1. Strict application of the regulations to this parcel would cause-UNDUE HARDSHIP
because this rectangular 1.19 acres (51,861 sq.ft.) is reduced to 21,690 sq.ft. (41.8%) by the
buffer and setbacks. This lot, which has an 80' wetlands buffer in the north-westerly corner, is
located at a comer of the industrial zone, and both the southerly and westerly property lines abut
the residential zone.
The imposition of a 50' buffer along the southerly and westerly boundaries in addition to
the wetlands restrictions at the north-west corner, result in exceptional difficulty and unusual
hardship so that substantial justice will be done by granting the variances requested. The
granting of the variances will not cause any harm to the public health, safety, convenience,
welfare or property values.
2. No other parcel in the district is so seriously impacted by the strict imposition of section
6.2.4 of the zoning regulations. This industrial lot is in a corner of the zone and borders
residential zones to the west and south and is uniquely affected with the buffer being along 2 lot
lines. In addition; the lot has an 80' wetlands buffer at the north-westerly comer.
3. The property is being developed solely as a parking lot to support the school bus terminal
on the opposite side of Ident Road. The automobiles currently parked at 38 Ident Road will now
park upon the subject property. There will be no change in the use of 38 Ident Road, no increase
in traffic, no change in the hours of operation, and the vacant industrial lot will become a gravel
parking lot. There will be no negative impact from this development, no new traffic, no vehicle
trips, etc.

Hello Michele,
Regarding the lot on Ident Road, conversations with neighbors prompts me to further refine the question
regarding "What has changed?" for First Student.
I don't have the details in front of me,but a question arose regarding the number of parking spaces that
will be in the new lot. It was mentioned that there would be 80 new spaces. If that is correct, that seems
to be approximately twice as many parking spaces as currently exist. And, unless there does plan to be a
change in use for the current employee lot, that means there could be three times the number of current
parking spots.
So: How many employee parking spots are needed? And,to repeat from below, is there a plan to change
the use of the current parking area?
Thank you for considering these questions. Also, is there now a new request filed, per your note below?

Thank you for your comments. FYI —The Mitchell variance request will not go forward tonight—there is a
discrepancy in the applicant's request and what the map shows—so the legal notice was not published
accurately. Attorney Gerlt(representing the applicant) has requested that we postpone the public hearing until
the October 1, 2009 ZBA meeting so that a correct legal notice can be published.
We will hold these comments and present them at the October 1st meeting. If you have any questions, please

Subject: Ident Road variance, GIS 8700R002A
Hello,
I understand there to be a meeting to consider the Zoning Board of Appeals application of Mitchell
Property Group, LLC, for the property at the west side of Ident Road. We will not be able to attend, but
we would like the following issues to be considered:
Usage:
We wonder what has changed that requires additional parking. The application indicates no additional
traffic. So what is inadequate with the current situation?
We have been very happy with Mitchell building for First Student. The building design, landscaping and
barrier trees result in an attractive property. Will there be any attempt to be sure the parking area is
equally well kept? What will happen with the current parking area? Will buses be parked there? If so,
this will defeat the benefits of the barrier trees.
Will drainage and other environmental issues be considered?
Have the properties on Bancroft Lane been properly notified? While there is a wooded lot/wetlands on
the westerly side, a 50 ft variance reducing the barrier to 5 ft seems excessive. How will the reduced
barrier impact the adjacent properties and the wetlands?
Safety:
The residents of Ident Road too often encounter employees of Lavallee Door, First Student, and the
businesses within the other commercial building exiting their parking areas without looking for traffic
from Ident residents. Our concern is that this will be another entry point- and one that will have the least
visibility down Ident Rd. (due to a bend in the road and trees). This could be an increased safety hazard
if the employees forget to check both directions.
If passed, please consider safety enhancements; perhaps a convex mirror strategically placed could help.
Pedestrian crosswalks should also be considered. We are also concerned about First Student employee
safety and the parking situation will require that they cross Ident Road.
High school students will now have another parking lot to cross to get to their bus stop. Please note the
students do not favor a bus coming down the road to pick them up unless it is full size(which can
successfully navigate the cul-de-sac, even though First Student has only sent smaller buses). We just
9/21/2009
want to make sure that all employees are made aware of the safety issues.
Property value:
There will be an impact. It should not be so quickly assumed that there will not.
Future:
If there are abuses, traffic increases, or driving hazards, what will be the best method to raise issues in
the future? We want to be sure that any variances granted do not lead to future relaxation of concern for
the residents in the area. We know that First Student services buses from other towns, so we are also
concerned that there could indeed be increased traffic that may happen gradually over time.
Thank you for considering our concerns and the general concerns of any property owner in South
Windsor.
Thank you.

RE: Appl. 2736-09—Mitchell, 35 Ident Road, I zone
Dear Attorney Gerlt:
At the meeting of the South Windsor Zoning Board of Appeals held on October 1, 2009,the
Board approved with conditions your request for a 13.5' variance to Table 6.2.4A along
southerly boundary to allow the buffer to be 36.5 feet and a 20' variance to Table 6.2.4A along
westerly boundary to allow the buffer to be 30 feet at 35 Ident Road, I zone.
The Board determined the hardship to be the extent of wetlands and required buffer for wetlands;

maintained over time to provide complete screen boundary; 3) crosswalk to be shown on plan at
time submitted to Planning&Zoning; 4)wheel stops as shown on the plan to ensure conformity
to the buffer as varied; 5)well at 47 Ident Rd. be tested prior to construction to establish baseline
of water quality; 6) approval of site plan by Planning&Zoning and Inland Wetlands.
