Are there wetlands on the property? YES x NO 2. Is any part of the premises within 500' of town line? YES x NO 3. Is this property within the CT Water Aquifer area? YES x NO (If yes,the applicant must file an application with the CT Water Company and submit copy with their application.) i f Requesting a Variance to Zoning Regulation Section(s): 3.1.2(A); 3.1.2(H) t Written Description of the variance request or Appeal of Zoning Enforcement Order/Decision: (Attach additional sheet if needed) We wish to replace our front steps, which are 6 feet wide and extend 6 feet toward the road. The replacement will be an unenclosed covered porch which will also extend 6 feet toward the road, and will be the full width of the house. The issue is that the setback distance is less than the required 40 feet. From the proposed porch to the property line is slightly more than 30 feet, and from the porch to the road is slightly over 40 feet (see site plan). OyVTd SFQ. \ For Variance request only: 1. Strict application of the regulations would produce UNDUE HARDSHIP beca{te ` The current concrete steps are crumbling and unsafe. The proposed front porch is more functional, safer and more aesthetically pleasing. This porch would extend no closer to the road than the existing steps. The immediate neighborhood already has several homes with far smaller setbacks, some less than 10 feet (e.g. 94 Troy, 59 Troy, 42 Troy). 2. The hardship created is UNIQUE and not shared by all properties alike in the neighborhood because This house was built in 1947, before the setback regulations were in place. The addition of a front porch is not an issue for houses built more recently, because they have at least a 50' setback, and consequently, these houses can employ the 10' porch setback reduction in order to comply with the zoning regulations f see 3.1.2 (H) 1 3. The variance would not adversely impact neighboring property; i.e. public health, safety, convenience, welfare and property value, because The proposed porch would improve the appearance of the house, and would be safer as the steps would be somewhat protected from the elements. It would afford shade to the southern exposure of the house, lowering cooling bills in the summer. According to our realtor, the addition of a porch would have a positive impact on the property value.
