The property in question has been in existence as an industrial
development area for many, many years before the Town of South Windsor
adopted a Planning and Zoning Commission and zoning regulations, and
sub-division regulations. The buildings which are in existence are
the same buildings or rebuilt buildings on the same sites as originally
constructed. The premises have been leased to various industrialists
and occupied and used by them for many years
The premises in question for which a sub-division approval is
requested, was requested of the Town Planning and Zoning Commission
and approved by the Town Planning and Zoning Commission subject to
the granting of the enclosed application, and are on a private roadway
owned by the Penn Central Railroad Company. The road is in existence
with a hard surface on a gravel base and is constructed even better
than the requirements of the Town of South Windsor for a road. It
has an entrance and exit on Strong Road and on Route 5.
The Railroad Company has granted a continuance easement to the
Applicants for purposes of ingress and egress over the road. The
basic reason for the requirement that a sub-division be on the high-
way [namely, that we have access to the sub-division for police, fire
and safety protection] is fully complied with in the existence of
this private roadway. There is no access to this property, nor can
there ever be a roadway in front of this property other than what
now exists.
A variance of Section 5.2.3 is respectfully requested.

Dear Ed:
Please be a('Avisecf that the Commission has approved
e
application of Louis j. Fol.a et al for subdivision of pro -
erty east of the railroad on John Fitch Boulevard and north
of Strong Road.
The Commission recognizes, that by allowinm, this subdivision
each of the owners must maintain their individual property,
and that this property conforms to all of the requ:iroments•of
a subdivision, excertinp; for the frontage. because of. the
unique situation existing on this propert , the Commission
feels that the present right-of-way is, for all practical
purposes, similar to a nuhlic right-of-way.

FIowever, since section 5.2.3 of the zoning regulations requires
a proposed subdivision to have frontage on a Public street, this
ai)proval is cootinpent u,Pon approval from the Zoning Board of
Appeals for a variance under that section.
