Request for a 5 year maj or home occupation permit to operate a 1 k/n service at 58 Edgewood Drive, A-20 zone. 2. The applicant has been operating a"small lawn service" under a minor home occupation permit since February 2005. At that time, the business consisted of one pickup truck with no sign on it, and no trailer on the truck; the mower was hauled in the bed of the pickup truck. There were no employees and no additional storage of business-related equipment or material, according to the minor home occupation application filed by the applicant. The applicant has provided a narrative statement describing his business. 3. This application originated as a result of a zoning complaint in May indicating that Mr. DeGiacomo is running a landscaping contractor business with storage of goods and equipment outdoors and in the garage. The complaint also included excessive noise and traffic. 4. The reasons for requiring PZC approval are to ensure that: ♦ the home occupation is clearly secondary to the use of the building for dwelling purposes, ♦ the home occupation is compatible with other permitted residential uses in the residential district, ♦ the residential character of the dwelling and the neighborhood are preserved, and ♦ all residents have freedom from excessive noise, excessive traffic, nuisances, fire hazards offensive odors and pollutants, and other possible effects of commercial uses being conducted in residential areas. 5. Performance criteria that must be met include: ♦ Maximum of 25% of the floor area can be used for the occupation; ♦ occupation cannot be visible from outside the dwelling unit; ♦ dwelling must maintain the character of a single family dwelling; ♦ no entrance or exit may be added solely for the occupation; i t ♦ no more than one non-resident employee allowed; ♦ the occupation can not create a volume of passenger or commercial traffic that is inconsistent with the normal level of traffic on the street; all parking needs must be met on-site; and ` C ♦ the Commission may require screening of additional parking from \off the street and from adjacent residential properties. 6. There are two questions regarding the MHO regulations that need Commission consideration for this application: • Is a lawn service considered a landscaping contractor? If yes, then it is expressly prohibited as a major home occupation. • Is this business actually functioning as a landscaping contractor based on its track record? If yes, then it should not be approved as a MHO. 7. Staff note that in mid-June, Mr. DeGiacomo deposited material cleared from his lot onto the Town-owned open space bordering his property to the rear. The damage inflicted included damage to Town trees. Karl Reichle, Director of Operations, sent a letter to Mr. DeGiacomo in mid-June outlining what Mr. DeGiacomo needs to do to return the open space to its previous undisturbed condition by July 30. Mr. Reichle indicated that Mr. DeGiacomo has begun addressing Mr. Reichle's concerns. 8. If this application is approved, the applicant will complete a home occupation form, which contains acknowledgment that the applicant will abide by criteria contained in the zoning regulations. The applicant would also be required to return to this Commission for renewal upon expiration of the 5-year permit period. Also, if approved, the Commission might consider adding as approval conditions: • Shorter approval length rather than the maximum 5 years so that any issues can be addressed expeditiously • Limitations on the amount of equipment and materials that can be stored on site; 2 • A ban on outdoor storage of equipment or materials; • Limitations on the number of times the vehicles can go in and out of the neighborhood (e.g., no returning for lunch breaks) u jk 4- 61"e- 0 p0 - r•hn.. 3 Home OCCUpadon 58 Edg►ewood DdVe. Retail,Sales • No retail stales are done on the premises.. 24 Intraduclron For the past 3 or so years,_I_have been operating a lawn service under a minor occupation approval. The business has been getting bigger and I have taken on an employee. With this development, I wish to apply for a Major home occupation. The equipment is currently stored in the garage and under a tarp behind the garage. I have obtaineda permit to build a 16 x 24 fbot shed in the back yard which will hold most of-the equipment and eliminate the tarp behind the garage. Some of the equipment will be stored in the garage but will not interfere with the ability to park both vehicles. External E, The Shed is not inconsistent_ with sheds that are currently in the neighborhood and will be maintained as such; see attached figure 3. No equipment will be stored outside the shed with the exception of a ladder, and a water-filled roller that attaches Behind a riding lawn mower. Both items will be-behind the shed-and shielded-fmm view with evergreen shrubs and trees. Normal daily activity of the business starts at 8:00 a.m. If the trailer is needed, it is retrieved from storage and brought back to the house. Both truck and trailer are loaded and we leave for the day. Four out of"five days we return and eat lunch at the house for 30-45 minutes, change equipment if needed and leave for the second half of the day. When the day is over we return to the house, unload the truck and trailer, the trailer is returned to storage and the truck returned to the house. As I cut several lawns in the neighborhood, the day would start with the hutting of the lawns in the neighborhood then loading up and leaving for the day. Periodically when work is finished early, maintenance is performed on the machines i.e. oil changing and filter, replacement, blade sharpening. There is noise produced when sharpening the blades. A grinding wheel is used to sharpen 6-9 blades normally taking approximately 15- 20 minutes to sharpen blades. The air compressor is on for 5 minutes or so at the same time as the grinding wheel and then shuts off automatically. The blade sharpening is dome normally twice a week around 4 or 5 o'clock. The oil changing is done once a month at best at the same time. 2"TAIIinq GharaORdEMOF The characteristics of the house and neighborhood will not be changed. There will be minimal visible signs of a business. The back yard will be greatly unproved as the lawn area will be increased; more ornamental flowers and shrubs will be planted to compensate for the loss of wooded greens that grew untamed in the back. Conmerria/_Tratc Traffic in the neighborhood will not be increased as it is rare that I have deliveries for items needed to run the business. I normally pick up all items needed for the day the same day and return an extra. Pagel livery is limited to once or twice a year as replacement parts are only replaced when .something breaks and I need to repair item as soon as.possible, thus visiting a local power equipment store to acquire said item. 3 of 3 Sri' z i __ • `,. t-..i t. . 7 '€"'4g fir.-- _ ' AW < Kf- iv2 Rccl '.' N S :. .ice 4 - C S•`'+°`...
