MARCH 14, 2016 SOUTH WINDSOR PLANNING DEPT. The site is a 8.75-acre parcel with 808 feet of frontage on the east side of Clark Street in South Windsor. The property is mostly open field with two barns. It is wooded where Quarry Brook abuts the north and east corners of the property. Clark Street is a minor collector road. The site is bordered to the northeast by Eversource Power Company property and to the south by the Manchester town line. Margaret Drive and Rugby Lane are on the west side of Clark Street. The existing house at the south corner of the property is not part of the development. See page A-1 The proposal is to change the zone from Rural Residence (RR) to Designed Residence Zone (DRZ). Twenty- two single-family detached residences served by a 1000 foot long private road are proposed. Open space is proposed between Clark Street and the developed area. Also, a sports field is proposed at the south portion of the property. A sidewalk is proposed along Clark Street. See page A-2. UTILITIES: The homes will be served by public sewer, water and gas which are available in Clark Street. The site is shown on South Windsor's Sanitary Sewer Service area map as Potential Future Sewer Service— areas not served today but could be connected to the sewer system. Storm drainage from the site will be directed to a detention pond at the north corner of the site. The stormwater will be released slowly from the pond before it enters the storm drainage system in Clark Street so that there will be no increase in flow off the property. TRAFFIC: A traffic report prepared by DLS Traffic Engineering LLC concluded that there will be no significant impact on the area roadways due to the proposed development. The DLS traffic report was based on 26 proposed homes and not the actual 22 homes currently proposed. The four less homes does not affect the traffic report. i m ru * „yam 001 •rF' I ro rtl u s xhl¢y9 t s,>•'' a ^ h': re Ir; ;4VIVII I a h5 u Npi rl II ., .d yF.,N 4M'' .,,• y iq yr Il rl IIII 'wu III I.Iu , .,r n a ' Ir h I ti vi~MrYa"I rlll II: r '' ^• i A M IId 3 V,h4 $" lr,, III 7 'M2 °✓k ., ' ak<„+ kNIP I 7 a I .-` ^" xkrlkv oury wkd*a I i ly ii r, v k1, .: PvI+W i Nu v x' I II Iyx har"' ".'^I rr a I Ilk ,.fC„=' ,r• '^",y P r rw +nM r hmv :I° ' @ 9 ff I^ I,x9, ^rt rw, I " ,ddW." See STORM SEWER DESIGN, page B-1, AND WATERSHED PLAN, page B-2. Storm water from the proposed road will drain to a water quality basin. This basin is designed to treat the Water Quality Volume of 8160 cubic feet. See Water Quality Volume calculation, page A-2. Storm water entering the basin from the flared end will enter a sediment forebay where coarse sediment particles will settle out. Water leaving the forebay will flow through an elongated flow path to a lower wet area planted with wetland plantings. The volume of the entire basin is 14,950 cubic feet. Storm water will leave the basin through an outlet structure consisting of a catch basin and a stone trench. The stone trench consists of a perforated pipe surrounded by stone and wrapped in filter fabric. Water enters the top of the stone and is filtered through the fabric and stone to the pipe which is connected to the outlet structure. For larger storms storm water will leave the basin through an orifice in the outlet structure. For storms larger than the 100-year storm, the water level will rise up and exit through a grate in the top of the outlet structure See basin calculations, page C-1. Storm water will be piped from the outlet structure to a storm manhole in Clark Street. The detention basin is designed so that there will be no increase in the peak flow from the property. See PEAK FLOW OFF OF THE PROPERTY CALCULATION, page A-3. WATER QUALITY VOLUME CALCULATION The water quality volume (WQV) is the amount of stormwater runoff from any given site that should be captured and treated in order to remove a majority of stormwater pollutants on an average annual basis. See 2004 Connecticut Stormwater Quality Manual, page 7-4. The following is the water quality volume for the area draining to the water quality basin. WQV = (1")(R)(A) / 12 Where: WQV = water quality volume (ac-ft) R = volumetric runoff coefficient = 0.05 + 0.009(I) I = percent impervious site coverage A = site area in acres R = 0.05 + 0.009(I) = 0.05 + 0.009(27) = 0.29 WQV = (1")(R)(A) / 12 _ (1")(0.29)(7.64) / 12 = 0.19 acre-ft = 8160 cu. ft. The site is located on. the east side of Clark Street and borders the Manchester town line. Access to the site will be from a U-shaped road on the east side of Clark Street. The southerly proposed roadway will intersect Clark Street opposite Margaret Drive. The proposed use is a small traffic generator from a traffic engineering point of view. Site generated traffic will typically occur during the roadway peak hours. Available counts on Clark Street indicate that the p.m. peak hour has significantly higher traffic volumes than the a.m. peak- hour. Accordingly, our analysis will be limited to the p.m. peak hour. Clark Street does not carry high volumes and will be able to accommodate traffic from the proposed development. Scope -This report was prepared to determine the impact, if any,of the proposed development of 26 single family homes at the sul?ject site. We completed a site visit to observe existing conditions and record roadway geometrics and characteristics. We also reviewed ConnDOT count data in the vicinity of the site. P.M. peak hour trip generation estimates were made based on Institute of Transportation Engineers trip generation data for single family homes. These trips were distributed to area roads based on existing travel patterns. For ease of computation and presentation, all site traffic was assigned to the Clary Street/Margaret Drive intersection(the northerly site drive intersection will operate as good or better than the Clark Street/Margaret Drive intersection modeled with all of the site traffic). Flow diagram for the volume development were prepared. Capacity analysis was completed for the study intersection with projected background volumes and with combined volumes. DLS Traffic Robert Mannarino October 14,2015 Page Two Background Conditions - The,site is located on the east side of Clark Street opposite Margaret Drive, adjacent to the Manchester town line and north of Chapel Road. Land use in the area is residential. Clark Street is a minor collector road running from Chapel Road to Pleasant Valley Load and northerly. At Margaret Drive, Clark Street is 30 feet wide with a 12-foot travel Lane and a 3-foot shoulder provided in each direction. The posted speed limit on Wolcott Road in the vicinity of the site is 30 mph. In August 2012, South Windsor Police pleasured the 851h percentile speed on Clark Street between Deming Street and Stanley Street at 42.4 mph. The 85' percentile speed on Clark Street near the site is expected to be similar. .Margaret Drive intersects Clark Street from the west under stop sign control. Margaret Drive is 26 feet wide. The posted speed limit on Margaret Drive is 25 mph. Background Volumes - The ConnDOT count database for South Windsor was reviewed. No current ConnDOT count stations are located in the vicinity of the site. However, in April 2010 ConnDOT completed an ATR count on Clark Street south of Pleasant Valley Road that showed an ADT of 4000 with an a.m.peak hour volume of 272 and a p.m. peak hour volume of 449. Because the p.m.peak hour volume is significantly higher than the a.m. peak hour, our analyses are limited to the p.m_ peak hour. In October 2015, we completed manual p.m. peak period turning movement counts at the. Clark Street/Margaret Drive intersection. On Clark Street north of Margaret Drive,we recorded 441 vehicles from 4:15 to 5:15 p.m. The upper left portion of Figure 1 graphically depicts the 2015 existing volume turning movements at the subject intersection. Intersection Sight Distance(ISD)-The intersection sight distance looking left and right from Moth site drives on Clark Street is over 600 feet. The posted speed limit on Clark Street is 30 mph. ConnDOT guidelines indicate 335 feet of ISD should be available for 30 mph. The approximate 851h percentile speed on Clark Street is 42.4 mph. ConnDOT guidelines indicate that 500 feet of ISD is needed for 45 mph. Therefore, the intersection sight distances from the proposed drives on Clark Street are good for the posted speed limit and for 85`h percentile speeds. Projected Background Volumes -The 2016 projected background volumes are shown in the upper right portion of Figure 1. Projected background volumes include a 2%annual growth factor to 2016 plus traffic passing the site from Clark Estates(18 single family homes under construction north of the site). LS Traffic Robert Mannarino October 14, 2015 Page Three Trim Generation -The trip generation for the proposed residential development was based on data from the Institute of Transportation Engineers. Trip Generation Manual (see Attachment A-1). Using ITF_, equations for single family detached housing. 31 p.m. peak hour trips are estimated (20 entering, I 1 exiting). The site generated traffic was distributed to Clark Street based on existing travel patterns (65/o to/from the south;35%to/froth the north). Again, all traffic was shown at.the southerly drive. Site traffic at the northerly drive will be less than the total traffic modeled at the southerly drive. The lower left portion of Figure I shows the distributed site generated traffic. Combined Volumes-The 2016 combined volumes are shown in the lower right portion of Figure 1. The 2016 combined volumes were obtained by adding the distributed site generated traffic to the 2016 projected background volumes. Capacity Analysis-The 2016 capacity analysis was completed using the volumes shown in the flow diagrams from figure L Levels of service run from"A"to"F"with "A"being the best with little or no control delay and"F"being the worst with long delays. The 2016 p.m. peak hoar projected background capacity analysis shows level ofservice"A"on Clark Street and level of service"B"on Margaret Drive (see Attachment A-2). Similarly, the 2016 p.m:. peak hour combined capacity analysis shows level of service"A"on Clark Street and level of service"B"on Margaret Drive and on the site drive (see Attachment A-3). The northerly site drive intersection with Clark Street will operate as good or better than the Clark Street/Margaret Drive intersection as analyzed above. Conclusion - Twenty six new homes are proposed at 100 Clark Street in South. Windsor. Background volumes on area roadways are moderate. Intersection sight distances available at the exit drives are good for 85"'percentile speeds and for the posted speed limit allowing exiting vehicles to see and be seen by oncoming traffic. The proposed use is a small traffic generator that can easily be accommodated by area roadways. Levels of service on area roadways will remain at "B" or better after the proposed development is fully occupied. There will be no significant impact on area roadways due to the proposed development. The permit is valid for five years and shall expire on June 1, 2021. It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration. 4. Bonds shall be collected in the amount of$10,000 to ensure proper placement and maintenance of erosion and sediment controls and $10,000 for establishment of the stormwater systems. 5. All approvals required must be obtained and submitted prior to any activity on the site. 6. A contact person shall be identified on the plans. Very truly yours, INLAND WETLANDS AGENCY/CONSERVATION COMMISSION Elizabeth A. Warren, Chairperson cc: Director of Planning ./ Chief Building Official MEMORANDUM To: Michele Lipe, Town Planner From: Jeffrey Doolittle, Town Engineer Date: 6/8/16 RE: Application 16-28P—Clark Estates 2, 100 Clark St Engineering has reviewed the site plan received for the above application and has the following comments: 1. Because this road design does not meet the Town standards for geometry, we understand the proposed road will be a private road, owned by an association and not maintained by the Town. In addition the sanitary sewers and storm drainage system in this development will be owned by an association and will not be maintained by the Town. There will need to be a bylaws and a maintenance plan in place for a homeowners association to maintain the road, storm drains, detention basin and sanitary sewer. I am not sure who will maintain the other utilities, water, gas, electric, phone and cable. 2. An assessment for connection of the sanitary sewers from this parcel to the Existing Town of South Windsor sewers in Clark Street may be charged. 3. The drainage report needs to include gutter flow analysis and a Hydraulic Grade Line Analysis to determine if water flows past CB's 10 and 11 into Clark Street. 4. Add another set of basins in the road by sta 1+0 to be sure there is no runoff from this road going into Clark Street across from Margaret Drive, unless the above analysis shows the proposed basins by sta 0+10 will catch all runoff. 5. All the pipes between and from YD should be at least 12" diameter for ease of future maintenance. 6. Part of the detention basin is a filled berm above the existing ground surface. Include a detail describing the material and construction method for the berm. 7. More detail is needed for the detention basin rip rap emergency spillway, which as shown appears to flow across the access drive and sidewalk and into Clark Street. Show this spillway on the plan and include a detail for its construction. 8. The topsoil stockpiles are located in fill areas. Will they need to be moved to place the fill? 9. show the proposed gas main connecting to the existing gas main across Clark Street. 10.There appears to be 4 patches needed in Clark Street for drainage, sewer, water and gas. 11.The sanitary sewer flow line elevations need to be shown at the buildings. Also show the slopes of the sanitary laterals. 1 12.A note leaves the specification of the road fill to the Town. The note should be revised to specify granular fill that meets the specification of Conn DOT Form 816 M.2.06, Grading B and be installed and compacted in lifts in accordance with the ConnDOT specifications. Reclaimed aggregate is not acceptable for fill for a residential street and lots. 13.The proposed grading plan needs to be reviewed to make sure the slopes are less than 4H:1V so the lawns are mowable and there should be more spot elevations near units to insure the water drains away from all units and does not pond near them. For example units 1, 2, 3, 4, 5, 6 and 20 all have potential flat spots near the buildings where puddles may form. 14.Suggest a vertical curve be used at Sta 1+0 where the proposed road slope transitions from 5.5% to 2.5%. 15. Eliminate the inside drop in the sanitary sewers at San MH #2. 16. Move the sanitary sewer lateral for unit 16 from where it is shown, heading north, to connect to the existing sewer lateral stub in Clark Street to the west. This is a shorter run and the lateral does not go between two other units. 17.A clean-out is needed at any bends in the sanitary sewer laterals to buildings. Most of the bends should be eliminated. 18. How will the sanitary sewer lateral from Unit 21 be installed so close to CB#7, and the sewer lateral from Unit 5 be installed so close to CB#4? 19.The Plan sheet G-1 should include the invert elevations of the inlet and outlet pipes and structures in the detention basin and the invert of the pipe connection to the existing manhole in Clark Street. 20.Verify that the storm drainage outlet connection in Clark Street is to a bypass manhole and not a stormwater treatment structure. 21.To help the PZC and public understand the proposed grading, include a plan showing areas of cuts and fills shaded different colors on the entire site. Cuts could be shaded one color and fills a different color. The greater cuts and fills should be shaded darker colors and the less cuts and fills shaded lighter colors. 2. An assessment for connection of the sanitary sewers from this parcel to the Existing Town of South Windsor sewers in Clark Street may be charged. 3. Part of the detention basin is formed by a filled berm above the existing ground surface. Include a detail showing the material and construction method for this berm. There needs to be a core of silt, clay or other impervious material in the north side of this berm. 4. Use the Town of South Windsor detail for a Rip Rap Ditch for the detention basin rip rap emergency spillway. Extend this rip rap emergency spillway all the way down the slope to the edge of the wetlands. 5. Note 33 on Sheet N-1 needs to state that any fill placed below the road gravel sub-base is to be granular fill that is approved by a geotechnical engineer and is installed and compacted in lifts in accordance with the ConnDOT specifications. 6. The proposed grading plan needs to be reviewed to make sure the slopes are less than 4H:1V so the lawns are mowable and there should be more spot elevations near units to insure the water drains away from all units and does not pond near them. For example units 1, 2, 3, 4, 5, 6 and 20 all have potential flat spots near the buildings where puddles may form. 7. The inside drop in Sanitary MH #2 needs to be eliminated or justified. 8. Verify that the storm drainage outlet connection in Clark Street is to a bypass manhole and not a stormwater treatment structure. 9. Include a note on the detail for the sidewalks that they be constructed in accordance with Town of South Windsor Standards, using Class F (4000 psi) concrete and Brick Red color detectable warning strips by Alert Cast or ADA or approved equal. Please contact me if you have any questions. 1 CLARK ESTATES II SPECIAL EXCEPTION/SITE PLAN PH 6/14/16 Planning Department Report 1. Request for approval of a special exception to section 3.3 and site plan of development for a 22 unit development to be known as `Clark Estates II', on property located on 8.8 ac, easterly side of Clark Street, north of the Manchester Town Line, Designed Residence zone. The zone change/general plan of development was approved by this Commission in April 2016. The site plan has been developed in general conformance with the approved general plan. 2. Special exception review criteria include: • The proposal is consistent with the goals and objectives of the Plan of Conservation and Development. • The application has met the requirements of the zoning regulations. • The land is physically suited to the proposed use. • Minimal, if any, adverse environmental impacts are created. • No traffic or other hazards will be created. • The impacts on the capacity of the present and proposed utilities, street, drainage systems, sidewalks, and other elements of the infrastructure will be minimal. • There will be minimal or no adverse effects on existing uses in the area. • Surrounding property values will be conserved. • The character of the neighborhood will be maintained or minimally disrupted. • The general welfare of the community will be served. • There is a balance between neighborhood acceptance and community needs. • Historic factors are adequately protected; or due consideration to preservation of historic factors has been demonstrated. • The overall physical appearance of the proposed development is compatible with surrounding development and the Commission's goals for the neighborhood/corridor. 9. The landscaping plan includes a berm between Clark Street and the new houses, with screening plantings along the top of the berm, including some larger trees at planting and street trees shown along the Clark Street frontage. 10.All unit types will be twp and three bedroom units. The applicant is requesting a waiver to Section 3.3.4 Dwelling sizes and types to be allowed to increase the size of some of the units to 1,600 sf. ( 1,vu w +nj 11.The Architectural and Design Review Board has reviewed this applicant's proposed elevations on June 2 and were pleased with the designs as submitted. They did suggest that the developer encourage variety of house styles and colors so that no two identical houses would be built next to each other. If approved, the Planning Department requests that the hearing stay open so that the final details of the Affordability Plan be submitted and reviewed by the Town's Attorney. qOW N Sf4 To O-P Saum ?d&zd4at a 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CT 06074 OR-CO TELEPHONE (860) 644-2511 CERTIFIED MAIL 7011 1570 0000 6337 2065 June 16, 2016 Robert Mannarino Mannarino Builders Inc. 400 Chapel Road, Unit 3-F South Windsor, CT 06074 Dear Mr. Mannarino: Re: Appl. 16-28P, Mannarino Builders Inc. All topsoil stockpile areas to be protected(ringed with haybales or equal). 3. During construction a crushed stone tracking pad may need to be installed and maintained to minimize tracking of dirt/gravel on to Clark Street. Calcium chloride or water is to be used for dust control as required. There will be two (2)tracking pads off Clark Street. 4. Install and stabilize the detention basin and swale on site first. Public Works 1. Three complete sets of approved/revised plans to be provided to Town prior to start of construction. They will be stamped by the Planning Department along with plans developer needs. Only approved plans are to be used on the job site. 2. The Engineering Department is to be notified forty-eight (48) hours prior to the start of major construction work in (Road Name) with inspections and testing per Developers Checklist for the following: a. After site is staked out b. All drainage work c. Preparation of subgrade, compaction tests as per Developer's checklist d. Placement of bituminous concrete, two (2) inch layers maximum 3. A street cut permit is required for each end of the new private road off Clark Street. 4. A street cut permit is also needed for each utility connection in Clark Street. 5. Certification of gravel used as subbase and processed stone for base will be required from an approved testing company 6. Certification of all products used -- storm pipe, structures, pavement,oil/grit separator and sewer grinder pump system shall be presented to the Town Engineer prior to installation. 7. The contractor should be aware that the inspection of the infrastructure improvements may result in the replacement of structure tops and/or structures prior to final paving if found to be deficient. 8. No subgrade formation/base in frozen ground/snow. Same for pipe/structure installation. 9. Progress As Built Plans are to be submitted to the Town Engineer for approval prior to paving and after subgrade formation. Show elevations and location of all storm drainage and sanitary sewer. 10. An as built plan will be required for the improvements to Chaponis Way. A separate as built plan will be required for each house. 11. As built plans are to include horizontal and vertical location of all underdrains, footing drains, and sanitary sewers and house service laterals located as per revised as-built checklist. 12. All pipe and structures to be backfilled with free draining material compacted in maximum one foot lifts with approved compaction equipment or approved equal if deep trench is encountered. Any pipe or structure work requires inspection prior to backfilling. 13. Any problems and/or questions regarding construction of this project will be directed to Jim Martucci in the field at cell phone 860-573-7176 or Keith Rector at 860-573-7984. 14. Any proposed changes are to be presented to the Engineering or Planning Department prior to implementation on change order form in quadruplicate with 4 copies of the drawing. Town will attempt to turn around within 24 hours. 18.Normal hours of operation 7:00 a.m. —5:00 p.m., no work on Sunday. 19. A plot plan will be submitted with all building permit requests for each house. 20. A drain layers permit is needed for installation of the sewer main and connection to the existing sewer main in Clark Street. 21. A drain layers permit is needed for the sewer lateral connection to each house and the current sewer connection, and user fees are due with the permit application for each house. 22.No paving after October 15 or before April 15 without written approval from Director of Public Works. 23. Extra care must be taken when compacting around structures such as catch basins and manholes. These spots often become problem areas in the future due to settling, therefore, the town staff/inspectors will be requesting additional compaction tests in these areas 24. Inspection of gravel access road required prior to placement of topsoil. 25. Sanitary lateral locations should be tied down to existing structures and shown on the progress as built. 26. For concrete sidewalks, 8" depth with reinforcements is required at driveway crossing. If the sidewalk is constructed before lot development, the locations must be indicated on the as-built plans. The Engineering Department suggests that the contractor also show locations of foundation drains and water laterals on this form. 28. During construction for individual house lots, lot to lot drainage must be addressed with drainage swales as necessary. For lawn establishment, town staff will be requiring erosion control measures to be installed prior to the issue of the certificate of occupancy to ensure soil stabilization. A detailed erosion control plan must be implemented and depicted on the plot plan for review prior to the issuance of the building permit — most particularly on lots with extensive grading. 29. Any unfinished site work will be bonded prior to Engineering and Planning Department sign-offs for a Certificate of Occupancy. Planning Department 1. Landscaping is to be installed in accordance with the approved landscaping plan. If there are changes required, contact the Planning Department. Tha x You, Rokfert` a arino Mannarino uilders,Inc. ?fir - _ HOUSING AFFORDABILITY PLAN INTRODUCTION Mannarino Builders, Inc., a Connecticut corporation with offices in South Windsor, Connecticut (the "Developer") submits this"Affordability Plan" to the Town of South Windsor Planning Department in conjunction with its development of 22 units of single family residential housing to be constructed within the common interest community fon nat as a planned community to be known as "Clark Estates II a Planned Community" (the "Planned Community"). The Planned Community is currently in the course of site construction and the Developer intends to commence the marketing and construction of the residential family units in the near future. The Planned Community is located on the easterly side of Clark Street, in the Town of South Windsor,on 8.75 acres of land(the"Property"). Under this Affordability Plan, 5 of the 22 single family residential housing units within the Planned Community will be designated as "Housing Opportunity Units," meaning that all such units will be affordable to individuals or families earning eighty percent(80%)or less of the median income for the Town of South Windsor or eighty percent (80%) of the median income for the Greater Hartford Area, whichever is less (referred sometimes hereinafter as "Affordable Housing Opportunity Applicant" or "Affordable Housing Opportunity Applicants"). The Housing Opportunity Units will be maintained as such For no less than 40 years (the "Affordability Period"). Because the information regarding median incomes for the foregoing respective determination areas are updated periodically, the actual maximum purchase price will be calculated at the time of purchase. This Affordability Plan describes how the affordable housing component of this Planned Community will be administered. I. Units Designated For Housing Opportunity within the Planned Community. As stated previously herein the Developer will be designating 5 of the 22 residential housing units within the Planned Community as Housing Opportunity Units in accordance with the Affordability Plan. A qualified Affordable Housing Opportunity Applicant will have the option of selecting the residential structure style from the Developer's offering of housing structure styles. The 5 Housing Opportunity Units will be located throughout the Planned Community so as to be indistinguishable when viewed from the exterior from the other housing units in the Planned Community. Each Housing Opportunity Unit shall only be used by the Affordable Housing Opportunity Applicants as their primary residence and only as a single- family residence. At the time of the sale of the Housing Opportunity Unit from the Developer to the Affordable Housing Opportunity Applicant, the deed of conveyance of title will be subject to the affordability provisions of the Affordability Plan for the entire duration of the Affordability Period, all of which shall be contained in a restrictive covenant within the body of the deed of conveyance of title. During the Affordability Period a Housing Affordability Unit may only be sold at a price that, and to a new owner who, qualify for such housing under the provisions of the Page I of 18 affordability Plan. In reference to the foregoing the Town shall have the right to withhold certificates of occupancy unless issued certificates of occupancy meet affordability ratio approved by the Planning and Zoning Commission Il. Forty(40)Year Period. As stated previously, the Housing Opportunity Units shall be designated as affordable housing units for no less than forty(40) years. The forty(40) year Affordability Period shall be calculated separately for each Housing Opportunity Unit, and the housing affordability period shall commence on the date of closing of title to the Housing Opportunity Unit. M. Nature of Construction of Housing Opportunity Units and Market-Rate Units. Within this Planned Community, Housing Opportunity Units shall be constructed in accordance with the final plans approved by the Town of South Windsor Planning Department. Housing Opportunity Units shall be comparable in size to market rate units of the same standard style offered to all other housing units of that style in the Planned Community. As stated previously the Affordable Housing Opportunity Applicant of a Housing Opportunity Unit will have the option of selecting any of the home styles being offered to all purchasers of units in the Planned Community which will be the same standard amenity/features, exclusive of size and style, provided to all purchasers. IV. Entity Responsibig for Administration and Compliance. This Affordability Plan will be administered by Developer or its successors and assigns ("Administrator"). The Administrator shall submit a written status report to the Town Zoning Commission on compliance with this Affordability Plan annually, every 12 months following the commencement of marketing and construction of the housing units within the Planned Community until the time that the Developer has completed the selling and constructing all housing units and has completed all other aspects of the Planned Community. The role of Administrator may be transferred or assigned to another entity, provided that such entity has the experience and qualifications to administer this Plan. Developer or its successors will provide written notice to the Town Zoning Commission no less than 30 days before any assignment of the role of Administrator. V. Affirmative Fair Housing Marketing Plan Pursuant to the provisions of Connecticut Fair Housing Act, C.G.S. § 46a-64c, the marketing and sale of Housing Opportunity Units shall be on an equal opportunity basis, and shall not discriminate against any Affordable Housing Opportunity Applicant based on race, creed, color, national origin, ancestry, sex, gender identity or expression, marital status, age, lawful source of income, familial status, learning disability or physical or mental disability. All notices shall comply with the provision of the Connecticut Fair Housing Act C.G.S. § 46a- 64c with respect to the sale of any Housing Opportunity Unit. Page 2 of IS Where appropriate, the Developer shall be responsible for advertising the availability of the Housing Opportunity Units via The Hartford Courant and the Journal Inquirer in the manner consistent with the intended purpose of the before stated statutory provisions as applicable to the Planned Community. Depending on the success of the before stated program in attracting qualified buyers for the Housing Opportunity Units, the Developer may further advertise the availability of those units, as it deems appropriate to accomplish the goals of the Affordability Plan. VI. Purchase Eligibility. Eligibility of families or households to purchase a Housing Opportunity Unit in the Planned Community shall be determined by the Administrator in accordance with the Affordability Plan including Schedule A and Exhibits 1,2, 3 and 4 thereto. V1I. Application Process. A purchaser ("Applicant") seeking to purchase one of the Housing Opportunity Units must complete the application form on Schedule A and Exhibits 1, 2, 3 and 4 thereto, to determine eligibility. The application form and process shall comply with the Fair Housing Acts. A. Application Form. The application form shall be provided by the Administrator and shall include an income certification form. In general, income for purposes of determining an Applicant's qualification shall include the Applicant family's total anticipated income from all sources for the twelve (12) month period following the date the application is submitted (`Application Date'). In determining what is and is not to be included in the definition of family annual income the Administrator shall use the criteria set forth by HUD and listed on Exhibit 2 to Schedule A, attached. B. Applicant Interview. The Administrator shall interview an Applicant upon submission of the completed application. Specifically, the Administrator shall, during the interview, undertake the following: 1. Review with the Applicant all the information provided on the application. 2. Explain to the Applicant the requirements for eligibility, verification procedures, and the penalties for supplying false information. 3. Make clear that the term "family" includes all individuals who are to occupy the home, and that no relationship by blood or marriage is required. Page 3 of 18 4. Request the Applicant to sign the necessary release forms to be used in verifying income. Inform the Applicant of what verification and documentation must be provided before the application is deemed complete. 5. Inform the Applicant that a decision as to eligibility cannot be made until all items on the application have been verified. 6. Review with the Applicant the process and restrictions regarding resale. C. Verification of Applicant's Income. Determine median income for the Town of South Windsor area and the statewide median as published by the U.S. Department of Housing and Urban Development for the subject municipality, and use the lesser of these figures. (2) Step 2. Adjust median income identified in Step I by family size by assuming that 1.5 persons will occupy each bedroom of an affordable unit. Family size adjustment shall be made with reference to the following percentages: NUMBER OF 1 2 3 4 5 6 7 8 PERSONSIN FAMILY PERCENTAGE 70% 80% 90% 100% 108% 116% 1240/a 1324 ADJUSTMENT (BASE) The family size adjustment that involves a half person (such as 4.5 persons) shall be calculated by taking the midpoint between the relevant figures above and below the half. For example, the adjustment for a 4.5 person household is 104 percent. (3) Step 3. Calculate eighty percent(801/1o) of Step 2. (4) Step 4. Calculate thirty percent (30%) of Step 3, representing that portion of household income deemed to be used for housing costs. Page 8 of 18 (5) Step 5. Divide step 4 by twelve(12)months to determine the maximum monthly housing payment. (6) Step 6. Determine by reasonable estimate monthly housing expenses, including real property taxes; real property insurance; any common interest ownership or similar fee required of all unit purchasers or owners; and heat and utility costs, excluding television, telecommunications, and information technology services. (7) Step 7. Subtract Step 6 from Step 5 to determine the amount available for mortgage principal and interest. (8) Step 8. Using the amount resulting from Step 7, apply a mortgage term and interest rate that is commercially reasonable and available to households likely to apply to purchase such units,in order to determine the financcable amount. (9) Step 9. Calculate down payment, which shall be the lesser of 20%of the total sales price or 20%of CHFA's maximum sales price limit for a comparably-sized unit in the area. 10) Step 10. Add Steps 8 and 9 to determine the maximum sale or resale price. Page 9 of 18 EXHIBIT 2 DEFINITIONS AND ELEMENTS OF ANNUAL FAMILY INCOME l.
