Subject: Cerone In Law application -items needed
Hi John,
There are a couple of items needed before we can process this application a plot plan showing the
driveways, grading etc and the exact size of in-law apartment versus the house and a brief narrative
addressing the in-law criteria:
♦ The in-law apartment cannot be larger than 900 sq ft or 40% of the gfa(whichever is smaller
♦ the entire structure must maintain the appearance of a single family dwelling;
♦ off street parking for three vehicles must be accommodated;
♦ adequate water and sewage disposal must be provided; and
♦ the owner of the dwelling units must occupy either the in-law apartment or the main dwelling
unit
The Commission may waive one or more of the provisions above (except the requirement that an owner
live in the apartment or house) after determining:
♦ There will be minimum adverse impact on existing uses in the area;
♦ Surrounding property values will be conserved and the character of the neighborhood will not be
unduly disrupted;
♦ Due consideration to preservation of historic factors has been demonstrated.
The waiver request should be a part of the narrative.
We also need copies of the certificate of mailing and who they were sent to.
This will be scheduled for a public hearing on April 14

Michele

Michele Lipe, Director of Planning
Town of South Windsor
1540 Sullivan Avenue
South Windsor, CT 06074
Re: Cerone In-law Addition, 26 Brewster Road; Special Exception
The Cerone family is seeking to construct an In-law addition for their home at 26
Brewster Road. This application requires a special exception because the size of the
proposed addition exceeds the 900 sf maximum allowed by the Zoning Regulations.A
waiver is being requested to allow for the addition to be 1,077 sf. Section 7.1.7 of the
regulations allows for a waiver for the size upon determination that there will be minimal
adverse impacts on existing uses in the area; that surrounding property values will be
conserved and the character of the neighborhood will not be unduly disrupted; and that
due consideration to preserve historic factors has been demonstrated.
We expect minimal adverse impacts on the existing uses in the area, as#56 Brewster
Road was approved to construct a 1-BR in-law addition with plans signed off by the
Planning Department on 8/5/13. The Planning &Zoning Commission did not have to
review this application as the proposed size for their 1-BR in-law was 895 sf, 5 sf below
the 900 sf threshold. The addition at#56 Brewster included a second 2-car garage so
the garages have space for 4 vehicles. This existing in-law addition is located 2 doors
down on the same side of the street. The Cerone's are seeking to construct a 2-BR in-
law apartment for Mrs. Cerone's parents to reside in. Each parent has medical issues
and will each have their own bedroom. This house proposes a 2-BR in-law addition with
182 sf more than the house located two doors down which was approved for 1-BR. This
size difference is essentially the same as a 13x14' room.
This Commission approved a similar application for a 940 sf in-law addition, located at
35 Vintage Lane, in July of 2003. Subsequent approval was given for this addition in
September of 2003 to increase the size to 1,100 sf to allow the area to be handicap
accessible. The Cerone's also wish to provide an addition that offers accessibility.As
their residence is a split level home, additional measures will be employed to allow for
accessibility such as chair lifts that navigate stairways.
As for property values, current records (2014) from the assessor's office were reviewed
and found that the property value for#44 Brewster Road, which is adjacent to both the
existing in-law addition and the subject property of this application, had not changed
from the previous years appraisal.
The Cerone's existing home was constructed in 1974, therefore, we believe there are no
historic factors to be preserved. That being said, David Goslin, a local architect has
designed an addition to enhance the existing features and character of the home. The
site itself offers challenges for any addition, including the shape of the lot which is on a
curve, which brings the front yard setback further back into the site as it extends away
from the house. In addition, there is an existing in-ground pool located directly behind
the existing home. Mr. Goslin has re-designed an addition that works within the bounds
of these challenges, and enhances the aesthetics of the circa 1970's home.
The applicants are anxious to proceed with construction of this in-law addition to ensure
proper care for their parents in the near term, while allowing them to remain in their
South Windsor community.
Respectfully submitted,
Karen Isherwood, P.E., LEER A.P., Principal

RE: Application 15-19P—Cerone Inlaw Apt, 26 Brewster Rd.
Engineering has reviewed plans for the above application and has the following
comments:
1. The concrete sidewalk panels across the proposed driveway will have to be
replaced with new concrete sidewalk panels that are 8 inches thick with WWF
(wire mesh) per Town Standards.
2. Will the existing concrete walk be extended to the proposed driveway?
3. What will happen to the existing stone retaining wall along the side of the existing
driveway (that is to be removed)?
4. What drainage area will the proposed yard drain serve and where will water from
this drain go after it discharges from the end of the proposed 8" pipe? The plans
appear to show a water course of which we have no record. Any storm water
from this new addition needs to be discharged on this property into the ground via
a rain garden or infiltration chamber, so it does not affect neighboring properties.
5. Show existing underground utilities from the street to the house.
6. Where will the utilities run into the proposed in-law apartment and how will they
be connected to existing utilities in the existing house?
Please contact me if you have any questions.
Cerone In-Law Apartment
PH 4/14/15
1. A Special Exception application to request a Section 7.1.7 Waiver of
Provisions to construct a 1,077 sq ft in-law apartment on property
located at 26 Brewster Road, A-30 zone.
2. The standard zoning criteria for an in-law apartment includes:
♦ The in-law apartment cannot exceed 900 sq ft or 40% of the
combined gross floor area, whichever is smaller;
♦ The entire structure must maintain the appearance of a single family
dwelling;
♦ Off street parking for at least three vehicles must be accommodated;
♦ Adequate water and sewage disposal must be provided; and
♦ The owner of the dwelling units must occupy either the in-law
apartment or the main dwelling unit.
The Commission may waive one or more of the provisions above (except
the requirement that an owner live in the apartment or house) after
determining:
♦ There will be minimum adverse impact on existing uses in the area;
♦ Surrounding property values will be conserved and the character of
the neighborhood will not be unduly disrupted; and
♦ Due consideration to the preservation of historic factors has been
demonstrated.
3. The applicant has provided a site layout showing the new addition in
conformance with zoning, elevations depicting the addition, as well as
floor plans for the addition — both as an in-law apartment and then
when it is converted back to single family living space.
4. The elevation shows that the addition will include a three car garage.
The existing two car garage will be renovated into living space for the
main house. The existing driveway is proposed to be removed, with a
new driveway leading to the addition. The Commission should decide if
this elevation is consistent with the appearance of a single family house
as required. It appears that all other zoning requirements can be met.
5. If this application is approved, the Commission may issue a permit valid
for up to five years. At the end of the permit period, if the family
situation has not changed, the applicant may request renewal by staff.
Staff would recommend the two standard conditions for this in-law
apartment be included in the approval:
• When the addition is no longer used as an in-law apartment, the
kitchen is to be removed and the living area must be converted into
other single family living space.
• This is a family situation and this approval does not make the
property income producing. If the family situation should change,
the home will have to be restored to a one-family dwelling unit.
