Re: Woodbridge Roofing Leaks
Chase Orchards Subdivision
Lot's 5, 9, 22, 26, 27, 30, 31, 34, 36, 37and 38
Dear Contractor:
Regretfully I am sending you this correspondence. We each have suffered much
disappointment and loss with our involvement at Chase Orchards. Prior to the outset of the
Gerber Construction lawsuit and ultimate foreclosure by Glastonbury Bank and Trust, we shared
a healthy business relationship. Unfortunately when a project is siphoned for what has now
reached almost $1,000,000.00 it is impossible to overcome the demise that has occurred.
This correspondence is sent as notice to all parties concerned in this matter as a single
correspondence to avoid multiple letters concerning the same subject. In that vain, this
correspondence relates individual as well as collective lots referenced above of which you may
or may not have performed work at. Specifically at this time, I am aware roofing leaks are
occurring at lots 5, 9, 22, 27, and 34.
The Problem:
A roofing leak has occurred at five of the eleven Woodbridge homes that were built at Chase
Orchards. The construction requires a valley (cricket) be framed over the garage where the
garage roof meets the second floor sidewall of the bedroom that is located over the dining room
of the Woodbridge model. When this problem was originally discovered, Angelo D'Leo of
Allphase Roofing and Remodeling inspected the eleven homes and reported to me that in his
opinion the leaking is being caused by the valley that was not properly framed with a cricket
which would shed the water away from the sidewall and therefore prevent any leaking from
occurring.
Chase Orchards, LLC Opinion:
After the inspection and ensuing discussion, I originally concurred with the opinion of Angelo
D'Leo, however after further consideration and inspection of the valleys with others, I believe
improper roofing and flashing installation is causing the leaks.
Page 2, Woodbridge leaks
The installation of the roofing by Allphase Roofing and Remodeling in the valley area included
15 lb. felt paper installed under the roofing and Ice and Water that was installed under the IKO
Architectural shingles in the valley. Standard step flashing was installed along the sidewall and
around the corner of the front corner post were it meets the valley.
The problem that occurs is leaking in heavy rains and/or during freezing temperatures. Firstly
when heavy rain is experienced, the water is unable to move past the corner post quickly
enough without backing up against the corner of the house. This backing up is causing the
water to seep over the step flashing and into the house. Secondly, when freezing temperatures
are prevalent, rain and snow forms into an ice dam that again works its way over the step
flashing and into the interior sidewall. In addition the ice dam backs up in the valley and works
its way under the roofing shingles, and leaks through the valley.
Conclusion (see drawings enclosed):
15 lb. felt paper should first be applied over the roof sheathing. Ice and water should be installed
under the valley and be installed in a continuous method up the sidewall and the front wall
where the wall meets the corner post. Ice and water should extend at least 36" beyond the open
side of the valley. Seams should be tarred to insure sealing. At the corner post, if necessary
additional Ice and Water should be installed to ensure a tight seal at that point. This requires
careful installation of the Ice and Water to ensure a solid seal. Step flashing should be installed
in a reverse method so as to extend higher on the sidewall. This would require additional or
(double courses) to be installed with each course of the roofing shingles. Roofing should then
be installed and the valley shingles should be sealed (tarred) on each course.
It is our opinion, if the above method of installation was used, there would not be any leaking on
Woodbridge models. Mr. D'leo disagrees, and claims the valleys installed by the framing
contractors are improperly constructed and that new crickets need to be installed to prevent the
leaking. Allphase Roofing and Remodeling was hired as a professional experienced in the
residential roofing business. It was expected they would use that experience and proper
installation methods to ensure a quality job that would not leak. The method of installation by
Allphase Roofing and Remodeling did not provide that installation and in our opinion they are
responsible to make corrections to any and/or all Woodbridge models.
Mr. Adebola H. Owodunni the owner of Lot 5 has notified Chase Orchards, LLC that his roof is
leaking. He has obtained an estimate from Barnett Construction Co. (copy enclosed) to make
these repairs. I am informed, he is not contracting with Barnett to make these repairs, but is
entering into an agreement with Angelo D'Leo of Allphase Roofing and Remodeling to make the
repairs at a lesser cost. It is Mr. Owodunni's position that he will have the work repaired and file
a suit to recover the cost .of repairs from Chase Orchards, LLC. Chase Orchards, LLC will
implead all parties concerned in this matter if that occurs. We do anticipate a conclusion would
result in responsibility to Allphase Roofing and Remodeling.

Lot's 4, 5, 9, 22, 26, 27, 30, 31, 34, 36, 37 and 38
Dear Angelo:
Recently you made repairs to the roof at lot# 5 at Chase Orchards to stop the leaking that was
occurring. I have inspected the work that you completed with an independent roofing contractor
and it appears the work has been completed satisfactorily. In our previous discussion after my
letter to you of 12-10-00, you indicated it would be necessary to install a cricket to correct the
leaking that was occurring. You further indicated that the reason the roofs were leaking was
because crickets were not installed by the framing contractors and if they had been the original
roof installations could have be done correctly and the roofs would not have leaked. When you
made the corrections to lot# 5 you did not install the crickets you insisted were needed. Per my
previous correspondence to you dated 12-10-00 1 disagreed with you position regarding the
crickets and provided a written as well as a plan illustration of the method that should have been
used to install the roofing correctly. My independent roofing contractor Mr. Leonard Barrett has
confirmed my position regarding the crickets you claimed should have been installed and of the
installation method I provided to you. It appears you applied that method to correct the leaking
at lot# 5
You stated in a telephone message to me after receipt of my 12-10-00 correspondence that we
did nct provide sufficient materials for the correct installation. As you are aware, our agreement
for your services provided that we supply all materials except nails for the installation. Part of
those materials was Ice and Water Shield You stated in your message that we did not supply a
sufficient amount of Ice and Water Shield to correctly install the valleys. May I remind you your
workmen were not limited in quantity to the materials that were ordered by us for roof
installation. We relied on you as a professional roofer experience in proper roofing application.
We in fact did supply a sufficient amount of Ice and Water Shield to correctly install the roofing
at all homes in Chase Orchards, however if you or your workmen indicated additional Ice and
Water Shield was necessary for the Woodbridge models, it would have been supplied to you as
it had on numerous occasions when your men indicated you were short materials.
There remain eleven additional Woodbridge models at Chase Orchards, some continue to leak.
I am enclosing a copy of Mr. Barrett's estimate to make the repairs to these eleven homes. I
would like to give you the opportunity to make the repairs. Please contact the homeowners
Page 2, Allphase
listed on the enclosed ASAP to determine if any leaking is occurring and make repairs to homes
that are leaking. Additionally the roof leaks have caused damage to the drywall and paint in
several of the houses. I believe your insurance would cover the cost of those repairs and I
would request you contact them for inspection of the repairs that are necessary. You may want
to make the repairs with your own workmen and I would agree if you were inclined to do so.
These homeowners have been very patience in this matter and I would hope you would act
expeditiously to make these corrections so as to not inconvenience them further.

Dear Chase Orchards Homeowner:
As you are aware, some buyers of Woodbridge model homes have experienced leaking
between the sidewall of the upstairs front bedroom/study into the garage and sometimes
basement area. We have worked diligently to have these repairs made by Allphase Roofing and
Remodeling and I am hopeful they will make the repairs to other homes as they have to lot# 5 If
the repairs are not made within 30 days receipt of my letter to Allphase Roofing and Remodeling
(copy enclosed), Chase Orchards will file small claims action against Allphase Roofing and
Remodeling for each home that has a leaking roof, and will have the repairs made by Mr.
Barrett
Thank you,
