Lipe,AICP Assistant Director of Planning Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 RE: Pleasant Meadow Estates/SDR Landscaping Garden Circle, South Windsor, CT Dear Michele; As per our meeting and discussions of Sept 7, 2007 the following items have been addressed and completed on the site at Pleasant Meadow Estates. 1. The missing plants on the west side of unit#18 (also known as unit#306)have been installed along with a mulch bed. (See enclosed photo#1) 2. The area that was disturbed on the Burr Meadow property was addressed by the original developer of Units#1-#12. I obtain a copy of the agreement from the attorney. The agreement states after the initial fill in by the developer,Burr Meadow's obligation was to maintain the walkway in perpetuity at their expense after that period. It does not appear that anything has been done to this walkway in years. However, for the sake of showing good faith, we installed several inches of stone dust that was then compacted in the area you required and we extended that area farther to repair the deep rut damage caused from someone riding a dirt bike through the path. Several inches of topsoil on each side of the walkway was installed and graded to meet the existing lawn area. Grass seed was installed, tamped, and hydrated. The enclosed pictures numbered(#2) &(#3) show the repaired area.Picture(#4) shows the condition of the path outside our area of repair. This is included just to demonstrate that Burr Meadow has done nothing to maintain the rest of the path. Also visible in photo's numbered(#2) & (0) are plantings that had already been installed as required on the border of the two properties as per the Landscaping plan. 3. The additional mulch to be placed around the groupings of shrubs behind building (#3)has been completed. See photo's (#5)& (#6).I am however also enclosing a copy of the minutes from the Association's July and August 2007 meetings. "Our integrity is the only thing we take from this world." Upon that cornerstone we seek to establish our relationship with you. As I have previously stated the minutes (see Exhibit#1-July 20tb)clearly indicate that the Association and the Property Manager, Steve Cabanis were aware that South Windsor Estates had completed the proper landscaping but wanted them to foot the bill for items not originally required by the Town. See July minutes highlighted paragraph begins with"Landscaping". 4. Photo's (#7) &(#8)-(#8A) show the grading and seeding of the area around the gas boxes located behind unit#12 building two and unit#15-#16 building number three. This is the second time these areas were done.(The association's lawn crew damaged these areas because of the way they drive over the areas when mowing). 5. Photo's (0)& (#10)-(#l0A) show repairs and re-stoning of the two corners of the Detention basin. One is adjacent to building(#2),the other is adjacent to building(0). 6. Unit#302 does not have a stone bed in front of it and has never gotten water in the basement as per the unit owner. The stone bed was constructed between units#303 İ. This was as requested by the town and per the plan. It was completed prior to the first CO being issued and a extension drain was placed in the center to insure all water run off would flow away from the building and down to the drain located on the opposite side of the parking lot. This worked very well until the association's snow-plow contractor shoved all the snow into this corner and torn out the extension drain. Photo's number(#11412413)show the stone bed between the units in question. This has been repaired and the drain extended(again). Upon the installation of this drain I spoke with the owners of both unit#303/#304.Both unit owners verified that they have never had water in their basements. The owner of unit#303 said the water back up into the corner when the torrential rain fell in May. He admitted he never called me and I showed him where someone had removed the extension drain that had been installed there last December 2006. He said he felt the gutter should be tied to the drain in front of his driveway.I advised him that is not how the professional gutter installers determined the best flow for the water, and that in the winter time the water could freeze in front of his driveway and if the drain was left in place correctly there would be no issues. I also asked the owner of unit#303 if he remembered my crew removing all the packed ice and snow last winter from this corner and from his front step.He stated he did know that we had tried to keep everything clear and that the snow plow company had not done the correct job. Additionally last week after the day of rain,I inquired of the owners of these two units if there had been any water problems.Nicky Smith the owner of unit#304 told me she paid very close attention to this area and all the water flowed directly to the storm drain and not one drop of water entered the corner or her unit. 7. Drainage causing water into the unit#102. Photo (#14) shows the way the downspouts and splash blocks were installed by South Windsor Estates August 2006. Exhibit(0)dated August 22,2006 is letter to all unit owners of buildings one and two informing them of the grading, stoning, down spouts, splash blocks, and planting issues that would be addressed in the next couple weeks. All this work was completed and inspected. This can be evidenced in Exhibit(#4) a letter requesting a reductions of the site bond for completion of the work required by the Town of South Windsor. Photo (#15) shows the downspout and splash block is now missing from this unit, and someone else has now placed a long black drain there .There are three other places on building one and two where someone has removed the extension of the downspouts placed there by South Windsor Estates last August 2006. Someone in the complex continues to push the splash block up against the foundation instead of leaving them overhang at the end of the down spouts and extending into the stone area where they are intended to drain the water away from the building. We do not feel we should be held responsible for the acts of the unit owners after the job has been completed to Town specification. 8. Photo's number(#16 through#22) show damage being done by the Association lawn maintenance crew to all the plantings that were installed by South Windsor Estates. I am including these so if these plantings do not thrive,we are not held responsible for the negligence of the association's contractors. 9. Also included are copies of e-mails between myself, the president of the association, and Steve Cabanis the property manager. Snow plowing issues, issues regarding the proper areas that need snow removal and lighting issues all brought to their attention during the past year of 2006. Please read the association minutes from July and August of 2007. You will see that areas of blacktop that were completed last May 2006 by South Windsor Estates have been re- paved by someone hired by the association just last week.I was at the site today and verified that this paving has been done. I do not know if the Town needs to check the paving job that was just completed on building two.We certainly do want to be held responsible for any water issues etc.,that may occur and were caused by someone paving over what was completed by South Windsor Estates LLC and approved by the Town last year. 10. On September 7t1'and 8`i'2007,I spoke to each owner of units 301 through units 305. There are no punch lists of items from any owner and each owner has indicated they are very happy with their unit, the workmanship of the unit, and my response to any questions or concerns they have had during the time I have been associated with the site.If the Town needs confirmation of this each owner said the Town might call them if they wish too. We believe we have successfully met all the obligations of the site requirements as per the plan as well as all additional request of the Town.To our knowledge the site has been inspected. Therefore we respectfully request the Bond in the amount of Thirty-Six Thousand One-Hundred ($36,100.00)and no/100t''Dollars be released. Please be advised. Staving August 23,2006 my Landscaping crew and my _ construction supervisor will be doing rc-grading,installing stone, grading back lawn areas in both front and back and pouring sidewalk areas as per site plan requirements. Unfortunately in our initial walk over of the building site we have discovered that there are plants, personal items, and patio blocks located in the common areas that are not permitted per my site plan requirements from the Town.of South Windsor. These items will need to be removed immediately.Mulch presently located on the site may-have to be removed in order to accommodate the grading process and level lawn areas: Y would suggest any plants you wish to keep should be placed in pots and placed on the decks or patios. The re-grading will involve work under some of the present decks, and any items under these decks will be removed and disposed of by the landscaping crew.Additionally some air conditioning units may have to be disconnected. s p are trying to avoid this taking place however if your unit becomes involved in this process we anticipate no more than two days of shut off time and will give you as much advanced notice as possible. I am sorry for any inconvenience this creates, but it is necessary to comply with the required site plan. Most important to me are the issues(1) concerning the egress stairs from the rear of each of the six ranch units and as well as their refusal to clear them(2)their refusal to repair the lights that are immediately at the curve to the entry of our portion of the parking lot. Is Steve Cabannis correct in his statement regarding the condo documents and snow removal? Since the Town of South Windsor required the lights are they not obligated to keep them in proper working order? If it is true that these elderly people need to clear their own staircase to have a safe exit in case of fire etc.,I need to make sure this is disclosed to them. I have never heard of this as a requirement, nor have I ever seen where a path from the rear of the buildings is not open for the same reason. This issue is very critical to the potential Buyer we have for unit#304. He is in a wheel chair and his wife works to support them. She is up there in age also. I want to be very honest with any Buyer and this requirement is news to me. The snow removal is a real issue here and Steve has once again passed it off the improper snow removal in the parking lot on our contractors. This is not true. He is also advising the Assocaition without having them obtain proper legal advise. I am therefore asking you to clarify both these issues for South Windsor Estates,LLC. "Our integrity is the only thing we take from this world." Upon that cornerstone we seek to establish our relationship with you. 7 I do not want to be held liable for these items and if the Town Planner and or inspectors have any issues I need to be very clear on both of these items. We cleared the front areas this past weekend and I have instructed my painter and one other contractor to clear the rear staircases and landings today to avoid any immediate problems. I will be away from February 22 through March 2, 2007. Could you please forward your response in writing to me. I do not want there to be even the appearance of negligence on my part for not attending to these issues. I would like to have something in my file should any questions arise during the forth coming CO inspections. When he approached one o; them to ask them to move their vehicles, they just walked away with no response. Pete thinks that they did not understand or speak English. Steve, thank you for your e-mail.As I addressed in my other e-mail.The clearing of the snow was done on Sunday when no one came to fix the situation. This was done to accommodate an individual in a wheel chair. The snow plow person has plowed the snow up against the building between unit#303İ.This blocked the front access sidewalk to both units, does not allow the special drain the town required us to put there to drain the water away, thus the driveway for unit#304 and the walk between the two units remains covered in ice. My crew removed as much snow&ice from there as possible. He has plowed the snow up against the model front entry and blocked that drain. Also the people in#303 could not access there front walk and we cleared that for them on Sunday. These issues had nothing to do with my contractors on site.Your snow plow crew has not done a proper job. I was on site all day Sat and Sun and no one came to fix these problems. As far as the cost to do this, please speak to Andy Martin, she is the one who pays the bills. I am here to oversee the site and the safety of the people who come here to view the site. If something is not done it is my responsibility to make sure it gets done. I will speak with gill Bresleu regarding the condo documents to make sure he has them in compliance with any town regulations regarding the clearing of egress stairs. I have reviewed Of Counsel the provisions of the Declaration dealing with maintenance, repair and replacement of the Oliver S.Chappell common elements and limited common elements. Robert F.Kahan (1922-1996) Your initial concern is whether snow removal from the stairs and stoops at the rear of the units is the responsibility of association or the Unit Owner. In Section 6.1,the Declaration provides that Unit Owners are only responsible for the maintenance of those portions of the limited common elements required by the Declaration to be maintained by the Unit Owners. According to Section 6.3 of the Declaration, the Unit Owners are 45 Hartford Turnpike responsible for snow removal from patios and balconies. Steps and stoops are listed P.O.Box K separately from patios and balconies in Article 5(c) of the Declaration, and the \,crnon.CT 06066-2181 Declaration does not provide for Unit Owners to be responsible for snow removal from Telephone steps and stoops. Consequently, such snow removal would most likely be the (860) 646-1974 responsibility of the association. Facsimile (860) 647-8302 Please note, however, that snow removal from stairways and stoops may not be a 205 Storrs Road service generally included in most snow plowing packages. Requiring that the Reservoir Commons association provide such a service for the benefit of Unit Owners may significantly Mansfield Center,CT 06250 increase the association's expenses. Telephone (860) 4.56-9494 Additionally, you inquired as to the maintenance of the lights at the entry to the Facsimile parking lot. These lights would fall under the definition of limited common elements in (860) 423-8410 Section 1.5 of the Declaration as they are for the benefit of all Unit Owners. Again, attorneys@kkc-law.com pursuant to Section 6.1 of the Declaration, maintenance of all of the common elements is the responsibility of the association. Accordingly, the association should be responsible w«,vad.-c-law.aam for any repair to such lights, unless, of course, they are able to convince the power company or town to make any repairs. Please forward a copy of this e-mail to the appropriate person in the engineering department. Regarding your comments about the planting that were left on the perimeter of the property. Many of these planting may have been the property of an individual unit owner but these were removed and discarded along the perimeter by the landscaper hired by the developer and therefore should be cleaned up by them. The Following non-landscaping items still need attention: I am copying this letter to members of the Pleasant Meadow Board of Directors. They may be aware of some punch list items not noted below. 1. Gutters and downspouts were never installed on the first building in the front of the center units. You will see similar gutters and downspouts that were installed in similar areas in building 2. 2. All three building should be powerwashed. the need to powerwash is due to the dust and dirt resulting from the construction activity for building 3. 3. There is paint remaining on several exterior windows of buildings 1 and 2. 4. The door frames and kick plates of the front and rear exterior doors were never painted. Can you advise us if the original building plan called for a maintenance free exterior, i.e.was this trim supposed to be wrapped? 5. At least 2 of the entry steps in building 3 have risers that exceed 9.5"and are therefore out of co e. There are a couple of areas of erosion around the detention basin that need repair. Can the town confirm that both detention basins have the proper sidewall slope(some areas seem extremely steep and dangerous)and that the elevation of the bottom of the basin meets the require ent of the plan. N. r 8 The gas curb boxes in the rear of unit 306 and 208 are above grade. Is the lawn elevation in these areas correct or do the curb boxes need to be lowered. 0 The grading behind unit 101 creates a situation where water does not flow away from the building resulting in basement water in this unit. (10 The stone bed in front of unit 302 was constructed in such a manner where water pools against fife foundation and allows water into the basement. ti/11. The Burr Meadow Condominium Association has advised me that South Windsor Estates was required to install some planting on their property and well as restore the walking path that was damaged when they did the utility tie-in. 12. There were a number of unit owners in buildings 1 and 2 that had interior punch list items that may or may not have been resolved. I hope the town would contact each of these residents to determine the status. It is my understanding that the developer has no assets remaining even when the final site and landscape bonds are released. . 13. The Association has not been made aware of outstanding punch list items for any of the units in building 3, other than those noted above. They may have communicated these items directly to the developer or to their attorney. Can the Town confirm with these unit owners that there issues have been resolved before releasing the bond? Please confirm receipt of this e-mail and let me know if there is any other information that you require. I am willing to meet with the engineering department if there are any additional questions. The missing plants on the west side of unit#18(also known as unit#306)have been installed along with a mulch bed. (See enclosed photo#1) 2. The area that was disturbed on the Burr Meadow property was addressed by the original developer of Units#1-#12.I obtain a copy of the agreement from the attorney. The enclosed pictures numbered(#2) &(#3)show the repaired area.Picture(#4) shows the condition of the path outside our area of repair. This is included just to demonstrate that Burr Meadow has done nothing to maintain the rest of the path. Also visible in photo's numbered (#2) & (#3) are plantings that had already been installed as required on the border of the two properties as per the Landscaping plan. 3. The additional mulch to be placed around the groupings of shrubs behind building (#3)has been completed. See photo's (#5) &(#6).I am however also enclosing a copy of the minutes from the Association's July and August 2007 meetings. "Our integrity is the only thing we take from this world." Upon that cornerstone we seek to establish our relationship with you. .,' Photo (#15)shows the downspout and splash block is now missing from this unit, and someone else has now placed a long black drain there. There are three other places on building one and two where someone has removed the extension of the downspouts placed there by South Windsor Estates last August 2006. Someone in the complex continues to push the splash block up against the foundation instead of leaving them overhang at the end of the down spouts and extending into the stone area where they are intended to drain the water away from the building. We do not feel we should be held responsible for the acts of the unit owners after the job has been completed to Town specification. .8. Photo's number(#16 through#22)show damage being done by the Association lawn maintenance crew to all the plantings that were installed by South Windsor Estates.I am including these so if these plantings do not thrive,we are not held responsible for the negligence of the association's contractors. 9. Also included are copies of e-mails between myself, the president of the association, and Steve Cabanis the property manager. Snow plowing issues, issues regarding the proper areas that need snow removal and lighting issues all brought to their attention during the past year of 2006. Please read the association minutes from July and August of 2007.You will see that areas of black top that were completed last May 2006 by South Windsor Estates have been re- paved by someone hired by the association just last week. I was at the site today and verified that this paving has been done. I do not know if the Town needs to check the paving job that was just completed on building two.We certainly do want to be held responsible for any water issues etc.,that may occur and were caused by someone paving over what was completed by South Windsor Estates LLC and approved by the Town last year. 10. On September 7"'and 8`I'2007, I spoke to each owner of units 301 through units 305.There are no punch lists of items from any owner and each owner has indicated they are very happy with their unit, the workmanship of the unit, and my response to any questions or concerns they have had during the time I have been associated with the site. If the Town needs confirmation of this each owner said the Town might call them if they wish too. We believe we have successfully met all the obligations of the site requirements as per the plan as well as all additional request of the Town.To our knowledge the site has been inspected. Therefore we respectfully request the Bond in the amount of Thirty-Six Thousand One-Hundred ($36,100.00)and no/100th Dollars be released. jinc reyrs, ricia S South Windsor Estates,LLC Enclosures CC/Attorney William Bresleau William Martin PIFASAN-T MEADO—W-ROARrn ter M TTFS The meeting was called to order at 2:10 PM by Louise Shaheen, via telephone: In attendance were Gilma_v Bouchard Frechette,Rich Wilson and Steve Cabaniss,Property Manager. I am telling you this information for your safety. If something happens to someone the board could be liable for neglience. I would speak with your attorney for your own protection. You also need to get the lights fix,the entry to the driveway and parking area are required to lit.My electrician replaced the lights in our sections in less than one week. I have reviewed Of Counsel the provisions of the Declaration dealing with maintenance, repair and replacement of the Oliver S.Chappell common elements and limited common elements. Robert E Kahan (1922-1996) Your initial concern is whether snow removal from the stairs and stoops at the `also admitted in MA rear of the units is the responsibility of association or the UnitOwner:In Section 6.1,the Declaration provides that Unit Owners are only responsible for the maintenance of those portions of the limited common elements required by the Declaration to be maintained by the Unit Owners. According to Section 6.3 of the Declaration, the Unit Owners are 45 Hartford Turnpike responsible for snow removal from patios and balconies. Steps and stoops are listed P.O.Box K separately from patios and balconies in Article 5(c) of the Declaration, and the Vernon,CT 06066-2181 Declaration does not provide for Unit Owners to be responsible for snow removal from Telephone steps and stoops. Telephone (860) 456-9494 Additionally, you inquired as to the maintenance of the lights at the entry to the Facsimile parking lot. These lights would fall under the definition of limited common elements in (860) 423-8410 Section 1.5 of the Declaration as they are for the benefit of all Unit Owners. Again, attorneysCilkkc-lawcom pursuant to Section 6.1 of the Declaration, maintenance of all of the common elements is v:v,%akkc-lawcoyn the responsibility of the association. Accordingly, the association should be responsible for any repair to such lights, unless, of course, they are able to convince the power company or town to make any repairs. 08✓31 '2007 FRI 14:48 FAX 860 644 7280 South Windsor Town Hall [a001/001 • • iI al Of Post=it°Fax Note 7671 Date ` pages Memo ' TO —TY! w From >C Co./Dept. The following is a partial list of items to be addressed: 1. Compaction test results have not been received for the base course of pavement. Pavement is not accepted until compaction test results are received 2. Grading around building is not acceptable—swale to be formed around building- may require slabs in rear to be replaced 3. Site remains to have turf established on disturbed area around first building. 4. Sanitary sewer is not approved a) Sanitary main connection to existing Burr Meadow SMH was not placed at correct elevation and brought in above brickshelf. Brickshelf to be knocked out and new invert formed as remediation. b) New sanitary sewer permit is required for above work. 5. Detention basin remains to be built a) Grading not completed b) Turf not established c) Retaining walls remain to be constructed. d) Detention basin outlet structure remains to be raised 1.29' per change order 10 and approved plans. e) Berm on north side of detention basin is to provide a minimum of 1' of freeboard above proposed outlet structure top of frame—to elev. 105.50'min or revised drainage calculations to be submitted. f) As-built of detention areas is required to show that basins are built to proper grades and capacities. 6. As-built required showing grading around first building and for entire detention basin areas to show that grading conforms to approved plans. This is a preliminary list of outstanding items that remain to be addressed from the Engineering department review. Additional items may be required to be addressed pending review of the as-builts when submitted and further site inspections. Two (2) temporary light poles need to be replaced with permanent light poles, one in front of unit #12 and one next to the detention basin. 2. A Guide rail (approx 25 feet long) needs to be installed at the end of the parking spaces in front of unit #13. 3. A split rail fence (approx 75 feet long) needs to be installed along the retaining wall above the detention basin near unit #13. 4. Line striping needs to be completed in the parking areas. 5. Handicap signs need to be installed by the handicap parking spaces. 6. Finish grading and seeding where disturbed. For example topsoil needs to be added around the rear of units 204, 205, 206 and 208, including under decks, to slope the ground away from the foundations. 7. Erosion near the north corner of unit #12 needs to be repaired, seeded and stabilized to prevent further erosion. 8. A stop sign and white painted stop bar need to be installed at the end of Garden Circle where it meets Pleasant Valley Road. 9. A Four foot high stockade fence needs to be installed along east side of parking area across from units #1-4 (approx 120 feet long). 10. The Town needs to receive a letter from a licensed surveyor stating that pins and monuments are set according to the approved plans. 11. Install gazebo, benches, etc. to approved site plan (see revised landscape plan approved as a change order). Page 2 Mr. William Martin August 3, 2006 12. Straighten the water and gas gate valve boxes and set them to be flush with the finished grade in front of units 101. 102. 201, 208 and anywhere else necessary 13. Concrete walks and steps need to be installed from the driveway to the concrete steps in front of all units, ie units 202 and 203. Also, install a cement landing at the base of the steps from the deck of unit 208. 14. Complete the site landscaping per the most recently approved plan. 15. There are places where curbs were not installed per the plans such as in front of the second building. This should be discussed with the owners association as it affects drainage and maintenance of the grass areas in front of the units. If an agreement is reached between the developer and owners association to eliminate the curb, a change order needs to be submitted to the Town for this revision. 16. The As-built plans need to be revised as follows: Show contours and the way the ground is graded to the rear of units 13 through 16. Show all line striping and handicap signs. Show all finish grading. Show all site lighting. Show sewer clean-outs. Show guiderRail, fences, stop sign, stop bar, gazebo, walkways, etc. Please call our office at the above number, ext 244 when this work is done so we can verify that the site work is completed according to the approved plans. When all the site work is complete the bond can be reduced to the maintenance level (10% of the original amount) and that will be held for one additional year. Sincerely, Jeffrey Doolittle, P.E. As a result, we have developed the following list of construction items to be corrected and finished with the Pleasant Meadows SRD. This list is not complete and should not be taken as a final punch list, but is a list of concerns with this project to date. The first group of items need to be completed before Engineering can approve any Certificate of Occupancy requests. 1. The Swale behind the buildings needs to be graded, loamed and seeded. This Swale needs to be graded to drain to the detention basin and should not hold water. As previously stated, some of the concrete slabs for the deck stairs may need to be replaced in conjunction with this re-grading. 2. Soil stockpiles need to be removed or secured and stabilized. The soil stockpile behind the second building should be removed. The other piles need to be secured with silt fence and'hay bales and stabilized by hydroseeding to prevent further erosion. 3. The area of the third building where the foundation hole is dug and soil stockpiles are located needs to be secured with construction fence. This fence must run around this entire area and tie into the natural barrier on the south side and the retaining wall on the north side. 4. The catch basin and sediment structure near the inlet to the detention basin needs to be uncovered (soil removed) and ringed with silt fence and/or hay bales so it does not get buried again. 5. The detention basin outlet structure elevation needs to be raised per change order 10 and the plans. This needs to be shown and certified at the correct elevation on a revised as-built plan. 6. The berm on the north side needs to be constructed to the design elevation, to provide 1 foot minimum freeboard above the outlet structure elevation. This needs to be shown and certified at the correct elevation on a revised as-built plan. 7. The brick and mortar inverts in the sanitary manholes must be rebuilt to function properly. A new sanitary sewer permit is required for this work. 8. A revised as-built plan is needed for review and approval before a C.O. can be issued for the second building. This needs to include the grading and elevations on the site around the first and second buildings and the detention basins. Locations and elevations must be shown for the detention basins, drainage structures, sanitary sewer manholes, retaining walls, roads, driveways and all other site improvements completed. 1pv1M at+ o * r 0 a u -0 soe.ca• 1540 SULLIVAN AVENUE• SOUTH WINDSOR, CT 06074 '` TELEPHONE (860) 644-2511 Other items that must be corrected or completed as soon as possible are: 9. The storm drainage and sanitary sewer pipes on Burr Meadow Condominium property need to be checked for settlement and damage near where the storm drainage pipes and sanitary sewer pipes from this project were connected to existing pipes. Any damage must be repaired to the satisfaction of the property owner. 10. The catch basin sumps must all be cleaned 11. The drainage pipes in the catch basins must be cut flush and mortared to blend in with the inside walls. 12. The 15" pipe between CB8 and CB9 has no pitch according.to the as-built plan for the first building. This must be re-laid so it has at least 0.5% slope or certified that it has at least 0.5% slope on a revised as-built plan. 13. The cast iron frames on the sanitary manholes must be grouted in place. 14. The lifting holes in the sanitary manholes must be filled with mortar. 15. The CB tops must be grouted in place. 16. The retaining wall between the detention basin and third building must be built according to the approved engineering plans. We are concerned because this was built and then disturbed by the excavation for the foundation of the third building. Engineering needs to inspect this wall and its final construction. Additional inspections may also be necessary 17. The pavement top course must be 2"thick Class II (after compaction). The compaction of this top course must conform with Town Standards as verified by an approved testing laboratory. 18. The large detention basin needs to be cleaned of soil from the stockpile, and debris, regraded and seeded as necessary. This is not a complete list of outstanding items but includes the items identified by the Engineering Department to date. All site improvements need to be completed according to the approved plans and approved change orders. Additional items may need to be addressed based on further site inspections prior to Engineering signing-off on future certificates of occupancy or building permits. We can arrange to meet on the site with you and/or the contractors to review these items. Please call me at 644-2511 x 245 if you have any questions. We look forward to a successful completion of this project. Sincerely, Jeffrey Doolittle, P.E. Town Engineer cc. The basin must be protected from sediment migrating into the basin. Hydrology in the basin is suspect. This structure must function as a wetland. Prior to the release of any bonds, the basin must be inspected and the function approved by the original consulting biologist/soil scientist. All perimeter erosion controls must be properly maintained or rebuilt. Grading around building #2 must be re-done. The drainage swale must be re-built and vegetatively stabilized. The area immediately north of the detention basin between the building and the basin must be re-graded and stabilized by vegetative establishment. ENGINE':: • r 4 MEMORANDUM ' M TO: Jeffrey B. Doolittle, P.E., Town Engineer FROM: Ed Beale DATE: 01/31 RE: spection Summary and DS;RD Pleasant Meadows/Garden This is a memo for your information and review about the status of the project referenced above and some of the situations that we should anticipate being a problem in the future. I will start from 06/12/01 which was the date of an inspection summary I left for Francis Costanza who took over inspections when I. was at National Guard training for 2 weeks. After addressing enough of the major items required before paving, the entrance road and driveways to the first building were paved on 6/22/01. The density tests submitted by the contractor's testing company were not acceptable. Remediation of this problem was proposed by Mr. IGslyuk as stated in a letter from Michael I Gantick; P.E. dated August 23, 2001. This would require that 2" instead of 11/2"of Class I be used when paving the final course over the Class II that was put down on June 12, 2001. Certificate of occupancies have been granted to the 4 units in the first building and a site bond has been posted for completion of work on the remainder of the project. The final three items listed in my memo of 6/12/01 have not been done as of this date. These items are listed below: 1. Cleaning of Catch Basin sumps. 2. Cutting drainage pipes in Catch Basins flush with walls. 3. Acceptance of invert construction in sanitary manholes. The brick inverts in the Sanitary Manholes will have to be rebuilt as an inspection on 1/24/02 showed that they were not functioning as required. In addition this inspection showed that some of the cast iron tops have not been grouted down and the lifting holes have not been filled with mortar as required.. Additional money was held with the bond reviewed on 1/28/02 to cover the cost of these items. . M h'{ The status of permits, fees, installation and changes to approved design for the laterals to units 201-208 must be resolved immediately. These laterals were installed some time in the fall of 2001 with out permits or inspection by our staff. When permits were .taken out in October and November of 2002 and an inspection requested, I found that the laterals were not installed in accordance with change order dated 2/20/01. As buiits have not been provided by the contractor. The location of the existing lateral connections should be verified by the design engineer and a request for a change order be submitted for approval or rejectidn. I recommend that if the. present location is accepted a test to guarantee that-there are no leaks in the system be done since the laterals were exposed for a considerable period prior to the contractor acquiring permits or requesting an inspection. Possibly a static head water test could be done. Another major item is the reconstruction of the versa lock retaining wall that was compromised when excavation was done for the adjacent foundation. This work will not be minor and the requirements and scope must be agreed upon prior to starting the work. IT WP E ward K. The regulation also has a provision for reduction of this bond for completed site work; and for a 10% maintenance bond for a one-year period after completion of the development(copy enclosed). In order to satisfy this zoning requirement, please have your site engineer complete the enclosed Bond Estimate Form, return it to us, and we will have the Engineering Dept. set a bond amount for approval by the Planning and Zoning Commission. Your engineer can use the same form to estimate the value of the improvements already completed, so that the bond amount can be reduced at the same time the original amount is established. After the reduced bond amount is established, please forward to us either a letter of credit or cash (passbook, certified check) in accordance with the enclosed bonding policy. Your earliest attention to this matter is appreciated, so that Certificates of Occupancy can continue to be granted without interruption. Thank you for your cooperation. Sincerely, a sa Marcia A. Tri-State Materials Testing Lab Inc. 121 "P"North Plains Industrial Road Wallingford CT 06492 Dear Mr. Hajjar, We have received a letter with a revision to a report by your office written on 06/22/01, report#007 for your client R.J. Fijol. The revised report cover letter from Bill Antonetti of j our office states that"The inspector that was at the job site for compaction of binder and was given the wrong specification by the contractor. After review of his inspection report it was determined that changes were to be made to this report to reflect the actual results. This report has been rewritten with the specifications supplied." On 07/31/01, Mr. Tracy LaPiene had a conversation with your office regarding the Min. Comp. Req. stated on your report. At this time your staff had stated that Fijol had instructed Jay Thomas, your testing inspector, that the minimum compaction required was to be 90% of the maximum density. As a result locations 1,2,4,5,6,10 & 11 on your report failed to meet the required specification of the Town of South Windsor of 92-97% compaction. At subsequent meetings between the Town, Fred of Fijol and Mark Kislyuk, Fred had stated that-he-had given the incorrect specification of 90% compaction to Jay Thomas. Furthermore Kislyuk had agreed to have his engineer review the results and proposed placing an additional V of Class I down when placing the surface course as remediation. The Town has a concern with the revisions made to this report. The report submitted to the Town on 07/30/01 stated the Min. Comp. Req: 90% and a Max.Wet Density: 159.8. The revised report submitted 08/22/01 states the Min. Comp. Req. 92-97%and Max.Wet Density of 157.2. In previous conversations with the Gallasso labs, Gallasso has stated that the specific gravities of Class II usually run between 2.58 and 2.60 thus maximum densities of between 161.0 and 162.2. The maximum density of Class II pavement placed on other projects in the Town had a max. density of 161.4, which is between the normal range stated by Gallasso. The Town is requesting further documentation on the revision to the Max.Wet Density stated on this revised &reissued report. Very truly yours, Michael J. Gantick, P.E. LaPiene, Project Engineer CC: Date: 06/26/01 Re: Pleasant Meadows 2000-7P Pleasant Meadows has requested final inspections for certificate of occupancies from the Building Department for the two end units of the first building. Pleasant Meadows will be requesting C.O.'s within the next couple of days. I believe it would be in both the Town's and the developer's best interests to send a letter to the developer spelling out what items remain to be addressed prior to an issuance of a certificate of occupancy A.S.A.P.. I request that the Engineering, Building and Planning departments including the department heads meet to address the desired level of completion and any outstanding items on this project. In the past such as Collins Crossing the Engineering department has required a site plan as-built for the building and surrounding area of the unit requesting a C.O. showing grading, utilities and building location. The Engineering department also ensured that turf was established and all drainage and sanitary structures including detention basins were installed and approved. Based on the history of this project I have a major concern that the Town's options may be limited in the event that a C.O. is issued for these two units and the developer folds up or no further site improvements are made. The following is a partial list of items that need to be addressed: 1. Pavement is not accepted until compaction test results are received 2. Site plan for units and surrounding area to be received 3. Monumentation remains to be placed 4. Change Order is required for Garden Circle realignment 5. Grading around building is not acceptable—swale to be formed around building- may require slabs in rear to be replaced 6. No turf establishment 7. Detention basin remains to be built 8. A number of retaining walls remain to be designed and constructed including 3 within detention basin. 9. Detention basin outlet structure remains to be completed 10. Sight line hazard at Pleasant Valley Rd remains to be cleared 11. Top course of pavement remains to be placed 12. Common parking area striping remains to be placed 13. Handicapped parking delineation and signage remains to be placed. 14. Landscaping structures remain to be built Again, due to the magnitude and character of some of these outstanding items I would like to address this as soon as possible. \\TOWN_HALL\VOL2\ENGINEER\Proj.-PU Wetland Applicatlons\Pleasant Meadows\LaPieneV&=MG 062WlTL.doc Page 1 of 1 TOWN OF SOUTH WINDSOR INSPECTION REPORT coll tom. -?1s`-2: J e1- . yuc ''S;y-e fyo ia ),,, (-ES)•.+ei l?r F-swdk, ►3,^c1. + AAftj ,tG. 4c rCo 'My fig S- /rr• ^e. %oc c 9 S ` y _ .rrw'C'J' ' a. Specifically, the grade of the drive at the entrance appears to steep which may cause a safety hazard to the future residents of this development. We have notified your site contractor and made him aware of our concern and suggested that he discontinue the construction of the entrance drive up to the first building until this issue can be resolved. We recommend that you have your engineer prepare a profile of this section of the roadway with a more gradual design grade for our review. Once we receive the revised plan, we will expedite the approval process so that your contractor may keep to his construction schedule. I can be reached at the South Windsor Town Hall at (860) 644-2511, extension 240 if you have any questions regarding this matter. Sincerely, (e4 seph J. Kerna Project Engineer cc: Michael J. AT THAT TIME ALL STORM AND NS7 ITARY PIPE AND STRUCTURES (MANHOLES AND CATCH BASINS) HAD BEEN INSTALLED WITH THE EXCEPTION OF THE SANITARY MANHOLE ADDED TO THE END OF THE LINE IN FRONT OF THE FIRST BUILDING. ON MY FIRST VISIT TO THE SITE TRACY LAPIENE WAS WITH ME AND HE DIRECTED THAT THE SANITARY LINE BETWEEN SMH (TF = 107.89)AND SMH (TF = 111.42) (CHANGE ORDER 8) BE EXPOSED BECAUSE IT HAD BEEN INSTALLED WITH OUT INSPECTION. A CLEANOUT WAS INSTALLED IN THE MIDDLE OF THE LINE AND WARNING TAPE WAS INSTALLED BEFORE THE TRENCH WAS BACKFILLED, I INSPECTED THE INSTALLATION OF THE NEW SMH AND THE NEW LATERAL TO THE FIRST BUILDING(CHANGE ORDER 10). WITH THE EXCEPTION OF THESE TWO INSPECTIONS I HAVE NO PERSONAL KNOWLEDGE OF THE CONDITION OF ANY OF THE UNDERGROUND CONSTRUCTION ON THIS SITE. JEFF FOLGER HAS BEEN DOING THE INSPECTION OF EROSION AND SEDIMENTATION MEASURES AND BASINS. YOU CAN CHECK WITH HIM AS TO THEIR STATUS. TWO RETAINING WALLS ARE BEING DESIGNED FOR INSTALLATION IN THE LAST BASIN. I DON'T HAVE ANY INFORMATION ON THE STATUS OF THESE WALLS OTHER THAN THE VERBAL ASSURANCES AT SEVERAL JOB MEETINGS THAT THE T.S.W STAFF HAS HAD WITH THE OWNER/DEVELOPER(MARK KISLYK)AND FIJOL CONSTRUCTION (SITE CONTRACTOR)THAT THEY WERE BEING DESIGNED BY A PROFESIONAL ENGINEER. I WAS TOLD THAT PARTIAL PAVING OF THIS PROJECT COULD BE DONE BEFORE THE RETAINING WALLS ARE INSTALLED. A PROGRESS AS BUILT WAS SUBMITTED THAT SHOWED SOME PROBLEMS THAT HAVE BEEN RESOLVED WITH THE EXCEPTION OF NOT SHOWING THE ADDITIONAL S.M.H. IN FRONT OF THE FIRST BUILDING AND A 15"DRAINAGE PIPE AT THE ENTRANCE OF THE PROJECT WHICH HAS NO PITCH. I DELIVERED A MEMO TO THE SITE ON 6/11/01 (A COPY OF THIS LETTER IS IN THE PROJECT FILE) DIRECTING THAT THE 15"DRAINAGE BE RELAID. A SURVEY CREW WAS AT THE SITE ON 6/11/01 DOING LOCATION AND I WAS TOLD THAT A REVISED AS BUILT WAS BEING PREPARED. KAREN FROM DESIGN PROFESSIONALS IS ALSO PREPARING A CHANGE ORDER FOR THE MINOR RELOCATION OF THE ROAD TO MEET THE LOCATIONS OF THE INSTALLED CATCH BASINS WHICH ARE SLIGHTLY OUT OF ALIGNMENT. SEE REVISED AS BUILT DATED: SHE IS ALSO DRAWING A PROFILE OF THE GRADING AT THE ENTRANCE TO THE SITE WHICH SHOWS THE INTENT FOR GUTTERLINE DRAINAGE ALONG PLEASANT VALLEY ROAD. THE BEST THING THAT HAS HAPPENED AS FAR AS THE COMPACTION OF THE EARTH WORK AT THIS SITE IS THAT IT HAS HAD MORE THAN 6 MONTHS TO SETTLE. COMPACTION TESTS ON THE SUBGRADE EXCEEDED 95%. A STRINGLINE INSPECTION OF THE SUBGRADE ELEVATIONS REVEALED THAT IT WAS SEVERAL INCHES LOW WITH THE EXCEPTION OF ONE AREA 50'+/-PAST THE FIRST SET OF CATCH BASINS AT THE ENTRANCE. THIS AREA WAS REGRADED AND THE EDGES OF THE ROAD BOX WERE CLEANED WHILE I WAS ON THE JOB. I WARNED THE CONTRACTOR THAT THE SUBGRADE AND SUBBASE HAD TO BE WIDE ENOUGH TO SUPPORT THE PAVEMENT UNDER THE CURB. I SPECIFICALY SHOWED HIM THE AREA THAT HE WAS PREPARING FOR THE PARKING AREA AND TOLD HIM THAT IT WOULD HAVE TO BE BIG ENOUGH TO FIT THE REQUIRED 18' PARKING SPACE AND CURB. THE SITE CONTRACTOR IS GOING TO USE ADDITIONAL GRAVEL BEYOND THE REQUIRED 6"FOR THE SUBBASE IN THE LOW AREAS. SOIL SAMPLES OF THE GRAVEL HAVE BEEN TAKEN BY THE CONTRACTORS TESTING COMPANY BUT AS OF THIS DATE I HAVE NOT RECEIVED THEM. IN MY MEMO OF 06/11/01 1 INFORMED THE CONTRACTOR THAT COMPACTION TESTS ON THE SUBGRADE WOULD HAVE TO DONE WHILE T.S.W INSPECTION PERSONNEL WERE PRESENT. AT THIS TIME ADDITIONAL TESTING SHOULD BE DONE AT THE DRAINAGE STRUCTURES. IF AREAS NEAR THE DRAINAGE STRUCTURES DO NOT MEET THE 95% COMPACTION REQUIREMENT THE CONTRACTOR SHOULD BE MADE TO COME UP WITH A SOLUTION. A HOE-PACK COULD BE USED IF THE JUMPING JACK THEY HAVE ON THE JOB FAILS BUT I HAVE NOT RECOMMENDED USING ONE BECAUSE I CAN SEE THEM SAYING THAT IT WAS OUR FAULT IF DAMAGE WAS CAUSED TO THE PIPE OR DRAINAGE STRUCTURE. A SANITARY MANHOLE WAS RAISED AT THE END OF THE TEMPORAR CUL-DU-SAC. THE CONCRETE LEVELING COURSE MUST BE REBUILT BEFORE BACKFILLING THAT STRUCTURE. (NOT DONE AS OF 06/12/01) A MAJOR PROBLEM WITH THIS PROJECT HAS BEEN THE LACK OF CONSISTANT SUPERVISION BY THE SITE CONTRACTOR(SEVERAL JOB SUPERVISORS HAVE COME AND GONE), CONSTRUCTION WITHOUT INSPECTION BY TOWN STAFF THAT HAS HAD TO BE REDONE AND THE LACK OF KNOWLEDGE OF THE BASIC REQUIREMENTS OF THE T. S. W. AS RECENTLY AS THIS WEEK THE SITE CONTRACTOR HAD NO BOOK OF SPECIFICATIONS AND WAS OPERATING WITH AN INCOMPLETE SET OF PLANS. SPECIFICALY THE DETAIL SHEET WAS MISSING AT THIS TIME. SOME(NOT ALL) MAJOR ITEMS REQUIRED BEFORE PAVING ARE: 1. PROGRESS AS BUILTS Z 2. MANDREL TEST OF SANITARY LINE./ 3. COMPACTION TESTS OVSUB BASE AND AREAS AROUND DRAINAGE STRUCTURESJ. 4. ENTRANCE GRADING. 5. CHANGE ORDER FOR ROAD REALIGNMENT. 6. APPROVAL OF SUBBASE AND BASE COURSE MATERIALS. 2 SOME (NOT ALL) MAJOR ITEMS COMING UP PRIOR TO FINAL APPROVAL ARE: 1. CLEANING CATCH BASIN SUMPS. 2. CUTTING DRAINAGE PIPES IN CATCH BASINS FLUSH WITH WALL. 3. ACCEPTANCE OF INVERT CONSTRUCTION IN SANITARY MANHOLES. 4 Town of South Engineering Department Memo To: Mr.Mark Kislyk From: Edward K. Beale, Engineer Assistant CC: File,M. Gantick, M. 1. The swale behind the buildings needs to be graded, foamed and seeded. The other piles need to be secured with silt fence and,hay bales and stabilized by hydroseeding to prevent further erosion. 3. The area of the third building where the foundation hole is dug and soil stockpiles are located needs to be secured with construction fence. This fence must run around this entire area and tie into the natural barrier on the south side and the retaining wall on the north side. 4. The catch basin and sediment structure near the inlet to.the detention basin needs to be uncovered (soil removed) and ringed with silt fence and/or hay bales so it does not get buried again. Locations and elevations must be shown for the detention basins, drainage structures, sanitary sewer manholes, retaining walls, roads, driveways and all other site improvements completed. tWN d1 . 0s • 5 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CT 06074 OSOR.c° TELEPHONE (860) 644-2511 Other items that must be corrected or completed as soon as possible are: 9. 12. The 15" pipe between CB8 and CB9 has no pitch according to the as-built plan for the first building. South Windsor Estates LLC 84 Willowbrook Rd. Longmeadow,MA 01106 - I Dear Mr. Kislyuk: RE: PLEASANT MEADOW SENIOR RESIDENCE DEVELOPMENT STAFF CONCERNS There are several site issues occurring at the above-noted development that need to be addressed, as follows. 1. Garages. The one-car garages as constructed in the first building do not appear to be able to function as garages. The intrusion of stairs and ducts into already-marginal garage spaces have resulted in garages that are smaller than required under current zoning requirements (minimum 180 square feet). It also appears that the intrusion of the stairs into the garage space renders it difficult if not impossible for a vehicle to actually park inside the garage and allow the vehicle's occupants to exit the vehicle. These problems need to be resolved in such a manner that the garages are able to be used as garages. 2. "Dead space"in units. Spaces shown as dead space on the building plans, necessitated by the original over-sizing of units above the maximum allowed by zoning, must be inaccessible and cannot be converted into useable space. 3. Second building foundation. Both the horizontal and vertical locations of the foundation need to be established, as it is our understanding that the foundation was not staked out prior to construction by the site designers (land surveyor). It is also our understanding that the foundation was raised during construction. A change order for a raised foundation was not submitted prior to construction (and has not been submitted as yet), so the implications for utilities and storm drainage have not been addressed. In addition, non-useable garages (similar to building 1) needs to be prevented. 4. As indicated in Mr.Jerry C. Iazzetta's letter of December 29, 2000, the Engineering Dept. has several issues: a. The sanitary sewer main within your project was not installed in accordance with approved plans. This work was not inspected by the Town, and the permit for this work expired. b. A permit is required for each unit and the connection charges for each unit must be paid in addition to the pro-rated sewer use fee. Fred Shaw, Superintendent of Pollution Control, Jerry C. Iazzetta, P.E., Town Engineer, and Tracy A. LaPiene, Project Engineer)to discuss problems concerning the installation of the sanitary sewer at Pleasant Meadows. It was indicated that your contractors did not install the sanitary sewer main or the laterals to units 1-4 as per either the approved plans or the approved change order. Mr. Shaw stated that the installation is unacceptable and must be rectified to comply with the approved change order plans. It was also indicated that part of the sanitary main was installed without any inspection by the Town. Mr. Iazzetta stated that test pits must be dug at several locations to determine if this part of the main was installed in accordance with Town Standards. We stated that the permit for the sanitary sewer installation had expired and a new permit was required before any other work, including test pits, was started. In addition, it was stated that before any sanitary pipe is brought into any unit, a permit will be required for each unit, and in addition to the permit fee, a connection charge of$750 plus the pro rated sewer user fee must be paid for each unit. To date, none of the corrective work, test pits or permits for connection to the units has been completed. If you have any questions, please call me at 644-2511, extension 245.
