Hardships, unique factors associated with this property, and other circumstances pertinent to • this application are: 1) On May 51h 2014 the Zoning Board of Appeals granted a request for a 33 feet variance to Table 4.1.6A to allow a 10,410 square feet addition to a non-conforming structure 17 feet from the northerly side of Sullivan Avenue(50 feet required)on the subject property. This variance approval was recorded in the Town Clerk's office on June 191,2014(Volume 2413 /Page 0299).-We are requesting the same variance, however,to accommodate a smaller addition; 2) In 2014,the board concluded the hardship to be: "the takings of the property by the Town and the State"; 3) We are presuming that the front yard setback of 50 feet should be applied from the state taking line (perpetual easement)rather than from the front property line which is well into the pavement of Sullivan Avenue; 4) The state taking was to accommodate a widening of Sullivan Avenue; 5) The existing building on the subject property is presently nonconforming to the front yard setback, whether it is measured from the taking line or from the property line in Sullivan Avenue; 6) The proposed addition is 19.1 feet from the taking line and 36.6 feet from the street line. If the Planning and Zoning Commission had retained the original Industrial Zone setback of 35 feet, this variance would not be required; 7) In recent history, the Planning and Zoning Commission amended its zoning regulations to require a 50 feet setback in the Industrial Zone along Sullivan Avenue. This setback, if applied from the current property line, encroaches on the existing building and the proposed building addition. This • C:\Users\rmoser.DESIGN\AppData\Local\Microsoft\Windows\Temporary Internet Files\Content.Outlook\GVRNKX7T\3626 ZBA Narrative • • Statement.docx setback, if applied from the current taking line, encroaches on the existing building and the proposed building addition by an even wider margin. This is for which we are requesting relief; 8) The proposed addition is an extension of the current building fagade; 9) The proposed addition's exterior elevation will be designed to complement the existing attractive building fagade; 10) The proposed addition is smaller than that which was previously approved by the Board, because of the need to provide required parking, in the form of a new parking lot to the west of the proposed addition; 11) The proposed addition is located as depicted on the plan in order to accommodate commercial vehicle circulation on the subject property; • 12) For your edification the applicant is proposing to relocate its manufacturing enterprise from another community in order to accommodate its projected growth. The number of employees is presently 18,and is expected to rise to as many as 31 in the next 2 years; • 13) The applicant has engaged the services of a professional architect(Capital Studio Architects),and a local engineering firm(Design Professionals,Inc.)to advise them on the building addition and the • site layout; 14) The proposed addition is designed to maximize internal and external operations at the facility; 15) The subject property does not presently have any handicapped parking spaces. We are proposing two handicapped spaces at the main entrance along Commerce Way, for a net loss of two existing parking spaces, and one handicapped space to the rear, in the vicinity of the new addition; 16) Under zoning required parking spaces are 57 and the ZBA plan depicts 61. Most of the additional parking is proposed between the addition and US Route 5. It was the only location for parking to meet this requirement; 17) The applicant is proposing a sign easement at the corner of Route 5 and Sullivan Avenue in favor of the Town of South Windsor. The size of this easement has been appreciably expanded from that which was presented to the Zoning Board in 2014 by the prior applicant; 18) There is a 50 feet landscaped buffer proposed between the residential zone to the west and north of the subject parking lot. In conclusion this application is very similar to that which was approved for the subject property by the Zoning Board of Appeals in 2014. The primary difference is the size of the proposed addition, and that the new applicant recognizes a need to provide additional parking to meet the zoning requirements.Thank you for your consideration of this application. • C:\Users\rmoser.DESIGN\AppData\Local\Microsoft\Windows\Temporary Internet Files\Conte nt.Outlook\GVRNKX7T\3626 ZBA Narrative Sta A=ansls .t C t' a U fr Town apslo 1540 SULLIVAN AVENUE*SOUTH WINDSOR, CT 06074 TELEPHONE(860)644-2511 June 13,2014 CERTIFIED#70111570 0000 6336 2981 M&Frank Borawski,PE LS PDS Engineering&Construction 107 Old Windsor Road Bloomfield,CT 06002 RE: Appl.2774-14,All-Phase- 15 Commerce Way&48 Sullivan Avenue Dear Mx.Borawski: At the meeting of the South Windsor Zoning Board of Appeals held on June 5, 2014,the Board approved your request for a 33 foot variance to Table 4.1.6A to allow a 10,410 square foot addition to a non-conforming structure 17 feet from the north side of Sullivan Avenue and east side of John Fitch Boulevard (50 feet required) on properties located at 15 Commerce Way and 48 Sullivan Avenue, I (Industrial) zone.
