Warren, Chairman Zoning Board of Appeals RWW:dr Attmt. cc: Building Department Planning Department Dowty Construction Co. , Inc . MEMO From: Marcia A. Banach Director of Planning To: Ralph Alexander Town Attorney Date: Wed Apr 26 As I indicated in my phone call to you yesterday, I need your advice to assist in the resolution of a problem. Zoning and building permits were issued for the construction of a new single-family house in Fall 1994. The house is now virtually completed, and the builder will be requesting the Certificate of Occupancy in time for the closing, within the next week or so. A neighbor called this week to complain that she thinks the house is too small for the neighborhood. Upon checking the building permit, we have discovered that the house does not meet the minimum square footage requirements in that zone (the area is short by about 130 square feet). Since this is clearly an administrative error by our staff, the dilemma is how to issue the C.O. now that we know a zoning violation exists. CGS 8-3(f) requires that, "No building permit or certificate of occupancy shall be issued for a building, use or structure subject to the zoning regulations of a municipality without certification in writing by the official charged with the enforcement of such regulations that such building, use or structure is in conformity with such regulations or is a valid nonconforming use under such regulations." The builder has indicated that he is willing to finish an area in the basement (which is a walk-out), to provide the additional finished area. The zoning regulations, however, have a definition of basement and indicate that basement cannot be counted toward living area.
