The landscape materials sales & storage business' special exception application(Article 4, Table 4.1.1A), was approved by the Commission on July 28, 2009. The use is proposed pursuant to regulations adopted on January 13, 2009. The level, 1.65 acre site is bordered on the west by the railroad line (across Route 5 from Nassau's : Furniture) and by a recently renovated residence at 275 Strong Road(occupied by family members), on the north by Strong Road, on the east by the access drive serving a Connecticut Light and Power facility, and on the south by CL&P. The property owners, Arthur and Cindy Silvestri, purchased this property in June, 2008. It is the site previously occupied by the Patria Greenhouses (Bruno Patria). The entire surrounding area is zoned Industrial, and is in the heart of South Windsor's Route 5 industrial corridor. There are some non-conforming residential uses in the area, including the house to the west of the site, and residences on the north and south sides of Strong Road. Two buildings are on the parcel. The primary structure is a 2,982 sq. ft. landscape center building erected in 2010 with a wrap-around porch to house offices of South Windsor Stone&Landscape Supply as well as East Hartford Sand& Gravel, a small retail showroom, a conference room, and a warehouse area for storage and processing of landscape materials. It has dark green sloping roofs, : tan exterior walls, cupolas, windows and doors. The second is a 1,050 sq. ft. hoop storage building, also for the storage and processing of landscape materials. SW Stone and Landscape Supply also contains a 12 car parking lot including one paved handicap space, an outdoor display/sales area for such items as flowers, nursery stock, landscape materials, as well as Christmas trees and other seasonal items. Regulations limit the area allowed for both interior and/or exterior retail sales to a maximum of 20%of the building gross floor area and exterior display, storage and yard areas. Therefore, the landscape center building has been limited to 596 sf for retail purposes, and the : exterior yard will be limited to 6,542 sf for retail purposes. The balance of the buildings and site is thus for wholesale operations. Customers of the wholesale operation include contractors and garden centers. To the rear of the parcel are 18 bins in a yard for the storage, sale and processing of landscape materials, e.g.,topsoil, crushed brick, aggregate, stone, tailings and pavers. This area • G:\jobs\2646\Docs\2646 Silvestri Revised PZC Narrative 8-5-2013.doc : includes a mobile topsoil screener(screener area shown on the site plan). The mobile screener's operation was recently observed by the Town's ZEO, accompanied by a DPI engineer who took sound measurements from adjoining residential property boundaries. The sound data indicated that the emitted sound met all regulatory requirements. A dumpster pad and water quality basin was installed in the southwest corner(right rear) of the site. After-hours commercial vehicle parking is to the rear. The property's outbuilding has been razed. • Primary access will be from a driveway entrance on Strong Road, which has acceptable sight lines. Reciprocal travel easements were not granted between CL&P and the applicant, thus a secondary means of ingress and egress over the existing CL&P driveway is no longer an option. A secondary driveway over the adjoining property at 275 Strong Road, also owned by the Silvestri family,is proposed to divert some truck and other vehicular traffic away from the residences opposite the site on Strong Road. • Yard Hours—We propose to modify the public hours of operation(yard& office) as follows: Monday thru Friday, 7:00 A.M. to 5:30 P.M.; Saturday, 7:00 A.M. to 5:30 P.M. (April 1 thru Labor Day), otherwise 7:00 A.M. to 2:30 P.M. (Labor Day thru March); and Sunday 10:00 A.M. to 2:00 P.M. (no material screening on Sundays). The highest business volume is in the spring and early summer, when the demand for landscape materials is most pronounced associated with commercial and residential landscape projects. The biggest month is May. Unfortunately, Strong Road was essentially shut down during this year's prime sales period while Strong Road was being reconstructed by the Town's contractor. This substantially impacted sales. Retail customers avoided the yard. We have reviewed the commission's special exception review criteria, as enumerated in Section 8.4, and we believe the modified landscape materials sales& storage facility, as described herein, in the prior submissions,in the documents/plans provided, and in our testimony at the forthcoming public hearing, is consistent with the goals and objectives of those 14 criteria. ofesskmah • G:\jobs\2646\Docs\2646 Silvestri Revised PZC Narrative 8-5-2013.doc P.O.BOX 1167 425 SULLIVAN AVENUE a SOUTH WINDSOR,CT 06074 PHOW'860.291.875S FAX: 860.291.8757 SSI01'15 www.designprofessionalsinc.com CIVIL & TRAFFIC ENGINEERS/ PLANNERS / SURVEYORS / GIS ANALYSTS / LANDSCAPE ARCHITECTS Serving Connecticut, Massachusetts, Rhode/s/and • August 5,2013 • VIA CERTIFIER MAIL Abutter Name Abutter Address Re: South Windsor Stone&Landscape Supply,LLC 287 Strong Road South Windsor,CT Special Exception&Site Plan Modification Application Dear Property Owner: In accordance with the Rules&Regulations of the South Windsor Planning&Zoning Commission, you are hereby notified that an application has been filed on the property located at 287 Strong Road, abutting your property, and is subject to a hearing by the Planning&Zoning Commission. The application and plans are on file with the South Windsor Planning Department. Please submit revised plans prior to the final engineering and planning review. General Comments The site plan submitted does not reflect the property accurately and is very difficult to determine what is proposed new versus what already exists. It appears there have been changes made from the original approval. The basis for this site plan modification should be the as-built and the plans should easily identify changes being proposed to what is currently on the site. The zoning data block should reflect current and proposed conditions. The new truck traffic pattern proposed is problematic for several reasons: 1) The proposed drive would bisect the existing residential property that is a separate lot and could be sold as a residential lot at any time; 2) The access to that residential lot traverses private property. There is no indication of an easement for use of that driveway. Documented rights from the railroad property; 3) it appears that the driveway goes over a swaled area (based on the original approval) Narrative Comments What is going to be screened? Is the screening seasonal or year-round? Will screening occur during all operational hours, or on a reduced schedule? Will there be a change in the truck/vehicle traffic from what was originally proposed and approved? Public hours of operation are proposed to change —will actual operation hours change as well (screening/processing, deliveries...)? 1540 Sullivan Avenue,South Windsor,CT 06074 PH 860-644-2511,ext.253 Fax 860-644-7280 e-mail michelerlipeAsouthwindsor.org r Landscaping plan Additional screening should be provided along the easterly property line to ensure screening of the bins (a cross section illustrating how the four foot high arborvitaes will screen the rear bins and outdoor storage of vehicles would be helpful). The concrete blocks have been moved by the applicant in the past and we are looking for a permanent elimination of that curb cut. • Page 2 OCANNED TRAFFIC STATEMENT SOUTH WINDSOR STONE&LANDSCAPING,LLC 287 STRONG ROAD SOUTH WINDSOR,CONNECTICUT South Windsor Stone&Landscaping,LLC, is proposing to construct a facility at 287 Strong Road. The site is 1.65 ac.located on the southerly side of Strong Road, easterly of the adjacent Connecticut Southern Railroad. The parcel contains few remains from previous buildings.Historically, the site had contained a number of greenhouse buildings and storage buildings, where Patna Greenhouse once operated. The proposed development of the site consists of the construction of three buildings: a 2,982 S.F.Landscape Material/Garden Center building, and two self-storage buildings (25'x50' and 50'x60').In addition, the site will provide a gravel parking area,a paved handicap parking space, and gravel storage areas. The site proposes access to Strong Road via two driveways. The main entrance drive provides direct access from the lot to Strong Road. The second driveway is proposed to access onto a Right Of Way owned by the adjacent property owner(N/F Connecticut Light and Power)which extends northerly, intersecting with Strong Road.Plans depict that this right of way access encroaches on the applicants parcel.'The secondary driveway will not be constructed until a"Right of Access"has been granted by the adjacent.property owner. The site will be used for a number of purposes including a garden center/nursery business providing wholesale and retail sales of a variety of landscape material,self-storage buildings available for lease, and a yard for display and storage of landscape material. The site will have in general, two separate uses;the operation of the nursery/garden/landscape material center business, and the lease of self-storage units. Trip generation for the 17 self-storage units is expected to be negligible as these units are typically operated by patrons who come to deliver, and allow items to remain in storage for some time. These units may experience infrequent visits to add or claim items on a monthly basis. Using the Nursery(Garden Center)generation rates per employee and assuming that only 2-3 employees would be on-site for sales and general business operation, the office and on-site sales would generate the following: Landscape Material Business Trips Weekday A.M. Peak Hour P.M. Peak Hour Generation rate 22.173 0.750 2.387 Vehicle Trips 67 2 SCANNED The South Windsor Stone&Landscaping business will consist of the storage of the hauling trucks and materials at the site. During the normal course of business, the employees will arrive at the site and remain for the day. The company vehicles are available for delivery of landscape materials to a job site. These trucks may also be used to bring stored material in.Assuming all employees arrive during the peak hour and 1 employee leaves(for pickup and/or delivery)during the peak hour,(2 employees remain in the office),there would be a total of 4 vehicle trips during the A.M.and P.M.peak hours. During the course of the day, there may be additional vehicle trips to pick up material, material deliveries etc. We would not expect these additional vehicle trips to average over 1-2 additional trips per hour. Over the course of the day,an additional 10 vehicle trips would be expected. A summary of the total vehicle trips for the business are as follows- Total Vehicle Trips . Weekday A.M. Peak Hour P.M.Peak Hour Vehicle Trips 85 6 11 The above estimates are believed to be conservative. The employees are expected to arrive for work prior to the hour of traffic on the a roadwaysystem. The sight line for the proposed access driveway onto Strong Road has been reviewed for adequacy. The posted speed limit for Strong Road is 30 mph. The eastern sight distance extends over 500 ft.to the intersection of Strong Road and Nutmeg Road North. The existing sight distance in the western direction is over 400 k through the intersection of U.S.Route 5(John Fitch Boulevard)and Strong Road. If this sightline were to become obscured by vegetation on the adjacent property, the available sightline from the driveway looking west within the limits of the site would be 250',which is the required stopping site distance for 35 mph design speed. 43 ORDINANCE #145 NOISE POLLUTION CONTROL ORDINANCE 1. Appl. 09-24P—South Windsor Stone&Landscaping Supply,LLC-request for a special exception to article 41 Table 4.1.1A and site plan approval for a landscape material sales and storage/warehousing business property located at 287 Strong Road, I zone Peter DeMallie, President of Design Professionals presented the application. The owners of the property are Art&Cindy Silvestry. On January 13,2009 the Planning&Zoning Commission approved a zoning amendment allowing for landscape materials sales and storage business within the Industrial zone as a special exceptions use. The location of the site is 287 Strong Road. In the past it was the location of a green house. The site is 1`.65 acres in size 228 ft.of frontage. The site has 12 parking spaces., There is an existing 20 ft. wide access way, that is owned by CL&P. The applicant has been in Communication with CL&P for an easement(see exhibit A). The purpose of the application is to establish landscape materials sales and storage business. The applicant is proposing three new buildings;the first and primary, one is in the northwest corner of the site. This is the landscape center building and it has a wrap around porch. Its uses will be office, some retail conference room and warehouse area for processing as well as storage for landscape material. The second building will have 12 self storage units. To the northeast of that there will be an additional building with 5 additional storage units. There is a 12 car parking.lot with one handicap space that will be paved. There will be an outdoor display and sales area for seasonal items such as flowers,Christmas trees and landscape materials. To the rear of the parcel there will be 13 bins for landscape materials and will be hidden by the tree buildings those will be 5 storage buildings. The overnight parking of vehicles will be to the rear of the buildings by the storage bins. The 18 bins will be separated by concrete blocks and in front of those will be a 60 ft area for maneuvering vehicles in that are. Access to the site will.be from the primary driveway on Strong Road and if permission is granted from CL& P the applicant will be utilizing the 20 ft access way as a second access drive way. The building was moved back 44'ft. in the event the town ever decides to widen Strong Road. The.hour of operation are Monday- Friday 7:30 AM to 5:30 PM Saturday from 7:OOAM-5:OOPM. Karen Isherwood,Project Manager and Professional Engineer with Design Professionals Inc. went over the drainage and traffic report on the site. The smallest self storage building is 12.1 ft. tall and the larger building is 14.2 ft. in height. There is an existing chimney that remained on the site from the previous buildings that will be removed. The site is currently vegetative with the site drains southwesterly to the rear of the property where there is an existing swale. That Swale heads easterly to the adjacent property and enters the storm drainage system on Strong Road. There is a proposed utility connection and also tie into the sewer on Strong Road. The building will be served by a private well there is no public water available. A Traffic statement was submitted. (See exhibit 13) i t The storm water management plan is that all runoff will enter the basin on the lower left hand side of the property. A majority of the site will be surface is going to be surface flow over the gravel and into the basin 2 - TOWN OF SOUTH WINDSOR0-0 • MINUTES PLANNING&ZONING COMMISSION TUESDAY,JULY 28 2009 PUBLIC HEARING/REGULAR MEETING' COUNCIL CHAMBERSIMADDEN RM,7:30 p.m. directly then there is a small potion'of runoff which is limited to the 12 space parking lot and will flow to the north. The basin will discharge through a pipe and spreader and back to the swale ditch that's located on the site. A silt fence will.protect all areas around the development and the stock pile area. Tim Starr representing New England Buildings described the architecture of the buildings'proposed. The buildings are wood frame and very attractive. The storage buildings are designed to look like carriage houses and the main buildingwill have a wrap around porch.and the storage units will match the buildings- Ben amin Wheeler, landscape Architect presented the landscape plan. Foundation plantings will be planted between the main building and the parking lot. There will be a mix of shrubs, evergreen, deciduous, and perennials. Between the main entrance drive"and the 12 car parking lot there is a landscape island that is 5.15 %of the entire parking.area. In that area there are a few shrubs and trees. The landscaping will help to screen the bins in the back portion of the lot. In the event that the 2 storage buildings are not built, the applicant proposes to have a 6ft vinyl fence be put up instead. There is a row of forty-three arborvitae on the eastern property line that can reach 10-12 ft at maturity. ,Due to a review comment from the Architectural Design and Review committee, the applicant has extended the screen further to cover from the secondary access drive all the way to the north edge of the eastern storage building. The applicant intends to save the 60 inch maple tree near the second entrance ipe had a Planning report. 1. Request for special exception to Table 4.1.1A and site plan approval for a landscaping supply center and two self-storage unit buildings on property located at 287 Strong Road, I zone. 2. The proposal includes,a 2,982 sf landscaping material building.including a showroom and office area with a wrap around porch. The self storage units.include two buildings, 1,250 sf and 3,000 sf respectively. 3. The lot size is 1.65 ac; minimum lot size allowed is 30,000 sf. Frontage is 228 feet;minimum allowed is 100 feet'. Front yard setback is 36.5 feet, 35 feet allowed. 4 Maximum impervious coverage;allowed is 65%allowed; 54.5% shown. 5. Parking requirement(retail, office and warehouse)is 12 spaces; 12 spaces shown: 6. The special exception proposed is to table 4.1.1A is for landscape materials sales and storage. (Landscape material is defined as items used for exterior landscaping, e.g.,decorative surface materials, earth materials, masonry pavers/blocks, landscape aggregate, stone dust, topsoil, mulch, brick chips, sand, processed gravel, trap rock, and plant materials.)Additional provisions for this use state: • Excludes storage or fabricating of structural steel and heavy concrete products. • Primary building shall be minimum 2,000 sq. ft. (excluding greenhouses). • Except plant materials, outdoor storage/sales area shall not be visible from a public street. 7. The applicant is proposing outdoor display areas along the front as well around the building. The pP P p g p Y g g applicant has provided the calculation display areas- allowing 6,542 sf of outdoor display area and 596 sf indoor retail display area. 10. The storage yard includes 18 bins for bulk storage of mulch, landscape stone, and landscape materials offered for sale. The rear of the property behind the larger self storage units is also shown as an - equipment storage area where vehicles(tri-axles,trucks and a trailer)that will be parked after hours. Staff expressed concern about potential conflicts with customer traffic in this area; the applicant has indicated that the equipment will not be on site during hours the business is open to the public. 11.The two self storage units are shown on the plans and will aid in the screening of the material bins in the rear of the site. The plans call for a 6 foot high decorative fence in front of the storage unit area that will be installed only in if the storage units are not constructed. 12.The landscape plan includes a variety of plantings around the building as well as a row of arborvitaes which extends down the eastern property boundary to screen the outdoor storage. There is a single family house located approximately 40 from this property line and 15+ feet from the access drive to the property to the south(Northeast Utilities). 13. The applicant is proposing a new driveway cut along Strong Road for access the site. A secondary driveway is shown in the rear of the site onto an existing ROW owned by CL&P located on the easterly border. The applicant is now working with CLP on such agreement to use this access. 14. The traffic study indicates approximately 85 total vehicle trips on a week day with 6 vehicles in the am and 11 vehicles in the pm peaks. They anticipate 1-2 trucks an hour would be entering/leaving the site. 4 TOWN OF SOUTH WINDSOR } MINUTES PLANNING&ZONING COMMISSION TUESDAY,DULY 28 2009 l' PUBLIC HEARING/REGULAR MEETING COUNCIL CHAMBERS/MADDEN RM, 7:30 p.m. 15. Lighting proposed includes 4-25 foot high poles, with cutoff fixtures, and goose neck lighting on the main building. Staff had suggested that lower light poles would be preferable as this use is going into an area where.several residential homes exist. 16.. They are proposing a 20 sf free standing sign embedded in a 5 X 8 masonry wall at the site entrance and a building sign, approximately 30 sf,on the front:of the building facing out to Strong Road. Designs of the signs have been submitted and are shown on sheet L2 17. The Architectural and Design Review Committee reviewed the plans on June 18th with the following comments: • the landscaping screening on the easterly side of the site should be extended up to the proposed fence to screen the landscape bins along the rear property line • details of the landscape bins to be used must be provided • hours of operation should be reviewed as it relates to the lighting on the site 18. There are no regulated`wetlands on the property. The applicant received conservation approval from the IWA/CC on June 17,2009 recommending a bond in the amount of$5,000 for erosion and sediment f control measures. - t 19. There is a well on site and sewer available to the site. The Town Sanitarian has reviewed the plans and has requested an approval condition stating: the foundation for any building that is less than 25 feet from the well cannot have any drains. Water Pollution Control Authority approval is required for the sewer connection. If this application is approved, the planning department would request, the impervious coverage calculation include the outdoor display areas and the proposed gate be added to the plot plan. Doolittle had an Engineering report as follows. 1. Please provide a quit=claim deed for ROW for Strong Road for 25 feet south from the center of the existing ROW along the entire frontage of both properties. This additional ROW is needed for any improvements to Strong Road and is based on the minimum ROW width needed for roadways. 2. The driveway needs to have a paved apron of at least 20 foot length. 3. The encroachment of the driveway to the CL&P property to the south should be removed from this property or be formalized with an easement. A better.defined, reasonable radius (such as 25 feet)for the western side of this driveway needs to be established to better define the driveway limits and reduce the encroachment area: 4. How will the islands and borders of the driveway and parking areas be formed? Will bituminous curb be used? Please label this on the plans. - 5 _ 3. There ro different Uses intermixed on this site which does not help the traffic flow. I suggest these two uses be separated and/or reduced on site to simplify the traffic flow: 6. Will the parking spaces be striped? If not, how will they be marked? 7. The grading of the main parking area to the east of the building is confusing. It appears to make water run north on the east side and south on the west side. This will be difficult to build and will probably result in,puddles,in this area. This grading needs to be simplified and clarified. 8. Have any soils test pits been dug on site to check the suitability of the soils for infiltration the groundwater elevation? Infiltration is mentioned in the Stormwater Management Plan but there are no provisions made to help stormwater infiltrate into the ground. Infiltration devices should be considered. 9. Water will pond in a grass swale at 0.5%. I suggest this swale be sloped at 1%if the intention is to have it drain quicker between storms. 10.What will happen to the existing 6"CMP from the site to the CB in front? 11. Stormwater will back-up into the swale during storms from the n to the 100 year intervals. More than half the swale will be inundated during the 25-200 yr storms. 12, The elevation of the west side of the swale and north side of the detention basin appears to be 74.0 which is 0.1 ft above the 100 year storm elevation. These sides need to be raised to provide at least l foot of freeboard for the 100 year storm all around the detention basin and swale. 13. The Stormwater Management Plan shows an increase in the peak runoff from this site during then and 10 year storms. These calculations and the detention basin design need to be modified so there is no increase in peak runoff for any storm from this site. 14.The outlet from the detention basin leads onto abutting property without any clear flow channel or rights to drain shown. Additional information as to existing drainage channels, topography and rights to drain need to be provided to complete the evaluation of the stormwater system design. 15. There needs to be an outlet structure from the detention basin with details and elevations. 16. Provide a flared end and rip rap plunge pool at the end of the DB outlet.pipe. 17. There needs to be a rip rap emergency overflow spillway near the detention basin outlet. 18. Provide,A gravel access road to the detention basin outlet. 19.Provide an operations and maintenance plan for the grass swale and detention basin/water quality basin on the plans. These should be mowed at least twice a year and inspected after major storms or at least twice a year. 6 TOWN OF SOUTH WINDSOR MINUTES PLANNING & ZONING COMMISSION TUESDAY,DULY 28 2009 ?-UBLIC HEARING/REGULAR MEETING COUNCIL CHAMBERS/IYIADDEN RM,7 30 pm. 20. If left, these need to refer to South Windsor(see note 6). A note that sewer construction must comply with the Town of South Windsor Public Improvement Specifications should be included. 22. This plan needs to be submitted to the WPCA for review and approval. A letter was read into the record from CL&P. (See exhibit A) Public participation was as follows. Virginia Bamber 315 Strong Road was representing a neighbor read a letter for the record. There were concerns with chemicals on site and invasive species on the property, the trees on the property as well as concerns with head light and noise. Rick Bamber 315 Strong Road had concerns with the wells and any chemicals that can potentially leak into the wells. Commissioners had questions and concerns. Responses will be in italics. • Commissioners asked what would happen to the trees that are on are currently on the site. Benjamin Wheeler responded that the trees on the property would be cut down for grading purposes and the big maple tree on the property will be preserved. • Commissioners asked at what point will the applicant know if the storage units will be going in or the vinyl fence The first building will be built then over a period of time the applicant would like to put other units in, if there is any delay he would put a vinyl fence Lipe recommended showing phasing of the site plan DeNlallie confirmed that the 1St building would be built and if the applicant chooses to phase it then he would return with another plan to address that. Commissioners asked if the light poles could be shorter Mr: Wheeler responded that the lighting plan is in compliance with the lighting regulations which requires full cut off lighting. By placing the poles 5ft apart it will require 4poles therefore distributing the light more ?verily. Lighting is important for security reasons. Commissioners asked about the chemicals and how far the wells were from the site and if the chemicals would impact any wells in the area. 7 TOWN OF SOUTH WINDSOR MINUTES . PLANNING&ZONING COMMISSION TUESDAY,JULY 28 2009 PUBLIC HEARING/REGULAR MEETING COUNCIL CHAMBERS/MADDEN RM, 7:30 p.m. Isherwood responded that there would be surface run off from vehicles but no chemicals would be contaminating the wells, the applicant's well is also located on the site. Commissioners asked it the applicant had any plan for mosquito control Isherwood responded that at this time the applicant does not have a mosquito control plan Lipe mentioned that the Commission could require a mosquito control plan in the case where water is not properly drained off the property. Commissioners asked Mr. &Mrs. Bamber if they would prefer a 6 ft decorative fence instead of the plantings along the property line. Mr. and Mrs.Bamber agreed that the Eft fence was sufficient. The public hearing closed at 9 PM. REGULAR MEETING-MADDEN ROOM 1. Appl.07-69P,Dzen Tree Farm Subdivision(Mannarino Bros.)-change order request for a sidewalk modification. Engineering has reviewed the site plan modification received on 9/3/13 for the above site and has the following comments: 1. This site plan does not clearly show the traffic patterns on site, where the screener and other equipment is located. all the soil stockpiles and how the surface drainage flows on site. It is also not clear what activities may be taking place and are proposed on the lot at 275 Strong Road with the house. These issues need to be clarified on the site plan and business operation narrative. 2. What is the purpose of and what vehicles will be using the proposed access driveway on 275 Strong Road that leads to the south west part of 287 Strong Road? There is already an existing driveway serving the house and garage on this property. Is the proposed access a one-way driveway? Is there a place for vehicles using this driveway to turn around on either property? How many vehicles will be using the business at 287 Strong Road (via all proposed and existing driveways) and what is the proposed traffic flow for this business? 3. This proposed driveway comes very close to the large 32" diameter birch tree on 275 Strong Rd. What measures will be taken to protect this tree from damage? 4. Clearly show the location of all equipment being used on 287 and 275 Strong Rd and the location of all soil stockpiles on both properties. 5. The plan shows two 6" spruce trees on the front western portion of 275 Strong Road and three 3" pine trees on the south west portion of 287 Strong Road. These trees are not all visible from the street. Insure the site plan accurately shows all trees and vegetation on both properties. 6. There are several sections of plastic vinyl fence that cross the property lines between 275 and 287 Strong Road. These need to be accurately shown and labeled. Why are they across the property lines? 7. The approved site plan called for a drainage swale along the western side of the building at 287 Strong Road to convey storm water from the building and front area to the water quality basin in the south west comer of this property The spot elevations do not clearly show this swale. Where is the stormwater from property at 275 and 287 going? Is any storm water flowing to the water quality basin? 1 8. The proposed access driveway and possibly the soil stockpiles and equipment are up close to the existing water quality basin. There need to be some measures to protect this water quality basin from sediment, debris and other impacts from the operations proposed and/or occurring around it. 9.-Stfow-atl-(granite)-posts along-theeside-of Stro-mg-Road in front of275and-287. - -- Any (granite) posts in the Town's ROW need to be moved out of the ROW because they are a hazard so close to the road, and may be damaged by snow plows and other vehicles. 10.Show the new radius of the driveway to the CUP property on the eastern side of the site, where it has been reduced and (mostly) moved off 287 Strong Rd property. Please contact me if you have any questions. 2 Appl #13-32P, SW Stone and Landscaping Supply LLC Public Hearing 9/10/13 Planning Department Report 1. Request for modification to the special exception and site plan approval for a landscaping sapply center, on property-located at 287 Strong Road, I-zone. 'Phis-request is in front of - the PZC because of complaints received by our office is May and subsequent zoning enforcement for non-compliance with the original approval granted. 2. The original approval granted in 2009 was for a special exception to table 4.1.1 A is for landscape materials sales and storage for his business, South Windsor Stone and Landscaping which included a showroom and office area. Additional zoning provisions for this use state: • - udes stor • Primary building shall be minimum 2,000 sq. ft. (excluding greenhouses); • Except plant materials, outdoor storage/sales area shall not be visible from a public street. 3. Also, at the time of the original approval, self storage units were approved on site and as originally designed, these buildings were to screen some of the bins and outside activities. The applicant's original plan also included the use of the existing ROW owned by CL&P located on the easterly border for access; however the was not able to reach an agreement with CLP. 4. The storage units were never built. Changes made on site included a temporary structure; removed existing required landscaping islands and added several bins around the property. expanded-and-the-applicant is now_has.a_screening-operation resulting in additional-truc-P—trafftc-than-stated-with the original_approval. It-appear sure-operating-fto-_site_=mast_ Hartford S-and-and-Grave-lzs-we11_as-the--o-r-iginal-SW-Stone and Larrdscap' miners. 5. Today's request is in response to that violation notice. The applicant is requesting to expand the original special exception approval. 6. The Special Exception criteria include: • The golds and objectives of the Plan of Development are met; • Adverse traffic impacts are not created; • Negative impacts on property values are not created; • The land is physically suited for the proposed use; • Adverse environ ental impacts are not created; • There is a bal ce between neighborhood acceptance and community needs; • Present and pro osed utilities, streets, drainage system, and other improvements have adequate capacit to accommodate the proposed use • Historic factors a adequately protected; and --- • The overall physic- 1-appearance of the proposed development is compatible with surrounding develo ment and the Commission's goals for the neighborhood/corridor. 7. The applicant is proposing expanded hours of operation to be Monday - Friday 7:00 am to 5:30 pm and Saturdays from 7:00 am to 5:30 pm (April 1 through Labor Day) otherwise until 2:30 pm; and Sunday 10 am—2 pm (no screening of materials). The changes from the previous approval include the additional of Sunday hours and later hours on Saturday. New landscaping proposed includes: adding the required landscape island; removing and replanting an area in the front were bins had been placed; adding the require arborvitaes to screen the bins up front; and closing of the rear access drive by adding plantings. 8. Other changes include additional bins. The original approval was for 18 bins; the bins in the front were to be a maximum of 4 feet and the bins in the rear were to be a maximum of 6 feet. That fence was installed does not accomplish the screening of these bins as required. The new site plan shows in excess of 30 bins. Are the bins still proposed to be 4 and 6 feet in height? Several of these bins do not appear to meet the screening requirement in the regulations which states, "Except plant materials, outdoor storage/sales area shall not be visible from a public street". 9. The rear of the property originally showed an equipment storage area where vehicles (tri- axles, trucks and a trailer) would be parked after hours. Staff originally expressed concern about potential conflicts with customer traffic in this area; the applicant had indicated that the equipment will not be on site during hours the business is open to the public. 10.The applicant is now requesting approval to operate the screening operation in that area— and again we have concerns that there is adequate room to do all that is stated on the plans. 11.The applicant has proposed a new 12 foot wide access drive on the far westerly end of the adjacent residential property (that he owns) for trucks. The new traffic pattern is a little unclear. Will this be for one way traffic? I- th the-scr ? 12.The original traffic study indicated approximately 85 total vehicle trips on a week day with 6 vehicles in the am and 11 vehicles in the pm peaks. They anticipated 1-2 trucks per hour over the course of the day. The complaints received by this office have documented a significantly larger number of trucks on a daily basis. We just received this information today and have not yet had a chance to complete our review. 13.Maximum impervious coverage allowed is 65%allowed; 58% shown. It appears that the adjacent property is being used as a part of the operations, either that site needs to be included with zoning information and request approval for the areas that are part of this operation, etc or activities currently occurring on that site need to be to pulled back on to 287 Strong Road with all activities supported solely on the lot that is subject of this application. 14.Parking requirement(retail, office) is 10 spaces; 10 spaces are shown. 15.Two temporary signs are currently depicted in the pictures and have not been permitted; a permit is required and only the sign in front of the lot where the actual business is being conducted is allowed. If this application is approved, the planning department would request that the public hearing remain open for the applicant to address some of the concerns raised by staff this evening and for an updated site plan. '32- P TV- TRAFFIC STATEMENT SMMNDSpR PI ONG DEPT. SOUTH WINDSOR STONE&LANDSCAPE SUPPLY,LLC 287 STRONG ROAD SOUTH WINDSOR,CONNECTICUT PREPARED BY DESIGN PRQMSSIONAI LS,INC. SEPTEMBER 9,2013 South Windsor Stone&Landscape Supply,LLC, is currently applying for a site plan modification to their existing facility at 287 Strang Road.Their business has been open since 2010.The primary changes to the site plan include the following: • Closure of the CI., P access drive on the east side of the property. • Rearrangement to and additions of material storage bins. • New gravel access drive on west side of property, from rear of building to Strong Road. (This will include the removal of an existing access drive that currently traverses through the Connecticut Southern Railroad property). • Addition of a mobile soil trommel/screener at the, rear of the property. Refer to the site plan modification drawings revised to September 3,2013, The purpose of this traffic statement is to provide a limited report that describes the existing commercial vehicular traffic activity at the site, and evaluation of safety related to the new access driveway. South Windsor Stone and Landscape Supply, LLC is opera year round and their business is specifically oriented toward the landscaping industry. As such, their busiest season is in during the spring from April to,Tune.Their vehicular traffic generation coins from two sources: 1. dump truck activity related to the delivery and processing of landscape products. 2. Retail activity related to the onsite store. During preparation of this Traffic Statement, no traffic counts were performed since the traffic generation at the site is negligible in comparison to the existing traffic volumes on Strong Road,Therefore,it does, not pose any risk of impacting the capacity of the roadway. Additionally, during preparation of the site plan modification application, Strang Road was under full depth pavement construction. However,South Windsor Stone&Landscape,LLC has provided historical truck traffic data based on customer receipts and logs. This data Is presented below. __ --- Truck Activity South Windsor State&Landscape Supply 20 Strong Road Month Year Personal Large Dump Customer Large Dump Total Track Activity Truck Acttvity Truck Activity (#trucks In&Out) trucks in&Out) (#trucks In&out) April 2012 130 45 175 May 2012 111 46 157 June 2012 93 42 135 December 2012 17 9 26 January 2013 is 7 22 April 2013 137 122 259 May 2013 118 101 219 tune 2013 1 90 65 15a *Tice above data is based on 24 working days per month The data above indicates that the busiest reported month for large truck activity was April 2013, with 259 trucks. The above data is composite and does not reflect peak day or peak hour traffic conditions. That is,some days of the week are busier than others, while there are busier/slower tinges during the day. However,a simple average indicates that the daily large true traffic generation during ft month of April 2013,was approximately 11 trucks per day, computed as follows: 259 trucks d 24 working clays= 11 trucks per day As seen f m the'Truck Activity Table, the generation of trucks to and from the facility come from two components;personal dump trucks and customer clump trucks.Personal dump trucks are owned by South Windsor Stone&Landscape Supply and are driven by their employees.Currently, they have three dump trucks(6+cubic yards),and two employed drivers. Custorwr dump trucks are owned and driven by others. The site is bleated in the middle of an industrial zone. There are numerous businesses in the immediate vicinity, located in the same industrial zone that generate substantially more commercial traffic along Strong Road, Some of the, businesses include New England Silica, Inc., R c land Brick, Inc.,G&S Scrap Metal,LLC, All American Waste, I L ,C , First Student, Inc.,and Old Dominion Freight Tine,Inc. The intersection sight lines for dice new gravel access driveway connecting with Strong Road were reviewed. The posted speed limit on Strong Road is 30 miles per hour. The eastern sight distance(looking right from new site driveway)extends over 700 feet to just. short of the Nutmeg Road North intersection. The existing sight distance in the western direction(looking left from new .gravel site driveway)extends to John Fitch Boulevard and beyond. The Torn Fitch Boulevard signalized intersection is approximately 180 feet away. The Connecticut Department of Transportation's Highway Design Manual provides guidelines for acceptable sightline distances for vehicles turning from a stepped condition onto a major roadway. Using ConnDOT's calculation procedures, the recommended sight distance in both directions is 420 feet for trucks. Locking east or right, there is over 700 feet of available sightline. Looking west or left, the distance is clear all the way to John Fitch Boulevard(180 feet)and beyond.By relocating the existing driveway off the Connecticut Srauthern Railroad property, and farther away from John Fitch Boulevard, sightline will be improved. It was also observed, that a driver steppe at the end of the new driveway will have clear sight in excess of 500 feet looking north at the southbound left turning lane of John Fitch Boulevard, and also by looking back,at least 500 feet toward the right northbound lane of John Fitch Boulevard, The radii of the new gravel driveway at its intersection with Strong Road,is proposed to be 25 feet. This meets the minimum radii suggested by the guidelines set forth within AASHTO's Policy on Geometric Design of Highways and Streets. The design vehicle was assumed to be a single unit truck. On Friday,September 6,2013,our office sent an email to Lieutenant Richard Band of the South Windsor Police Department requesting traffic accident data within the immediate vicinity to 297 Strong Road for a period during the past three years. There are numerous businesses in the immediate vicinity, located in the same industrial zone that generate substantially more commercial traffic along Strong Road. Some of these businesses include New England Silica, Inc., Redland Brick, Inc., G&S Scrap Metal,LLC, All American Waste, LLC, CL&P, First Student, Inc., and Old Dominion Freight Line, Inc. The intersection sight lines for the new gravel access driveway connecting with Strong Road were reviewed. The posted speed limit on Strong Road is 30 miles per hour. The eastern sight distance (looking right from new site driveway)extends over 700 feet to just short of the Nutmeg Road North intersection. The existing sight distance in the western direction(looking left from new gravel site driveway)extends to John Fitch Boulevard and beyond. The John Fitch Boulevard signalized intersection is approximately 180 feet away. The Connecticut Department of 'ramsportation's Highway Design Manual provides guidelines for acceptable sightline distances for vehicles turning from a stepped condition €into- r jor-roadway- Is4WCon T-!s-calcufat-ior,mc-ecAuresr t -r-eeomme e -sight distance in both directions is 420 feet for trues., Looking east or right, there is over 700 feet of available sightline. Looking west or left, the distance is clear all the way to Jahn Fitch Boulevard(I80 feet)and beyond.By relocating the existing driveway off the Connecticut Southern Railroad property, and farther array from John Fitch Boulevard, sightline will be improved. It was also observed, that a driver stopped at the end of the new driveway will have clear sight in excess of 500 feet looking;north at the southbound left turning laze of Jahn Fitch Boulevard, and also by looking back,at least 500 feet toward the right northbound lane of John Fitch Boulevard, The radii of the new gravel driveway at its intersection with Strong Road,is proposed to be 25 feet. This meets the rninimum radii suggested by the guidelines set forth within AASHT O's Policy on Geometric Design of Highways and Streets,The design vehicle was assumed to be a single unit truck,. fin Friday, September 6,2013,our office sent an email to Lieutenant Richard Pond of the South Windsor Police Department requesting traffic accident data within the immediate vicinity to 287 Strong Road for a period during the past three years. Added features have been incorporated onto the site plan(fourth sheet of the site plan set). • The zoning data block shown on the cover sheet has been revised to reflect the proposed conditions. A new 12' wide gravel surface driveway is now proposed on the west side of the property (see site plan). This driveway replaces the one previously used within the CL&P property. It is intended to be used as an egress for trucks. Appropriate signage will be installed(See site plan). The new driveway does not appear to traverse through any drainage_ swales. Since the ownership of the residential property to the west of South Windsor Stone&Landscape Supply, LLC is the same, no access easement is required. Additional fencing will be installed between the properties owned by the applicant. The existing driveway that crosses through the railroad property is now proposed to be eliminated. Narrative Comments: A row of arborvitaes is proposed streetside of the existing storage bins located on the northeast corner of the property. The existing storage bins in this area will be removed and restored with turf establishment as shown on the site plan(fourth sheet of the plan set). The topsoil screener(trommel)may be used year round. Sound study indicates that the soil screener conforms to the Town's Noise Ordinance. Soil screening may be in operation during all operational hours, except for Sundays. In regards to traffic volumes, see the Traffic Statement dated 9/9/13,prepared by our office. It outlines historical site generated traffic volumes related to South Windsor Stone&Landscape Supply, Inc. The operations related to dump truck deliveries will generally coincide with the proposed changes to the hours of operation of the yard. • Landscaping Plan: Permanent screening will be provided by the new rows of arborvitaes shown on the site plan. Engineering Department Comments (9/10/13): 1. The location of the screener is shown on the site plan. The location of the temporary soil stockpiles is also shown on the site plan. In general, loaded trucks dump material within the area of the temporary stockpiles. A payloader transfers the material to the screener. The material processed through the screener is subsequently transferred to either a storage bin or directly into another dump truck for delivery. In regards to the proposed traffic flow, see response provided under Planning Department comments. 2. The proposed 12' wide gravel driveway will primarily be used by trucks and for egress only. The existing driveway on the west side of the property traverses through railroad property and therefore will be removed. All other vehicles will use the main driveway. : 3. The edge of the proposed driveway is approximately 9 feet from the tree's trunk. Passing trucks will unlikely impact the tree. However, should portions of the tree obstruct truck traffic, small limbs may be cut. 4. The location of the soil screener is approximately shown on the plan. Although the screener is a mobile unit, South Windsor Stone&Landscape Supply intends to keep its position near to where it remains. At the close of business, dump trucks and the payloader will be parked behind the building. 5. The site plan has been revised to show accurate locations of trees. • 6. The fences are now shown on the site plan. Both lots are under the same ownershi . • eign • G:\jobs\2646\Dots\Correspondence\Sent\207 3 1001 Response to Comments.doc W : 7. Following site inspection of this area, it is evident that the area to the west of the building is graded such that storm runoff is directed south and towards the basin. There appears to be no evidence that this area drains to either Town property or adjacent private property. 8. The site plan has been revised to show additional sediment and erosion control protection : for the water quality basin. The applicant has agreed to clean up this area. 9. The granite posts were installed by the applicant in order to prevent trucks, primarily egressing from Redland Brick&New England Silica, from damaging the landscaping of South Windsor Stone&Landscape Supply, LLC. Some of the posts presently in the right of way are in an area previously owned by the applicant and deeded to the Town without compensation. If required by the Planning&Zoning Commission, the applicant will relocate any posts within the right of way. However, this will result in regular damage to the landscape elements of this site. : 10. The new radius is shown. Please contact me if you have any questions. • Sincerely, DESIGN PRO SIONALS, INC. Measurements were conducted during the morning hours of Friday, September 20`h,2013. The objective was to determine if emitted sound from the site was in conformance with the Town of South Windsor's Noise Pollution Control Ordinance(Town ordinance). During daytime hours.Town ordinance restricts noise above 61 decibels from industrial uses upon residential property. In the case where background noise exceeds 61 decibels, the industrial use shall not exceed the background noise levels by 5 decibels. The Town ordinance refers to The Connecticut Department of Environmental Protection's "Connecticut Regulations for the Control of Noise". • The Town ordinance also restricts impulse sounds generated from emitter's sites to no more than 100 decibels upon residential properties during daytime hours. The ordinance defines impulse noise as "a sound of short duration, usually less than one second, with an abrupt onset and rapid decay, where said sound is not repetitive". : Sound measurements were taken using a Sper Scientific sound meter, model number 850013. The instrument was calibrated per ANSIINCSL Z540-1,and ISO/IEC 17025 standards by Sper Scientific on May 29,2013. All sound measurements reported herein are in decibels at the 'A' weighted scale. Refer to Appendix C for sound meter information. • • Sound measurements were conducted in conformance with the"American National Standard's Quantities and Procedures for Description and Measurement of Environmental Sound—Part 3, Short-term Measurements with an Observer Present" guidelines as published by ANSI/ASA S 12.9-2013/Part 3. Procedure: Design Professional's engineer,Andrew Krar. P.E., conducted sound measurements at three locations on residential properties adjacent to the site. The weather was clear, in the low 60's,and negligible wind. The three sound measurement locations are listed below. Refer to the map presented as Appeendix A: : • Front vard of 290 Strong Road(brick house), adjacent to the road and across the street from the site. • Front yard of 306 Strong Road, adjacent to the road. • West side yard of 307 Strong Road, adjacent to the CI &P drivewa : 09@SS OI"taIs Sound measurements were conducted at each location during both background and combined noise conditions for approximately 10 minutes. The Town of South Windsor's Zoning Enforcement Officer, Pam Oliva accompanied Mr. Krar during all the • measurements. Michele Lipe and Peter DeMallie were also present during portions of the measurements. : Background Sound: The Town of South Windsor's Noise Pollution Control Ordinance defines background noise as"noise which exists at a point as a result of a combination of many distant sources individually indistinguishable". The Connecticut Department of Environmental Protection(now CT DEEP)further defines background noise statistically as the noise : level which is exceeded 90%of the time(1-90),in which the measurement is taken. • During the background sound measurements,no operations were taking place at the site. Both the payloader and soil screener were turned off. The only audible sounds emanating : from the site were sounds coming from occasional vehicles turning into and out of the driveway. Combined Sound.• During recording of the combined sound measurements, operations at South Windsor Stone& Landscape Supply were ongoing. The prominent sound sources generated from : the site consisted of the following: • Soil screener • Payloader transferring topsoil from a stockpile to the soil screener • Payloader's backup alarm • Occasional dump truck unloading material to a pile • One instance of the payloader dumping stone into a customer's pickup truck Findings Results demonstrate that the sound emitted from South Windsor Stone& Landscape Supply is in conformance with the Town's ordinance. The readings recorded and observed during the investigation are summarized below and are presented in full as Appendix B: • fIs Location Condition Decibels Site#1 Background 48.0(Lgo) 290 Strong Rd. Combined 54.9 (Average) Site#2 Background 473 (Lgo) : 306 Strong Rd. Combined 57.0 (Average) Site#3 Background 45.9(Lfl) 307 Strong Rd. Combined 52.3 (Average) No impulse sounds in excess of 100 decibels were measured or recorded during any of a the sound measurements at any time, from any source. Further findings of impulse : sounds are presented below: • The loudest measured impulse sound was 87.4 decibels. (Truck driving by on Strong Road unrelated to site, while meter was positioned in front yard of 290 Strong Road). : • Loudest measured sound while a dump truck was unloading material on the site was 62.3 decibels. This measurement was taken in front of 306 Strong Road. : • Loudest measured sound while the payioader was dumping stone into a customer's pickup truck was 68.7 decibels. This measurement was taken in the west side yard of 307 Strong Road. • It is noted herein that noise levels generated from South Windsor Stone&Landscape Supply's payloader backup alarm were incorporated into the combined sound : measurements. Cinder section 3d of the Town's ordinance, reference is made regarding sound sources that are excluded from the ordinance. The section refers to the Connecticut Department of Environmental Protection's Regulation for the Control of Noise, sections 22a-69-1.7-1.8. It states that sound created by safety and protective devices do not apply to the regulations. The inclusion of the sound associated with the payloader's backup alarm was done for purposes of conservative approach and simplicity. • • SIs Appendix A MAP r f r«.Ar,O A 'RIC jsll 506NC V,ASLGFVCNY:OW104/i ♦ICS STRG4N ROO 1 r' it .. f' IT 0B `SOuwL+YcA,$VtLuCHY.DCA 11pJ,d M_ fJy`i` ! SWSL.rtf We are here today, not because the owner of SWSL has voluntarily submitted new plans asking your committee to approve a modification of the original 2009 approved plans, but because he was issued a NOV letter on 5/13/13, as he was observed conducting activities, which he is still conducting without the approval of your committee. We understand two of the violations are not an issue here today, but we feel the violations in the letter issued 5/13/13 should be addressed because we believe they are pertinent in your review of the modification Mr. Silvestri is requesting: ------Hoop house Mr. Silvestri put up in fall of 2012 of which he never applied for a permit. ------Trespassing on private property for 3 years. suppose to provide planning officer, as outlined in his agreed requirements in 2009, with a letter granting him permission to use an access road adjacent to his property belonging to CUP. ------(last) moving in large screener, processing raw materials, construction payloader, transporting off property of processed materials, in commercial tri axle EHSG trucks and the storing of large piles of sand in the back of his property and not in bins as was agreed in his original S/E approval. We are hoping you will see that the NOV's as outlined above, the time it took Mr. Silvestri to comply including the way Mr. Silvestri is conducting new activities, will show Mr. Silvestri should not be approved for the new activities. That Mr. Silvestri has mislead me, my neighbors and mislead, including disrespected your committee and that his property in back is now merely a construction site and extension of his EHSG business. During the past 3 years, up to March of this year, I know for me, and I believe my neighbors will agree, there were no issues with the operations at SWSL. --------noise levels of equipment he was using. small payloaders. --------up keep of the property--all materials were as required and agreed with in 2009 in bins. Size of bins as approved in 2009. 4ft for the height of the bins in the front and 6 ft of the back bins. --------traffic flow of customers coming and going really unnoticeable. --------respectful to us neighbors. March of this year that all changed. --------Noticed entering, exiting, several large EHSG tri axle dump trucks. --------Noticed large construction payloader. --------Noticed large screener. --------Noticed several large piles of sand all over back of property ------Noticed several bins higher then the agreed height which allowed Mr. Silverstri to hold the large piles of sand. Activities everyday including Sat: --------Dump trucks enter property, dump sand in the back of the property. As many loads delivered as could cover most of the back property. --------Large construction payloader move sand to the screener until the sand reached the top of the screener. --------Dump trucks return with more sand to fill the back of the property and then wait for the screened sand to be loaded in the dump trucks and transported off the property. These activities: --------Start shortly after he opens and goes all through to closing. --------Observed on the large construction pay loader several hours of the day. ----picture the noise levels of the dump trucks engines, the beeping, the banging of the back gate when the several loads are dumped every hour. -------The banging of the bucket on the payloader moving around the lot and loading the dump trucks. beeping sound. These noises we believe go way beyond his property including the appearance of his property with all the sand piles all over the place. He even has sand piles on either side and in the back of the residence garage. We want you to know Mr. Silvestri was observed having as many as 39 dump trucks a day entering and exiting his property. I work full timeand on the days I was off I would record, the amount of trucks. He would have more then one dump truck lined up to enter the property. It got to be so many trucks that is why we filed the complaint with the planning officer which resulted in the NOV. During the past several months the quality of life for me and my neighbors has been terrible. The months of April through Sept are months when we should be able to enjoy our homes, sit in our yards or for my family enjoy our pool without wearing earplugs. Instead we hear the banging of dump trucks, banging of the payloader, beeping several hours a day. The traffic in and out of his property was constant by these large dump trucks. I have resided in my home for 27 years and some of my neighbors longer. Again we want to let you know we were okay with the original plans that were approved. For the past 3 years there was no issues with noise, appearance of the property and traffic but now his activities are out of control. I would also like to point out that SWSL website ----------updated in 2013 to now show two businesses. same address. ----------had been conducting these new activities of transporting in and out bulk amounts of sand at another site, still available on John Fitch Blvd. 1/4 mile away. ----------observed driving payloader on strong road in and out of the quarry. ----------Mr. Silvestri believes, as he has expressed to myself, husband and neighbor in April of this year, that since we are an industrial zone he can conduct any activities he wants and if we did not like the noise to move. Other concerns: --------amount of vehicles entering every hour. Mr. Silvestri should of been issued as part of his NOV letter a warning about the the amount of traffic for the past several months but he was not. --------we can all here today vouch for the fact the amount of traffic that Mr. Silvestri and his atty's have indicated in the original plans is not what he has followed. --------owns several vehicles for EHSG. Where is Mr. Silvestri garaging these other vehicles. Does he plan on moving them to this lot. --------99% of the vehicles entering and leaving SWSL are tri axle EHSG trucks. -------- area in the back allotted for the manuvering of these large trucks. large trucks noticed making several turns before being able to exit back property. noticed several back up to leave. I do not believe Mr. Silvestri has shown that he meets all of the 14 criteria in 8.4. Even in the months Mr. Silvestri outlines in his letter, will be the busiest, will make life for us difficult to be outside. One other point I would like you to consider in making your determination is the way Mr. Silvestri has conducted himself in the past several months. He wants you to believe he is a good neighbor and business person but: --------conducted business before and after agreed hours and being notified by EO to abide by his approved hours of operation. ------Trespassed on private property for the past three years including AFTER the town block the opening on his property where he was conducting the trespassing. --- ----was told to submit new plans by May 31 and only submitted them on Aug 5 and by the way were incomplete. ------- caused visits by DEEP including our town health officer due to heavy traffic and dust emitting onto neighboring properties. ------visits by SWPD for actions not becoming of a business owner. We are hoping that the information, we have provided today, along with information the planning officer can show such as, missing deadlines including delays and incomplete plans and incomplete outline of his activities, will show that Mr. Silvestri has not been a good neighbor in the past several months and has not shown he can comply with rules as set forth by your committee. Including that Mr. Silvestri will need to be monitored as he pretty much does what he wants and not what is authorized to do. Please consider requesting, even though we are industrial zone, that Mr. Silvestri move the screener back, to the quarry where we have been told existed before this year. These activities should be conducted in a quarry away from homes. Operating two businesses SWSL and EHSG on the size of the lot he has appears not safe or healthy. The traffic flow around the property is congested. 0'U t 5+ ten d I have reviewed article 8.4 and are asking you to please consider the following when Mr. Silvestri's attorney indicates in his narrative he meets the 14 requirements. 8.4 Special Exception Standards and Procedures Plans: Please consider that Mr. Silvestri has submitted incomplete plans. Does not show the piles of sand he has created with his new requested activities. The piles are consistent in the same area and have been for several months. (see pictures). Does not show screenings in front of bins being seen from street. Does not show heightened bins above 6 feet as were stated in his original plans. He has added jersey barriers on several of the bins. Narrative: Indicates 12 parking spaces. Currently has 7 but new plans appear to add 2 more. Does not indicate how the new access road is going to handle incoming and out going traffic within 12 FT. Does not indicate with the screening of top soil/transporting off site, with busiest months May through Sept, will increase traffic. We are asking you to also please consider the size of the back lot where Mr. Silvestri is conducting new activities of both SWSL and EHSG. His new activities has increased the entering and exiting of vehicles, which are at least 99 percent large tri axle dump trucks, large construction pay loader, less area for maneuvering of vehicles for items sold in back bins. Not issue before this year. It has been witnessed that some dump trucks, with the pay loader in the back have had to make several turns to exit the back area. Some have been seen backing up to the only opening to exit. Safety issue Back lot not paved, new activities which have increased the amount of traffic created more dust in the warmer months. When it rains there are several mud piles which could generate mosquitos. Health issue. Mr. Silvestri has not provided any information as to where he is getting the sand that is being transported on the lot for screening. Previously Mr. Silvestri only sold screened top soil. Not screened on site. Health issue. Construction of new driveway is being requested to be constructed on the residence property and cross over the residence driveway that runs along the railroad tracks. There is a child in that residence. Safety issue. Mr. Silvestri, as you can see from my emails and pictures has not maintained his property. Even though cannot be verified at this time, we believe the values of our homes will be affected if he is approved to continue these activities as his property is no longer just a small business with minimal traffic and noise including he is not maintaining his property on the side or in the back. He has not show his additional activities will be a benefit to the public or are a balance between neighborhood acceptance and community needs. Mr. Silvestri should be conducting these activities in the quarry where these activities were previously conducted, away from homes. His new activities have and still are disrupting the neighborhood Thank you very much. After zoning sign-off's on this change, a building permit will be required for the structure. • Activities observed after the approved hours of operations (approval condition#9 limited operation to 7:00 AM - 5:30 PM Monday through Friday; 7:00 AM—2:00 PM on Saturday as presented in the narrative); You intend to abide by the above hours of operation. You understand that if you want to expand these hours, additional PZC approval is required. • Additional activities, specifically the processing of raw materials not sold on site and additional truck traffic supporting such activity, violate the uses permitted by the special exception approval. These activities have contributed to the dust and noise complaints received by this office from neighboring residential properties; I will be in contact with our attorney and get back to you regarding additional approval that may be required for this use. I will follow up with you the week of May 20th ® Use of the secondary access drive way without obtaining an easement from the property owner, CL&P. You intend to contact CLP and provide the town with documentation indicating approval to use this access drive. I have attached the original letter we have on file related to this matter. Really appreciate it. First I want you to know I have pictures of him showing the opening including the vehicle on the road. I also filed a police report of him trespassing. Second, you are not going to hear from CL & P. I have been in touch with them. They do not believe they need to say yes or no to him to use their driveway. At this point, since the opening was on the original plans awaiting permission and he has not received permission it appears he needs to put the rest of a fence up. How may months are you going to assume that he is going to get permission. Don't take this the wrong way but you are waiting to hear on something that will never happen. CL&P has told me that him using the road is not a necessity as he has the strong road driveway. They also had their surveyors out and have found their bounderies show they do not need to care if he leaves the rocks all the way out to his property line. They realized that several feet of the driveway has been overgrown with grass and the trees on my neighbors land. This has been a right away for SEVERAL years and the prior owner did not care if trucks crossed the corner of the property. It just became an issue with Art. As I stated they are not going to answer. They know they have enough room to leave the road without using his property. If you could explain to me why you cannot just tell him he has to put the rest of the fence up. Is it because someone made a mistake in letting him trespass for 3 years. I am not sure why that matters. NOTE: As I am writing this email he is on the large payloader moving dirt around. He started about 10 minutes ago. The property is a mess. He now has sand piles all the way the the railroad tracks. He even knocked down a part of the fence on that part of the land. No. 2646 August 5,2013 Revised September 3, 2013 • South Windsor Stone&Landscape Supply, LLC has applied to the Planning&Zoning Commission to modify the prior special exception and site plan approvals for the existing operating facility in the Industrial Zone at 287 Strong Road. The landscape materials sales & storage business' special exception application(Article 4, Table 4.1.1A),was approved by the Commission on July 28, 2009. The use is proposed pursuant to regulations adopted on January 13, 2009. • The level, 1.65 acre site is bordered on the west by the railroad line(across Route 5 from Nassau's Furniture)and by a recently renovated residence at 275 Strong Road(occupied by family members), on the north by Strong Road,on the east by the access drive serving a Connecticut Light and Power facility, and on the south by CL&P. The property owners,Arthur and Cindy Silvestri, purchased this property in June,2008. The primary structure is a 2,982 sq. ft. landscape center building erected in 2010 with a wrap-around porch to house offices of South Windsor Stone&Landscape Supply as well as East Hartford Sand&Gravel, a small retail showroom, a conference room, and a • warehouse area for storage and processing of landscape materials. It has dark green sloping roofs, tan exterior walls, cupolas, windows and doors. The second is a 1,050 sq. ft. hoop storage building, also for the stora a and rocessing of landscape materials. SW Stone and Landscape Supply also contains aQ2 cRparkir ncluding one paved handicap space,an outdoor display/sales area for such items as flowers, nursery stock, landscape materials,as well as Christmas trees and other seasonal items. Regulations limit the area allowed for both interior and/or exterior retail sales to a maximum of 20%of the building gross floor area and exterior display, storage and yard areas. Therefore, the landscape center building has been limited to 596 sf for retail purposes, and the i exterior yard will be limited to 6,542 sf for retail purposes. The balance of the buildings and site is thus for wholesale operations. Customers of the wholesale operation include contractors and garden centers. To the rear of the parcel are 18 bins in a yard for the storage, sale and processing • • C:\Documents and Settings\michelerlipe\Local Settings\Temporary Internet Files\OLK363\2646 Silvestri Narrative 9-3-2013.doc • i i : of landscape materials, e.g.,topsoil, crushed brick, aggregate, stone, tailings and pavers. This area includes a mobile topsoil screener(screener area shown on the site plan). The mobile screener's operation was recently observed by the Town's ZEO, accompanied by a DPI engineer who took sound measurements from adjoining residential property boundaries. The sound data indicated that : the emitted sound met all regulatory requirements. A dumpster pad and water quality basin was installed in the southwest corner(right rear) of the site. After-hours commercial vehicle parking is : to the rear. The property's outbuilding has been razed. Primary access will be from a driveway entrance on Strong Road, which has acceptable sight lines. Reciprocal travel easements were not granted between CL&P and the applicant, thus a secondary means of ingress and egress over the existing CL&P driveway is no longer an option. A secondary driveway over the adjoining property at 275 Strong Road, also owned by the Silvestri family, is proposed to divert some truck and other vehicular traffic away from the residences opposite the site on Strong Road. • Yard Hours—We propose to modify the public hours of operation(yard&office)as follows: Monday thru Friday, 7:00 A.M.to 5:30 P.M.; Saturday, 7:00 A.M.to 5:30 P.M. Retail customers : avoided the yard. We have reviewed the commission's special exception review criteria, as enumerated in Section 8.4, and we believe the modified landscape materials sales&storage facility, as described herein, in the prior submissions,in the documents/plans provided, and in our testimony at the forthcoming public hearing,is consistent with the goals and objectives of those 14 criteria. : Narrative Update for September 13, 2013 Modified Plans: 1) At the request of Town staff,we updated the base plan to reflect changes to the site since the as-built survey was completed in 2010; 2) The revised plan reflects removal of some material bins in the northeastern part of the site, i, restoration of landscaped areas, and installation of arborvitae screening; • 3) In order to divert some of the truck traffic from the primary drive and away from adjoining non-conforming residential uses, we are proposing a new 12' secondary access drive fJ J westerly of the house and easterly of the railroad right of way. It will also route southerly lfs N and westerly of the water quality basin, and is no longer proposed to go between the housel 4lr and garage. The long standing driveway on the'railroad property will be abandoned; : 4) Irrigation system has been installed to control dust in southerly areas of the yard; 5) Bin locations are more accurately depicted, e.g., southeasterly portion of site; 6) Added landscaped island with trees to parking lot; 7) Computed impervious coverage for proposed plan; 8) Clarified proposed areas of gravel and dirt;and 9) Extended arborvitae screening to area of former CL&P access. • O\Documents and Settings\michelerlipe\Local Settings\Temporary Internet Files\OLK3B3\2646 Silvestri Narrative 9-3-2013.doc y „ F PlanningSouth Windsor Memo To: Peter DeMallie, DPI From: Michele R Lipe, Town Planner Date: 8/12/13 Re: Appl#13-32P, South Windsor Stone and Landscaping Following are review comments for the above-referenced application. Public hours of operation are proposed to change—will actual operation hours change as well (screening/processing,deliveries...)? I I I 1540 Sullivan Avenue,South Windsor,CT 06074 PH 860-644-2511,ext.253 Fax 860-644-7280 e-mail michelerlipg(ftouthwindsor org a ,I i z + Y Landscaping plan Additional screening should be provided along the easterly property line to ensure screening of the bins (a cross section illustrating how the four foot high arborvitaes will screen the rear bins and outdoor storage of vehicles would be helpful). The concrete blocks have been moved by the applicant in the past and we are looking for a permanent elimination of that curb cut. In reviewing the most recent aerial (2012), it appears that Art has added more bins and eliminated the 60"maple that the plans indicated was to remain. The plan submitted show it exists. In response, Mr. Silvestri has blocked off the access point to the CLP ROW which he was using for his truck traffic. He did not have the proper authority to use that access. (This was originally one of the primary complaints from the residents.) Secondly, Mr. Silvestri applied for the building permit for the temporary structure he had placed on the site without permits; and lastly he has submitted a revised site plan and narrative requesting to change the scope of his original approval to include the additional truck traffic and screening of materials on site. This application was submitted in early August; however due to PZC's summer schedule and the number of pending applications, it has been scheduled for September loth Staff has issued some preliminary comments requesting more details on the site plan and more details in the narrative of the new scope of work. (For example, we do not find the new traffic pattern proposed acceptable; areas have been disturbed and are not correctly reflected on the plans submitted.) After speaking with his consultant, I anticipate a revised plan in here by September 3 addressing our comments. We have kept the neighbors apprised to the status of the violation and new application submitted and anticipate they will come out to the September loth public hearing to voice their concerns. Ultimately it will be up to the PZC to determine what can occur on the site. Our goal with zoning violations is to achieve voluntary compliance (not end up in the Court system which can take a very long time before anything happens.) In this instance, balancing the permitted industrial activities allowed in the industrial zone while trying to be sensitive to the residents living in the industrial zone has been challenging. The PZC will have to consider all of this in their deliberations. Please let me know if you have any other additional questions. Conk -k d Thanks, rn Q y Gr t Michele 1() n rnanOJ CSC QI' Michele R.
