Request for site plan approval to place a sunroom structure on the front of the Mill on the River restaurant, A-20 zone. The Mill is an existing nonconforming use in the A-20 zone. Part of the existing building is nonconforming within the front yard setback, but the greenhouse addition would adhere to the required 40- foot front yard setback. 2. Several variances have been granted to the Mill in the past, including variances in 1986 and 1988 to allow the addition within the front yard setback, and a variance to allow the liquor license in 1965. 3. A definitive determination of the square footage of the restaurant has been performed for this application in order to determine parking requirements. The required parking for a 12,756 sq ft restaurant is 255 spaces, the applicant has 190 existing spaces. Architectural and Design Review Committee reviewed this application on September 20 and was satisfied with the proposal. 5. There are regulated wetlands on the site. The piers for the greenhouse are located within the Podunk River floodway. IWA/CC approved this application on September 19, 2007, with no unusual approval conditions. 6. The Fire Marshal has reviewed the plan and has no concerns. 7. The restaurant is connected to public water and sewer. 8. If this application is approved, the Planning Dept has no requested approval modifications. MEMORANDUM To: Marcia Banach, Director of Planning From: Jeff Doolittle, P.E., Town Engineer Robert Grillo, P.E., Project Engineer Date: September 25, 2007 Re: App 07-54P Helmar Wolf& Arturo Guerra — 989 Ellington Road We have reviewed the proposed site plan for Helmar Wolf&Arturo Guerra (Mill on the River), last Revised July 20, 2007 located at 989 Ellington Road and have the following comments: 1. The flood map shows that the limits of the 100 year flood and the floodway run together north of the river between the dam and Ellington Road, where. the proposed green house will be located. Based on the elevation information shown on the plans, it appears that during a 100-year flood the piers (including the concrete to steel joint) and the stairway for the proposed structure will be partially submerged in the floodway. No information was provided as to whether the wall along the river is a flood proof structure. The application should provide documentation demonstrating compliance with Section 5.2 of the Zoning Regulations, Flood Plain Zone. In particular a registered professional engineer needs to certify that foundation is designed and will be constructed to withstand the forces of a 100 year flood and that the 100 year flood level will not be increased by the construction of this structure. . 2. The top of all the concrete reinforced piers needs to be set at elevation 49.0 or higher so this TOW is at least 6 inches above the 100 year flood elevation of 48.5. Please let us know if you have any questions.
