Requesting Variances at 11 Mountain View Road
Zoning Regulation Sections: 2.14.C.1 and 3.1.2A
We are asking for a side yard variance of less than 3 feet to construct an in-law
apartment in line with the existing attached garage. We also ask to raise the roof of
the garage to add a second floor which will be used as storage but could be turned
into a bedroom at a later date, however we are now considered a non-conforming
property and the existing garage is only 7.5 ft from the boundry. We also ask for a
front yard variance to add an enclosed front porch(32ft x 8ft).
We realize that our house was built prior to zoning regulations but with the
topography of our land they designed and built the house on the best part of the
property in keeping with the look of the neighborhood.
1. Strict application of the regulations would produce UNDUE HARDSHIP
because:
We wish to add an in-law apartment (approximately 840 sq.ft.) while keeping it in
line with the garage so it will not impede on the kitchen windows on the existing
house. The garage will be used for the in-law apartment so we can keep everything
on one level.
Adding a second story above the garage will give us additional walk-in storage but
could be turned into another bedroom. The roof height will be less than the
existing house roof height. This addition will add much value to this property as
we do have a large lot at the end of a dead end street which is very desirable for
any family.
Adding an enclosed front porch will not only give us much needed curb appeal but
will also help us to reduce heat loss every time we have to open the front door.
2. The hardship created is UNIQUE and not shared by all properties alike in the
neighborhood because:
Because our house was built before zoning regulations side yard and front yard
dimensions probably were not as critical as they are today. With the topography of
our property the only feasible place to put the house is where it is unless it was put
