The prior expired on February 5, 2013. The location of this earth removal operation is at 1440 John Fitch Boulevard, east of the brick plant, For this application, we are requesting to continue mining clay in the same location previously approved. The acreage approved prior includes the areas identified as Phase 1 through Phase 4, Phase 6, and Phase 7 along with areas adjacent which were formerly mined by Redland Brick. The reclamation plan and 5 year projections for the site are attached. The geology of the area includes a deposit of sand on top of a deposit of clay. East Hartford Sand and Gravel under separate permitting has been removing the sand so Redland can access the clay. Redland Brick mining operation includes removing any remaining sand or overburden and either stockpiling it elsewhere on Redland Brick's property or using for reclamation. The clay is loosened with a farm type disk, allowed to air dry, pushed to a side of the quarry, loaded into trucks, and hauled to a storage area. The storage area can be either to.an enclosed storage shed or an outside stockpile during warm months of the year. The mining operation is weather dependent and is restricted to material to supply the plant for the entire year. It is critical that at least this much acreage is permitted to allow for sufficient air drying time. No wetlands will be disturbed by continued mining activity. Redland Brick views itself as a steward of the environment and a good neighbor. Redland formerly designated approximately 5 acres of their property in a Conservation Easement with the Town. 1:\R\REDLB-REDLAND BRICK,IN.EDLAND BRICK,KP PLANT,1440 JOHN PITCII BOULEVARD,SOUTH WINDSOR,CT O(074U2ED2OO4CE\1VP\Application\Earlh Removal Application-revised 12-12-2013.docr HRP ATTACHMENT B DRAWINGS J:\R\REDI.B-RBDLAND BRICK,INC\REDLAND BRICK,KE PLANT,1440 JOHN PITCH BOULEVARD,SOUTII WINDSOR,CT 0G074\RED2004CE\WP\APPlicutionV artl R...,,lI APPlic.tinn-revixed 12-12-2013.docx HRP Drawing List Drawing Title Title Sheet C1.0 Overall Existing Conditions Plan C1.1 Existing Conditions Plan TP-5 Excavation Plan- Phase 6 & 7 JARXREDLB-REDLAND BRICK,INC\REDLAND BRICK,KF PLANT,1440 JOHN FITCH BOULEVARD,SOUTH WINDSOR,CT 06074MD2004CE\WP\Applicatioa\Earth Removal Application-revised 12-12-2013.doea HR ATTACHMENT C RECLAMATION PLAN .1\RkREDLB-REDLAND BRICK,INC\REDLAND BRICK,KP PLANT,1440 JOHN PITCH BOULEVARD,SOUTH WINDSOR,CT 00074\RED2004CE\WP\Applieallon\Em4h Removal Application-revised 12-12-2013.docz HRP REDLAND BRICK INC.-KF PLANT EARTH REMOVAL PERMIT FIVE (5) YEAR PROJECTIONS-RECLAMATION PLAN Listed below are our plans for the next five years as well as our reclamation plan for the clay pit when mining is completed. In order to gain a proper understanding of the KF Plant operation, plans for the future, and our reclamation plan, it is first necessary to explain some history at this site. BACKGROUND As a result of a search of historical data we are aware that excavation and brick manufacture has been occurring at this site for almost 100 years. For many years this work was conducted without any regulatory requirements or restrictions- it was pre-regulation. The geology of the property and much of the surrounding area is relatively level property with sedimentary material including a deposit of about ten (10) feet of sand on top of a significant deposit of clay. The fine clay captures water. The area was a glacial lake and this unique feature has been studied on site by students and professors of local colleges. In the past the sand was removed for sale, generally by East Hartford Sand and Gravel, and Redland removed the clay for brick manufacturing. (Note that Redland does not use the sand in the body of the brick although we may use it for coatings on the surface of the brick.) Two large clay pits were developed as a result of prior excavation for brick manufacture. Water enters the site and fills these clay pits from wetland areas to the south, from two drainages off of Strong Road and from ground water infiltration. (Redland recently gave the Town of South Windsor an easement to allow water to drain from Strong Road in one of these drainages onto the Redland property as part of the Strong Road improvements.) The water filled clay pits are now ponds and have been in place since at least the 1940's based on historical overhead photos. This off site water flows into the south pond, exits the south pond through a concrete pipe into the north pond, and Leaves the north pond through another concrete pipe into Bancroft Brook to the northeast of the property, and eventually flows to the Connecticut River. When the Kelsey-Ferguson Brick Plant was purchased by Steetley Brick, prior to Redland ownership, clay material was excavated from the south pond with a dragline as wet material and mixed with shale mined and hauled from a shale pit in Suffield. The shale material was depleted and that quarry was reclaimed and closed. Steetley elected to open a new clay pit on site and mine dry material to have better moisture control, a more consistent raw material mix and better overall quality control in the brick manufacturing process. 1 In the new clay pit, water entered the pit as a result of precipitation and groundwater runoff and Redland pumped the water out and into the south pond. The south and north ponds served as sediment ponds for the pumped water as well as the sediment laden water entering the ponds from off site. In the early 1990's, Redland created a vegetated swale to pump this water into to remove much of the sediment from the water prior to it entering the south pond. This swale and process was under the approval of the Connecticut Department of Energy and Environmental Protection (DEEP). After about fifteen (15) years of using the vegetated swale, in 2007,.the DEEP informed Redland that since water entered and left the ponds all of it satisfied the definition of and was now considered "waters of the state". The water removed from the clay pit was considered "process water". Regulations required all process related water entering "waters of the state" to be treated prior to that entry. As a result the ponds would no longer be able to be considered sediment ponds and all sediment would have to be removed from the water prior to it entering the ponds. 5 YEAR PROJECTIONS While it is reasonable for the Town of South Windsor to ask Redland what our projections are for the next five years, at this time this is unknown. What is known is that Redland must have a source of clay for brick manufacture or brick manufacturing will cease at this location. Given this fact, Redland is interested in whatever help the Town of South Windsor can provide for us so that we can continue to be a viable and profitable manufacturing source in this Town. Listed below are several scenarios that could occur: 1. Redland does not find a means of addressing the issues of the DEEP related to removing water from the clay pit, the clay is covered with water, Redland is unable to mine clay, manufacturing at the site ceases, and Redland reclaims the area. Please understand that this scenario is unacceptable to Redland, but is listed simply because is it a possible option. 2. Redland purchases additional property nearby, applies for the appropriate permits, supplies clay for brick manufacture from that site to the plant, and continues to manufacture brick on site. At the point where it is determined that we will no longer mine the pit on site, reclamation will occur and our Earth Removal permit for the current pit will be closed. 3. Redland finds an economically feasible way to remove water from the clay pit, applies for and is granted a National Pollutant Discharge Elimination System (NPDES) permit from the DEEP and continues to mine from the same clay pit. From test drilling we know that there is clay at least one hundred feet (100') deep on the property. 2 4. Redland purchases clay from another source. If Redland went in this direction and it was determined we would no longer mine the current pit, we would reclaim around the current pit. RECLAMATION PLAN The reclamation plan has been approved by the Planning Commission on each of the last two earth removal permit renewals. There will be three ponds on the property. We will allow the drainages that convey the water to the two existing ponds to remain in place and continue to convey that water. The banks on those drainages are already stabilized and planted. The existing clay pit will be filled with water up to the ground water levels. Slopes on the pit leading to the water level are 2:1. Four inches of topsoil will be spread on the area around the ponds to the water's edge. Redland will plant appropriate grasses, as recommended by Town staff, such as fescue, rye as a cover crop, and legumes (crown vetch, lespedeza). Redland will not plant wetland vegetation but fully expects some wetland vegetation to grow around the ponds naturally as early as the first growing season after reclamation has occurred. Within two years of no disturbance of the ground by mining, it is expected that some native tree species will begin to take over the area. There are fish in the existing ponds (largemouth bass, catfish, and bluegills) as well as turtles, frogs, toads, snakes, muskrats, beavers, ducks and geese. Ducks and geese have already begun to inhabit the water in the clay pit and it is anticipated that all of these animals other than possibly the fish will move into the clay pit naturally. The clay pit will become a natural water source for all wildlife in the area. 3 ATTACHMENT D TOWN OF SOUTH WINDSOR CHECKLIST J:\R\REDL➢-REDLANDBRICK,INCIREDLAND➢RICK,KPPLANT,1440JOHN PITCH➢DUI,EVARD,SOUTI[WINDSOR,CT0C074\RE:D2004CE\WP\Applicalion\Eatlh Removal Application-reviled 12-I2-2017.d.,HRP orica?ea; YLG, Pmama[Safety Oivisim Owpo ste Colter[rive ;cs n► Xk nom .0 AIM-4 26 262 67 9157 800 245 D779 Page 1 of 26 587 4447 Fax Certificate of calibration Certificate )pt 55t3G9ljWOOj4X33 tted Ely; 15716 CUM SPRI)M ROAD Tip IF}+F13-i lin 21795 r,1 wuwlsr: Qc'8o:013-3 Date RccciT=d-. e}U}t01-3 mar A; 5 DaCe 10S edi 8126/2013 l c 0,300 POSIt+MER VT.tiI= a136/2011 comdit3on2 t C-04w i ti on g 1pyratflrt..z IO&C U> 29'' As Fossae, W TOrERANCE UdA t 201 to Cry As Ieert' IN TO1.I. Scientists October 18, 2013 ' File No. 05.0045211.00 Northern Construction Service, LLC 1516 Park St. PO Box 900 Palmer,MA 01069 Attention: Shawn Clark Project Manager Reference: Vibration Monitoring Redland Brick Mining Site South Windsor, Connecticut 655 Winding Brook Drive, Suite 402 Glastonbury,CT 06033 Dear Mr. Clark: 860-286-8900(phone) 860-652-8590(fax) GZA GeoEnvironmental, Inc. is pleased to submit this letter report providing the results of www.gza.com vibration monitoring at the Redland Brick Inc. clay mine in South Windsor, Connecticut. The monitoring and preparation of this report was performed according to our executed proposal dated August 9, 2013. The purpose of this vibration monitoring was to document vibration levels at or near the property boundary during actual or simulated mining operations and to compare these recorded levels with published data for vibration levels that could cause damage to structures. The information and conclusions contained in this report are subject to the limitations included in Appendix A. BACKGROUND GZA understands that at least one property owner adjacent to the Redland Brick property is concerned about the level of vibrations caused by the mining activities. Northern Construction Services provides the equipment and operators for the earthwork operations at the clay mine owned by Redland Brick Inc. We understand that Redland Brick is in the ' process of renewing its mining permit for this site. FIELD MONITORING GZA coordinated our work with you and Mr. Ed Cunningham, Plant Manager for Redland Brick Inc. Your operators provided the equipment and typical operations during the monitoring on August 14, 2013. The equipment being used to load and haul clay included a Komatsu D65PX Bulldozer and a Volvo BM A30, 20 ton capacity, off-road dump truck. GZA used an Instantel B1astMate III Multi-channel Seismograph, Serial #BA8684, to measure vibrations during the operation of the mining equipment. Two methods were used An Equal Opportunity EmployerMINVIH Vibration Monitoring—Redland Brick Inc. October 18,2013 File No. 05.0045211.00 Page 2 to monitor the vibrations: Trigger Level readings and Timed Interval (Histogram) readings. For the Trigger Level method, a minimum vibrations level of 0.02 in/sec was set on the seismograph. When the vibration levels reached the minimum trigger level from equipment operations, the triggering event and 3 seconds of data were recorded. Vibrations below the minimum threshold level of 0.02 in/sec were not recorded during this method. For the Timed Interval (Histogram), the seismograph was set to record for three seconds every one minute regardless of the vibration level. A minimum trigger level was not used during the Timed Interval method. Vibration data presented in this report represents the Peak Vector Sum measured in inches per second. The sensor records peak particle velocities in three principal directions and the seismograph then mathematically sums these vectors and reports the Peak Vector Sum. The data obtained from the seismograph is presented in Appendix B. Various locations were monitored for different equipment. The Komatsu bulldozer was monitored during tracking and blading operations and the loaded dump truck was monitored during hauling operations. The equipment did not operate at the same time. The attached Vibration Monitoring Location Plan, Figure 1, identifies the approximate location of the six monitoring locations with respect to the haul road, existing drainage ditch, and nearby property boundaries. Current haul roads, the seismograph locations, and the existing structure locations are approximate. The seismograph locations and the current haul road configuration were not surveyed for this investigation. Monitor locations 1 through 3 and 6 were along the southern property boundary and locations 4 and 5 were set up approximately 10 feet from the operating bulldozer and truck, respectively. A summary of the maximum recorded peak vector sums for the various conditions monitored are presented in the following table. Table 1 —Summary of Peak Vector Sums PVS Location Approximate Max. This vibration level is 6 to 25 times lower than the vibration limits that may cause damage rVibration Monitoring-Redland Brick Inc. October 18 2013 File No.05.0045211.00 Page 3 r to structures based on the following criteria. The United States Bureau of Mines' (USBM) recommended safe levels of vibrations for residential structures to be 0.2 to 2.0 inches per second, depending on the frequency of the vibration. For the frequencies recorded during our monitoring, the safe vibration limits range from 0.5 to 2.0 inches per second. The USMB limits are plotted on the Event Reports presented in Appendix B. The PVS values recorded at or nea r Rediand Beck's . property boundary were approximately 50 to 150 feet from the source of the vibrations. It should be noted that the nearest habitable structure is an additional 150 to 200 feet from the closest planned mining operation and vibration levels decrease rapidly with distance. Published data' would indicate that the raining generated vibrations at distances from 200 to 350 feet from the source would be in the"slightly perceptible"to"imperceptible"range. We trust this letter report meets your present requirements and we appreciate the opportunity to work with you on this project. GZA GeoEnvironmental, Inc. (GZA)prepared this report on behalf of, and for the exclusive use of our Client for the stated purpose(s) and location(s) identified in the Proposal for Services and/or Report. Use of this report, in whole or in part, at other locations, or for other purposes, may lead to inappropriate conclusions; and we do not accept any responsibility for the consequences of such use(s).Further, reliance by any party not expressly identified in the agreement, for any use, without our prior written permission, shall be at that parry's sole risk, and without any liability to GZA. Standard of Care 2. GZA's findings and conclusions are based on the work conducted as part of the Scope of Services set forth in Proposal for Services and/or Report, and reflect our professional judgment. These findings ' and conclusions must be considered not as scientific or engineering certainties, but rather as our professional opinions concerning the limited data gathered during the course of our work. If conditions other than those described in this report are found at the subject location(s), or the design has been altered in any way, GZA shall be so notified and afforded the opportunity to revise the report,as appropriate,to reflect the unanticipated changed conditions. 3. GZA's services were performed using the degree of skill and care ordinarily exercised by qualified ' professionals performing the same type of services, at the same time, under similar conditions, at the same or a similar property. No warranty, expressed or implied,is made. Subsurface Conditions 4. The generalized soil profile(s) provided in our Report are based on widely-spaced subsurface explorations and are intended only to convey trends in subsurface conditions. The boundaries between strata are approximate and idealized, and were based on our assessment of subsurface conditions. The composition of strata, and the transitions between strata, may be more variable and ■ more complex than indicated. For more specific information on soil conditions at a specific location refer to the exploration logs. 5. In preparing this report, GZA relied on certain information provided by the Client, state and local officials, and other parties referenced therein which were made available to GZA at the time of our evaluation. GZA did not attempt to independently verify the accuracy or completeness of all information reviewed or received during the course of this evaluation. 6. Water level readings have been made in test holes(as described in the Report)and monitoring wells at the specified times and under the stated conditions. These data have been reviewed and interpretations have been made in this Report. Fluctuations in the level of the groundwater however occur due to temporal or spatial variations in areal recharge rates, soil heterogeneities, the presence of subsurface utilities, and/or natural or artificially induced perturbations. The water table encountered in the course of the work may differ from that indicated in the Report. ' April 2012 PAGE I N 7. GZA's services did not include an assessment of the presence of oil or hazardous materials at the property. Consequently,we did not consider the potential impacts (if any)that contaminants in soil or groundwater may have on construction activities,or the use of structures on the property. 8. Recommendations for foundation drainage, waterproofing, and moisture control address the conventional geotechnical engineering aspects of seepage control. These recommendations may not preclude an environment that allows the infestation of mold or other biological pollutants. Compliance with Codes and Regulations 9. We used reasonable care in identifying and interpreting applicable codes and regulations. These codes and regulations are subject to various, and possibly contradictory, interpretations. Compliance with codes and regulations by other parties is beyond our control. Cost Estimates 10. Unless otherwise stated, our cost estimates are only for comparative and general planning purposes. These estimates may involve approximate quantity evaluations. Note that these quantity estimates are not intended to be sufficiently accurate to develop construction bids,or to predict the actual cost of work addressed in this Report. Further, since we have no control over either when the work will take place or the labor and material costs required to plan and execute the anticipated work, our cost estimates were made by relying on our experience, the experience of others, and other sources of readily available information. Actual costs may vary over time and could be significantly more, or less, than stated in Ube Rerert r Additional Services 11. GZA recommends that we be retained to provide services during any future: site observations, design, implementation activities, construction and/or property development/redevelopment. This will allow us the opportunity to: i) observe conditions and compliance with our design concepts and opinions; ii) allow for changes in the event that conditions are other than anticipated; iii) provide modifications to our design; and iv) assess the consequences of changes in technologies and/or regulations. r April 2012 PAGE 2 APPENDIX B INSTANTEL BLASTMATE III MONITORING DATA i 1 1 z 0 H U O a a tw r r Instantel Event Report ' Date/Time Long at 10:05:32 August 14,2013 Serial Number BA8684 V 10.60-8.17 BlastMate III Trigger Source Geo:0.0200 in/s Battery Level 6.3 Volts Range Geo: 10.00 in/s Unit Calibration November 20,2012 by Instantel Record Time 3.0 sec at 1024 sps File Name J684EXOC.180 Notes Project&Location: Redland Brick,South Windsor,CT USBM RI8507 And OSMRIE , Client: Northern Construction Unit Location: Prop line by stockpile 10 Unit Serial Number: BA8684 No velocity above 0.04 in/s , Extended Notes 5 Southern Property Line at Location#1 Bulldozer Tran Vert Long ' PPV 0.0200 0.0150 0.0200 in/s 2 ZC Freq >100 >100 >100 Hz / Time(Rel.to Trig) 0.725 -0.032 0.000 sec / Peak Acceleration 0.0530 0.0530 0.0530 g Peak Displacement 0.00002 0.00002 0.00002 in w 1 / Sensor Check Passed Passed Passed Frequency 7.3 7.5 7.2 Hz w Overswing Ratio 3.9 3.7 3.7 , 0.5 rPeak Vector Sum 0.0206 in/s at-0.069 sec 0.2 r 0.1 , 0.05 0.0394 , 1 2 5 10 20 50 100 > Frequency(Hz) Tran: + Vert:x Long: o ' Long 0.0 , U Vert 0.0 Tran / 0.0 1.0 2.0 3.0 Time Scale:0.20 sec/div Amplitude Scale:Geo:0.100 in/s/div Sensor Check Trigger= ►- t Printed:August 14,2013(V 10.30-10.30) Format©1995-2011 Xmark Corporation Instantel Event Report Date/Time Vert at 10:06:23 August 14,2013 Serial Number BA8684 V 10.60-8.17 BlastMate III Trigger Source Geo:0.0200 in/s Battery Level 6.3 Volts Range Geo: 10.00 in/s Unit Calibration November 20,2012 by Instantel Record Time 3.0 sec at 1024 sps File Name J684EXOC.2N0 Notes ' Project&Location: Redland Brick,South Windsor,CT USBM R18507 And OSMRE Client: Northern Construction io Unit Location: Prop.line by stockpile Unit Serial Number: BA8684 Extended Notes No velocity above 0.04 in/s 5 Southern Property Line at Location#1 Bulldozer ' Tran Vert Long PPV 0.0150 0.0250 0.0200 in/s 2 ZC Freq >100 85 >100 Hz / Time(Rel.to Trig) 0.013 0.000 0.360 sec / ' Peak Acceleration 0.0530 0.0530 0.0530 g Peak Displacement 0.00018 0.00004 0.00005 in Sensor Check Passed Passed Passed / Frequency 7.3 7.5 7.2 Hz . Request for a five year Special Exception permit to Section 7.16 for an earth removal permit and site plan approval to extract clay on Redland Brick property at 1440 John Fitch Blvd, Industrial and RR zones. 2. This application was recently in front of the PZC for renewal; however it was determined by the Town Attorney that it had to come back in as a new application since the permit period had expired before the renewal request had been submitted. 3. The applicant has had two-year permit renewals since 2000; in 2007 the PZC changed the regulations to allow for a five year permit period. 4. The site is currently accessed from Route 5 and will continue to be accessed from Route 5. The plans show that the applicant continues to work it the same area that was permitted five years ago. The plan reflects the existing grades as well as proposed grades over the next five years. 5. Based on concerns raised during the last hearing, the applicant did address several concerns raised. They identified specific hours of operations (listed in approval conditions). The applicant also represented they have a water truck on site to deal with any dust concerns as they arise and will respond immediately. They also provided a noise study demonstrating compliance with the town' s noise ordinance. These could be considered for conditions under the special exception approval. 6. The zoning regulations allow removal of earth materials, including clay, as a Special Exception, in conformance to certain criteria, including: • The plan shall provide for proper drainage of the area of the operation after completion; and no bank shall exceed a slope of 1 foot of vertical rise in 2 feet of horizontal distance. • At the conclusion of the operation, or of any substantial portion thereof, the whole area where removal takes place shall be covered with not less than 4 inches of topsoil, and seeded with suitable cover crop. • Except in an industrial district, no stone crusher or other machinery not required for actual removal of the material shall be used. • In passing on such applications, the Commission shall consider the effect of such removal on surrounding property and the future usefulness of the premises when the operation is completed. In the case of removal of quarry stone, and mining operations, the Commission may modify the foregoing requirements where such 1 operations will not endanger public health and safety or be detrimental to the neighboring properties. • Such permits shall be issued for a period not exceeding 5 years beyond the date of Commission approval. • Extension of time or modification of the scope of work originally approved may be granted by the Commission. • The applicant shall post a bond with the Town Treasurer in an amount approved by the Commission after consultation with the Town Engineer as sufficient to guarantee conformity with the provisions of the permit issued hereunder. 7. The applicant has provided a reclamation plan. Staff recommends a restoration bond in the amount of$30,000 shall be submitted to this Commission. Prior to the start of the restoration, a report shall be submitted to the Environmental Planner and Town Engineer to determine the appropriate seed mix that is comparable to the hydrology on the site. 8. The town engineer, Jeff Doolittle, has asked that a detailed restoration plan be submitted for staff approval before the final restoration is completed. 9. There are regulated wetlands on the site and the applicant has an active wetlands approval. The IWA/CC approved the application on October 5, 2011. If this application is approved, Planning Dept. has no further recommendations to request. 2 MEMORANDUM To: Michele Lipe, Town Planner From: Jeffrey Doolittle, Town Engineer Date: 1/24/14 RE: Application 14-01 P— Redland Brick, KF Plant 1440 John Fitch Blvd Engineering has reviewed the plan received for the above site and has the following comments: 1. Before final restoration of the excavated areas on site, The applicant/owner needs to submit a final restoration plan for Town Staff to review and approve. Lipe An IS09001 Registered Quality System Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Dear Ms. Lipe: Enclosed is the reclamation bond to the Town of South Windsor, Connecticut as obligee in the sum of $30,000. The approval letter dated January 29, 2014 asked for a restoration bond with no other instructions provided. We proceeded to obtain the $30,000 bond in the most cost effective manner for Redland Brick. Like many other companies who are in the construction industry, Redland Brick in general and the KF Plant specifically have been hard hit by the down turn in construction. The KF Plant has not operated for a full twelve months in any year since 2006 due to the dramatic decrease in brick sales. In recent years, the KF Plant ceased production for six months in 2012 and for five months in 2013. The plant is currently shutdown this winter with no plans to begin production until at least April. The two methods to provide surety that you provided to Barry Miller today will require Redland Brick to set aside $30,000 for a surety bond. This will create a financial hardship on our company due to the current poor economic conditions. I also spoke to our insurance company concerning the process for the Town to collect on the bond in the unlikely event that Redland Brick would default on the reclamation. The agent explained that the Town must write a letter describing the nature of the claim and submit the fetter to the insurance company. There would be no need for the Town to sue the insurance company in order to collect on a valid claim of default. Redland Brick Inc. has always maintained a good working relationship with the Town of South Windsor, and over the years we have strived to be a good corporate citizen of the Town. We respectfully ask that the Town of South Windsor consider an exception to the surety bond requirements and accept the reclamation bond issued by Fidelity and Deposit Company. Thank you for your consideration in this matter. Sincerely, Sherry R. Below are the acceptable types of surety for subdivision public improvements, landscaping and/or site improvements. ➢ Letter of Credit—The applicant may provide an irrevocable letter of credit from a bank or other reputable institution acceptable to the Town and in a form satisfactory to the Town. The wording on the letter of credit should be specific to the approved project. It should reference the application number; Commission approval date; name of the preparer of the plans - including project number and all revision dates; and the specific purpose of the bond(e.g., landscaping, erosion and sedimentation measures; public improvements). Example attached. ➢ Bank Checks/Certified Checks—The applicant shall submit a bank check/certified check made out to the Town of South Windsor. This check will be deposited into a Town account. The Town will release the monies (and interest earned) as indicated above. A W-9 Form is required to be submitted with each surety posted. The applicant is responsible for any required IRS reporting of interest earnings. Llpe Town of South Windsor An IS09001 Registered Quality System 1540 Sullivan Avenue South Windsor, CT 06074 Dear Ms. Lipe: Enclosed is the reclamation bond to the Town of South Windsor, Connecticut as obligee in the sum of$30,000. The approval letter dated January 29, 2014 asked for a restoration bond with no other instructions provided. We proceeded to obtain the$30,000 bond in the most cost effective manner for Redland Brick. I also spoke to our insurance company concerning the process for the Town to collect on the bond in the unlikely event that Redland Brick would default can the reclamation. The agent explained that the Town must write a letter describing the nature of the claim and submit the letter to the insurance company. We have been given pictures and video showing large plumes of dust coming from your equipment and suspended in the air of the surrounding property. When we met with you on May 22, 2018, we discussed the conditions of your current Special Exception, which requires you to monitor and mitigate the dust generated on site daily. You are to keep a water truck on site, with the use recorded and logged. Those logs are to be available for inspection within twenty-four (24) hours of any request by me. Please take immediate steps to address the dust issue on your property to avoid enforcement action by this office. Call me at (860) 644-2511, ext. 251 if you have any questions.
