FEBRUARY 26, 2014 The site is a 6.16-acre parcel on the east side of Clark Street in South Windsor. The property is an open field with 692 feet of frontage on Clark Street. Clark Street is a minor collector road. The site is bordered to the north and west by Westage at South Windsor Condominium and to the south Connecticut Light and Power Company. There are single family residences on the west side of Clark Street. See page A-1 The proposal is to change the zone from Rural Residence (RR) to Designed Residence Zone (DRZ). Eighteen single-family detached residences served by a 600 foot long town road are proposed. Open space is proposed between Clark Street and the developed area. A sidewalk is proposed along Clark Street. See page A-2. UTILITIES: The homes will be served by public sewer and water which are available in Clark Street. The site is shown South Windsor's Sanitary Sewer Service area map as Potential Future Sewer Service — areas not served today but could be connected to the sewer system. Natural Gas is available at Margaret Drive and Pleasant Valley Road and will likely be brought from one of these two locations. Storm drainage from the site will be directed to a detention pond at the southwest corner of the site. The stormwater will be released slowly from the pond before it enters the storm drainage system in Clark Street so that there will be no increase in flow off the property. TRAFFIC VOLUME: The State of Connecticut Department of Transportation performed a traffic count on Clark Street just south Pleasant Valley Road site on April 5 & 6, 2010. See page A- 3. This count found that the average daily traffic is 4000 vehicles and that the peak hourly volume is 449 vehicles per hour. See page A-4. "Trip Generation," published by the Institute of Transportation Engineers, has performed studies and established trip generation rates for various land uses. Using this reference and given an 18 Dwelling Unit, it is estimated that the development will generate about 215 trips per day and about 22 trips during the pm peak hour. See page A-5 and A-6. The average daily traffic is estimated to increase from 4000 vehicles per day to about 4215 vehicles per day. The peak hourly volume is estimated to increase from 449 vehicles per hour to 471 vehicles per hour. It is estimated that the roadway has a capacity of 2000 vehicles per hour. This is more than adequate to carry the anticipated traffic. South Windsor Police conducted a traffic count on Clark Street between Deming Street and Stanley Street in August 2012. See Pages A-7 and A-8. This count found the average daily traffic to be 2675 vehicles, the peak hourly volume to be 337 vehicles per hour, and the 85 percentile speed to be 42.4 miles per hour. SIGHT DISTANCE: Clark Street has a posted speed limit of 30 miles per hour. For a design speed of 45 miles per hour, a sight distance of 500 feet is required. See "Connecticut Highway Design Manual," Connecticut D.O.T., Figure 11-2C. The sight distance from the site exit was measured. From the exit driveway, there is a sight distance in excess of 500 feet in each direction. See photos below. Therefore, the sight distance is adequate. a Sight Distance Looking Right. Town Public Improvement Specifications limit the number of driveways in cul-de- sacs to 3. Four (4) driveways (units 10, 11, 12, 13) are shown in the proposed cul-de-sac per Town standards. One of these driveways needs to be moved out of the cul-de-sac. 2. The sanitary sewer layout crosses the proposed private open space by Clark Street. The sanitary sewer should be entirely within the proposed right-of-way for the new street. 3. Any existing storm drainage or sanitary sewer or utilities along Clark Street that conflict with the proposed road must be relocated. 4. Several yard drains are shown in the back yards of units and tie in to the street drainage system. All yard drains are to be privately owned and maintained. Some of these yard drains may be connected into the existing Clark Street drainage system on the north side of the property, separate from the proposed drainage system for this new road. 5. The Town will review the storm water system submitted with the site plan and comment at that time. Revisions may be required including relocating the inlet and/or outlet to the detention basin. The Town may want the detention basin outlet connected to MH 2 instead of the catch basin just uphill. A review of the design of the storm water system in Clark Street and analysis of the impacts of this new development will be required. 6. The proposed detention basin inlet and outlet need to be accessible so they can be maintained. 7. An easement to the Town is needed over the proposed detention basin if the applicant wishes the Town to maintain this. 8. All utilities must be underground in the proposed road. Any service boxes, or transformers must be flush with the ground, especially in the cul-de-sac. 9. the grading for this development must be shown on the site plan and is expected to be entirely on this parcel or rights to grade obtained from neighboring parcels. 1 10. The proposed sidewalks must be at least 4 feet from the curb, and should go behind any conflicting utility poles. Sidewalks must go around any existing utility manholes, gate boxes, or other devices or these utility devices can be relocated. Provide handicap ramps in accordance with ADA standards. 11. All proposed street trees should be at least 25 feet off the edge of road so they do not grow into utility lines and sidewalks in the future. 12. WPCA review and approval of the site plan is required. Lipe, Town Planner Date: 3/24/2014 Re: Application#14-21 P, Clark Estates Zone Change/General Plan Planning Department review comments for Clark Estates 1. The property address in the zoning data block must be corrected. Information must be submitted related to the affordability of the units proposed and how the applicant intends to keep the units affordable over time. 'S, RV/boat trailer storage area? How is this being handled? 4. Please show on the plans the open space area that meets the recreation requirement of 600 square feet of developed recreation land per unit or 3,500 sf of undeveloped open space. (Note that detention area does not count toward the open space requirement—it would be helpful if you would clearly identify what is considered part of the 1.45 acres of open space.) Also, we would recommend that the gazebo be pulled back away from the road. 5. Density calculation should refer to the percentage of units required to be affordable. The sizes and unit types should be identified in the zoning data table 6. Landscaping: seems sparse. • Is a berm proposed along Clark Street? • Development must be landscaped on all sides, including open space sides. Although a buffer is not required, the intent of the 40 foot setback was to allow for landscaping screening around the perimeter border. The attached spreadsheet documents this calculation and assumptions applied. The spreadsheet will allow you to alter assumptions for factors such as monthly housing expenses, mortgage term and interest rate, and down payment. Based on my calculations using the 8-30g-8 formula, estimated affirdable sales prices are as follows for a household earning 80%of the Hartford Area Median Income: • 2-Bedroom Unit,20%Down Payment=$281,373.52 • 3-Bedroom Unit,20%Down Payment=$340,513,83 • 2-Bedroom Unit, 10%Down Payment=$250,109.79 • 3-Bedroom Unit, 10%Down Pay ment=302,678.96 The maximum allowable down payment is 20%of sales price. As you are aware, in order to qualify as an affordable unit, deed restrictions regarding buyer income limits and sale/resale prices are required, I hope this information is helpful. Please let me know if you have further questions. Sincerely,J 1 - Mary Ellen Kowalewski' Director of Policy and Planning cc. For the duration of this covenant or restriction, this dwelling unit may be sold only to persons and families whose annual income does not exceed _% (insert 60% or 80% as applicable) percent of'median income' as defined in subsection 8-30g-1(10) of the Regulations of Connecticut State Agencies, applicable to this unit as specified in an affordability plan as on file with the [municipality). In addition, this unit may be sold or resold only at a price equal to or less than the price determined using the formula stated in section 8-309-8(a), or the formula stated in section 8-30G-8(B), as applicable, of the Regulations of Connecticut State Agencies. (b) In order to assist In any determination that the sale or resale price of an affordable housing dwelling unit complies with applicable limitations, any owner, seller, purchaser or prospective purchaser of such dwelling unit may be required by the administrator of the affordability plan to provide documentation of the annual income of the person or family who will occupy the dwelling unit and of compliance with applicable sale price or resale price limitations, which documentation shall be available upon request to the zoning enforcement authority of (the municipality). Maximum housing payment calculations in set-aside developments (a) The maximum price for any affordable unit that is sold or resold within a set-aside development, for the period of affordability restrictions, to a household earning eighty percent of the median income or less, shall be determined as follows: (1) Step 1. Determine area median income and the statewide median as published by the U.S. Department of Housing and Urban Development for the subject municipality, and use the lesser of these figures. (2) Step 2. Adjust median income identified in Step 1 by family size by assuming that 1.5 persons will occupy each bedroom of an affordable unit, except in the case of a studio or zero-bedroom unit, in which case 1.0 person shall be assumed. Family size adjustment shall be made with reference to the following percentages: NUMBER OF PERSONS IN FAMILY 1 2 3 4 5 6 7 8 PERCENTAGE 70% 80% 90% I00%o 108% 116% 124% 132% ADJUSTMENT (BASE) The family size adjustment that involves a half person (such as 4.5 persons) shall be calculated by taking the midpoint between the relevant figures above and below the half. For example, the adjustment for a 4.5 person household is 104 percent. (3) Step 3. Calculate:eighty percent (80%) of Step 2. (4) Step 4. Calculate thirty percent(30%) of Step 3, representing that portion of household income deemed to be used for housing costs. (5) Step 5. Divide step 4 by twelve (12) months to determine the maximum monthly housing payment. (6) Step 6. Determine by reasonable estimate monthly housing expenses, including real property taxes; real property insurance; any common interest ownership or similar fee required of all unit purchasers or owners; and heat and utility costs, excluding television, telecommunications, and information technology services. (7)Step 7. Subtract Step 6 from Step 5 to determine the amount available for mortgage principal and interest. (8) Step 8. Using the amount resulting from Step 7, apply a mortgage term and interest rate that is commercially reasonable and available to households likely to apply to purchase such units, in order to determine the financeable amount. (9) Step 9. Calculate down payment, which shall comply with subsection(c) of this section. (10) Step 10. Add Steps 8 and 9 to determine the maximum sale or resale price. (b) For a unit required to be sold or resold to a household earning sixty percent (60%) or less of the median income, the formula stated above shall be used, except that in Step 3, sixty percent (60%) shall be used instead of eighty percent (80%). (c) The maximum allowable down payment used in calculating the maximum sale or resale price of an affordable unit that is sold shall be.the lesser of twenty percent (20%) of the total sale price or twenty percent (20%) of the Connecticut Housing Finance Authority (CHFA) maximum sales price limit for a comparably-sized unit in the area, as published by CHFA. (d) The maximum monthly payment for a rental unit in a set-aside development, for the period of affordability restrictions, for a household earning eighty percent of the median Income or less, shall be determined as follows: (1) Step 1. Family size adjustment shall be made with reference to the following percentages: NUMBER OF PERSONS IN FAMILY 1 2 3 4 5 6 7 8 PERCENTAGE 70% 80% 90% 100% 108% 116% 1241% 132% ADJUSTMENT (BASE) The family size adjustment that involves a half person (such as 4.5 persons) shall be calculated by taking the midpoint between the relevant figures above and below the half. For example, the adjustment for a 4.5 person household is 104 percent. (3) Step 3. Calculate eighty percent (80%) of Step 2. (4) Step 4. Calculate thirty percent (30%) of Step 3, representing that portion of household income deemed to be used for housing costs. (5) Step 5. Divide Step 4 by twelve (12) months to determine the maximum monthly housing payment. (6) Step 6. Determine the fair market rent for a unit with the same number of bedrooms In the subject municipality as published by the U.S. Department of Housing and Urban Development. (7) Step 7. Multiply the U.S. Department of Housing and Urban Development fair market rent as determined in Step 6 by one hundred twenty percent (120%). (,8) Step 8. The maximum monthly housing payment for occupants of the subject rental unit shall be the lesser of the calculations in Steps 5 and 7. Title to the planned development unit in question is hereby conveyed subject to the following restrictive covenants which will run with the land for a period of 15 years from the date of this conveyance (the "Affordability Period"), and which shall be binding on the Grantee(s) and his, her or their heirs, administrators, executors, successors and assigns: (a) This planned development unit is an affordable housing "Dwelling Unit" under Section 3.3 of the Town of South Windsor Zoning Regulations for the Designed Residence Zone (DRZ),the Town's "Affordability Plan", and under the applicable regulations for the State of Connecticut Department of Housing (or its successor) in effect on the date of original zoning application for the DRZ development within which this Dwelling Unit is located, and is therefore subject to a limitation, at the date of purchase, on the maximum annual income of the household that may purchase the Dwelling Unit, and is subject to a limitation on the maximum sale or resale price. These limitations shall be strictly enforced, and may be enforced by the "Zoning Enforcement Officer" for the Town of South Windsor as to compliance, and by the "Department of Human Services" for the Town of South Windsor as to the determination of maximum sale or resale price, under the provisions of the DRZ and to the Affordability Plan. (b) For the duration of Affordability Period these covenants require that this Dwelling Unit may be sold only to persons and families who annual income does not exceed eighty (80% )percent of`median income' as defined in subsection 8-30g-1(10) of the Regulations of Connecticut State Agencies, applicable to this Dwelling Unit as specified in the Affordability Plan. In addition, this Dwelling Unit may be sold or resold only at a price equal to or less than the price determined using the formula state in section 8-30g-8(a), or the formula stated in section 8-30G-8(b), as applicable of the Regulations of Connecticut State Agencies. (c) During the Affordability Period, in order to assist in any determination that the sale or resale price of the Dwelling Unit complies with applicable limitations, any owner, seller, purchaser or prospective purchaser of such dwelling unit may be required by the Department of Human Services, as the administrator of the Affordability Plan,to provide documentation of the annual income of the person or family who will own and occupy the dwelling unit and of compliance with applicable sale price or resale price limitations, which documentation shall be available upon request to the Zoning Enforcement Officer. Request for a zone change from RR to Designed Residence Zone for 6.12 acres and a General Plan of Development for an 18 unit development to be known as `Clark Estates', on property located on the easterly side of Clark Street, approx. 380 feet south of Pleasant Valley Road. 2. The subject site is adjacent to existing multi-family zoned property along the northerly and easterly borders. There are three single family homes along Clark Street to the west that are in the RR zone and the vacant land to the south is also in the RR zone. A zoning map has been provided. 3. The proposal is for 18 single family homes as a part of a common interest community. Twenty percent of the units to be "affordable units" which equals 4 units. This percentage is based on the density the applicant is seeking — in this case 3 units per acre. These affordable units would count towards the state's goal of each community 10% of their housing units affordable and would be the first unit's deed restricted in this fashion. (The town would need 185 more units to meet that goal). The developer's attorney has provided a sample document they would propose to use as a covenant on the land records. One concern we have raised with the applicant is the duration of the deed restriction. We would recommend a 40 year restriction to be consistent with the affordable housing statute. 4. Section 8.3 includes criteria for zone change, including but not limited to: a. The goals, objectives, and recommendations of the Plan of Conservation and Development; b. The purposes of zoning and of these regulations; c. Changes that have taken place in the rate and pattern of development and land use within the Town and adjoining communities; d. The supply of land available in the present and proposed zone; e. The physical suitability of the land for the proposed zone; f. The impact on the capacity of the present and proposed utilities, streets, drainage systems, and other improvements; g. The general character and zoning of the neighborhood; h. Impacts on the surrounding area; 1 i. Traffic congestion impacts; j. The impact on surrounding property values; k. The environmental impacts; 1. The health and general welfare of the community; m. Neighborhood acceptance weighed against community needs; and n. The protection of historic factors. The Town Plan "Future Land Use Map" indicates that this residential area to be sewered and is serviced by public water. The Housing Element of the Town Plan of Conservation includes goals that are relevant to this application, including: • Allow flexibility in meeting emerging housing preferences and needs — allow a multi-family type development as a transition. This is the first project of it type approved since 1996 providing for smaller households, and incorporating energy efficient measures in their project. • Monitor Housing Affordability - Town could encourage affordable housing and provides such tools as density bonuses to create affordable units. 5. A zone change is the appropriate time to discuss traffic impacts. The applicant's traffic report indicates that the area roadway network is sufficient to accommodate traffic generated by the proposed development. 6. The purpose of the general plan is to show the planned use and layout of the property if the zone change is approved, including the general layout of utilities, drainage, open space/recreation areas. The information depicted in the General Plan is meant to be viewed as general information, with engineering details to be provided at the site plan stage. This two-step method provides the opportunity for the Commission to determine whether the designed residence use is appropriate for this site, and to make meaningful revisions if appropriate, prior to the applicant spending a substantial amount of money on full engineering. Special exception and site plan of development approval would be required prior to any construction on this site. 7. The general plan shows a new town road built to town standards. A sidewalk is proposed along the Clark Street frontage as well as one side of the new road. 8. Proposed impervious coverage is about 24%, 30% allowed. The applicant has provided a breakdown of unit types, open space requirements, parking requirements in accordance with the Designed Residence regulations. 9. The DRZ zone requires 600 sq ft of developed recreation area per unit or 3,600 square feet of undeveloped recreation area pre unit which equates to 1.45 acres. The applicant has designated open field/lawn area in the front of the parcel along the 2 Clark Street frontage as passive recreation and is adding a walking trail with gazebo. The walking trail as shown is 4' wide with bluestone. 10.There is no buffer requirement along all property boundaries as was required in past developments. In 2007 the PZC changed this regulation to require a 40 foot perimeter setback around the entire parcel and within that area landscaping screening and treatments are expected. The applicant may want to consider a soft berm or more of a variety of landscaping along the Clark Street frontage. 11.All units are proposed to be single-family units and will range in size and unit type. The affordable units must be dispersed among the other units. The applicant should be aware that placement of decks, pools and sheds will be very limited for these units. 12.There are no regulated wetlands on this site. IWA/CC approval is not required for the general plan; if PZC approves this application, then the applicant will need approval from the IWA/CC for an erosion and sedimentation site plan. 13.Public water and sewer are available. The applicant's engineer has indicated that the utilities have adequate capacity to support this development. 14.Trash disposal will be handled through the use of individual containers 15.The site is more than 500 feet from a Town boundary, so no referral to CRCOG was required. 16.If this zone change is approved, the Commission must state on the record that you have found the zone change to be consistent with the Town Plan of Conservation and Development. 3 Comments for Tuesday April 8 P & Z Public Hearing on Clark Estates development on Clark Street, South Windsor. This route along Clark Street is and will be a main connection to the Bike route on Chapel Road and to the Bike way in Manchester going to the East Coast Greenway. Young children on bicycles heading for the Bikeway to the East Coast Greenway should be provided with a safe off Road route. An 8' Multi use trail would be the best for this purpose and would provide for passing safety for young bicyclists to pass other bicycles or pedestrians. As an alternative of a 5 or 6' straight sidewalk would provide for some help for safety concerns but would be insufficient with future increases in use. Mr. Todd Mannarino 400 Chapel Road, Unit 3F South Windsor, CT 06074 Dear Mr. Mannarino: Re: Appl. 14-21P Mannarino Builders, Inc. Zone Change and General Plan of Development We are pleased to advise you that at its May 6, 2014 meeting, the Planning and Zoning Commission voted to approve the above referenced application for a zone change from Rural Residential zone to Designed Residence zone and General Plan of Development for a development to be known as Clark Estates on property located on the easterly side of Clark Street, approximately 380 feet south of Pleasant Valley Road. This approval is based on plans prepared by Alford Associates, Inc. dated February 26, 2014 as revised, and is subject to the following modifications: 1. This approval is for a Zone Change from Rural Residential to the Designed Residence Zone for 6.2 acres and a General Plan of Development showing 18 single family units. Twenty percent (20%) of the units must be affordable. The affordable units must be dedicated by deed restriction for a period of forty years in a manner as the Town may require. The developer shall work with the Town on the Affordability Plan and submit deed restriction documentation at the time of the special exception/site plan request. 2. The affordable units shall be evenly dispersed throughout the development. Generally no affordable units shall be located adjacent to another affordable unit. Affordable units shall not be apparent by exterior appearance, and shall comprise a variety of unit types. 3. The Commission notes that this approval is for a General Plan of Development, which does not address all engineering and site design details. The applicant must submit an application for a special exception and site plan of development approval, at which time the Commission will review all specific details of the project, including but not limited to the following concerns raised during the Zone Change/General Plan application process: • Storm drainage design at the site plan stage must thoroughly and adequately address storm water quality and quantity, including both on-site and downstream impacts • All utilities (including pedestals)must be placed underground. • Additional landscaping variety must be provided to break up views from Clark Street. The applicant may want to incorporate a soft berm into this area. 4. All yard drains shall be private and access to the detention basin for maintenance must be addressed. 5. The sidewalk along Clark Street should be slightly east and show a gradual transition around the utility guide wires. An easement to the town is required in areas where the sidewalk is shown on private property. 6. Trees and hedgerows must be preserved to the maximum extent possible along the southeastern border;preservation details to be shown on the site plan. 7. Placement of trees along the street frontage should be located to avoid conflict with utilities. 8. Water Pollution Control Authority is required. In the granting of this zone change, the Planning and Zoning Commission found the zone change to be in conformance with the Town Plan of Conservation and Development. Within ninety days, a black and white mylar zone change map (1" = 40') with an A-2 certification, showing the distance and bearings of all boundary lines and acreage of the property where the zone change was granted, with this approval letter reproduced thereon, must be submitted. The map shall be drawn in accordance with the rules and regulations of the State Board of Registration for Professionals Engineers and Land Surveyors and shall be stamped and signed by a Registered Land Surveyor. The zone change map must be submitted on black and white mylars, with this approval letter thereon, together with three blueprint copies of the Zone Change. Black and white mylars of sheets GPD-1 and EXC-1 of the General Plan of Development and boundary surveys must also be submitted. After the mylars have been stamped and signed by the Commission, they will be returned to you for filing in the office of the Town Clerk.
