General Statutes, of dams reservoirs and other facilities necessary to the impounding, storage and withdrawal of water in connection with public water supplies, except as provided in Sections 22a-401 and 22a-403 of the General Statutes. 4 . 2 The following operations and uses shall be permitted, as nonregulated uses in wetlands and watercourses, provided they do not disturb the natural and indigenous character of the wetland and watercourse by removal or deposition of material, alteration or obstruction of water f low or pollution of the wetland or watercourse: a. Conservation of soil, vegetation, water, fish, shellfish g � and wildlife; nb. Outdoor recreation including play and sporting areas, golf courses, field trails, nature study, hiking, horseback riding, swimming, skin diving, camping, boating, water skiing, trapping, hunting, fishing and shellfishing where otherwise legally permitted and regulated. SECTION V -- REGULATED ACTIVITIES AND USES 5. 1 Subject to the provisions of Section II hereof, regulated activities affecting the wetlands and water courses of th Town are prohibited except as they may be permitted by the Agency, as hereinafter provided. 5 . 2 Within regulated areas there will be a minimum 20 foot non- disturbance setback from wetlands and watercourses and a 40 foot setback for building and paved areas; exemptions may be given to complete an approved regulated activity. 5 . 3 If a water course is located within the 100 year flood plain: a . The Agency will in riverine situations require the applicant to notify adjacent communities and the State Flood Insurance Program Coordinating Officer prior to the issuance of a permit by the Agency for any alteration or relocation of a water course and submit copies of such notification to the Federal Insurance Administrator. b. No water course shall be altered or relocated unless the flood carrying capacity of said water course is maintained. -7-
