As I indicated, my client, Scott Leonard, owns approximately 2.0 Acres, more or less, on the westerly side of Buckland Road, immediately northerly of your company's center in Manchester. We have been urged by the Town Planner in South Windsor, Ms. Marcia Banach, to seek your company's approval to connect an access drive into your shopping center in Manchester rather than seek approval for a separate commercial driveway access from Buckland Road. I requested that you consider granting such rights to Mr. Leonard. In addition, I am seeking permission to tie into the sanitary sewer located within forty feet (40') of the common property line between your center and Mr. Leonard's property. Other sewer connections are available but at substantially greater cost and inconvenience to my client. You indicated in our telephone conference that your company has a very firm policy in dealing with such requests in that such requests are uniformly rejected, or, if ever considered, are tied to extremely protective restrictive covenants and monetary consideration. I am asking that you respond in writing to my request. My intention is to present your response to the South Windsor Planning and Zoning Commission to indicate that we made the effort requested by Ms. Banach and that your company indicated its intention to adhere to its long- standing policy. G Traffic Operations Analysis (Combined-Saturday) g Introduction: SCANNED The following traffic study has been prepared as part of a Planning and Zoning Commission application for a zone change from Residential to Restricted Commercial (RC)zone for land owned by Scott Leonard at 1, 9, & 15 Buckland Road in South Windsor, Connecticut. The site is located on the west side of Buckland Road and straddles the South Windsor/Manchester Town line. The site consists of 4 parcels of land containing approximately 2.1 ac. The report has also been prepared to address an issue that has been raised as to whether the site should have a separate curb cut on Buckland Road, or be restricted to access through the adjacent plaza to the south of the site. Appendix A contains a site location map for the study site. Study Area: The site is located within a heavy retail corridor, and the size of the site is very small when compared to the surrounding retail developments. The site is located in a very interesting area. Due to the center median within Buckland Road, traffic entering and exiting the site will be restricted to right turns only. The question raised is what will be the impact of adding a driveway in the corridor on the existing traffic patterns. As such the study area has been taken as the section of Buckland Road extending from Tamarack Avenue to Pleasant Valley Road. Buckland Road becomes Buckland Street within the town of Manchester. Existing Roadway Network: Buckland Road at Tamarack Avenue: This intersection is a 4-way signalized intersection. Buckland Road runs in the north/south direction through this intersection. Tamarack Avenue(Evergreen Walk's southern drive)runs from Buckland Road to the west. The Northern Hills Drive(Access drive to Lowes and Target)runs from Buckland Road to the east. The Buckland Road northbound approach is four lanes wide, with one left turn lane, two through lanes, and a dedicated right turn lane. The Buckland Road southbound approach is three lanes wide with a dedicated left turn lane, one through lane and one through/right turn lane. Tamarack Avenue eastbound approach has a through/left turn lane, a dedicated through lane, and a dedicated right turn lane. The Northern Hills Drive westbound approach has a dedicated left turn lane, a combination left turn/through lane, and a dedicated right turn lane. The traffic signal consists of six phases. The first phase is a southbound advance which provides an opportunity for southbound traffic on Buckland Road to turn left into the Northern Hills Driv. Also permitted during this phase are west bound right turns fr und om Northern Hills Drive onto Buckland Road. The second phase allows the northbo through and right turn movements to occur on Buckland Road. The third phase allows SCANNED the Tamarack Avenue traffic to exit onto Buckland Road in both directions and the through movement to Northern Hills Drive. The fourth phase allows for all westbound movements from Northern Hills Drive. The fifth phase allows for the northbound left turn movement from Buckland Road into Tamarack Avenue, and also allows for a right turn movement from Tamarack avenue to southbound on Buckland Road. The sixth phase allows for the southbound through movement on Buckland Road. All approaches are vehicular actuated and part of a closed-loop interconnected traffic signal system along Buckland Road. Buckland Street at Plaza at Buckland Hills Driveway: The Buckland Street/Plaza at Buckland Hills Driveway is a tee intersection where Buckland Street runs north south forming two legs, and The Plaza at Buckland Hills Driveway forms the third leg running west off of Buckland Street. The intersection is un-signalized. Buckland Street in the southbound direction through this intersection contains two through lanes, two left turn lanes, and a right turn lane(extending from the Pleasant Valley Road intersection to the north). The Town Center Plaza, driveway has a single exiting lane. Buckland Street at Pleasant Valley Road: This intersection is a 4-way signalized intersection. Buckland Street runs in the north/south direction through this intersection. Pleasant Valley Road runs from Buckland Street to the west. Buckland Hills Drive runs from Buckland Street to the east. The Buckland Street northbound approach is five lanes wide, with two dedicated left turn lanes, two through lanes, and a dedicated right turn lane. The Buckland Street southbound approach is five lanes wide with a two dedicated left turn lanes, two through lanes and a dedicated right turn lane. Pleasant Valley Road eastbound approach has five lanes with two dedicated left turn lanes, two through lanes and a dedicated right turn lane. The Buckland Hills Drive westbound approach has 5 lanes with two dedicated left turn lanes, two through lanes and a dedicated right turn lane. The traffic signal consists of eight phases. The first phase is a northbound advance which provides an opportunity for northbound traffic on Buckland Street to turn left onto Pleasant Valley Road. The second phase allows the southbound through movements to occur on Buckland Street. The third phase allows the westbound left turn movements to occur. The fourth phase allows for the eastbound through movements to occur. The fifth phase allows for the northbound through movements on Buckland Street. The sixth phase allows for the southbound left turn movement from Buckland Street onto Buckland Hills Drive. The seventh phase allows for eastbound left turns from Pleasant Valley Road to northbound on Buckland Street. The eighth phase allows for westbound through movement to occur. All approaches are vehicular actuated. Proposed Site Driveway: The issue has been raised as to whether the site should have a separate curb cut on Buckland Road, or be restricted to access through the adjacent Plaza at Buckland Hills immediately to the south of the site. SCANNCU There appears to be a number of issues with utilizing the Plaza at Buckland Hills driveway as a primary access to the subject site. Traffic counts were conducted during the Weekday P.M.peak hours and also during the Saturday peak hours at the intersection of Buckland Street and the Plaza at Buckland Hills. Completing the traffic counts afforded ample opportunity to observe this intersection in actual operation. We observed that approximately two times as many cars exited from the Plaza at Buckland Hills onto Buckland Street from the driveway as entered the driveway from Buckland Street. This was true for both the weekday P.M.peak hours and the Saturday peak hours. Of the cars that exited from the Plaza at Buckland Street, approximately 1/2 were noted to be crossing the right turn and two through lanes to take a left at the Buckland Street/Pleasant Valley Road intersection. Many of the vehicles would cross into the left most left turn lane in order to make a U-turn at this intersection. In order to be able to make this maneuver, the automobiles would need to wait until there was a break in the traffic sufficient to make this maneuver. The Buckland Road/Tamarack traffic light to the north systematically provided a platoon affect that generally afforded at least one or two vehicles to make this maneuver every cycle. During the majority of the cycle, vehicles would often be backed up within the Plaza at Buckland Hills drive waiting for a clear avenue for the first car in line to make the crossing maneuver to the left turn lanes at the Buckland Street/Pleasant Valley Road intersection. Often 5+vehicles were in the queue at this driveway waiting. During this period, vehicles were continuing to enter the driveway often at a reasonable higher rate of speed then would typically be experienced at driveways. The dedicated right turn lane for the southbound Buckland Street at Pleasant Valley Road extends beyond the Plaza at Buckland Hills driveway. As such vehicles turning right both into the Plaza at Buckland Hills and vehicles turning right at Pleasant Valley Road both use the same lane. This appears to create some confusion whereby vehicles proceeding to Pleasant Valley Road to take the right turn are traveling at a higher rate of speed and having to react suddenly to vehicles taking a right into the Plaza at Buckland Hills. Providing a primary site access through the Plaza at Buckland Hills would be difficult due to the constraints imposed by the present operations. Due to the existing queues of vehicles waiting to exit the Plaza at Buckland Hills onto Buckland Street, any traffic from the subject site that's exiting onto Buckland Street at this location could potentially obstruct the traffic entering the plaza from Buckland Street. Due to the higher speeds of some vehicles entering the plaza, this could be a very serious condition. The alternative of providing a primary site access directly onto Buckland Road from the site appears to be a better alternative. There is ample sight distance to safely locate a curb cut on Buckland Road along the frontage of the subject site. The driveway location at a greater distance from the intersection of Buckland Street and Pleasant Valley Road allows a greater distance for vehicles to change lanes. The location of the site drive to the north of the beginning of the left turn lanes and right turn lane allow vehicles to enter the SCANNED roadway without interfering with the weaving maneuvers occurring with the additional turn lanes. The proposed site drive is designed to intersect Buckland Road to form a tee intersection. The site drive will be controlled by a stop sign, allowing for free now of traffic on Buckland Road. There will be a single lane approach on the site driveway. Background Traffic Volumes: The site is located in a very dynamic retail area, with a high level of development occurring. Due to the retail nature of the area, the typical retail peak periods (weekday between 4:00 and 6:00 P.M., and Saturday between 11:00 A.M. and 1:00 P.M.) were used for analysis. The analysis assumes that the site will be permitted during the winter of 2009/2010, and construction is to be complete by the fall of 2010. As part of the proposed Evergreen Walk expansion, recent counts were completed by F. A. Hesketh&Associates, Inc. (FAH). FAH then compiled complete background traffic rates for a 2010 build year which included all of the Evergreen Walk expansion and also included the previously permitted Deming Plaza development. Subsequent to this analysis, the site for the proposed Deming Plaza development was re- permitted as a Senior Living facility with a substantially lower traffic associated with the development. In addition, one part of the Tuscan Hills development has been constructed and is now open for business. Traffic counts were conducted during the P.M.peak hours and the Saturday Peak hours at the intersection of Buckland Street and the Plaza at Buckland Hills driveway. The traffic counts conducted by Design Professionals indicated a higher level of traffic under 2009 existing conditions than contained in the FAH report for the 2010 background condition. The existing 2009 traffic counts were used for the analysis. These counts were distributed through the Buckland Road/Tamarack Ave. and Buckland Street/Pleasant Valley Road intersection in the same proportion as contained in the FAH report. In order to develop background traffic volumes, the 2009 counts were increased by 1%to account for background traffic growth between 2009 and 2010. In addition, projected traffic volumes from a number of previously approved developments that have not been constructed were added to develop the 2010 background volumes. The Deming Plaza development was added. Even though the site was re-permitted for a senior living facility, the original Deming Plaza approval is still valid, and would be the higher of the two for traffic generation. The undeveloped portion of the Tuscan Hills development was added as was the additional traffic from the Evergreen walk residential and retail development as outlined in the FAH 2O07 reports. Appendix B contains the background traffic volumes for the weekday P.M. and Saturday peak hours. SCANNED Site-Generated Traffic: The site was reviewed for a number of traffic uses as allowed in the RC zone. Our understanding is that at the present time, fast food restaurants with a drive-thru are not permitted uses. The two uses with the potentially highest generation rates reviewed are a stand alone restaurant and retail. Based on conceptual site plans reviewed, the site can accommodate up to 14,700 S.F. of retail or up to 5,400 S.F. of restaurant. In reviewing the trip generation rates for a Quality Restaurant(Land use code 931)in the ITE manual, it was found that for the P.M. Peak hour and Saturday Peak hour, the trip generation would be less than for the 14,700 S.F. of retail. As such, the retail use was used for the trip generation analysis. In determining the projected site generated traffic volumes, the Institute of Transportation Engineers (ITE) Trip Generation Report was utilized. The proposed site development is to consist of approximately 14,700 S.F. of retail stores. Land use code 814 within the ITE manual for"Specialty Retail Center"was used to calculate the projected trip generation rates for the facility. A trip is defined as a one-way vehicular movement. A vehicle that travels to the site is considered as one vehicle trip. When that vehicle leaves the site, it is considered as a separate vehicle trip. The land use code 814 for Specialty Retail Center was used. The land use code 820 Shopping Center could be used, but for small developments, the results are severely skewed. For instance, under land use code 820, a 14,700 S.F. retail center standing alone would generate 177 vehicle trips during the P.M.peak hour. Adding 14,700 S.F. of retail to a 100,000 S.F. retail center would only add 59 vehicle trips. For small retail centers, the results of using land use code 820 are severely skewed. The calculations using land use code 814 are contained in appendix C, and summarized below: Friday P.M. : 57 trips total (56%entering, 44%exiting) Saturday Peak Hour: No information given. The generation rates for the weekday P.M. peak hour were increased by a factor of 1.4 for use. Distribution was taken at 50% entering and 50% exiting. No reduction has been taken for either the weekday or Saturday peak hour due to pass-by trips. Typically it would be expected that a percentage of the vehicle trips would already be on the roadway network and would not be new generated trips. Different studies have shown from 25%to over 50%of vehicle trips may be pass-by trips depending upon the specific use(s). For purposes of analysis,no reduction has been taken for pass-by trips. Traffic Distribution: All traffic entering the site and exiting the site are right turns due to the existing roadway median. The distribution of traffic at the Buckland Street/Pleasant Valley Road SCANNED intersection was assumed to follow existing distribution patterns. All traffic at the Tamarack Drive/Buckland Road intersection was assumed to be coming from the north direction only. Combined Traffic Volumes: The combined traffic volumes consist of the addition of the background traffic volumes and the site generated traffic volumes. Included in appendix D are the combined traffic volumes for Weekday P.M. and Saturday peak hours. Traffic Operations Analysis: The analysis of the traffic operations of the study intersections was completed using the Synchro traffic software. The study intersections were analyzed under background and developed conditions. The background analyses for the study intersections are included in appendix E(Weekday P.M.) and appendix F(Saturday Peak Hour). The analysis under developed conditions for the study intersections and the site drive are included in appendix G(Weekday P.M.) and appendix H(Saturday Peak Hour). . The results are summarized in the following table. Table 1. Summary of Intersection Analysis Buckland Road at Tamarack Drive(2010 Design Year) Weekday P.M. Weekday P.M. The traffic analysis of the intersection of Buckland Street at the Plaza at Buckland Hills Drive is miss-leading in its rating of the intersection. Due to the propensity for vehicles to cross all lanes of traffic to take a left at the Buckland Street/Pleasant Valley Road intersection, the actual wait times for vehicles exiting the Plaza at Buckland Hills Driveway onto Buckland Street and the corresponding queue lengths are substantially greater than noted. During the Saturday count, there were always vehicles queued up waiting during the peak hour to exit this intersection. The driveway was operating at maximum capacity and vehicles waited through multiple cycles to exit this driveway. Sight Line Analysis: The sight lines for the proposed site driveway were reviewed to determine the adequacy of the proposed site drive. The sight line from the site drive extends to the north for approximately 700'. This would be adequate for a 65 mph design speed, and is more then adequate for the 40 mph posted speed. Conclusions: The change of zone for the site to RC and development of the site would have a negligible impact on the surrounding roadway network. Due to the limitations and issues with the existing Plaza at Buckland Hills Driveway on Buckland Street and its Proximity to the Buckland Street/Pleasant Valley Road intersection, we would not recommend accessing the site through this driveway as its primary access. We would recommend placement of the driveway on the subject site as far to the north as reasonable in order to maximize the separating distance from the proposed drive to the above noted intersection. The Trip Generation data available for"Specialty retail Center" (ITE land use code 814) is based on a multitude of studies throughout the United States. Application of the data needs to take into account the size and number of studies and the average size of the study group. The proposed development is to consist of 14,700 S.F. or retail development. A trip is defined as a one-way vehicular movement. A vehicle that travels to the site is considered as one vehicle trip. When that vehicle leaves the site, it is considered as a separate vehicle trip. The ITE trip generation manual provides generation rates based on the gross square footage of the site development. Generation rates based on an average rate, ranges of rates, and a fitted curve are provided. The fitted curve for the generation rates fell within the range of rates, and was used for the weekday P.M. peak hour generation rates. The Saturday generation is discussed in the report. The calculations are as follows: Weekday P.M. Average=2.71 trips per 1,000 S.F. For 14,700 S.F. =40 trips Range of rates=2.03-5.16. For 14,700 S.F. =30-76 trips Fitted curve: Tt=2.40(X)+21.48. For 14,700 S.F. =57 trips The ITE data sheets are included herein for reference. GALLIGAN Town Manager July 10, 2009 Mr. Patrick Kennedy Chairman Planning &Zoning Commission 9 Tuttle Circle South Windsor, CT 06074 Re: Appl. 09-18P, Scott Leonard, One Buckland Rd Dear Chairperson Kennedy: Please read the following into the record of the July 14, 2009 Planning & Zoning Commission Public Hearing as my support for Application 09-18P, Scott Leonard, One Buckland Road: Please be advised that I am not able to attend this July 14, 2009 Planning & Zoning Commission meeting due to the fact that I am on vacation in Vermont. This vacation was scheduled over a year ago. I would like to inform the P&Z Commission that the project before you being presented by Scott Leonard, is a project that the Town Manager is endorsing. I would like to help Mr. Leonard provide a quality project on his site. The reason I am coming forward to support this project is that during the Evergreen Walk Hearings and Approvals, Evergreen Walk had to do some site lines and approvals for their entrance into their facility. As part of that, as you now, the Town Council did not do any condemnation on Mr. Leonard's site as he had worked with the developers of Evergreen Walk to give them some easements so that they would be able to move forward on the Evergreen Walk project. This created better site lines for the cars that are traveling along the Buckland Road Corridor. During that process, it was discussed that the Town would try to protect Mr. Leonard from being hurt by his voluntary decision to help us with our project and that he would still be able to have an entranceway on to Buckland Road for any project that he may do in the future. That is why I am supporting his application to`have Mr. Leonard be able to have access off of Buckland Road. I know that the Applicant has tried to work with the Simon Property to secure access from their property, but that has been denied. I do not want to see Mr. Leonard get hurt on this project. He stepped up to the plate to help us on a major project, which has proved to be a strong economic impact to the community. It has SCANNED provided a quality of life that South Windsor has been able to enjoy with its shopping and retail environment. I once again, support this application and apologize for not being here. If the public hearing remains open, I will be more than happy to come to the extended hearing to have discussions with the P&Z Commission as to what took place five years ago and how Mr. Leonard was very helpful and key in our Evergreen Walk project. Mr. Scott Leonard has also done other work in South Windsor and has been a pleasure to deal with. He has followed all of the rules and regulations that our department heads, from Building Inspector to Director of Planning, and has always been accommodating to make sure that he follows the approvals as outlined by the P&Z Commission and Staff. I want to thank the Chairman and the Commission Members for taking the time to review this letter. I stand ready to discuss this further if the Public Hearing is continued. If not, I hope we see our way clear in approving this application. Very truly yours, Matthew B. You indicated in your remarks to the Commission that you are represented by counsel and I would request that you refer this letter to your attorney so that I may communicate with your lawyer. As you are represented by counsel, but did not identify him/her by name, I was unable to send this correspondence directly to your attorney. The intent of this letter is to offer to meet informally and privately with you and your attorney to discuss ways that Mr. Leonard can proceed with the development of his property for commercial purposes that would reduce the impacts on your property, that would give you the assurances you seek that what is approved will be completed and that your concerns will be considered early in the planning process. I certainly recognize that you have no obligation to meet with us, nor is there any assurance that we can find a common solution to your concerns. I do want to express that Mr. Leonard has a willingness to attempt to find a plan that addresses as many concerns of yours as possible. It is my experience that such efforts are far more successful when undertaken early in the planning process and outside of the context of a formal public hearing. An unfettered, off-the-record conversation is more likely to find some areas of agreement and accommodation than is the formalized debate style of indirect communication that a public hearing requires. If you do not want to involve your attorney but still wish to meet, we are willing to do so but I would urge you to consult with your counsel in determining if and how you would like to proceed. I look forward to a positive response from you or your attorney. Thank you for your attention in this matter. Minimum lot size required in the RC zone is 30,000 sq ft; minimum frontage required is 150 feet. 2. There is some zone change application history on this site. In October 2000, a zone change request to Buckland Gateway zone for this property was denied by the Commission. The reasons for denial were: a. Commercial development with access directly onto Buckland Road in this vicinity would create a safety hazard; and b. There was concern that commercial development would propose access onto Smith Street, which is residential in nature. The minutes of that meeting reflect Commission discussion that this area is probably no longer desirable nor appropriate as residential property due to the extensive amount of surrounding commercial property, but that access needs to be addressed. It was also noted that if the access issue is addressed, the Commission would be receptive to a reapplication. In 2003, another application for a zone change to Buckland Gateway zone was submitted, but the application was withdrawn prior to the public hearing. ion development depicts-this area as Economic 3. Section 8.3 provides criteria for the Commission to consider for all zone change applications. The criteria include but are not limited to: a. The goals, objectives, and recommendations of the Plan of Conservation and Development; b. The purposes of zoning and of these regulations; i r n conform to the access management requirements. The Commission's access management planning on Buckland Road included the provision of traffic lights spaced to eventually serve all Buckland Road driveways. This property does not have existing or future access to any of those traffic lights—but it does hwmmthe 4L v 4- the Plaza at Buckland Hills existing driveway. If this zone change is approved, Planning Dept requests the standard access management interconnection easement to the south to allow for a future interconnection with the Plaza at Buckland Hills, in accordance ith the provisions of Section 5.5 of the zoning regulations. Site design'Jao need to demonstrate that the interconnection is physically feasible, and the easement document will need to be filed on the land records. The standard easement requires that when the access is available on the adjoining property, the subject property must complete the interconnection and remove the stand-alone driveway. The Commission has consistently required the same treatment on Buckland Road properties since the access management regulations wer adopted. /I Ins .- s, va- rfeeQ o% 1/ s-an_r d:I.,_ w K,i - "_ a, s a-1 A 1/h L,t 4- -/QV, n A,. 6 ,t d ,cw 7. This property has the challenge of a steep grade from the road to the back of the property, with about a 30-foot difference in grade over a length of about 270 feet. The options for development include: filling up to Buckland Road level; terracing; or splitting the difference and filling to the midpoint of the grade. Filling up to Buckland Road would result in3a^high retaining wall along the back and Smith St side property boundaries. The abutting neighbor at 383 Smith Street will be most impacted by filling and retaining walls as there is not much space between the existing house and the Leonard property boundary. Terracing up to Buckland Road would make development difficult because the property is small. Staff recommend that the grade be split, thus reducing the retaining wall impact on the house at 383 Smith St and facilitating access to the adjoining Plaza at Buckland Hills driveway. 8. The Town Sanitarian has indicated a concern with drainage from this site potentially affecting existing septic systems. Detention will be needed for stormwater runoff. There is existing stormwater drainage in Smith Street but it is probably not adequate to incorporate drainage from the Leonard property. 9. There would be a buffer requirement on the east property boundary. The Restricted Commercial zone buffer requirement is 50 feet. The applicant has indicated this intention of seeking variances to setback and buffer requirements. +v IO.Public water is available in Smith Street.
