We, Robert & Kimberly Austin are requesting that we be allowed
to use the property at 64 Morgan Farms Dr as an in-law setup for
the following reasons :
The parents of Kimberly (Robert and Arline Jackson) are now in
their mid 70 ' s and it is becoming increasingly more difficult for
them to care for the home they presently occupy in Wallingford and
to care for themselves. We presently reside in Manchester and work
in Hartford and" due to the distance involved in traveling to
. Wallingford the number of times necessary to care for a home and
parents make this an undesirable option.
Three (3) years ago Robert was diagnosed with prostate cancer and
due to this condition may soon demand surgery and radiation
treatments. A process that would leave him in a seriously weakened
and limited position. As their only child, it is our desire to care
for them during these difficult times .
We had looked at other properties with this arrangement in mind,
but found none as suitable as this property. The living quarters
are all on one level, the bathroom has a handicapped accessible
shower. Other options in living arrangements required the use of
stairs by Robert and Arline or some other inconviences.
This property is ideally suited for our needs in both privacy
and proximity. It is our understanding that the present owners were
granted a permit for the very same reason.
At such time .as Robert and Arline no longer reside there, the.
rooms would be absorbed into our living space with them being used
as a family room, a study, and guest rooms .
Thank you for your cooperation in this matter.
Robert N. Austin

Austin In-Law Apartment T & C Renewal PH 5/11/99
1. Request for renewal of a Temporary
q p ry & Conditional permit for an in-law
apartment at 64 Morgan Farms Drive, A-20 zone. The original ZBA approval
was granted on May 11, 1995, and this Commission renewed it in 1997. The
PZC approval for the in-law apartment imposed the standard approval
condition:
• This approval is for an in-law apartment for a family member/relative only.
When the in-law apartment is no longer occupied by a relative of the family,
the apartment cannot be treated as a second dwelling unit. Instead, the
kitchen must be removed and the living area must be converted into other
living space for the main dwelling.
1. The PZC adopted a new in-law apartment regulation on 1/28/98 including a
definition of an in-law apartment as well as specific criteria for the unit; and
providing for a 5-year permit period. These criteria include:
♦ The in-law apartment cannot be larger than 900 sq ft or 40% of the gfa
(whichever is smaller
♦ the entire structure must maintain the appearance of a single family
dwelling;
♦ off street parking for three vehicles must be accommodated;
♦ adequate water and sewage disposal must be provided; and
♦ the owner of the dwelling units must occupy either the in-law apartment or
the main dwelling unit
The Commission may waive one or more of the provisions above (except the
requirement that an owner live in the apartment or house) after determining:
♦ There will be minimum adverse impact on existing uses in the area;
♦ Surrounding property values will be conserved and the character of the
neighborhood will not be unduly disrupted;
♦ Due consideration to preservation of historic factors has been demonstrated.
2. The application indicates that this in-law apartment is approximately 900 square
feet; it was previously approved when there were no criteria.
If this application is approved, the Commission may grant approval for up to five
years. The applicant will be asked via letter to reaffirm ownership of the property
every two years. At the end of the permit period, if the family situation has not
changed, the applicant may request renewal by staff.
