The development is attractive, well maintained, and an asset to the Sullivan Avenue commercial area and to the community's tax base. The purpose of this application is to seek a variance to Table 4.1.6A in the General Commercial Zone to allow for an attractive, residential style shed in the far corner of the property, in order to house equipment and tools associated with property maintenance, thus maintaining a 5 feet rear yard (15 ft. required, 10 : feet variance). • Hardships, unique factors associated with this property, and other circumstances pertinent to this application are: 1) A shed cannot be placed on the subject property without the benefit of a variance, due to the property's unique "L"shape, traffic patterns, the need for parking to support the three businesses, aesthetic considerations, and the desire to avoid any on- or off-site impacts; 2) The subject location is adjacent to two dumpsters, effectively adding another element of screening between the dumpsters and the residentially zoned property to the north ("The Neighborhood" in the DRZ zoning district); 3) The selected location is contiguous to two vegetative buffers, one along the north side of Mr. Leonard's property, and another on the residentially zoned property. These two buffers effectively screen the area of the proposed shed; 4) The applicant has selected an attractive, residential style shed with a cupola from the Barnyard in Ellington. If any part of it were visible to anyone in The Neighborhood, they would view a shed characteristic of sheds in a residential zone; 5) The property has a Town sanitary sewer easement running its entire depth on the west side (serving "The Neighborhood"), immediately contiguous to the selected location for the shed. This easement precludes the erection of any buildings; • G:\jobs\l585\docs\Applications\ZBA Application\1585 ZBA Narrative 6-18-15.docx 6) The property is subject to access management restrictions (Mr. Leonard's access driveway must also serve the abutting undeveloped property of Tim Moriarty),which further restricts the placement of any maintenance shed; 7) The shed cannot be placed on Mr. Moriarty's property(no area for it after accommodating a commercial building and parking); 8) The presence of utility and travel easements, including those in favor of Mr. Moriarty's property, further restricts where a shed could go; 9) The shed will allow Mr. Leonard to secure his maintenance equipment and tools from the elements, and the occasional vandal or thief; 10)While Mr. Leonard has every right to store his maintenance equipment and tools outdoors,he knows it will be far better to keep them out of view; 11)The available parking will still exceed zoning requirements (51 provided, 50 required), after the loss of two spaces to accommodate the shed; : 12)The two lost parking spaces are arguably the most dispensable, given that they are in : the extreme northwest corner adjacent to two dumpsters; 13)The proposed 14 feet x 24 feet residential style shed is only 336 square feet in size; 14)The majority of the shed will be conforming to the rear yard setback. Only 140.57 square feet will be over the setback line, while 195.43 sq. ft. will be conforming; 15)The adjoining property to the west is in retail use (the Colony Shops), and thus should not be impacted in the least; 16)The building's peak will be 18 feet high(approximately 14 feet in height per zoning definition),plus an attractive cupola, which is substantially lower than the other buildings on the property; 17)The shed will conform to the side yard setback; 18)The property will remain substantially conforming to lot coverage (10%vs. 30% allowed) and impervious coverage (55.85%vs. 65% allowed); 19)The applicant is only requesting a variance for this small area(approximately 140.57 square feet) of a residential style shed, and is not requesting a reduction of the rear yard across the back of the property. esign • • G:\Jobs\1 585\dots\Applications\ZBA Application\1585 ZBA Narrative 6-18-1 S.docx f } jv cp ji CD R6 NO- ro i e a X Y ,''fib .- z• s. j -k - I#.
