Inasmuch as I will be out of the state on February 5, the night of your public hearing,, I wish to express my cone rn and opposition to this proposed gas station. I would further like to call to your attention that a hardship must be shown and that the undersized lot created by the state land taking is not considered a legal hardship. Time permitting, I will get you the court case which rules that there is no hardship on such property remaining. In the particular case mentioned the court ruled that when the state takes the property the owner had full knowledge of the land remaining and accepted full compensation from the state. This compensation was determined to be not only for the property received but for any effects that it may have on the remaining property. I would suggest that you consult with ,attorney Cavanaugh on this particular issue before rendering your decision. Very truly yours, L eato N G AND NING COMUSSION Joseph J.
