An additional provision would be included to read "Provided that the external appearance and general character of the building as a single-family dwelling shall be preserved." A rooming house is currently defined in the zoning regulations as "a residence in which the resident owner, or tenant, rents rooms for compensation to 1 or more persons, but not in excess of 6 persons". It is my understanding that that while the definition of a rooming house exists, current regulations have no provisions to allow this use in any zone in South Windsor. In addition, parking requirements in Table 6.4.3A to should be modified to specify minimum required parking spaces for 1 space per bedroom for a rooming house use. The intent of this text amendment is to provide additional means of residential housing, as supported by The Housing Element of the Town Plan of Conservation, which includes goals that are relevant to this application, including: • Develop housing to meet the needs of the entire community, including but not limited to: small families, large families, the elderly, single adult households, various income levels, and • Develop a full range of housing styles, types, sizes, densities, affordability, and forms of ownership in order to meet the housing needs of the community. FROM: Walter Summers, Fire Marsh DATE: 7/18/2013 RE: Isherwood Text Amendment Michele, The Fire Marshal Office has reviewed the text amendment proposal submitted by Isherwood Civil Engineering to allow Rooming Houses in A-40 Zone. First,I reviewed the definition of a Rooming House in the Town's Zoning Regulations. Rooming House: A residence in which the resident owner, or tenant, rents rooms for compensation to I or more persons, but not in excess of 6 persons. This definition mirrors the definition in the Connecticut Fire Code for a Boarding House. A building arranged or used for lodging for compensation, with or without meals, and not occupied as a single-family unit. The first impact to the Fire Code is the requirements for a change of use group for the building. The Fire Code defines change of use as: Change of Occupancy Classification or Use:In any building or structure, whether or not a physical alteration is needed, a change from one occupancy classification to another shall be permitted only where such a structure, building or portion thereof conforms with the requirements of this code that apply to new construction for the proposed new use, except that a change of tenants or ownership shall not be construed to be a change of occupancy classification where the nature of use and assigned occupancy classification remain the same If the Building changes from a single family use group to a boarding house use group, the building would have to meet new Fire Code requirements. These requirements could include fire sprinklers, fire alarm system, means of egress changes, etc. The Fire Code Official would also have two important occupant factors to consider with a Rooming House/Boarding House use being applied to a building. First is personal care services provided. Personal care services are defined as the operator is responsible for the safety of the resident while inside the building. The second issue is the capability of the occupant for self preservation. The definition of self preservation is the occupant capable of responding to emergencies without physical assistance from staff. These two issues directly effect the important factor on how capable are the occupants in facilitating their egress in an emergency situation. We have similar homes in South Windsor that care for residents with special needs in residential zoned areas. I would advocate that these types of applications be reviewed on a single case basis. This is a request for a zoning text amendment to to amend Article 3 Residential Zones, Table 3.1.1A, Permitted Uses, Impervious Coverage and other Provisions Zone, to add"Rooming House" as a use permitted by special exception in A-40 residential zone and amend Table 6.4.3A Minimum Required Parking Spaces — Residential Uses, to require 1 space for each bedroom in a rooming house to allow for Rooming Houses by Special Exception in the A-40 zone. 2. As defined in our current regulations, a Rooming house is "A residence in which the resident owner, or tenant, rents rooms for compensation to 1 or more persons, but not in excess of 6 persons." 3. This regulation would allow for the conversion of a single family homes as well as for new construction specifically in the A-40 zone. In reviewing the zoning map, I would note that there are only two areas in our town that are A-40 zoned—the bulk of Main Street area as well as a small area in the vicinity of Dart Hill and Ellington Road. 4. Minimum lot sizes required in the A-40 zone are 40,000 sf with 150 feet of frontage. I would note that several of the properties in the A-40 zone are undersized to these requirements. I would recommend the Commission require the lot to be a minimum of 40,000 sf. 5. Additionally, the Commission may want to consider requiring that the owner on the property live in the house similar to what is required in the accessory apartment regulation. 6. The second proposed text change is to require an additional parking space be added for any rooms that are rented. I would recommend that we add the same requirement for parking that is found in the major home occupation regulations. Those requirements are: • All parking needs must be met on-site. Any parking in excess of customary residential parking may be required to be screened from the street and from adjacent residential property by either: • Fencing of a type typically used in residential areas such as stockade fencing, not slatted chain-link fencing; or • Evergreen plantings of sufficient height and spacing to establish an adequate screen. 7. The Residential Development Section of the newly adopted Town Plan of Conservation includes a strategy that is relevant to this application: • Allow flexibility in meeting emerging housing preferences and needs; Also, since much of Main Street is zone A-40, the Community Character-section of the plan addresses strategies for Main Street. Under the strategy of Preserve Historic Building, Structures and Landscapes —it supports the idea of allowing flexibility in the zoning that may help owners to re-s*e historic buildings. VSc 8. A rooming house use is,defined under the fire and building code. The Fire Marshal and Building Inspector have indicated that any proposals would have to meet the minimum building and fire codes and would be addressed at the time of application. 9. There should be no infrastructure impacts of associated with this amendment. Adequate Sewage disposal, water and refuse pickup would have to be addressed at the time of application. 10.There should be no environmental impacts associated with this amendment. 11.There should be no significant traffic impacts associated with this amendment. At the time of the special exception/site plan application, the applicant would have to address anticipated traffic. 12.The Capitol Region Council of Governments has reviewed this amendment and have offered the following comments: READ CRCOG REPORT 13.If this application is approved, the Planning Department has no requested modifications other than indicated above. South Windsor.is a wonderful place to live. It has upstanding citizens, good infrastructure, and excellent schools. While these amenities make life here enjoyable, they alone fail to distinguish South Windsor from any number of other municipalities in Connecticut or across the nation. South Windsor's uniqueness is wholly due to its historical, architectural, and cultural heritage—qualities embodied primarily by Main Street and its adjacent area currently zoned as A-40. Maintaining the fragile balance between our past and future requires maintaining existing zoning restrictions. Allowing this proposed zoning change will open Pandora's Box: • This zoning change would negatively affect the character of Main Street and the Town's Historic District through necessary changes to interiors and exteriors required to bring any special exception building in compliance with state and federal codes and regulations • Special use inevitably requires site modifications, such as increased parking areas, which negatively affect the surrounding properties and the area in general • This change would be in direct conflict with the recently enacted Demolition Delay Ordinance, which seeks to"limit the detrimental.effect on community character and heritage that may result' when existing historical structures are threatened with modification or demolition. Again, special exception applications would necessarily require changes that cannot be reconciled with the ordinance • Once enacted, this change would give future applicants legal and ethical grounds to force other special exception applications to be granted on Main Street, accelerating the destruction of the qualities that make South Windsor unique There is no compelling reason to modify the existing A-40 zoning regulation and significant reasons against it. I mention this because Main Street has been recognized as a treasure, not only for South Windsor, but for the State and even the Nation. I would also note that in your recently finalized and outstanding Plan of Conservation and Development for the town, you state that 77%of the population wants to see the character of Main Street preserved. The Historic District Commission has regulations that allow it to protect the exterior features of the structures included in the less than one mile of its jurisdiction on Main Street. We understand that many of these houses are large and require a special interest in maintaining their integrity. If we look at the case history of the Watson House, for example, we can learn that zoning allowing a B & B is very different from that allowing for a rooming house. In approving the use of the Watson House as a Bed & Breakfast, stringent requirements for owners living on the premises and the length of stay of guests, were included specifically to protect it from becoming a "rooming house." The other very important factor, is that the owner of a B & B has a financial interest in preserving the 18th century character of the exterior as well as the interior: its paneling, interior shutters and twelve fireplaces, all add to the charm and unique experience it provides its patrons. The owner of a rooming house has no such incentive. The Watson House is of course only one of many potential sites for this proposed use in the Historic District and on Main Street. It is however, considered a rare example of a three story mansion, one of the first designed by an "architect," remaining in the Connecticut River Valley. And so, I would urge the Commission to deny this broad request that could lead to the irreparable damage and degradation of the character of Main Street, that the majority of South Windsor residents would like to see preserved. 10*N Sf4 m 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CT 06074 Soa co TELEPHONE (860) 644 2511 September 13, 2013 Karen Isherwood Isherwood Civil Engineering 58 Ordway Drive South Windsor, CT 06074 Re: Appl. 13-30P, Isherwood Zoning Amendment Dear Ms Isherwood: This is to advise you that on September 10, 2013 the Planning and Zoning Commission voted to deny your request for a zoning text amendment to amend Article 3 Residential Zones, Table 3.1.1A, Permitted Uses, Impervious Coverage and other Provisions Zone, to add"Rooming House"as a use permitted by special exception in A-40 residential zone and amend Table 6.4.3A Minimum Required Parking Spaces—Residential Uses, to require 1 space for each bedroom in a rooming house to allow for Rooming Houses by Special Exception in the A-40 zone.
