Dear Ms. Anita Gold:
At the meeting of the South Windsor Zoning Board of Appeals held on March 6,2008,the Board
approved your request for a P 4" height variance to Table 6.5.8b to allow a sign to be 6' 4"(5
feet allowed) for Century 21 on property located at 35 Oakland Road,RC zone '
The Board concluded the hardship to be:
1. That the visibility of the current sign is obstructed by trees planted by the State as part of
the landscape beautification.
2. The proposed sign must meet the State Right of Way requirements and the location
identified where the sign can fit is restricted by the distance between the property line and
the parking lot.
3. Additional height for the new sign would help ensure that drivers can quickly and safely
identify the business location and the driveway entrance safely.
Any new building, or alteration/additions to existing buildings, requires a building permit prior
to start of construction.
These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your
own expense.

Zoning Board of Appeals will be heard on Thursday, January 3, 2008 at 7:00
p.m. in the Madden Room of the South Windsor Town Hall, 1540 Sullivan
Avenue, South Windsor. Someone must be present at the hearing to present

Windsor Zoning Hoard of Appeals, requesting a variance of
Section 4.4.9 to allow a sign larger than permitted on
premises known as 35 Oakland Road, has been granted as
follows.
The Board voted the approval of Appeal 0852, request for a
variance of Section 4.4.9, to allow a sign larger than
permitted due to the difficulties of the normal traffic
b ing able to see beyond the gas station parking and normal
activities to the substantial setback of the sign. The
sign is not to exceed llj feet in height, is to contain not
more than a 31 x 51 illuminated area with not more than
three 1' x V attached signs, and,with identical sign design
as proposed and submitted to the Zoning Board of Appeals with
the application. The sign is to be set back sufficiently
from the State taking line so as not to create a traffic
hazard. The illumination of the sign is not to continue past
midnight.

At the Zoning Board Appeals meeting of 1/x/08, the Board requested additional information
related to the signs located at 41 Oakland Road and 25 Oakland Road. Both properties had
received ZBA variances in the past for signage and copies are attached -- 41 Oakland Road
(Dzen Realty formerly Shea's Florist- see ZBA Appl# 1717-87 and Appl# 1724-87 ) and 25
Oakland Road (South Windsor Medical Arts formerly the Sheridan building- see Appl# 1339-79
and Appl# 1380-80). I would note that the variances were granted at a time when only a free
standing or building sign were allowed on commercial properties (not both) and the free standing
signs were limited to 12 sf in size.
Both properties currently have free standing signs. Joy O'Connor, Zoning Enforcement Office did
field measurements and took some pictures for your use. The field measurement of the existing
freestanding sign at the South Windsor Medical Arts sign is approximately 13 feet from the edge
of the road and is approximately 8 feet by 4 feet in size and 8 feet in height. The Dzen sign is
approximately 14 feet from the edge of road. The owner of the Dzen property provided the
following dimensions of their current free standing sign- 4'2" X 4' 6" wide and approximately 6 'h
feet high.

Requesting a Variance to Zoning Regulation Section(s): 6.5.8 B (Height Maximum of Five Feet)
Written Description of the variance request:
We are requesting a height variance of one foot four inches above the five-foot maximum sign
height in a Commercial Zone for the business property located at 35 Oakland Road(Route 30.)
This property suffers from a group of unusual circumstances that have caused great difficulty in
arriving at a new business identification ground sign that would meet Town Zoning requirements
and State Right-of-Way restrictions.
1.Strict application of the regulation would produce UNDUE DARDSHIP because State DOT
realignment of Route 30 reduced the area available for ground sign location. Investigation by
Kevin Kamble, of District Traffic(DOT)and a surveyor for Clemens have arrived at a consensus
of a five-foot area of the landscaping strip next to the parking spaces as acceptable for placement
of a ground sign. Due to this width restriction, a longer, lower sign meeting the five-foot height
requirement could not be used at this location.
2. The hardship created is UNIQUE and not shared by all properties alike in the
neighborhood because visibility of a new identification sign is a tremendous issue at this
location due to various obstructions specific to the property. Trees planted by the Town as part of
a landscape beautification at 35 Oakland and the neighboring medical office building for
Eastbound motorists and a picket fence, telephone pole and roadside traffic signs traveling
Westbound all contribute to obstructing the view of anyone trying to find their way to the Century
21 building. In addition, the traffic on this section of Route 30 moves quickly and driver response
time for turn-signal and driveway entrance location is very short. Because the proposed sign must
be narrow to meet the State Right-of-Way, the additional height for the new sign would help
ensure that drivers can quickly identify the business location and driveway entrance.
3. The variance would not adversely impact neighboring property;i.e.public health, safety,
convenience, welfare and property value, because the proposed height of the new sign would
not obstruct the signs of neighboring businesses. It would also be appropriate in size, style and
color for the specific property and for the general commercial area.
Presently, there is a tall landscaping bush next to the driveway entrance that will be removed to
open up a view of the proposed sign for eastbound traffic. The tree currently makes it difficult to
exit the driveway with a clear line of sight. The proposed sign will sit far enough back from the
road and far enough away from the driveway entrance to leave an unobstructed view for exiting
motorists.

Dear Mr. Sheridan:
Your application to the South Windsor Zoning Board of Appeals
requesting a variance of section 4.4. Article 4.4.3 to allow a i
second sign and one larger than permitted on premises known as
25 Wcland Road, Zone lC has been granted.
The Board voted to grant this application because it felt that
granting of this variance is in keeping with the general
philosophy of the Board to encoiaage the orderly development of
business in town. They felt that to deny the Variance would
cause the bank and its customers to be inconvenienced and the
public could be subjected to a safety hazard through an improper
flow of ingress and egress to the drive-in window.
This action is effective June 18, 1980 and upon filing of the
enclosed form in the Town clerk's Office. The enclosed form,
however, must be completed by inserting the legal description of
the property in question, as well as the name of the owner of
