Dear Attorney Alter:
We are pleased to advise you that at the Planning & Zoning Commission meeting on February
27, 2018 the Commission determined by consensus that the proposed use of the property at 420
John Fitch Boulevard as a site for the manufacturing of earth products as referenced in your letter
dated February 11, 2018 and described at the meeting is similar to other permitted uses in the
Industrial zone and would be permitted by site plan approval.

Michele:As we discussed, I am requesting that you bring the attached letter to the attention of the commission at its
next meeting. I am seeking confirmation that my reading of the regulation is correct and that this manufacturing use
requires only Site Plan approval. As we discussed there is still planning to be done before the site plan is ready for
presentation to the commission for its consideration but before JR Russo begins to complete its plans,we need to have
an assurance of the process for approval that we will follow. I am confident that we will bring forward a compliant,well-
conceived plan for the town staff and then the commission to consider. Again,thanks for taking the time to review this
