Design Professionals Zoning Amendment/Mixed Uses in Industrial Zones Public Hearing 4-10-07 Planning Department Report 1. Request for amendment to Section 5.7.2 of the zoning regulations to expand the zones in which mixed residential and business uses are permitted. The current regulations allow a maximum of 25 dwelling units to be located above commercial uses by Special Exception in RC, GC, RO and OCO zones; the amendment would modify the regulation to allow dwelling units above industrial uses in industrial zones located adjacent to residential zones also. Planning Dept staff have provided a GIS map showing all residential properties abutting industrial zones so that the Commission can see where this zoning amendment would be applicable. 2. The existing Mixed Use zone requires the dwelling units to be located on the second floor. Dwelling units may be townhouse-style if height restrictions permit, but no dwelling units can be located on the ground floor. A mix of unit sizes must be provided, and 3-bedroom units are not allowed. In addition to the specific criteria for the mixed uses, the regulation also includes the standard Special Exception criteria for Commission consideration. 3. The Town Plan of Conservation and Development does encourage mixed-use development, but is not specific about appropriate zones for the mixed uses. 4. The addition of dwelling units above industrial uses is not likely to impact local infrastructure, nor to create environmental impacts greater than the environmental impacts created by the industry itself. 5. The Commission should consider the potential traffic impacts of combining residences on the same site as industrial users. It is difficult to conceive of residential vehicles sharing full-time occupancy with industrial trucks on a site. 6. The Special Exception itself is for the residential units, not necessarily the underlying industrial use, which could change over time from a suitable industrial use (such as an office building) to an unsuitable industrial use. The Commission needs to consider the precedence of enacting this amendment. The Commission may also want to consider the legal and liability implications of allowing dwelling units to share the same site and building as industrial uses. If the proposed amendment is enacted, the Commission may want modifications i to ensure that dwelling units can only be located over specified appropriate industrial uses such as office buildings and financial institutions, and not over such as-of-right uses as warehouses and manufacturing establishments. 7. The Capitol Region Council of Governments has reviewed the proposed amendment as required and finds no apparent conflict with regional plans and policies or the concerns of neighboring towns. If this application is approved, Planning Dept requests no other modifications except as already noted. 2
