Lipe, AICP Director of Planning Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 RE: 1161 John Fitch Boulevard My Clients: Manchester Property Group, LLC Mike and Tony Auto Repair, Inc. Dear Director of Planning: I am legal counsel to both Manchester Property Group, LLC and Mike and Tony Auto Repair, Inc. Manchester Property Group, LLC "MPG"purchased the property on July 28, 2016 from Leonard M. Treglia. The subject property is located in the Industrial Zone and requires a special exception application for the proposed use as a General Repair and Retail Used Car Dealership. The subject property is a 1.6 acre parcel containing a two story brick building which was previously underutilized. The site is environmentally clean and is ideally suited for commercial or industrial use. Two previous applications for special exceptions were filed by the previous owner. The first application was granted on June 28, 2012 and recorded at Volume 2266 at page 43 of the Land Records and allowed Cross Fit to operate a retail business in the Industrial Zone. The second application was granted to Leonard M. Treglia on May 26, 2016 to allow for a Dealers' license and the wholesale of vehicles in the Industrial Zone. The approval granted to Mr. Treglia was not recorded on the land records. My client seeks a modification to the May 26, 2016 application. The modifications include reducing the number of cars to be stored on the lot for display, additional lighting and landscape elements; and provides for the ability to operate a general repair and used auto business from the current location. Mike and Tony Auto Repair has entered into a notice of intent with MPG to lease the premises. Mike and Tony Auto Repair is a licensed general repairer and used car dealer bearing Registration No. U7557. The principals Anthony Mahon and Michael Mahon have successfully operated their general repair and used car business in Hartford for twenty years, and wish to expand and relocate their primary business to South Windsor. The business currently employs seven full time employees, and upon relocation to South Windsor would look to add up to three full time employees, and two seasonal employees. Mike and Tony currently has existing working relationships with several established South Windsor businesses, and seeks an opportunity to expand its business relationships with the automotive industry related business 1 $111k 32 Wintonbury Avenue ♦ Bloomfield, CT 06002 ♦ plyle@lylelegal.com ♦ www.lylelegal.com located on Route 5 and nearby Sullivan Avenue, while becoming an active member of the South Windsor community. Consistent with the plan of development for Route 5, Mike and Tony, with consent of Manchester Property Group, LLC has undertaken to make several improvements to 1161 John Fitch Boulevard. Those improvements include repaving the parking lot, improving the fagade of the structure through the installation of new windows, siding, entrance doors, perimeter lighting, and signage. Improvements also include creating show-room space, remodeled and redesigned reception and office area to provide for a superior customer service experience. Parking areas will be organized to allow for easy access to displayed cars by customers, resulting in no more than half a dozen cars_being offered for sale,to be located at the front of the lot immediately --adjacent to Route 5 at any one time. At the same time, my clients have undertaken to add additional landscaping in the form of planting white pine trees along the perimeter, installing grass coverage, planter boxes, planter beds, and sprinkler system to ensure that all trees, hedges, and flowers will retain their vitality. In addition to all of the foregoing, my clients will retain the historical look and feel of the site, and remain consistent with the historical nature of the surrounding neighborhood by retaining the barn located at the rear of the property, and by installing corral fencing to continue the rural farm character of the nearby horse and sheep farms. At the conclusion of the matter, the improvements contemplated and already undertaken by my clients, the proposed usage, and renovations will: • Increase the value of the property • Provide additional employment • Maintain the character of the neighborhood • Create no traffic or other hazards • Operate a business that is compatible with surrounding development • Meet the Commission's goals for the corridor. I look forward to the opportunity to present my client's case for Special Exception and Modification at the next scheduled meeting. r' Very tru yours, t Patrick G. We have observed that a large area of the site that was previously gravel and grass has recently been paved. This paving has not been approved. It may coincide with the areas shown to be paved on the plan that was submitted recently, however this needs to be verified and the plan updated. 2. The impervious area of the site as it now exists needs to be recalc ulated to determine if it meets the regulations. 3. The plan shows several catch basins and a drainage manhole but no information about the connecting pipes or where the water goes from this site. Additional information is needed about the drainage system including the invert elevation of the pipes in and out of the manhole on the south west corner of the property and the TF and invert elevations of the catch basin and inlet and outlet pipes in the south east corner near John Fitch Blvd. The location of the outlets of all pipes from these two structures needs to be located (may be off site) and identified to show the storm water flow direction off this site. Any storm water flow off site should be in piped systems and/or have rights to drain if needed. 4. The design calculations for the 2 grass swales proposed show they were sized for the water quality storm event and for 18,073 sq ft and 6143 sq ft of impervious area. These calculations need to be checked and expanded. The impervious area draining to each swale needs to be checked based on the current site conditions. The drainage calculations need to show pre and post development flows from this site for the 2 yr, 10 yr, 25 yr and 100 yr storms. The post development storm water flows need to be at or lower than the pre development storm water flows from the site for all these storms. Detention may be needed based on these flows. Water quality treatment is needed on this site. Any detention basins or water quality swales should have outlet structures and pipes to convey flow off site in the event of a heavy storm or if any expected infiltration does not work. 5. Provide an operations and maintenance plan for all storm water structures and devices to be used for this site. The first call had to do with an abutting owner's concerns that their property was being used to. access the subject property without permission and consent. Immediately following the call, I instructed my client to address the issue. On October 18, 2016, my client met with the abutting owner, apologized in person for the unauthorized use. At that time I became aware that my client had obtained an estimate from a contractor to re-pave the paved portion of the property in the front of the building and immediately to the rear of the building, including potential payment of the remaining portions of the parking lot demarked on the pending site development plan. I also became aware that the contractor had undertaken to re-pave the front of the property, including the curb cut connecting the property to Route 5. I advised my client at that time that no work could commence on the property which was subject to approval by the P&Z before permission was obtained. I asked my client to inquire of the contractor, "The Driveway Guys, LLC" of Norwich, Connecticut, whether they had submitted and obtained a permit to re- pave the existing paving, and the curb cut. My client inquired of the owner of"The Driveway Guys, LLC" whether they had obtained a permit as required for the re-pavement of existing pavement, and my client was advised by the owner of the company that a permit from the State of Connecticut was in hand. I instructed my client that under no circumstance can any contractors commence or undertake any site work 1 .8plllu0- ;2 WirimnNiry Avenue • Rlccmtield. CT 06002 ♦ nlvlerdJvleleaal.com # www.Iyle legal.coin Oct 20 2016 07:09PM HP Faxlyle Legal 8602420616 page 3 that was not previously approved by the Town and evidenced on the approved plans on file dated June 15, 2016 and after. On October 19, 2016, at approximately 3:40 P.M. I received an email letter from your office indicating that a second complaint is on file regarding the pavement of the property prior to P&,Z approval. I had stopped into the office on or about 1:00 P.M. to hand deliver A-2 surveys, and was unaware that there were any issues at that time. Upon receiving your letter, I again contacted my client regarding this issue, and after inspection my client advised me that the paving contractor had undertaken to complete the paving work including the proposed paving as outlined on the September 17, 2016 Site Development Plain. I made contact with your office by telephone this afternoon, to indicate my finding. After speaking with you I ultimately spoke with Joseph Patterson, the owner of the paving contractor. During the conversation it became evident that Mr. Patterson's company which is located in Norwich, and is primarily a residential paving contractor, failed to apprise himself of two important considerations. First, Mr. Patterson, mistakenly relied on proposed plans dated September 17, 2016, on which he based his quotation, to concluded that the plans were "Approved Plans". Secondly, Mr. Patterson, mistakenly believed that applying for a permit from the State of Connecticut to re-pave the curb cut leading from the subject property to Route 5, was sufficient authority for his company to undertake the paving work. These issues arc primary to the secondary issues of the absence of a permit for the paving, and payment of the requisite permit fees. In conclusion, my client retained the contractor, on the information and belief that the contract would proceed with the work after the required permits, and approvals were in hand. The contractor's explanation for proceeding without the permits are unsatisfactory, and my client, as well as the Town should expect that licensed contractors will apprise themselves of all rules and regulations governing the work that they hire themselves out to perform. My client ultimately understands that responsibility for contractors not performing work in accordance with clearly established rules and regulations result in vicarious liability, and we stand ready to address this issue with the Town at the appropriate place and time. It is my understanding that a representative from the Town did speak with Joseph Patterson, and may have confirmed the same information 2 Oct 20 2016 07:09PM HP Faxlyle Legal 8602420616 page 4 that I am relaying to you. Given the seriousness of this issue, and the negative impression that I believe it may convey to the Town regarding my client's approach to rules and regulations, I wish to fully on behalf of my client, take responsibility for what is a gross omission by the contractor. My client has and fully intends to adhere to all rules and regulations imposed with regards to its current and proposed usage of the property. My client did not intend to skirt the process in place, and would not under any circumstances knowingly participate or acquiesce to any of its agents, or employees skirting the process which vests ultimate authority in the P&Z to approve substantial changes or modifications in the usage of private property. I have discussed directly with the contractor where he ran afoul of the process, and he and his company, stand ready to make amends to the Town in any manner that the Town deems necessary. " • Minimal, if any, adverse environmental impacts are created. • No traffic or other hazards will be created. • The impacts on the capacity of the present and proposed utilities, street, drainage systems, sidewalks, and other elements of the infrastructure will be minimal. • There will be minimal or no adverse effects on existing uses in the area. • Surrounding property values will be conserved. _ CW- t, • The character of the neighborhood will be maintained or minimally disrupted. Y c, • The general welfare of the community will be served. • There is a balance between neighborhood acceptance and community needs. • Historic factors are adequately protected; or due consideration to preservation of historic factors has been demonstrated. • The overall physical appearance of the proposed development is compatible with surrounding development and the Commission's goals for the neighborhood/corridor. • The architectural design is aesthetically pleasing and blends well into the surrounding area. The Commission may impose additional conditions in accordance with these regulations in order to ensure that all applicable criteria enumerated above and/or within a particular use category are satisfied. 3. The PZC has approved limited car sales in the industrial zone associated to other car repairs business as well as associated with wholesale operation. 4. This applicant's proposal is to operate a general repairer's business and auto sales. The site plan shows the layout of display vehicles on a paved area. What are the intended hours of operation? The applicant's narrative indicates there will be up to six vehicles for display in the front of the lot. However they have not been shown on the plans. Where will cars waiting to be worked on park as well as employees? 5. How will cars be brought to the site; it does not appear that a car carrier can safe maneuver on this site. 6. Exterior improvements proposed include: paving the parking area; fagade improvements including new windows and doors, additional green spaces, lighting and signage. Interior renovations include upgrading the showroom and offices. The majority of the outside area for the cars will be screened by existing fencing that will be slatted as well as the existing barn that exists along the Glendale Road frontage. 7. My understanding is there is additional exterior lighting proposed. We would need information related to the location, type of lighting and lightings level to evaluate for compliance with zoning requirements. 8. Proposed impervious coverage is 65%; 65% is allowed. Staff has worked with the previous applicant to introduce some water quality measures on the site and to differentiate between the green space area and the graveled parking areas. The town engineer will have some additional comments on the drainage. 9. Based on the uses on the/ site the number of parking spaces required are 12; 12 spaces have been shown. The site is served by public water and sewer. WPCA approval is not required as there are no inside drains. 10.With this request, the applicant is seeking approval for a used car dealer's license which is issued from the DMV. It was recently brought to my attention that in the past legislation session, the law was changed again and now all DMV licensing is to be handled with an application to the ZBA. If this application is approved, the Planning Dept requests the dumpster be placed out of the setback, the site plan reflect the display areas in the front parking lot and clarify the parking for employees and customers, provide a lighting plan and remove additional parking shown in the grassed areas (on the engineer plan). I was able to determine that the catch basins located on the property all flow into the Manhole loacated on the South West corner of the property and directly into the Edwn Road waste water system. Storm Water from the Edwin Road system flows into a municipal storage ditch located north of the property , on Glendale Road. The plans detailing the water system are set out on the Site plan for 1145 John Fitch a ` Boulevard November 19, 2008 and Plan and Profile Property of Joseph Vinick from November 14, 1968. \f As indicated on the site plan, the paving company failed to follow the design which would have diverted a significant portion of the storm water away from the catchment systems and into two grass swales located on the South west corner of the property and the north west corners respectively. In addition, the pitch calculations which were contained on the site plan were not followed in the rear 1/3 portion of the paved section of the property beginning immediately to the rear of the existing building. New elevations of the property were taken and I should have the revised calculations prior to the meeting. As a result of these deviations the paving company created a bowl around the catch basin located in the center rear of the building and diverted the storm water towards catch basin.-As a result no storm water from the property will be diverted onto any adjacent properties. In the event that this deviation can be accepted by the Town it is my hope that we can proceed with an evaluation of the other issues raised during the meeting. The new site plan aso details the proposed entrance way on Glendale Road, and the proposal to put down a gravel parking area to accomodate service and employee parking to the rear of the property. This revision is in response to a query from the Committee regarding access to the property of large vehicles (car carriers) from Route 5 and safety issues presented thereby. The proposal to address the change however would require a variance x.green space as the property would be below the minimum green space requirements. dunUE,, ,► i d; ;, ,,(,( r . t v In the event the Town'has concerns regarding the storm water issues presented by the current site situation, there appear to be possibly options for remedy. ' Option 1: Repave the existing 1/3 rear portion of the property and divert the water flow as indicated on the plans. i Option 2: Cut the pavement and create a pave trench along the rear eastern portion of the building running westerly and then southerly in order divert Istorm water into the South west swale and southern grass strip of the property. ' 11/10/2016 Page 2 of 2 It was my intention to meet this morning to discuss these and other suggestions with you personally but unfortunately I just finished a lengthy trial and could not get my notes and thoughts together prior to the meeting. SOUTH WINDSOR PLANNING DEPT. Date: 01-04-17 Re: Drainage at 1161 John Fitch Boulevard Mike and Tony's Auto Repairs, LLC is proposing the re-development of the site at 1161 John Fitch Boulevard in South Windsor. The site is approximately 1.65 acres in size and currently improved with a 4,800 square foot building (footprint) most recently occupied by a fitness center and a barn. Previously, the site was utilized for automotive use and the Atlantic Fence Company. The site is currently equipped with an on-site stormwater collection and conveyance system comprised of a series of catch basins and piping. One catch basin is located in the southeast corner of the site and collects runoff from the paved area to the east of the building. Two additional catch basins are located in the western portion of the site which has historically had a gravel surface. In addition, one of the western catch basins is connected via an 8-inch pipe to the stormwater collection system on the adjacent property at 1179 John Fitch Boulevard. Thus,a portion of the runoff from that site is also conveyed through the on-site system. The on-site system leaves the property via a pipe at the southwest corner of the property, where it ties into the downgradient system serving other properties within the area. Review of 2005 and 2009 aerial photographs of the site on the South Windsor GIS website (attached) reveal that in excess of 80%of the site was historically covered with impervious area(buildings, pavement and gravel). The current plan calls for the reduction in impervious area to 65% which is the maximum coverage allowed by the current zoning regulations. This reduction in impervious area is anticipated to result in a reduction in the peak rate and volume of runoff that leaves the site. In addition to the reduction in runoff resulting from the reduction in impervious coverage, the re- development plans include the installation of a new subsurface infiltration system. The subsurface system will be constructed in the southwestern portion of the site. It will be connected to the incoming pipe from the catch basin in the southeast corner of the site and the drain manhole. All of the initial runoff from the on-site drainage system will be diverted to the sub-surface infiltration system by the construction of a weir within the existing drain manhole. Larger storms will over the weir and out the existing outlet pipe from the manhole. The contributing area to the system is approximately 2.11 acres, including approximately 0.47 acres of the adjacent property at 1179 John Fitch Boulevard. The infiltration system will consist of 14 Stormtech SC-740 chambers. Based on test pits and infiltration test data obtained from prior plans by Trinkaus Engineering, the underlying soils at the site consist of well drained fine to medium sand with an infiltration rate of approximately 12 inches per hour. For the purpose of the design, a more conservative infiltration rate of 4 inches per hour was used. Using this rate, the system was sized to completely infiltrate the runoff from up to a 1-inch, 24-hour rainfall event, which includes over 90% of the average annual rainfall events. The HydroCAD calculations verifying the sizing of the infiltration system are attached. In conclusion, the reduction in impervious area and the addition of the subsurface infiltration system will help to mitigate both runoff quality and quantity prior to discharge. Based on the 2005 and 2009 aerial photographs, it is estimated that the site at those times contained approximately 80 percent impervious coverage. The proposed development will result in the reduction of impervious area to 65 percent coverage in accordance with the Zoning regulations. In order to demonstrate that the development will not increase the peak discharge from the site, the peak discharge for the pre and post development conditions are calculated below using the Rationale Method: Q =CxIxA where Q =peak rate of runoff in cubic feet per second (cfs) C =runoff coefficient I =rainfall intensity in inches per hour(in/hr) A=contributing area in acres (Ac) Calculations were performed for the 10-year, 25-year and 100-year design storms. Based on a time of concentration of 10 minutes, the rainfall intensities (I) for these design storms are 4.8, 5.5, and 6.5 in/hr according to the CONNDOT Drainage Manual. The runoff coefficients (C) used for impervious and pervious area is 0.9 and 0.25, respectively. Based on the percentage of impervious coverage on site and the fact that all of the contributing area on the adjacent parcel is impervious, .the contributing area (A) can be broken down as follows for the pre- and post development conditions: PRE: Impervious area=0.80 x 1.64 Ac+ 0.47 Ac= 1.782 acres Pervious area= 0.2 x 1.64 Ac = 0.328 acres 1 Shoham Rd.East Windsor,CT06088-www.irrusso.corn CT860.623.0569.MA 413.785.1158 SERVING C:ONNECTICUT & MASSACHUSETTS POST: Impervious area=0.65 x 1.64 Ac+0.47 Ac= 1.536 acres Pervious area=0.35 x 1.64 Ac= 0.574 acres The corresponding composite runoff coefficients (C-values) can are then calculated as follows: PRE: C = (1.782 Ac x 0.9) + (0.328 Ac x 0.25)] /2.11 Ac. =0.80 POST: C =(1.536 Ac x 0.9)+ (0.574 Ac x 0.25)] /2.11 Ac. =0.72 Plugging the runoff coefficients, rainfall intensity and contributing area into the Manning Equation for each design storm provides the peak discharge from the on-site drainage system for each design storm. These quantities for the pre- and post development conditions are summarized in the table below: SUMMARY OF PRE&POST PEAK DISCHARGE 10-year 25-year 100-year Pre Post Pre Post Pre Post Runoff 0.80 0.72 0.80 0.72 0.80 0.72 Coefficient(C) Intensity (I: in/hr) 4.8 4.8 5.5 5.5 6.5 6.5 Contributing Area 2.11 2.11 2.11 2.11 2.11 2.11 (A: acres) Peak Discharge 8.10 7.3 9.3 8.4 11.0 9.9 (Q: cfs) As shown in the summary table, the proposed development is anticipated to result in a reduction in the peak discharge from the site. It should be noted that these calculations are conservative as the effects of the proposed infiltration system are ignored. This infiltration system is anticipated to further reduce the runoff from the site. I hope that this letter addresses your concerns.
