Mann Recording Secretary Planning & Zoning Commission r t- r Y r RECEIVED March 19, 1992 MAR swO M2 A WOW PUIWJX WL Planning & Zoning Commission Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Dear Sir or Madam: I am writing regarding the plans of Chris and Carolyn Didden of it Stonefield Trail to seek approval for an Accessory Apartment. I have attached copies of their letter to us and the Zoning Regulations on Accessory Apartments. I am writing because my wife, Pat, and I will be out of town on Tuesday, March 24 when there is a Public Hearing on the Diddens' request. Pat and I are opposed to their plans for the reasons I outline in this letter. I have also spoken to Paul and Kathi St. Onge, Rick and Mary Kenny, Jim and Adria Strife, and Jean and Bob Kmon, all residents of Stonefield Trail . They all also oppose the Diddens' plans. I have yet to speak to anyone who sup- ports their plans. Some of my reasons for my objection to this request are based upon information received from John McCahill , a Zoning/Wetlands Enforcement Officer, whom I met with at Town Hall on March 9. First, the Diddens begin their letter by referring to "the existing attached apartment". What they fail to mention is that "the existing attached apart- ment" is in violation of the Zoning Regulations. I do not think the Diddens knowingly planned to violate the Zoning Regulations, but an "attached apart- ment" is not permissible in our neighborhood, which is a Residence A Zone. When I met with John McCahill , he indicated the Diddens came to the Zoning Department at Town Hall sometime ago with remodeling plans (I think for a master bedroom addition). At that time, the Zoning Department informed them that their "attached apartment" was in violation of the Zoning Regulations. The Zoning Department suggested they pursue an application for an Accessory Apartment which would allow them to conform again to the Zoning Regulations. Second, the Accessory Apartment Regulation was enacted by South Windsor several years ago to be in compliance with legislation passed by the State. (Given the State's recent performance relative to the budget crisis and the nuclear dump, this alone should be sufficient reason to oppose the Accessory Apartment concept.) The main purpose of both the State and the Town to enact this legislation is to encourage moderately priced housing. This purpose is not being met by the Diddens' request. Rather, their request simply is based upon their desire to take advantage of the Accessory Apartment Regulation loophole, at the Town's suggestion, to cure a current Zoning violation. The purpose of the Diddens' request is not to assist them in being able to afford a house on Stonefield Trail . They already own their house and, in fact, appear to have plans to spend additional money on remodeling. Planning b Zoning Commission Page 2 March 19, 1992 Third, while the Criteria for Approval of an Accessory Apartment requires that "the owner of the dwelling units must occupy either the accessory apartment or the main dwelling unit", John McCahill has told me that once the property is approved for an Accessory Apartment it remains so whether the Diddens reside there or not. Simply put, the Diddens could move out and the house could be occupied by two, or potentially more, unrelated tenants. The Diddens could even sell the property to an investor who might have no interest in main- taining the character of Stonefield Trail , but only in maximizing the return on their investment. Fourth, the Diddens note that, to date, there have been no formal complaints on the appearance of the dwelling. To date, I contend that they have been the beneficiaries of overly tolerant, non-confrontational neighbors. At the time we built in 1985, Pat and I . as well as several other original owners, voiced our concern regarding the appearance of the Diddens' house (which they did not own at the time) to Bob Murdock, the realtor for U b R. Bob assured us that the house would be fixed up to make it more in character with the neigh- borhood. Clearly, that never happened. Over the last several years, the maintenance of the Diddens' yard has been, in my mind, deficient. I cannot imagine the approval of an Accessory Apartment will enhance the appearance. Certainly, seeing five or six cars parked in the driveway as you first turn onto Stonefield Trail will not be a plus. For the above reasons, Pat and I oppose the Diddens' request. We are both very concerned about the impact on the value of our house and the character of the neighborhood we have chosen to live in. Pat and I request that you reject the Diddens' request. We do not think the request is based upon the intent with which both the State and the Town enacted the Accessory Apartment Regulation. erely yours, J ph E. Wehr, 93 Stonefield Trail South Windsor, CT 06074 jwk Attachments v-yc V41, _5 c) 0 c If d 4) Y C4 of OW CL t4l March 24, 1992 To: South Windsor Planning and Zoning Board From: James R. Strife, 56 Stonefield Trail Subject: Opposition to Didden Application for an Accessory Apartment at 11 Stonefield Trail On behalf of my neighbors on Stonefield Trail and the accompanying cul-de-sac, Wildwood Circle, I have summarized the primary objections to the subject application which have surfaced through many discussions. As background, let me first describe our development. Stonefield Trail and Wildwood Circle comprise a development of 1?homes primarily constructed by U&R from 1985-1988. The Didden residence is on the corner of Stonefield Trail and Miller Road and was a previously constructed residence. This is an A30 single family residence zone. All homes are constructed on a minimum 3/4 acre lot size with 150 ft. minimum frontage. The homes range in living space from approximately 2400-6000 sq ft, all with attached two or three car garages. Their approximate market values range from $275,000 to in excess of$750,000. This is a beautiful development whose character we wish to maintain. Our primary objections to the proposed application are summarized as follows: (1) Accessory apartments/rental units are not consistent with the character of this neighborhood. (2) There are no assurances for the long term upkeep of the property as a rental unit. In a discussion with John McCahill, a Zoning Enforcement Officer, on March 9, Joe Wehr was told that once the Accessory Apartment is approved, it remains so whether the Diddens reside there or not. This raises the possibility for the property to become a rental unit owned by an investor who has no interest in maintaining the character of Stonefield Trail, but only in maximizing a return on investment. (3) None of us enjoy the thought of a perpetual image of a small parking lot occupied by 5-6 cars on the corner as we enter our development. (4) We feel that the primary purpose of the subject application is to cure a current zoning violation by taking advantage of the Accessory Apartment Regulation. We hope that the Board will consider these points as sufficient grounds to disallow the Application for Accessory Apartment on 11 Stonefield Trail. The extent of our opposition is evidenced by the attached petition signed by 117 of the remaining 19 residents in the development. ?-a /Z- E TO: South Windsor Planning and Zoning Board REFERENCE: Di dden Application for Accessory Apartment-1 1 Stonef i e l d Trail FROM: Residents of Stonefield Trail We, the undersigned residents of Stonefield Trail, are opposed to the application of Chris and Carolyn Didden for approval of an accessory apartment at 1 1 Stonefield Trail, We feel that it is totally out of character with the rest of the neighborhood, and will have a long term adverse effect on the property values of the other residences, NAME ADDRESS 64-4 v )30 j . It is my understanding that you will act on this at your meeting on April 7. Unfortunately, because of business travel commitments, I will not be able to attend the April 7 meeting. I was also unable to attend your March 24 meeting when you first discussed this. I appreciate your taking the time to publicly read my letter, a copy of which is attached, at the March 24 meeting. I am writing again to reaffirm my opposition to the Diddens' request. I am opposing on the grounds that an Accessory Apartment is not consistent with the character of our neighborhood and would have a negative impact on property values. As such, the Diddens' request fails to satisify one of the three cri- teria explicitly stated by the Planning & Zoning Commission when they enacted the Accessory Apartment Regulations. I am not alone in my opposition on these grounds. Previously, you have re- ceived a petition, a copy of which is attached, signed by my neighbors. So there is no confusion regarding the depth of our opposition, I would like to make the following points: * There are 21 properties on Stonefield Trail and Wildwood Circle, the small cul-de-sac off Stonefield. * If you take out the Diddens, there are 20 property owners left. Of these 20, 19 were willing to publicly state their opposition and con- cern by signing the petition. The unwillingness of the remaining property owner to sign the petition is not based on their support of the Diddens' request, but rather their desire to avoid a confron- tation on this matter. * Simply put, this petition indicates unanimous opposition, based on one of the three stated criteria necessary for approval of the Diddens' request. Assuming we live in a country based on a represen- tative government and there is a purpose to a public hearing, this degree of opposition cannot be ignored. Planning & Zoning Commission Page 2 April 6, 1992 Additional issues I 'd like you to consider are: * If you should decide to ignore our opposition, is the residence at 11 Stonefield Trail given permanent Accessory Apartment status or is Accessory Apartment status granted only while the Diddens own and occupy the house? If it is the latter, is the Planning & Zoning Commission going to document this in writing and what steps will be taken to ensure compliance? Also, if it is the latter, what impact will a six month temporary move to California, as the Diddens made during 1991, have on the Accessory Apartment status? * Within the last month, Chris Didden has had phone conversations regarding this matter with at least two of my neighbors on Stonefield. In one he indicated he and Carolyn own another residence in Glastonbury. In the other, he indicated that he and Carolyn might move from Stonefield Trail within 12-18 months. I was not a party to these conversations nor do I know if Chris was telling the truth, but I 'm sure you can understand my concern regarding these conversations. * For several years now, the Diddens have rented in violation of Zoning Regulations. Our unawareness of this situation and lack of opposi- tion to this illegal activity should not be used as a justification, to any degree, by Planning & Zoning to grant Accessory Apartment status. Even if you assume the Diddens were unaware of the Zoning Regulation, they have still been in violation of this law. * Further compounding the above is the Town's complicity in suggesting the Accessory Apartment Regulation as a loophole to cure the existing violation? What is the role of the Planning & Zoning Department - is it not to enforce the Town's Zoning Regulations? * A building permit was issued by the Town at the time the addition being proposed for the Accessory Apartment was built. Clearly, the permit did not include construction of kitchen facilities. Who was responsible for the building inspection and ensuring compliance with the building permit? * If the appropriate governmental agencies are not going to adequately protect our rights, are you prepared for the hypervigilance, suspi- cion, and confrontation among neighbors that may arise? Isn't it preferable for the Planning & Zoning Department and Commission to act responsibly and perform the job they are charged with? Planning & Zoning Commission Page 3 April 6, 1992 * Does not the concept of "spot zoning", of which the Accessory Apartment Regulation is an example, unfairly allocate the cost of social change? * Excluding the Diddens, the property owners of Stonefield and Wildwood pay $102,556.24 in annual property taxes. Is the Town willing to forego over $10,000 in taxes if the approval of the Diddens' request leads to a 10% reduction in neighborhood property values? I apologize for not being able to attend either of your meetings on the Diddens' request. I appreciate your reviewing and considering my two letters. I do not take any pleasure in opposing the Diddens' request but think, given the facts, it is something I must do to protect the interests of my wife, three daughters, and myself. We have lived in South Windsor since 1978 and do not want to see the character of either the town or neighborhood we have chosen to raise our family in change for the negative. When this application was approved in 1992 the property did not have a garage and I assume that the screening was required due to concern about the number of vehicles that would potentially be parked in the driveway. Subsequent to my purchasing the property in 1999 I had a 2-car attached garage constructed and I respectfully request that the screening requirement be removed. In addition to excessive surface parking no longer being a concern,my reasons for this request include(1)visibility problems caused by the screening when vehicles are exiting the driveway and(2)snow disposal problems caused by the fact that the entire paved area is enclosed by the screening, the garage and a pool fence. This request only applies to the evergreen screening along the driveway and not to the evergreens that block the view of the property from Stonefield Trail. For your reference I have enclosed a site plan that shows the location of the main house, the accessory unit, the garage, the evergreen screening that I propose removing and the evergreen screening that will remain.
