Please be aware that the Town of South Windsor Zoning regulations restrict the location of such structures. The regulations, in Table 3.I,2A, Residential Area, Density and Dimensional Requirements, states that no buildings can be erected except in conformance with the above referenced table. If your shed is larger than two hundred square feet, you will need to file a building permit as well as obtain zoning approval for the location of the shed. If the shed is two hundred square feet or smaller, you will need only a zoning permit. Either permit will require the shed to be located in accordance with the setbacks noted in Table 3.1.2A. As you are a corner lot, the property along Oakland Road and Slater Road are considered front yards. I have enclosed the pertinent section of the regulations for your reference as well as an application form for small structures. Please file the appropriate permit application, demonstrating compliance with the zoning setbacks by August 22, 2016 to avoid enforcement action from this office. If you have any questions, call meat (860) 644-2511, extension 251. Thank you for your attention to this request. Sincerely, . t? o Pamela A. In response to that letter, you came in and explained that the shed had been there for many years, and you had refurbished it recently. Because the shed had not been identified as unpermitted for at least 3 years, the structure became a legal, non-conforming structure. As such, the regulations in Section 2. 14 Non-Conforming Buildings and Uses allow for the reconstruction or repair of a non-conforming structure to address damage or wear and tear, but not for any enlargement of the building without first obtaining a permit. A complaint was filed on September 14, 2016 which states that your current shed is larger than the original structure. Based on the aerial photographs from 2009, it appears that the original shed was approximately 8 feet by 10 feet. Please submit documentation that the current shed is not any larger than the previous structure. I have enclosed the pertinent section of the regulations for your reference. Please submit documentation regarding the size of the original and current shed by September 30, 2016. If you have any questions, call me at (860) 644-2511, extension 251 . Thank you for your attention to this request. Sincerely, Pamela A. Oliva, CZEO Zoning Enforcement Officer cc: Director of Planning
