Lavado , Jr. Mr. Eri.--ss,on stated for the record that Mrs. Murray would be disquay:=,;ring herself on this appeal because she is an abutting property- :-,kmer. He explained to Mr. Lavado that, therefore, it would _ -2. four-member Board because one alternate was ill and the o _= alternate could not be reached. He stated that it takes four ative votes to approve a variance and gave Mr. Lavado the option of returning next month with a 5-member Board. Mr. Lavado stated he would prefer to come back next month. Application #1441-81, Roder Thrope Mr. Thrope appeared before the Board regarding a house located at 2916 Ellington Road that he is restoring. He said the back-half is falling down and is unsafe ; however, when it is removed, the remaining house will not comply with the required square footage for the zone. It was noted- for the record that no one in the audience spoke in favor of or in opposition to this application. In response to questioning, Mr. Thorpe stated that the lot is • approximately 5 acres, set back 53 feet from the road, with 573 feet of frontage. He plans to be putting on an addition in the future which will bring the square footage of the house up to that required for a RR Zone . ` Application #1442-81, Amelia Ma.rouski and Anna Pilken Mr. Conway appeared before the Board representing Miss Marouski and Mrs. Pilken. He said they are proposing to build a garage to replace an old barn on the property that was destroyed by fire. The barn used to be eight feet away from the property line, and the existing house is four feet away from the street. He said if the garage is placed back 50 feet as required, it will make it further for the women to walk to their car and Mrs. Pilken has some difficulty in walking. If the 25-foot set-back variance is granted, the garage would be 24-feet from the house . Mr. Conway also noted that trees and a well prohibit placing the garage anywhere else on the Clark Street side of this corner lot. He further no-ed that the driveway is off Clark Street; however, if the new garage were placed on the Pleasant Valley side, it would )--ohibit any -rebuilding of the house in the .future for whatever re:son because the garage would be where the house would have to g- to be in conformance with the set-back requirements of the ZoY _ -.:eulations. He also noted that all adjoining property is owned relatives and that no one would be affected adversely by the of this new garage . .: 46- It was noted for the record that no one in the audience spoke in favor of or in opposition to this appeal. Application #144.3-81 —David Gudzunas Mr. Gudzunas appeared before the Board to request a 10-foot side yard variance to put-up a passive solar addition on the south side of the house. Mr. 8::___F.rd Bordua, 1417 Main Street, spoke in opposition to this reques unless something is placed on the record prohibiting cons of a chimney in -the addition. He explained that, as the a:;utting property owner, he doesn't want a chimney that Close his house because the quality of air might be affected. He sa=d he has no objection to the side-yard variance . It was noted flat no one else spoke in favor of or in op position pposition to this appeal. Mr. Gudzunas said he does not plan to put a chimney in this addition, and if any additional heat is required, it will be electric. He also noted that the addition could not be placed anywhere else on the property because of its solar nature. Application #1444-81 - Josephine Patelli Attorney John J. Woodcock, III appeared before the Board representing this application. He said the Patellis live on a 10-acre piece of land on the west side of Sullivan Avenue which is divided by a zone line ; half being RR and half being A-20. They would -like a two-year temporary and conditional permit to conduct a retail "collectables" business in the large barn located on the property. The business would be part-time on weekends and would operate on a seasonal basis from April 15 to October 15. Attorney Woodcock described the- location of the property and indicated the varied character of the neighborhood, which includes quite a few businesses in the near vicinity. He stated that the barn is 300 to 4.00 feet off the road with ample parking and a dirt circular driveway. He said the sight line is good in both directions from the driveway and noted that this type of business would not attract a great deal of traffic . He noted also that the Patellis have plans to do extensive renovation of the barn, which is presently in need of repair and will improve the aesthetics of the neighborhood. He pointed out that this is a family business and is more of a hobby than a commercial venture because both Mr. and Mrs. Patelli have full-time jobs. Attorney Woodcock stated that Mitchell Fuel Company is in favor of the application and gave him permission to speak in their :behalf because they feel it will enhance the neighborhood. He referred to Mitchell Fuel Company and the Antique Shop that received variances to operate businesses in this area and have , therefore, set a rtreCe'.en. He noted that a temporary and conditional permit gives -th= more control than a variance, and a variance is germane=: _ atare . Mr. Cliff Slicer, 391 Niederwerfer Road, spoke in favor of this 19491. application. He said the barn has an interesting historical background and feels this is a good use for it. He said often historical properties are lost because the owners cannot afford to restore theme Mr. Bill Crowley, 1136 Sullivan Avenue, spoke in opposition to this appeal. Le said it is not a neighborhood feud or neighbor's opposites c: to change. He said, rather, that the area is plagued with co-s giant noise of traffic and this operation will create an additic=-' nuisance. He referred to the tag sales conducted at this 'prz--D=ty recently and the traffic problems they generated, include-=- on-street parking. Attorr_=-, .1zarold Cummings appeared before the Board representing neighbors in opposition to this application. He said Mr. Crowley had adequately stated the neighbor's objections, and he would like instead to speak to Section 11.4.1 of the Zoning Regulations which outlines the powers and duties of the ZBA. He said temporary and conditional permits may only be granted for uses no-t specified elsewhere . He said commercial sales are permitted elsewhere; therefore, ' he does not believe the Board has the legal authority to grant this request. He said that over the years temporary and conditional permits have become "catch alls for an end run around the Zoning Regulations" . He noted that a site plan would not be required and he does not believe this is the intent of the regulations. He said he felt with the significant business activity and the proposed renovations, the applicant should go to Planning and Zoning Commission for a Special Exception. Attorney Cummings spoke of the traffic accidents in this area and submitted to the Board a petition signed. by 26 of the neighbors which he read into the record in opposition to this application. He further asked the people present who were in opposition to stand (approximately 15) . He asked the Board to request an advisory opinion from the Town Attorney to clarify if this is a legtimate application for the Board to consider. In response to questioning from the Board, Mrs. patelli said they would have a small sign stating the name of the business and whether it was open or closed. The "collectable s" business was explained as being old, used objects, but not antiques, for sale. She said they are small "odds and ends" items that people collect. She said there would be no booths and it would not in any way resemble a flea market. Advertising would be mostly by word of mouth. Mr. and Mrs. Patelli would be the only two employees. When asked why she applied for a temporary and conditional permit rather than a variance, Mrs. "patelli said the Town Planner suggested she apply in this manner. Attorney Woodcock stated that he was not involved in the filing of the application, but was asked to represent it a week ago . Attorney Woodcock also noted that there would be more contra l and less traffic with this operation than with the tag sales t..hey have been running. Mrs. patelli said. she doesn't want to c:-_t_Lnue with the tag sales because she is not allowed to purchase _ _e- s or resale at a tag sale . She said she wishes to establis Y_ Ks=ness. She said the barn contains approximately 4, 000 sq_u e feet; however, they would only be using one-half of it for stoNa_ and display. r WORK SESSION Application 14.41-81 - Roger A. Thrope Mr. Warren moved to grant application #1441-81 fora variance to Section 6.2 of the Zoning Regulations to allow a single-family dwellin with less than the required floor area on premises known as 2916 Ellington =oad, RR Zone , because the house should be 'preserved due to its historical nature . However, the Board voted to allow the der-_o=-tion of the current sheds and allow the remaining single- family of approximately 1200 square feet to exist with less than the r;:quired floor area provided that the sheds to be demolished are no- _,-s tainable, were constructed well in advance of the current zoning - .lations , and cannot be rebuilt because there are no f ounda-_-Z.s. The motion was seconded by Mrs. Murray and voted unanimously in favor. EFFECTIVE DATE: September 16, 19 Application #14.42-81 - Amelia Marouski and Anna pilken Mrs. Murray moved to grant application #1442-81 for a variance to Section 5.2 of the Zoning Regulations to allow construction of a two- car garage within the required side yard on premises known as 10?5 pleasant Valley Road, RR Zone because the existing house on a corner lot is 4.17 feet away from the street line, pre-existing zoning, and the most logical location for the new garage to replace the barn destroyed by fire, without disturbing trees or an existing well, z requires the 25:foot variance . She also noted that if the garage were placed facing Pleasant Valley Road, it would prohibit rebuilding of the house (if this ever became necessary) in conformance with the Zoning requirements. The motion was seconded by Mr. Cote and voted unanimously in favor. EFFECTIVE DATE: September 16, .. Application #13-81 - David Gudzunas I Mr. Murrin moved to grant the application of David Gudzunas for a variance to Section 5.2 of the Zoning Regulations to allow a 10-foot side yard variance for construction of a house addition on premises known as 1425 Main Street, A-4.0 Zone , with the restriction that no chimney be installed as part of this addition in order to preserve the air quality in the, area of the immediate adjoining property. The passyve solar addition is located on the only feasible side of the house ( south) . Also, the existing garage pre-existed the 20-foot side yard requirement and the addition will not encroach further on the side yard at one point than the existing garage does at another -oo int. The motion: ==;as seconded by Mrs . Murray and voted unanimously in ifavor* EFFECTIVE DATE: September 169 i .55 Application #1444-81 - Josephine Patelli The Board discussed Mr. Cummingb'- contention that it -was not' within their authority to grant this permit. Mr. Eriksson said it is a family business, not a commercial venture, and they have done it in the' past enough to establish precedent. The Board members concurred with this, and felt granting a temporary and conditional permit was prefera: e to continued unregulated tag sales. Mr. moved to grant application #1444-81 for a temporary and condi ti=na.1 permit to allow a part-time seasonal, retail "collectables" busine SS- out of a barn on premises known as 1135 Sullivan Avenue (A-20 :d RR Zones) through October 15, 1982, subject to the following condiiior.s: 1. The family operation is not to be considered a full-time commercial venture; therefore, -it shall be open for business only on weekends and sales shall be limited to eight (8) daylight hours* 2. All sales shall take place inside the barn. There shall be no outside displaying of merchandise and no attempt to encourage impulse stopping by signs or displays. 3. There shall be no advertising or promotional announcements designed to attract large numbers of people. 4. All parking shall be on the property, and parking on Sullivan , Avenue is prohibited. 5. Entrance and exit points shall be clearly marked on the property. The motion was seconded by Mr. Warren, and voted unanimously in favor.
