June 27,2014 dewormed Stafford 860-604- July 3,2014 8408 WebPhoto:1231235 MEMORANDUM TO: Michele Lipe, Director of Planning RE: Proposal to Add Breweries to Permitted Uses in Commercial and Industrial Zones DATE: June 24, 2014 In regard to the proposal to add breweries to the list of permitted uses, it should be recognized that such facilities will produce a very strong wastewater as measured in concentrations of total suspended solids (TSS) and biochemical oxygen demand (B.O.D). The Town South Windsor Water Pollution Control Authority Rules and Regulations (Section 6 "Use of the Public Sewer") prohibits the discharge of "...any pollutant or wastewater which will interfere with the operation or performance of the sewerage system."Among those pollutants listed under this regulation are any materials which exert a B.O.D. greater than 212 mg/I or T.S.S. greater than 238 mg/I. Typical brewery wastewater values average between 1,400 -2,000 mg/I for B.O.D. and 500 -700 mg/I for T.S.S. Furthermore, because brewery wastewater has a high concentration of organics and therefore requires a large amount of aeration, anaerobic treatment processes are preferred for wastewater treatment in the brewery industry to save energy and minimize sludge disposal costs. The Town's wastewater treatment facility uses an aerobic process for wastewater treatment. Therefore, breweries should be required to provide a system for pretreatment of its wastewater before discharge to the municipal sewerage system in order to comply with the Town sewer use rules and regulations and to avoid cost increases at the Town Water Pollution Control Facility that would be passed on to the other rate payers of the community. They must complete a plan review application and submit floor plans of the establishment and tasting room to the South Windsor Health Department (SWHD) for review and approval. SWHD will inspect the establishment prior to operation to ensure compliance with the approved plan. In addition, the establishment must meet all regulatory requirements of the Connecticut Department of Consumer Protection (DCP) - Liquor Control Division. SWHD is required to provide a signature on the DCP liquor permit application verifying that the establishment is in compliance with Connecticut Public Health Code regulations. If they have any questions regarding DCP licensing requirements, they may contact Agent Lewis at 860-713-6210. Breweries Zoning Amendment July 8, 2014 Planning Department Report 1. This amendment is in response to several inquiries our office has received and staff has crafted these regulations on behalf of the PZC to receive public input to allow breweries on a larger scale. Currently, there are no references to breweries in the Use Table of the zoning regulations; however a brewery would be considered as a permitted industrial use under the manufacturing category: the processing or manufacturing of component or goods. This use currently would not be permitted in any other zones. 2. This proposal would accomplish several things: o Add to Section 10 Definitions for: Brewery, Microbrewery and Brewpub - These definitions were standard to what other regulations had for definitions o revise Bulk Table 4.1.1A Permitted Uses in the Commercial and Industrial Zones to add Breweries as a permitted use (with site plan approval) in the Industrial zone (I); Microbreweries and Brewpubs as permitted uses (with site plan approval) in the General Commercial zone (GC) and by Special Exception Use (with site plan approval) in the Restricted Commercial zone (RC). o Define additional provisions for the uses; currently as proposed in the Industrial zone- accessory uses would be limited to use of 20% GFA as is currently allowed in the industrial zone. The Commission may want to talk a little more about this as our parking regulations do not require additional parking if such as area is used for a "tasting room" open to the public. The Commission may want to consider requiring this as a special exception use if there are going to be other uses on site. o In the Commercial zones, the additional provisions allow spell out the maximum number of barrels to be produced in a given year; wholesale and retail sales, tasting rooms and outdoor dining. Parking and other site design considerations would be evaluated as a part of the site review process. 3. The infrastructure impacts of proposed uses should be evaluated at the time of a text amendment. I have provided you with two correspondences for the record. Fred Shaw, Superintendent of the Water Pollution Control Facility has provided a memorandum dated June 24 addressing requirements that will have to be met related to discharge from these types of facilities into the town sewer system. Sherry McGann, Environmental has provided information related to the Public Health Code requirements. We will have the secretary read them into the record. 4. Other environmental impacts and traffic impacts would be evaluated with the individual site plans submitted. All of the zones being considered for these types of uses are either state highways of collector roads. Zoning map shows the zones 5. The Town Plan of Conservation and Development does not speak specifically to this issue; however does express the need to create a balance between allowing new types of businesses to help build the tax base while protecting important resources and preserving those qualities that contribute to the high quality of life residents enjoy. Route 5 and Sullivan Ave are specifically targeted as areas for commercial development. 6. The Capitol Region Council of Governments has reviewed this amendment as required and has forwarded the following report: ***CRCOG Report*** If this amendment is approved, the Commission must find that it is in conformance with the Town Plan and must set an effective date.
