Kittens Police-860-644-2551 Animal Control-860-648-6239 Robin.bond@southwindsor.org South Windsor Regional Animal Shelter Servin.'East Hartford.Manchester and South Windsor For more than twenty years the South Windsor Police Department has sought out a permanent home for the agency's animal control operations. The Town's former dog pound was located on land adjacent to the Town Garage facility on Burgess Road. The facility had only 4 kennels and was not conducive to training, visits from the public or long-term sheltering. The Towns of East Hartford and Manchester have agreed to partner with South Windsor for the sheltering of animals taken into the custody of animal control officers from each of the three towns. The new facility at 124 Sullivan Avenue, Burgess Road Dog Pound. South Windsor, is well located for easy access by each town. The frontage along Sullivan Avenue (Rt. 194)provides excellent exposure and curb appeal for the new facility. Such exposure is likely to attract more volunteers, more recognition and more potential families to adopt shelter animals. Initial funding for the shelter will be provided through a grant obtained in 2008 for the acquisition of land and building of a regional animal shelter. The grant was received from the State of Connecticut and totaled$515,000. Funding for the continued operation of the facility would be obtained from three primary sources-the operating budget of the Town of South Windsor, an annual usage fee paid from each participating community, and a daily animal housing fee paid for the duration of an animal's stay. Additional funds may be available through donations and the proceeds from public programming. The shelter will fulfill the statutory need to provide a shelter for the comfortable and sanitary detention of dogs that come into the custody of local animal control officers; iF (CGS 22-336). Additionally, the shelter will provide a location for animal sheltering in the event of a disaster. Situated on two acres of land, the Sullivan Avenue site is suitable for the short-term sheltering of large animals in the event of a disaster. The existence of an animal shelter in our community will provide our department with a focal point for animal control education and community outreach. The shelter will become the centerpiece for-animal education and training in.the community. Through a partnership with the South - Windsor Parks and Recreation Department,we will offer _programs such as pet grooming, animal communication, alm-al population control, disease prevention and other useful pet owner educational programs. - -- - The shelter will become the office for South Windsor's animal control officers. They will have office space at the shelter where they can write reports and communicate Page 1 of 3 South Windsor Regional Animal Shelter Serving East Hartford,Manchester and South Windsor with headquarters and the public. Quartering the animal control officers at the shelter will be beneficial in that it will ensure a nearly constant presence at the facility. Animal control officers from participating R communities will also have a space to complete required forms, reports and make contact with the public. All of the .t` animal control officers will take a role in maintaining the shelter in a sanitary, well-kept condition suitable for the I public. The control of disease, odor and noise is a priority for any animal control shelter, and we will strive to maintain the shelter to the highest of standards. The CEOs of each participating municipality will serve as a Board of Directors for the facility and will be responsible for fee setting, strategic planning, policy setting and the overall operation of the facility. Considerations for the long-term maintenance of the facility will also be the responsibility for the Board as they work to ensure that future capital improvements are properly contemplated and funded. How will this impact the operations of the South Windsor Police Department? South Windsor employs two Community Service Officers )whose CSOs e_ .` primary - responsibility is animal control. Through the years these ._ CSOs have not only focused on animal control but they have also engaged in other non-hazardous duties such as the investigation of minor traffic accidents, traffic control and assistance to residents for services such as fingerprinting. We understand that those two CSOs will have to focus y -NMImore time on the animal shelter. We are able to accommodate this change within our current staffing levels. When we began the CSO program nearly twenty years ago we envisioned them having to focus on animal control duties almost exclusively. Because the CSOs will no longer have to travel out of town to drop off, pick up or otherwise tend to our sheltered animals, we anticipate that they will continue to be accessible to assist our police officers. Funding Models There are different funding models under consideration for the shelter. 1. Flat Rate—Each participating community pays a flat rate annually to cover the cost of sheltering. Additional costs would be assessed for veterinary care as needed. 2. Per animal—It is not uncommon for a shelter to charge between$15 and $25 per day per animal. Veterinary cost would be added for care provided to a specific animal. 3. Hybrid—A combination of models 1 and 2 above could be employed. A participating community would pay a flat fee for access to the shelter and then a reduced per day rate per animal. Veterinary fees would be added for care provided to a specific animal. Page 2 of 3 South Windsor Regional Animal Shelter Serving East Hartford. Manchester and South Windsor For example, in 2009 Manchester sheltered a total of 232 dogs. The average stay for each animal was 5 days for a total of 1,160 shelter days. At a charge of$20 per dog per day the total assessed for the sheltering of the 232 dogs would be $23,200. Redemption When a dog is claimed by its owner, a statutory fee is collected. (CGS 22-333). The redemption fee cannot be in excess of$15. The owner may also be charged for any advertising that took place upon the Town's recovery of the dog. In certain cases the owner can also be charged the full cost of sheltering the dog. Annual Budget for Shelter Operation Utility costs for a 12 month period are estimated at $20,000. During the last three years, the fire department paid an average of$11,000 per year for utilities.ties. However, the building was occupied on a part-tune basis with no consistent environmental control. It is anticipated that as an animal shelter, the facility will be used on a daily basis and the environment will have to be kept suitable for animals and employees around the clock. Utilities (Electricity,, Natural Gas, Water, Telephone) $20,000 Animal Food $ 1,000 Cleaning Supplies $ 1,200 Animal Disposal $ 500 Vet Fees $ 2,500 Facility Maintenance $ 2,500 TOTAL $27,700 Our goal is to eschew the image of the stereotypical city-run"dog pound"as a dark, run down, smelly, uncomfortable place where sick, mangy dogs go to be destroyed. Instead, we want to join the growing trend of communities that adopt a humane animal control policy by providing a clean, comfortable, sanitary facility designed to care for household pets who become separated from their owners, and to provide sheltering services for other animals who are in need of medical care and rehabilitation. We want to create a facility that is inviting for community members in order that we can reunite shelter animals with their families and adopt out as many unclaimed shelter animals as possible. The 2.001 acre site contains a 4,239 square feet vacant building that previously was home to a fire station. The old firehouse will be repurposed for use as the Tyler Regional Animal Care Shelter. The site is wooded along the northern and eastern borders. It is also wooded along the western border adjacent to the parking lot area. The Animal Shelter will : serve the towns of East Hartford,Manchester, and South Windsor. Attached is a brochure describing the mission of the Animal Care Shelter and a document summarizing the goals and objectives of the Animal Shelter for this location and consistent with the requirements of zoning. The footprint of the building will be unchanged. A 900 square feet outdoor enclosed area is proposed adjacent to the east side of the building. The wall facing Sullivan Avenue will be brick and a six feet chain link fence is proposed for the east and north face of the enclosure. The Animal Shelter will be connected to public sewer, and the existing septic system will be abandoned. The : building is connected to public water and will remain as such. All other utility connections will remain the same. Presently, there are two paved entrances to the site. The eastern driveway will be removed and replaced by a lawn area. There are seventeen parking spaces presently, thirteen perpendicular and four parallel spaces along the western driveway. Two of the perpendicular spaces will be converted to a van accessible handicap space for ADA compliance and the four parallel parking spaces will be removed to improve circulation, thereby reducing the total number of parking spaces to twelve. The calculated total number of parking spaces required is nine. Additional lighting and a new sign are proposed. : It is anticipated that four employees will be utilizing the facility for office space; two employees : from the Town of South Windsor, and one each from East Hartford and Manchester. Based on our understanding of the facility's proposed use, building occupants will not consistently be arriving or departing during peak commuting hours. However, a conservative estimate for the number of one- way trips per day is sixteen. During the morning and afternoon peak hours, we estimate that the animal shelter will generate two trips each. The sightline at the existing entrance driveway is adequate in both directions. It is our opinion that there will be no adverse traffic impacts to Sullivan Avenue, nor will the safety of motorists using this facility be compromised. • G:\jobs\2977\Docs\Applications\2977 Special Exception Narrative 022712.doc South Windsor Online Property Viewer Page 1 of 1 Town of South Windsor Printable Abutter List Total Abutters: 7 ( Close Owner Address City State Zip MASSCONN DISTRIBUTORS CPL 12 COMMERCE WAY SOUTH WINDSOR, CT 06074 INC MASSCONN DISTRIBUTORS CPL 12 COMMERCE WAY SOUTH WINDSOR, CT 06074 INC GARDEN GROUP LLC 48 COMMERCE WAY SOUTH WINDSOR, CT 06074 SCHWEIR LEON &EILEEN 17 SMITHFIELD LANE BEDFORD, NH 03110 TRUSTEE C/O KAREN S PETRAGLIA SOUTH WINDSOR TOWN OF 59 124 SULLIVAN AVENUE SOUTH WINDSOR, CT 06074 FIRE HOUSE 3 AMARO JOSHUA 135 SULLIVAN AVE SOUTH WINDSOR, CT 06074 D&L CARON LLC 312 DEMING ST SOUTH WINDSOR, CT 06074 This abutters list is for reference only. Based upon state law and the Town's regulations, it is my opinion that the Town should seek both an 8-24 report and special exception approval to install the shelter. An 8-24 referral to the planning commission is required whenever a town substantially improves or leases any municipally owned property or public building. I understand that the Town owns the building in question and would like to install an animal shelter, including cages, exercise pens and associated offices. Although there is some flexibility in interpretation, e.g. is the intermunicpal contract really a "lease"and are the improvements"substantial,"given the fact that two council members have expressed concern and the fact that P&Z must sign off on the special exception (see below), it seems best to make the referral and avoid a challenge later on this ground. I understand that the building in question sits in an RC zone. The Town's regulations specifically permit the installation of municipal facilities in this zone upon Special Exception approval. See Section 4.1.1.A. I have looked for exceptions to this rule, such as reviewing this from the standpoint of an "Essential Community Service"as defined in the regulations, but even this requires special exception approval and seems to be limited to residential zones. Moreover, my brief legal research indicates that these types of municipal uses are often subject to special permit or special exception approval and that there is no automatic override simply because it is a use the Town must provide. I would also point out that veterinary hospitals and boarding kennels are not otherwise permitted in this zone. Finally, I looked into whether the fact that this building already was approved for a municipal facility would obviate the need for further permitting but Section 8-3.C. states that any substantial changes in facilities or uses subject to a special exception require further approval from the Commission. If you would like this in a formal memo and/or need anything further, please let me know. Best- Kari Kari L.
