In the attached narrative, you describe bringing food from Vito's by the Water to be served on the farm. In order to allow food to be served to the public in this capacity in South Windsor, you will need to complete a temporary event permit for each event hosted on the farm. This will require a complete application, map of the food service area, QFO certificate, and menu to be submitted. I have included a copy of the temporary event application for your reference. I can also send you this form electronically for your convenience. I would strongly suggest that access/exiting be through Saxton La to avoid accidents, especially when we are talking about 50 to 250 people coming and going. Even Saxton La has a sight line issue to the south though it is not severe from there. I saw an area that looks like they are already using it for access into the property from Saxton which looks like it would be ideal. Let me know if you need anything else. Several concerns were expressed (between site lines and width of drive)with using the existing driveway to access the proposed parking area in the back. It was suggested that they pursue access through Saxton Lane in East Windsor directly to the rear of the site. Have you had o chance to look at this location? I have included a map and the narrative and hope to get comments back to the applicant in the next day orso. |f they need toQo through a process in East Windsor, | want to advise them sooner than later! Lipe, AICP Director of Plannine Date: 7/26/2017 Re: Application #17-29P, Wedding on the Farm Planning Department Review Comments General Comments 1. Staff from the police, engineering, fire marshal's office, health department and planning have reviewed the site and proposal submitted. The primary concern expressed was the proposed access into the site for event attendees through the existing residential drive on Rye Street. Concern there is significant site line problems in both direction from the existing driveway location; Concern for the ability of emergency vehicles to access the event area through the proposed drive; No ability for two-traffic through the existing residential drive For these reason, that access point is unacceptable. It is suggested that an access be brought into the property off of Saxton Lane (through the property owned in East Windsor) connecting directly into the parking area shown to the rear of the house. Please contact the East Windsor Planning Department to find out the necessary steps to obtain approval for such access. It is the staffs recommendation that this application not go forward to public hearing until the access is resolved. 2. The Health Department will require a temporary event permit for each individual event. Building permits will be required and the applicant should contact Building Department and Fire Marshall Office regarding any code requirements that may be applicable to hold such events. • Page 1 ' 3. The applicant should contact the assessor's office to understand if there are any tax implications of taking some of the land out of the farming category. Plan Comments 4. The plans should show the reminder of Saxton Lane that is in South Windsor and the new access point into the property from Saxton Lane. 5. The amount of new disturbance with the proposal needs to be determined. In the event over 1/2 acre is proposed to be disturbed, conservation approval will be required. 6. The plans should include general locations for the port-a potties/hand wash stations. Area where the servers will be stationed with food should be also be identified. 7. Is there a dumpster area proposed? The owner will be responsible to provide for commercial refuse pickup. 8. Is there any temporary or permanent lighting proposed to illuminate the parking area or safe passage to the tents? If not, staff would recommend some lighting be considered to safely get patrons to their vehicles. 9. Staff would recommend that the Sunday evening hours be reduced to 7 PM. 0 Page 2 f RECEIVE© August 4, 2017 n J be C vvv'/ AUG 0 8 2017 Chairman Gary Bazzano Planning&Zone Commission pyj 1540 Sullivan Ave C WJTM WNDSOR KMNNG DE! South Windsor, CT 06074 Re: Vito's on the Farm Dear Chairman and Commissioners: I am writing you today to express our dismay on the application that has been filed by Vito's on the Farm for zoning changes that will significantly impact our bedroom and gentleman's farm community. We built our home at 684 Rye Street in 1957. We chose our location based on the fact that Rye Street was a farming and single family bedroom community that offered us a family friendly environment and great schooling opportunities for our growing family. We are very concerned that the gentleman's farm across the street is currently operating as a commercial entertainment venue for weddings and parties. We will admit that we were naive in our belief that the parties thrown across the street over the last couple of years were for family and friends of Mr. Maffucci. As good neighbors,we did not voice complaints on the amount of noise—people, music, and traffic-even though they were loud and disruptive. We do not understand how Vito's was allowed and continues to be allowed to conduct business at 677 Rye Street. It seems nefarious that Vito's does so without proper zoning and we suspect licensing. We feel unsafe knowing that our neighbor does not have a personal relationship with attendees and that the venture is commercial. We understand that they are serving alcohol to the public and we do not believe that this type of partying is in standing with our current neighborhood and our quality of life. How can the venue ensure our personal and property safety? We adamantly oppose a commercial entertainment venue for weddings and parties to operate in our single family bedroom community. Having commercially served parties, from May through October, operating from 8 a.m. until 12 a.m.,with a capacity of up to 350 people, negatively impacts our environment and significantly decreases our homes value. New families will not entertain moving into a home with a party venue across the street. Single family homes have replaced most of the farm lands over the years increasing the numbers of families and South Windsor has recognized that development by building Rye Street Park. We have welcomed the change, while noticing a significant increase in car traffic that courses along Rye Street. We have not voiced our concerns on the amount of truck traffic that includes tractor trailers (including tandem), industrial equipment trailers and dump trucks that now consistently travel up and down Rye Street due to the industrial and warehousing development that has been allowed on Rye Street from Sullivan Avenue to Troy Road because we understand that communities change along with their needs and that the development of this area did not attract single family homes. We do believe however that approval of Vito's on the Farm will add additional traffic, noise and pollutants that Rye Street is unable to accommodate presently, especially from Griffin Road to Rye Street in East Windsor as it is the narrowest section of roadway. ► 1 We do not have city water and each of our homes require an individual well. These wells are dug into the same aquafer as the farm. We are concerned how the water level will be impacted if Vito's is approved. Where will they get their water for servicing up to 350 people? Will we have issues with water being drained from our wells? Also, there are no public fire hydrants, so a fire safety issue is of concern. The ludica farm across the street once had 100's of chickens in two coops (large sheds)that were lost to fire due to the firemen's lack of access to water to put out the flames. The small pond on the premises was not adequate protection. The ludica farm never recovered commercially and that was when the property became a gentleman's farm. We ask the Planning and Zone Commission to deny the change in zoning and implore that Vito's be given a cease and desist order from conducting business as a commercial entertainment enterprise for wedding and parties. Vito's on The Farm are still advertising as a going concern on multiple websites: www.wedding-spot.com/venue/5246/Vitos-On-The-Farm/,www.telp.com/biz/vitos-on-the- farm-south-windsor,www.ctnow.com/food-drink/ctnow-vitos-hosts-fall-harvest-farm-dinner- 20150910-story.html, www.theknot.com/marketplace/wedding-reception-venues-south-windsor-ct. We are unable to attend the meetings of the Planning and Zoning Commission as were are elderly and home bound. We will ask my daughter,Ann Kielbania to attend in our stead. Please let us know the date and time of the meeting when this topic is open for public discussion. We were told that it will not be on the August meeting agenda. We hope that each of the commissioners will consider when voting whether they would want a drinking party venue across the street from their homes. We pray that the commission hears our plea and votes against changing our bedroom community. Sincerely, John and Irene Piechowski 684 Rye Street South Windsor, CT 06074 (860) 289-5880 cc. Matthew B. The plan needs to show the TOSW ROW for the east end of Saxton Lane and the current owner of the strip of land the proposed driveway will be crossing. 2. The driveway off Saxton Lane is a good idea. This driveway should only serve the property at 677 and 653 Rye Street, but not Lot 1 Saxton Lane. It needs to have a curb cut and a 10 ft long paved apron. The rest can be gravel. Request for a two year temporary and conditional permit to hold up to four (4) wedding and/or corporate events between June and October, on property located at 653 and 677 Rye Street and 5 Saxton Lane East Windsor, RR zone 2. The events would take place on weekends —Friday through Sunday and would be held between 11 am— 10 PM. The Commission may want to limit the hours particularly for Sundays. The applicant would be responsible for complying with the town's noise ordinance. 3. The applicant narrative requests a max. of 4 events a year; group size 50-150; during the warmer months - June through October. 4. Food will be catered and tent and restroom facilities will be rented as needed for the event. 5. Parking for the event will be on-site. There is no on street parking. Staff had expressed concern with access from the existing residential drive on Rye Street. The applicant modified the plan and a temporary access is shown over the owner's land off of Saxton Drive to a gravel parking area south of an existing foundation on site. Both Police Services and the Fire Marshal have reviewed this plan and are satisfied with the proposal. 6. All health code requirements for a temporary event must be met. The applicant will be responsible for ensuring that all necessary permits are obtained and submitted to the Health Department and to coordinate an inspection if necessary. Building Department permits and Fire Marshal review are also required. 7. The wording of the T & C permit regulation is that, "Temporary and conditional permits may be granted by the Commission for a period not to exceed 2 years. Such approval may be given after a public hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use." If this application is approved, the applicant should notify the 2018 dates with the Planning Department once determined. If there are buildings, structures or other items that require a building permit or other Town approvals/permits, all such approvals or permits must be obtained prior to construction or use of the site. 7. Engineering comments dated 8/22/17 must be incorporated into the final plans: 1. The plan needs to show the Town of South Windsor ROW for the east end of Saxton Lane and the current owner of the strip of land the proposed driveway will be crossing. 2. The driveway off Saxton Lane is a good idea. The driveway should only serve the properties at 677 and 653 Rye Street, but not Lot 1 Saxton Lane. It needs to have a curb cut and a 10 foot long paved apron. The rest can be gravel. A street cut permit is required from the Town of South Windsor for this new driveway. 3. The applicant will have to maintain the proposed gravel parking area. How will parking spaces be marked? 8. The applicant shall notify the Planning Department of each season's upcoming event dates. 9. Speakers must be aligned away from Rye Street. 10. Clean up debris on old foundation near the parking area prior to future events.
