We are requesting two 12) variances: the first is a five foot (5') variance from
the side yard variance requirement of ten feet (10 ) , and the second is a 3.27
increase in the maximum allowable impervious coverage requirement of 50. Both
variances are requested to permit the placement of a 20' x 192' car storage building
to be used in connection with the Classic Car Club, LLC business already located
on the property.

1. Strict application of the regulations would produce UNDUE HARDSHIP bec�t :C��i� !
of the property's unique triangular shape which precludes the placement
of the propose ui ing on t e site. Other hardships may be presente
at the hearing.

2. The hardship created is UNIQUE and not shared by all properties alike in the
neighborhood because
of the property's irregular shape which is the reason the proposed
development cannot meet the side yard setback and maximum impervious
coverage requirements.

3. The variance would not adversely impact neighboring property; i.e. public health, safety,
convenience, welfare and property value, because
the property is located in the industrial zone on a commercially developed
highway. The proposed building will compliment the existing car club
business and will have no negative impact on the other commercial neighbors.

Records.
Said premises are subject to taxes on the List of October 1,2003 and thereafter,which taxes the
grantee herein assumes and agrees to pay.

This is to confirm our recent conversation concerning the Department of Transportation's opposition to
the request by the subject owners for a zoning variance at 1496 John Fitch Boulevard. The primary
reason for CDOT objection is due to the close proximity of the proposed rear of building to the State's
railroad ROW line. Future maintenance to the rear of the building, rear pedestrian and vehicular access
would be nearly impossible upon the owner's remaining narrow strip of property between building and
the State's ROW line and future encroachment into the railroad operating area by the owner for the
aforementioned purposes appears inevitable.
