The current excavation permit expires on January 28, 2019. The location of this earth removal operation is at 1440 John Fitch Boulevard to the east of the brick plant. For this application, we are requesting to continue mining clay in the same location previously approved. The acreage approved prior includes the areas identified as Phase 1 through Phase 4, Phase 6, and Phase 7 along with areas adjacent which were formerly mined by Redland Brick. The reclamation plan for the site is attached. The geology of the area includes a deposit of sand on top of a deposit of clay. East Hartford Sand and Gravel under separate permitting has been removing the sand so Redland can access the clay. Redland Brick mining operation includes removing any remaining sand or overburden and either stockpiling it elsewhere on Redland Brick's property or using for reclamation. The clay is loosened with a farm type disk, allowed to air dry, pushed to a side of the quarry, loaded into trucks, and hauled to a storage area. The storage area can be either to an enclosed storage shed or an outside stockpile during warm months of the year. The mining operation is weather dependent and is restricted to material to supply the plant for the entire year. It is critical that at least this much acreage is permitted to allow for sufficient air drying time. No wetlands will be disturbed by Redland's continued mining activity. Redland Brick views itself as a steward of the environment and a good neighbor. As an example, Redland formerly designated approximately 5 acres of their property in a Conservation Easement with the Town. \\hrpfa—ner\data\RaEDLB-REDLAND BRICK.BdC\REDLAND BRICK.KF PLANT.I440 JOHN FITCH BOULEVARD.SOUTH WINDSOR.CT 06074\RED2008CE\WP\PZ appiwation\Pern it Apphcation-Earth Exc ationdocx ATTACHMENT B DRAWINGS 1:\R\REDLB-REDLAND BRICK,INC\REDLAND BRICK,KF PLANT,1440 JOHN FITCH BOULEVARD,SOUTH WINDSOR,CT 06074\RED2008CE\WP\PZ applicatioa\Permit Appheatioa-Earth E—atioa.docx , Drawing List Drawing Title Created Revised Title Sheet 09/04/13 01/15/19 C1.0 Overall Existing Conditions Plan 09/04/13 01/15/19 CIA Existing Conditions Plan 09/04/13 01/15/19 TP-5 Excavation Plan- Phase 6 & 7 09/04/13 01/15/19 \\hrpf—cncr\data\R\REDLB-REDLAND BRICK.INC\REDLAND BRICK,KF PLANT,1440 JOHN FITCH BOULEVARD,SOUTH WINDSOR.CT 06074\RED2008CE\WP\PZ application\Pecmit Application-Earth Excaeatlondocx GENERAL NOTES 1. In order to gain a proper understanding of the KF Plant operation, plans for the future, and Redland's reclamation plan, it is first necessary to understand the history of the site. BACKGROUND As a result of a search of historical data we are aware that excavation and brick manufacture has been occurring at this site for almost 100 years. For many years this work was conducted without any regulatory requirements or restrictions- it was pre- regulation. The geology of the property and much of the surrounding area is relatively level property with sedimentary material including a deposit of about ten (10) feet of sand on top of a significant deposit of clay. The fine clay captures water. The area was a glacial lake and this unique feature has been studied on site by students and professors of local colleges. In the past the sand was removed for sale, generally by East Hartford Sand and Gravel, and Redland removed the clay for brick manufacturing. (Note that Redland does not use the sand in the body of the brick although we may use it for coatings on the surface of the brick.) Two large clay pits were developed as a result of prior excavation for brick manufacture. Water enters the site and fills these clay pits from wetland areas to the south, from two drainages off of Strong Road and from ground water infiltration. (Redland recently gave the Town of South Windsor an easement to allow water to drain from Strong Road in one of these drainages onto the Redland property as part of the Strong Road improvements.) The water filled clay pits are now ponds and have been in place since at least the 1940's based on historical overhead photos. This off site water flows into the south pond, exits the south pond through a concrete pipe into the north pond, and leaves the north pond through another concrete pipe into Bancroft Brook to the northeast of the property, and eventually flows to the Connecticut River. 1HRP When the Kelsey-Ferguson Brick Plant was purchased by Steetley Brick, prior to Redland ownership, clay material was excavated from the south pond with a dragline as wet material and mixed with shale mined and hauled from a shale pit in Suffield. The shale material was depleted and that quarry was reclaimed and closed. Steetley elected to open a new clay pit on site and mine dry material to have better moisture control, a more consistent raw material mix and better overall quality control in the brick manufacturing process. In the new clay pit, water entered the pit as a result of precipitation and groundwater runoff and Redland pumped the water out and into the south pond. The south and north ponds served as sediment ponds for the pumped water as well as the sediment laden water entering the ponds from off site. In the early 1990's, Redland created a vegetated swale to pump this water into to remove much of the sediment from the water prior to it entering the south pond. This swale and process was under the approval of the Connecticut Department of Energy and Environmental Protection (DEEP). After about fifteen (15) years of using the vegetated swale, in 2007, the DEEP informed Redland that since water entered and left the ponds all of it satisfied the definition of and was now considered "waters of the state". The water removed from the clay pit was considered "process water". Regulations required all process related water entering "waters of the state" to be treated prior to that entry. As a result the ponds would no longer be able to be considered sediment ponds and all sediment would have to be removed from the water prior to it entering the ponds. Redland has applied for the National Pollutant Discharge Elimination System (NPDES) permit and has received a draft. Redland is waiting on approval for the final permit from CT DEEP so the clay pit can be dewatered. 2 MPIRP FUTURE PLANS Redland must have a source of clay for brick manufacture or brick manufacturing will cease at this location. Given this fact, Redland is interested in whatever help the Town of South Windsor can provide for us so that we can continue to be a viable and profitable manufacturing source in this Town. Listed below are several scenarios that could occur: 1. Redland does not find a means of addressing the issues of the DEEP related to removing water from the clay pit, the clay is covered with water, Redland is unable to mine clay, manufacturing at the site ceases, and Redland reclaims the area. Please understand that this scenario is unacceptable to Redland, but is listed simply because is it a possible option. 2. Redland purchases additional property nearby, applies for the appropriate permits, supplies clay for brick manufacture from that site to the plant, and continues to manufacture brick on site. At the point where it is determined that we will no longer mine the pit on site, reclamation will occur and our Earth Removal permit for the current pit will be closed. 3. Redland finds an economically feasible way to remove water from the clay pit, applies for and is granted a NPDES permit from the DEEP and continues to mine from the same clay pit. From test drilling we know that there is clay at least one hundred feet (100 deep on the property. 4. Redland purchases clay from another source. If Redland went in this direction and it was determined we would no longer mine the current pit, we would reclaim around the current pit. PROPOSED CLAY MINE CHANGES Recently, Redland Brick received complaints from neighbors on the southern property boundary in regards to elevated levels of dust and noise due to mining operations. In order to address these concerns, Redland is considering: 1. Permit to pump water. Recently, Redland obtained a permit to pump water with a continuous monitoring system. This allows for the assurance that only clean water will be going into Bancroft Brook, as well as the relocation of some mining operations to an area further from the adjacent properties. 3 *3 R P 2. Cover the haul road with crushed bricks and/or trap rock. This top coat will be easy to clean with the water truck, allowing for a reduced risk of contamination to the clay. If options #1 and #2 are not effective, then the remaining options may be considered: • Plant trees along the Southern border. This approximately 1,300 foot long wall of trees will be used to help alleviate the dust and noise impacts on neighbors. Thuja Green Giant are a fast-growing evergreen commonly used as a privacy hedge that grows to 15 feet in diameter and 40-60 feet tall. • Adjusting operations for weather conditions. A plan has been developed to have a person devoted to monitoring weather conditions full time in order to adjust mining operations accordingly. With this new role at Redland, mining will only occur when the conditions allow for no dust to leave the property. If an issue arises, mining will be stopped until a solution is found. RECLAMATION PLAN The reclamation plan has been approved by the Planning Commission on each of the last three earth removal permit renewals. There will be three ponds on the property. We will allow the drainages that convey the water to the two existing ponds to remain in place and continue to convey that water. The banks on those drainages are already stabilized and planted. The existing clay pit will be filled with water up to the ground water levels. Slopes on the pit leading to the water level are 2:1. Four inches of topsoil will be spread on the area around the ponds to the water's edge. Redland will plant appropriate grasses, as recommended by Town staff, such as fescue, rye as a cover crop, and legumes (crown vetch, lespedeza). Redland will not plant wetland vegetation but fully expects some wetland vegetation to grow around the ponds naturally as early as the first growing season after reclamation has occurred. Within two years of no disturbance of the ground by mining, it is expected that some native tree species will begin to take over the area. There are fish in the existing ponds (largemouth bass, catfish, and bluegills) as well as turtles, frogs, toads, snakes, muskrats, beavers, ducks and geese. Ducks and geese have already begun to inhabit the water in the clay pit and it is anticipated that all of these animals other than possibly the fish will move into the clay pit naturally. The clay pit will become a natural water source for all wildlife in the area. 4 ATTACHMENT D TOWN OF SOUTH WINDSOR CHECKLIST L\R\REDLB-REDLAND BRICK,BQC\REDLAND BRICK,KF PLANT,1440 JOHN FITCH BOULEVARD,SOUTH WINDSOR,CT 06074\RED2008CE\WP\PZ applicmwn\P mmit Application-Earth Excavation.docx TOWN OF SOUTH WINDSOR CHECKLIST REQUIRED INFORMATION SITE PLANS APPLICANT REDLAND BRICK, INC. The engineering plan set was also revised to respond to comments and concerns received from Town of South Windsor Residents. As a result of the comments, HRP revised the Excavation Plan Sheet TP-5 and created two additional drawings (Haul Road Plan Sheet TP 5-1 and Details Sheet Sheet TP-5-2). The Excavation Plan (Sheet TP-5) was revised to reflect the installation of new haul road closer to the clay pit. The new haul road is approximately 100 feet farther north and approximately 25 feet lower in elevation. The excavation plan shows that an evergreen hedge (Thuja Green Giant) trees will be planted along the south end of the existing haul road. The trees will be planted 20 feet on center. The trees have a mature height of 40 feet to 60 feet high with a diameter of 15 feet. The new sheet (Haul Road Plan Sheet TP 5-1) was created to better show the proposed haul road on the south end of the clay pit. The haul road is 20 feet wide and approximately 1,400 feet long. Sprinklers will be added to each side of the road to suppress dust. The sprinklers are situated 10 feet apart along the roadway. The sprinklers will feed by a pump floated in the clay pit pond. The pump will be feed by electricity from the pump house. The new sheet (Details Sheet TP 5-2) was created to show details of the road, tree planting, and site restoration details for site reclamation. The proposed haul road detail shows that the sprinklers will be centered on berms on each side of the road. They are designed to sprinkle road to the center line of the road from each side. The detail shows the dimensions of the berms along the roadway. The berm slopes will be protected from erosion by addition of crushed brick on the surface. o.b 5 IR f Jli APPROXIMATE ---= SEQUENCE OF OPERATIONS STOCKPILE — `mil `- , /`\`\ \ \ -\ \ 1.THIS GEOLOGICAL FORMATION CONSISTS OF SAND AND GRAVEL APPROXIIAA ELY TEN FEET(10')THICK ON TOP OF A LAYER OF 4.RBI WILL STRIP REMAINING OVERBURDEN AND EITHER STOCKPILE IT OR USE IT ELSEWHERE ON ITS PROPEI l ✓ `- CLAY OVER 100 FEET THICK.MOST,IF NOT ALL,OF THE SAND AND GRAVEL HAS PREVIOUSLY BEEN REMOVED BY EAST AS RECLAMATION MATERIAL. f-- `\ LOCATION / y C\`\\\`\\\ \\\ \ o 2.RTFORD SAND AND GRAVEL,UNDER A SEPARATE PERMIT. 5.RBI WILL REMOVE CLAY AND STOCKPILE IT ON PROPERTY AND IN STORAGE SHEDS. n/ \=- 2.REDLAND BRICK INC.(RBI)HAS MINED FOR MANY YEARS IN AN OPERATION THAT PREDATES ZONING WILL BE Il10N5 IN THE TOWN - \ \ \ `'_ EAOF TERLY DIRECTION. 6 AND 7 ARE PART OF THIS EXISTING CLAY PIT.THE MINING OPERATION N1LL 8E IN A WEST TO 6.RBI WILL MAINTAIN 2:1 SLOPES D THE NORTHERN AND SOUTHERN EDGES OF PHASES I AND 7 AND PE EASTERN EDGE OF PHASE 7.THE EDGES OF THESE AREAS N1LL BE REMOVED.RBI WILL MAINTAIN 2:1 SLOPE ON ALL OUTSIDE EDGES OF THE CLAY PIT. 3.RBI HAS ACQUIRED TITLE TO PHASES 1,2,3,4,6 AND 7.RBI ALSO MINED CLAY TO THE NORTH AND SOUTH OF THIS AREA ON RBI PROPERTY.THE CLAY IS USED IN R81'S LONG-STANDING BRICK MANUFACTURING FACILITY.RBI WALL ALSO MINE CLAY ON ITS PROPERTY, 7.AT THE CONCLUSION OF ALL MINING,RBI WILL RECLAIM THE MINED AREA BY SPREADING NOT LESS THAN EXCEPT IN WETLAND AREAS.RBI WILL MAINTAIN A 40 FOOT SETBACK FROM ALL WETLANDS. SOUTH WINDSOR, CONNECTICUT *, HRPASSOCIATES.COM APPROVED: SHEET SIZE:DML 24"X36" Appl # 19-08P, Redland Brick Earth Removal Special Exception/Site Plan PH 3/12/19 1. Request for a renewal of a five year Special Exception permit to Section 7.16 for an earth removal permit to extract clay on Redland Brick property at 1440 John Fitch Blvd, Industrial and RR zones. 2. The applicant has had two-year permit renewals since 2000; in 2007 the PZC changed the regulations to allow for a five year permit period. The narrative provided by the applicant describing the current operations as well as a copy of the most recent approval from 2014 was included with your packets. 3. The zoning regulations allow removal of earth materials, including clay, as a Special Exception, in conformance to certain criteria, including: • The plan shall provide for proper drainage of the area of the operation after completion; and no bank shall exceed a slope of 1 foot of vertical rise in 2 feet of horizontal distance. • At the conclusion of the operation, or of any substantial portion thereof, the whole area where removal takes place shall be covered with not less than 4 inches of topsoil, and seeded with suitable cover crop. • Except in an industrial district, no stone crusher or other machinery not required for actual removal of the material shall be used. • In passing on such applications, the Commission shall consider the effect of such removal on surrounding property and the future usefulness of the premises when the operation is completed. In the case of removal of quarry stone, and mining operations, the Commission may modify the foregoing requirements where such operations will not endanger public health and safety or be detrimental to the neighboring properties. • Such permits shall be issued for a period not exceeding 5 years beyond the date of Commission approval. • Extension of time or modification of the scope of work originally approved may be granted by the Commission. • The applicant shall post a bond with the Town Treasurer in an amount approved by the Commission after consultation with the Town Engineer as sufficient to guarantee conformity with the provisions of the permit issued hereunder. 4. The special exception criteria of Section 8.7 apply as well. 1 5. The site is currently accessed from Route 5. The plans and narrative indicate that the applicant continues to work it the same area that was permitted five years ago. The plan submitted reflects the existing grades as well as proposed grades over the next five years. 6. As the applicant has referenced and you will hear tonight, there have been some concerns expressed by abutting property owners regarding the operations on the site. We had initially received a few noise complaints related to late night operations that seemed to get resolved in 2016. Our office also received complaints in both 2016 and 2018 related to excessive dust coming from the site during the hauling operations. These complaints were sporadic as the hauling operation onsite has been sporadic. Staff met with Redland Brick the spring of 2018 before operations started to review neighbors' concerns and reiterate the need to control dust from the site. In June of 2018 another complaint was filed related to dust problems. The neighbors also involved DEEP Air Quality unit in their complaints. We have not been able to receive copies of those complaints and would ask the applicant to address their status. 7. This past December staff met again with representatives of Redland Brick, knowing the renewal was pending, to understand what suggesting measures they could take to address these ongoing concerns. To address these specific concerns, the applicant is proposing the following changes to the operations: • Requested permit to pump water with continuous monitoring. This would allow clean water to be discharged into Bancroft Brook and allow for the relocation of the some of the operations to an area further from adjacent properties,; • Cover the haul road with crushed bricks and/or trap rock to minimize dust; The applicant has offered two other measures to address these concerns if warranted, Staff would recommend that the trees suggested toA mitigate the noise and dust be planted at this time and the monitoring to adjust the mining operations based on the weather conditions. 8. As it relates to the last requirement, the applicant has provided a reclamation plan and has on file a restoration bond in the amount of$30,000. Previous approval conditions have stated, "Prior to the start of the restoration, a report shall be submitted to the Environmental Planner and Town Engineer to determine the appropriate seed mix that is comparable to the hydrology on the site." There are regulated wetlands on the site however there are no activities at this time that require an active wetlands permit. If this application is approved, Planning Dept. would request the approval conditions from the previous approval be incorporated into any future approval A 4&t ` `J► off, C4 a To whom it may concern: My name is Joseph Masciovecchio of 478 Strong Rd and I am writing in response to the article I read on February 20th in the journal inquirer about the noise and dust associated with Redland Brick. There were many exaggerated points in the article and the operations of Redland Brick in my opinion have very minor impacts on the life of the residents on Strong rd. Redland bricks "pit" in discussion is straight back behind my property and though we do hear some normal construction noise during business hours that's the extent of the inconveniences. We are "outdoorsy" people who live outside in our yard during the spring, summer and fall, and we have our windows open all the time for fresh air and we have no issues at all with dust, excessive noise or vibration from the construction equipment. I think it's important to note that Jim poulin is not a resident of strong road and lives on a private drive off strong rd where his home is extremely close to Redland Brick and though he may be experiencing some dust and additional noise due to his proximity to the pit he does not properly represent the feelings from residents on strong rd. I am in full support of the renewal of Redland Bricks 5 year earth removal permit and encourage the town council to allow this business to continue its normal operations that they have been doing for over 100 years. Thank you, Jose Masciovecchio f Date 2/21/19 EXHIB IT B Connecticut Department of ENERGY & ENVIRONMENTAL P R O T E C T i O N NOTICE OF VIOLATIQQI Chn'stiau Lytle,Plant Manager Notice of Violation Number Rcdland Brick,Inc.17930 1440 John Fitch Blvd. South Windsor,CT 06074 The purpose ofthis Notice is to inform you that personnel of the Department cfEnergy and Environmental Protection (DEEP) have made observations or otherwise obtained information indicating that a violation of law has occurred at the propeny located at 1440 John Fitch Blvd.South Windsor,CT.On 8/27/1 8,an inspection was conducted by Alyssa Park of the DEEP Bureau of Air Management.Based Lipon that inspection,it appears that you have failed to control airborne patticulate matter as required by Connecticut Genexal Statutes Section 22a-174 and Section 22a—174-18(c)(2)(A)ofthe Regulations of Connecticut State Agencies. (2) All metals analyses identified in this permit shall refer to analyses for Total Recoverable Metal as defined in 40 CFR 136 unless otherwise specified. (3) The term Minimum Level (ML)refers to either the sample concentration equivalent to the lowest calibration point in a method or a multiple of the method detection limit (MDL). MLs may be obtained in several ways: They may be published in a method;they may be sample concentrations equivalent to the lowest acceptable calibration point used by the laboratory; or they may be calculated by multiplying the MDL in a method, or the MDL determined by a lab,by a factor. The MLs specified in Table A represent the concentrations at which quantification must be achieved and verified during the chemical analyses for those noted parameters. Analyses for these parameters must include check standards within ten percent of the specified ML or calibration points equal to or less than the specified ML. (4) The value of each parameter for which monitoring is required under this permit shall be reported to the maximum level of accuracy and precision possible, consistent with the requirements of this section of the permit. (5) Effluent analyses for which quantification was verified during the analysis at or below the levels specified in the Section 5 tables and which indicate that a parameter was not detected shall be reported as "less than x" where 'x' is the numerical value equivalent to the analytical method detection limit for that analysis. If the Permittee is required to submit its DMRs through the NetDMR system, the Permittee shall report the non-detect value consistent with the reporting requirements for NetDMR. (6) Results of effluent analyses which indicate that a parameter was not present at a concentration greater than or equal to the Minimum Level specified for that analysis shall be considered equivalent to zero(0.0)for purposes of determining compliance with limitations or conditions specified in this permit. (7) MLs for certain parameters in Table A may be higher than the corresponding permit limit. With respect to these parameters, if a test method/procedure becomes available that will result in a lower ML than the one noted in Table A,then these lower MLs shall supersede the MLs in Table A. SECTION 7: AQUATIC TOXICITY TESTING (A) ACUTE TESTING REQUIREMENTS. The Permittee shall conduct acute aquatic toxicity testing for DSN 00 1-1 and DSN 002-1 as follows: (1) TEST METHOD: Acute aquatic toxicity shall be performed as prescribed in the reference document Methods for Measuring the Acute Toxicity of Effluents and Receiving Waters to Freshwater and Marine Organisms (EPA-821-R-02-012), or the most current version, with any exceptions or clarifications noted below.
