The previous owners had a permit for an approved in-law apartment. Per South Windsor Zoning Regulations, in-law apartment approvals are valid for 5yr. periods &run with the property owner&not the land. At this time, I am not sure if the in-law apartment has been removed or is currently being used by you or is currently in existence but not in use. If it is still in existence, you may apply to the Planning&Zoning Commission to continue its use, or if you choose not to use it in this manner, it must be converted back to living quarters of the main dwelling. I have enclosed a copy of the original approval for the in-law apartment & a copy of our Zoning Regulations regarding in-law apartments. Please feel free to contact me with any questions you have at 860-644-2511 ext.251. Sincerely, Linda M. The permit was granted for a period of five (5) years, and expired on February 23, 2009. This letter serves as a warning that enforcement action will be taken against the property if this matter is not addressed in a timely manner. Section 7.1.3 B 2 of the Town of South Windsor Zoning Regulations, In-Law ApartmentsApplication, requires the permit holder to, prior to the expiration of the permit, either reapply to the Zoning Enforcement Officer (ZEO) for a renewal of the In-Law permit, or inform the ZEO that said apartment is no longer needed and has been converted into living space for the primary dwelling. If the in-law apartment is still in existence, you must apply for a permit to continue its use. If you do not wish to continue using the space as an in-law apartment, it must be converted back to living quarters of the main dwelling. Please contact me at (860) 644-2511, ext. 251 within the next fourteen (14) days to resolve this issue so as to avoid potential enforcement action from this office. Pursuant to your request to maintain the in-law apartment for an additional five (5) years, please note that your permit has been extended for 5 years from the date of the prior permit expiration date. 1. This approval is for an in-law apartment for a family member/relative only. When the in-law apartment is no longer occupied by a relative of the family, the apartment cannot be treated as a second dwelling unit. Instead, the kitchen must be removed and the living area must be converted into other living space for the main dwelling. 2. This permit will expire in five years from the expiration date of the prior permit, on February 23, 2014, and will have to be renewed at that time if the use is to be continued. Owner(s) of the property must reside in the apartment or the main dwelling unit. Reaffirmation of occupancy by owner will be required every four years. This will be done via a letter from the Planning Department requesting the reaffirmation of occupancy. 3. Any new building, or alterations/additions to existing buildings, requires a building permit prior to start of construction. Thank you for your attention to this matter.
