C 07 G Print Nam of Applicant Print Naye of Property Owner Revised 1/9/2017 Craig Kochanski Application 108, 118& 128 Troy Road Re-zone to A-30 Article 8 Section 8.3 Item D. Review Criteria 1. The goals, objectives, and recommendations of the Plan of Conservation and Development; The goals and objectives of this application is to update the property zoning performed many years back to a zone more suitable for the surrounding area to match the existing residential appeal. The rezoning will protect existing property values by preventing incompatible uses of a property. For example, an automobile club next door to a residential home. 2. The purposes of zoning and of these regulations; The purpose of the rezoning is to provide a transitional area that maintains the general welfare of the community and to protect and conserve the value of their properties.By rezoning this property,it will bring it back to residential zoning where it was once blanket rezoned years ago. When the town rezoned the section of Sullivan Avenue to General Commercial, the extending properties on Troy Road along with the connecting properties were all rezoned to General Commercial at that time. 3. Changes that have taken place in the rate and pattern of development and land use within the Town and adjoining communities; The gateway zone is rapidly developing and expanding the commercial and residential markets 4. The supply of land available in the present and proposed zone; The property is 2.7 Acre(115,260 SF) 5. The physical suitability of the land for the proposed zone; The property is presently zoned commercial, however used as residential and would remain residential. The rezone change would allow a transitional area where the zone goes from industrial to residential to general commercial. 6. The impact on the capacity of the present and proposed utilities, streets, drainage systems, and other improvements; The present utility capacity would remain the same or have substantial less impact if commercial would be developed. 7. The general character and zoning of the neighborhood; The present character is a small residential neighborhood with no visual evidence of commercial development. 8. Impacts on the surrounding area; The rezoning would have beneficial impacts on everyone's property values in the surrounding area 9. Traffic congestion impacts; Having the property rezoned would have negligible impact; however remaining as commercial could have a substantial impact by adding hourly and daily traffic. 10. The impact on surrounding property values; The property values in the immediate area would increase as the concern with a commercial enterprise being constructed adjacent too,or across the street would be eliminated. 11. The environmental impacts; Craig Kochanski Application 108, 118& 128 Troy Road Re-zone to A-30 The rezoning would have no environmental impacts 12. The health and general welfare of the community; The zoning change to residential will allow the health and wellbeing to remain as is. 13. Neighborhood acceptance weighed against community needs; and The neighbors for which I discussed this change are in favor as they were concerned on the type of commercial business would move into the area. The residential property abutters will appreciate the protection of this zone change by keeping the look and natural aesthetic feel of a residential neighborhood. 14. The protection of historic factors. Not applicable Craig A. The Plan does not appear to be to the scale shown. Check and print this plan to scale. 2. The existing driveway for Lot 1 needs to be narrowed to 24 feet wide at the street line. 3. Label the existing well for Lot 2. 4. Label the proposed bit driveway for Lot 3 that is at most 24 ft wide at the street line. 5. Show a proposed well location for Lot 3 that is far enough from the proposed sewer lateral to meet the State of Ct Health Code. 6. The proposed sewer lateral on lot 3 needs to show the pipe size and type, a proposed slope of at least 2%, invert elevation at the sewer main and proposed invert elevation at the house. 7. Show a proposed foundation drain location and invert elevations for the house on lot 3. 8. Show proposed underground electrical, cable and phone for the house on lot 3. Please let me know if you have any questions. Appl #18-59P, Kochanski Zone change/Subdivision 11/27/18 1. Request for a request for a zone change of 2.6 acres of land from General Commercial to Residential A-30 zone and subdivision for property located on the southerly side of Troy Road west of Brookfield Street (known as 118 Troy Road) 2. The applicant was in front of this Commission about 2 years ago and received a three lot subdivision for commercial lots. The site contains a single family house and a previous commercial building. There is residential property to the north of the site and commercial properties to the west and south. 3. The minimum lot size in the A-30 zone is 30,000 sf minimum lot size. Frontage requirement in the A-30 zone is 150 feet. The existing house lot is being adjusted slightly to conform to the A-30 setback. 4. Section 16 includes criteria for zone change: a. How the zone change compares with the Comprehensive Plan of Development; b. How the land shall bKad m flooding and other dangers; c. How the land upstrestream in the same watershed shall be secured from floer dangers; d. How the land shall water, sewerage, transportation, and other public utili ese. How the proposed zill affect any wetlands in the area. 5. The POCD depicts this area as a transition area between single family residential category and commercial development. The plans does encourage the protection of established neighborhoods and maintaining residential densities and patterns. 6. The possible uses in this zoning category include, in addition to single- family housing, farming uses, keeping of horses and ponies, municipal buildings, Town parks and playgrounds, places of worship, schools, housing for the elderly and senior residence developments. 7. There is existing water and sewer availability in Troy Road. The properties will continue to be serviced by well water and public sewers. WPCA approval will be required for any new sewer connections. 8. There is a buffe equirement ween single-family "nesd commercial that woul addressed at the tim the subdiv' ion and thelan must be mo ' ied to reflect the buffer requireme 9. If this zone change is approved, the Commission must state on the record that you have found the zone change to be consistent with the plan of conservation and development. With respect to the changes to the plans for the residential subdivision, the proposal is to allow for three single family houses with no commercial activities and if approved, this would supercede any existing approvals on the property. 10. It should be noted that all three lots would be conforming the A-30 zoning requirements. In addition, the lots are subject to a buffer requirement wherever the new residential zone meets the commercial zone. The buffer setback line and lot setback requirements should be corrected on the plans and details of how the buffer area will be treated should be provided. 11.It should be noted that there is an existing 25 foot right of way approximately 12 feet in from the western property line which provides access to and from the property at 468 Sullivan Ave. The easement should be clearly marked on the plans so that any residential buyer is aware of this. 12.The proposed driveway for the new lot would require the removal of a large town owned tree. We would request the applicant be required to locate the driveway to preserve the tree if the tree is healthy. 13.There are regulated wetlands on the properties. The applicant previously received IWA/CC approval for the subdivision on 9/21/16, with no unusual approval conditions. 14.At the time of house construction, the applicant will have to submit plot plans for the building permit on these properties. If this application is approved, the planning department has no other modifications to request.
