During one of our telephone conversations in June, you in- formed me that Rick told you he was going to correct the problem and install a shower drain trap. Please send me a notorized letter outlining that telephone discussion with Rick because he is contesting my court action. I have en- closed a copy of the Small Claim and Notice of Suit. Lopes 164 Woodland Drive South Windsor, Ct. 06074 Dear Mr. Lopes In response to your letter of October 29, 1991, I will concur that I did speak with Mr. Cianci by phone after your odor problem became evident. He admitted that he had not trapped the shower and had agreed to me that he would fix it. (i .e. place a trap in the shower drain line) Regarding the inspection, I can only surmise that if the shower was in place, the trap was not visible and the -inspector assumed it was there (trapping fixtures is a very elementary requirement of the plumbing code) , or the shower was not in place, and the piping would be connected following the inspection. The inspector who made the inspection is no longer with us, so it is difficult to ascertain exactly what transpired. I would like to again say that trapping all fixtures is a basic requirement of the code. Mr. Cianci does not possess any kind of plumbing license to my knowledge. Had he been licensed, I'm sure he would not have installed the shower without the required trap. Sinc el John R.
