires only that an annual meeting be held. Current practice in Connecticut reflects the size of the district and frequency of applications. While most commissions hold monthly meetings, Wethersfield, the stato's largest district with over 1,000 buildings, holds a meeting every two weeks. Some commissions for very small rural districts,on the other hand, meet only when an application is received and for an annual meeting. A set of sample rules is contained in Appendix 5. Z JURISDIMON: Ref.7-1470,d ~ Connecticut's enabling statute confers on historic district and historic properties AM Commissions jurisdiction over the erection or alteration of any building or structure or portion thereof visible from a public street.way,or place. In addition, historic properties commissions specifically have jurisdiction over objects or sites of historical, architectural,or archaeologi- cal significance such as earthworks. The term 'structure" as used in the statute is defined as 'any combination of materials, other than a building, which is affixed to the land." Included are signs, fences, walls, streets, bridges, dams, driveways, monuments, parking lots, lampposts, bandstands, curbs, sidewalks, statuary, docks, outdoorfkeplaces, swimming pools, and any otherfeature of the built environment,as long as it is within the boundaries of the historic district or historic property and visible from a public street, way,or place. In current practice, temporary buildings and structures are not regulated by most commissions. It would appear that the phrase"affixed to the land"as used in the definition of'structure"could imply permanence. However, there is no legal precedent on this issue and some commissions do have policies regarding temporary signage, such as real estate signs. it Is Important to remember that the portion of a building or structure under a • commission's jurisdiction may be visible not only from a public street, but also from a 'way or place."'Public way"may include a privately owned lane, alley,or right-of-woy to which the public has access by customary usage, and the term also Includes a navigable waterway such as a river or Long-tskmdSound..'Public place"also includes a parts, green, square,or other public space. Howeve5 r` fere-tb+ortegal precedent IS lacking r - Section 7-147k V of the historic district enabling statute specifically exempts th property of a nonprofit institution of higher education from the provisions of the act. This Is the so-called Yde University Amendment, the result of a powerful lobbying effort by that institution in 1980,but It is the only exemption and is not Included in the historic properties act. Even though muriicipol attorneys in some locoUtles have claimed that municipolities are xempt from historic district commission jurisddiction in the some way that they are considered _,exempt from planning and zoning, most towns follow the policy of applying to the local commission,as do many state agenci s.Towns are not eligible to vote as property owners In the establishment of on historic district or historic property. There Is no specific exemption In the nabling statute for property owned by either municipalities or churches. _ '' y -e va• t. cam$" 1;._ " ' • 't =',,,,,- ,_ .' •'.;.tom-• ,. --` r z•_ - - tP; ul •inEaC ko O i _ _ 2i..Zs N 40 lip. ` I 3 • u Q / P co } T I- Sown-► WiNosolk EVRGRFEN I t CEMST TARY I • Zy• M I 4 .N • .S I 90• N ``•Sb 20.0' ---- • tit O _ 2 CHO =P zQ N `10'- I-I Xp NA A1N S't'RSE T r - - -. . r,f the rrCq-., tr-loth®r With With p!an ln"I 4dinp ar,,,7 stito t;-ws 'Jed by- the Bulib'm, ,ep.,rlv,j,,qt ?W& a "tion nd firw suance oVa uurTnk, ,mod z is CA&n Is approved suhkµct to the 'ndit; iers and ordinances regu4ating t-MINAng SS mpiled with, Appvq.vM ;these filmed 'luAdMg inspectpA 79 4 0'- r !uf I n o L 1" I., Date 4 1 /jA.A PERMIT DEPARTMENT DECISION APPLICATION FOR ELECTRICAL PERMIT Application is hereby: TOWN OF SOUTH WINDSOR APPROVE DISAPPROVED BUILDING INSPECTION DEPT. 644-2511 Ext. 230 Application must be printed or typed . Goodwin, Clerk BUILDING DEPARTMENT 588 Main Street South Windsor, CT 06074 To The Historic District Commission: In your recent communication, you requested additional information concerning the pending installation of the swimming pool in the back yard of our home at 1533 Main Street. As you are aware, we notified you out of courtesy so that you could acknowledge that the pool in question was not within your jurisdiction because it cannot be seen from a public street, way or place. Thus, further information concerning it, is not necessary for your acknowledgement regarding jurisdiction. Several weeks ago, prior to our submission of this most recent document, we contacted Mr. William Rhines, former head of the Connecticut Association of Historic District Commissioners for a number of years, and reviewed the situation with him for guidance. He stated that under the circumstances involved, no Historic District Commission has any authority or jurisdiction over matters pertaining to subjects/objects not visible from a public way. Should you find otherwise, we will be guided accordingly. We have acted in good faith and hope that you will likewise, so that we can put this confrontation to rest. Every source we have consulted and/or brought to the premises to inspect the situation...including the South Windsor Building Inspector...find that your Commission has and is exceeding its authority. We, therefore, respectfully request that you release the building permit for the swimming pool forthwith. In summary, it seems to other residents within the Historic District, as well as the various professional sources and references which we have involved in the circumstances surrounding the issues at 1533 Main Street, that the South Windsor Historic District Commission is operating outside of the Connecticut State Law - a copy of which is attached. As requested above, we therefore ask that you remove yourselves from this issue and allow the appropriate bodies to act w?thin their designated jurisdiction.
