NARRATIVE FOR WETLANDS PERMIT
May 10, 2010
Application: McDonald's Wetlands Permit
Applicant: 1049 John Fitch Blvd, LLC
Property Location: 1049 John Fitch Boulevard
1049 John Fitch Blvd, LLC (the "Applicant") seeks the approval of the South
Windsor Inland Wetlands Agency/Conservation Commission for a permit to work
within Regulated Areas in a Restricted Commercial Zone at 1049 John Fitch
Boulevard (the "Property"), in connection with its proposal to develop a 3,886
square foot McDonald's, with associated parking, utilities and other
improvements, on the Property. The Applicant also seeks approval of its
proposed Conservation Plan (erosion control plan).
Wetlands have been field delineated in the northeasterly corner of the Property
by John lanni, certified soil scientist. A copy of Mr. lanni's report will be
submitted prior to the Commission's review of this application. A very minor
portion of the improvements shown on the attached site plan are proposed within
the 80-foot upland review area ("URA") surrounding the wetlands. No work is
proposed within the wetlands.
Specifically, the work for which the Applicant requests a permit involves the
construction of a small portion of the entry drive off of John Fitch Boulevard. This
activity will involve the disturbance of approximately 800 square feet of the URA.
The Applicant anticipates the placement of less than 100 cubic yards of clean fill
within this area to create an adequate base for the driveway. The Applicant
anticipates that this work, if approved, will be conducted in the Summer of 2010.
The proposed erosion controls are shown and described on Sheets C-6 and C-7
of the attached site plan. The measures have been designed to comply with the
2002 Connecticut Guidelines for Soil Erosion and Sediment Control.
Additional testimony regarding this Application will be provided by the Applicant's
engineer, John Kucich, and wetlands consultant, John lanni, when the
Commission reviews this application.

RE: Former National Cigar Company Property
1049 John Fitch Boulevard
South Windsor, Connecticut
Dear Mr. Folger:
In follow up to our recent phone conversation this correspondence further explains and
documents the known environmental conditions at the referenced property. Mr. Dan Zak
and Bob Urso have an option to purchase the referenced property with the intent to develop
the site into commercial retail and/or restaurant. Prior to exercising their option to
purchase they contracted with ATC Associates (ATC) to conduct a Phase I and Phase II
environmental site assessments (ESA). The Phase I ESA confirms that the site is not an
"establishment"per the Connecticut Transfer Act(P.A.-85-568) and has no known release
of hazardous waste or oils. Because of the historic agricultural use of the site, ATC
assessed the potential for pesticide impacts in site soil and groundwater.
ATC took 20 soil samples on a 100 foot grid and installed four shallow groundwater
monitoring wells. The results of this assessment shows shallow soils contain residual
concentrations of the pesticides dieldrin and toxaphene at levels above the Connecticut
Department of Environmental Protection(CTDEP) Remediation Standard Regulations
(RSRs)residential direct exposure criteria(RDEC).
ATC's assessment included an evaluation of the soils' compliance with the RSR Pollutant
Mobility Criteria(PMC) for selected samples with highest mass detections of pesticides.
These soils were analyzed via the synthetic precipitation leaching procedure (SPLP)and
showed results complaint with RSR PMC for all samples analyzed. A copy of the ATC
data tables is included as Attachment 1.
The ATC assessment provides a reasonable assessment of environmental soil and
groundwater conditions for this property history and environmental setting. The
assessment provides the basis to conclude the following:
■ The residual impacts in soils are not the result of a release at the site. The
pesticide residuals were likely the result of reasonable and customary application of
the chemicals at the time.
Mr. Maurice R. Hamel, Environmental Analyst III
Connecticut Department of Environmental Protection
February 22, 2007
Page 2
■ The site is not an"establishment" as defined in the Connecticut Transfer Act.
■ The Site is not subject to the RSRs.
■ The residual soils impacted with pesticides can be managed and re-used on-site in
any manner consistent with the March 1999 CTDEP guidance on Development of
Former Agricultural Properties. Included as Attachment 2.
In our previous discussions you indicated that the Town of South Windsor has dealt with
similar sites like the referenced site and that some input from the CTDEP is preferred in
the Towns review. Additionally, the 1999 CTDEP guidance suggests that site specific data
may be submitted for review. However, the CTDEP does not require review or approval
of non-RSR and non Transfer Act sites. This guidance leads to a somewhat ambiguous
process that can vary by site and/or town.
I contacted Maurice Hamel at the CTDEP to review the situation and inquire about their
current implementation of the policy. Mr. Hamel stated that the 1999 technical
components of the agricultural guidance remain valid. However the CTDEP does not have
time to review all applications of it on behalf of land owners and developers. Instead this
is left to local officials to review. If the local official request CTDEP input than they
would be available to provide technical assistance to the Town in their implementation of
the policy.
On behalf of the potential owners and developers of the referenced property, GEI requests
that that the Town of South Windsor reviews the proposed implementation of the CTDEP
guidance regarding the development of former agricultural properties.
The proposed development is currently in a conceptual stage but enough is know to
address the on-site management of the pesticide impacted soils during development. The
relevant facts and performance standards of the proposed development relative to the
environmental impacts are as follows.
• The development will consist of a commercial retail and/or restaurant
establishment.
• The site will be tied to public water and sewer.
• No soils will be removed from the site as part of the development.
• The soil pesticide exceedences of the RSRs are all less than two times the industrial
commercial DEC.
• The detected pesticides are fairly evenly distributed in the top sols of the previously
cultivated areas of the site.
Mr. Maurice R. Hamel, Environmental Analyst III
Connecticut Department of Environmental Protection
February 22, 2007
Page 3
• The relatively low concentrations and the distribution are indicative of past
pesticide application according to the intended use of the chemical. There do not
appear to be any significant"hot spots".
• The new development will manage the soils impacted above the industrial
commercial DEC through a combination of soil blending and isolation.
• Soils will be blended to achieve a mass pesticide concentration less than the
industrial commercial DEC.
• Any soils on the site not able to meet the industrial commercial DEC will be
environmentally isolated to avoid human contact. The environmental isolation will
be consistent with the RSR definition of environmentally isolated. Specifically, the
soils will be placed either; 2 feet under pavement, under permanent building
structures and/or below 4 feet of un-impacted soil.
• The Town of South Windsor will be provided with a plan of post development
environmental conditions that will include; soil ample results after mixing, and the
locations of any soils above the industrial commercial DEC that are managed on
site. This plan would also serve to inform others that the site soil management is
consistent with industrial commercial land use. Any future development proposed
for residential use would have to consider the concentrations of pesticide residue
above the residential DEC.
On behalf of the proposed owners and developers, GEI requests the opportunity to discuss
this issue with you in person. To facilitate any discussion between you and the CTDEP a
copy of this correspondence has been forwarded to Maurice Hamel.
We greatly appreciate your attention to this matter. Please contact me if you have any
questions.
Very truly yours,

Y Soil Blending Report
Former National Cigar Company/South Windsor Tobacco
1049 John Fitch Boulevard,South Windsor,Connecticut
October 29,2007
1.0 INTRODUCTION
1.1 Purpose
ATC Associates Inc.(ATC)was retained by Mr.Daniel Zak of Century 21 to conduct soil blending activities
at the Former National Cigar Corporation/South Windsor Tobacco Facility, located at 1049 John Fitch
Boulevard,South Windsor,Connecticut(herein after referred to as the"Site"—see Figure 1,Site Location
Map). The purpose of these soil blending activities was to satisfy requirements set in place by the Town of
South Windsor for redevelopment of agricultural properties as outlined in the State of Connecticut
Department of Environmental Protection (CTDEP) guidance document and letter compose by GET
Consultants,Inc.(GEI)regarding the status of the Site. Specifically for this Site, the Town of South Windsor
required that soils impacted by proper historic pesticide use be blended to reduce concentrations and adhere to
the following qualifications: concentrations of pesticides within Site soils be below applicable
industrial/commercial direct exposure criteria(I/C DEC) as listed in the Draft Proposed Revisions to the
Remediation Standard Regulations(RSRs)for the CTDEP; Site soils be blended to reduce contaminants to
acceptable levels; and, a berm be created with the top three feet of accessible Site soils along the Site
perimeter. This report documents on-Site activities conducted by ATC to satisfy the soil blending
requirements of the Town of South Windsor as set forth by GEI.
1.2 Background
According to the report,Phase I Environmental Site Assessment National Cigar Corporation/South Windsor
Tobacco Facility, July 25, 2007 prepared by ATC, the Site is currently occupied by a single-story,brick
former tobacco processing warehouse located at the southeast corner of the Site with a tobacco barn along the
southwest perimeter(half of the barn is located on the Site)along John Fitch Boulevard. The western portion
of the Site is utilized as agricultural fields along with the area north of the Site building which is followed by
undeveloped wooded land beyond. Stoughton Brook traverses the northeastern corner of the Site from
southeast to northwest. The Site building and barn are currently unoccupied. Based on the findings of the
Phase I ESA(historic agricultural uses of the Site [i.e.tobacco farming/processing] for at least 100 years)
ATC recommended that a Phase II Subsurface Investigation be conducted to address proper
pesticide/herbicide application within the areas of known agricultural use.
Based on this recommendation,ATC conducted a limited subsurface investigation at the Site on August 2nd
and P, 2007 to address AOC's identified during ATC's July 2007 Phase I ESA. Investigation activities
included the collection of the following:

C Soil Blending Report
Former National Cigar Company/South Windsor Tobacco
1049 John Fitch Boulevard,South Windsor,Connecticut
October 29,2007
• Twenty(20)shallow surface samples(SS-1 through SS-20)for analysis of pesticides in accordance
with USEPA method 8081, with the five highest results having been run for synthetic precipitate
leaching procedure(SPLP)pesticides;
• The collection of five soil samples,UST-I and TW-1 through TW-4,from a depth of approximately
two and a half feet to five feet below ground surface utilizing direct push methodologies.UST-1 and
TW-1 were collected from the area of the former fuel oil UST,TW-2 was collected from the area of
the current septic leaching field, and TW-3 and TW-4 which were located within the agricultural
portion of the Site.Soil samples from the area of the former UST were analyzed for Extractable Total
Petroleum Hydrocarbons in accordance with the CT DEP published method. TW-1 was also
analyzed for Volatile Organic Compounds(VOCs)via EPA Method 8260 and Semi-volatile Organic
Compounds via EPA Method 8270, all remaining soil samples were analyzed for pesticides in
accordance with USEPA method 8081;and,
• The completion of four soil borings as temporary monitoring wells, TW-1 through TW-4. The
groundwater sample collected from TW-1 was analyzed for ETPH in accordance with the CT DEP
published method, VOCs via USEPA Method 8260 and SVOCs via USEPA Method 8270.
Groundwater samples collected from TW-2, TW-3, and TW-4 were analyzed pesticides in
accordance with USEPA method 8081.
Based on the results of the aforementioned partial Phase II ESA activities and GEIs review of the I partial
Phase II ESA,it appeared that shallow Site soils have been impacted by historic pesticide use. Specifically,
the contaminants which exceeded both the CTDEP Residential and Industrial/Commercial Direct Exposure
Criteria in shallow site soils were Dieldrin and Toxaphene. It appeared that a total of approximately three
acres of the Site had been impacted by proper historic pesticide use that exceeded commercial/industrial
criteria. Based on the large size of the impacted area and review of the General Guidance and Development
offormer Agricultural Properties(March 1999) ATC proposed that blending of the top eight inches of soil
be conducted in order to lower the levels of total pesticides detected in shallow Site soils. Blending ofthe top
eight inches was to be facilitated by the following:
• Plowing of the affected area with a bottom plow in a criss-cross pattern to effectively turn over the
top eight inches of the effected area(Figure 2-Site Plan).
• The entire area will then be tilled in a cross-cross pattern utilizing a disc harrow in order to
effectively blend the"flipped"soils.
• This method will be repeated a total of two times over approximately three days.
The following report documents ATC's on-Site soil blending activities within the three affected acres of the
Site.

2.0 REMEDIATION ACTIVITIES
2.1 Site Preparation and Soil Disposal Characterization Sampling
ATC updated the Site-specific Health and Safety Plan(HASP)in accordance with the Occupational Safety
and Health Administration (OSHA) Standard "Hazardous Waste Operations and Emergency Response"
guidelines (29 CFR 1910.120). The HASP was reviewed and signed by ATC personnel and their
subcontractors prior to performing work at the Site. The plan detailed the potential exposures associated with
on-Site activities and the actions necessary to minimize potential exposure.
2.2 Field Activities
2.2.1 Soil Blending
Soil blending activities were conducted by ATC on October 9`"and l0u',2007. The affected three acres(see
Figure 2-Site Plan)of the Site were first plowed to a depth of ten to twelve inches with a two bottom, tractor
mounted, hydraulically operated plow in order to"flip"this area of effected soil. This area was then blended
utilizing a pull behind disc harrow in order to break apart the soils into individual grains and "mix" the
affected area. The affected area was then plowed perpendicular to the first, to a final average depth of
eighteen to twenty inches in order to"flip"the secondary soil horizon, beyond the layer of organic top soil,to
further blend the Site soils. This area was then"mixed"a second time utilizing a pull behind disc harrow in
order to break apart the soils into individual grains and"mix"the affected area. Photographs showing the
blended area are presented in Appendix A.
2.2.2 Post-Blending Confirmation Soil Sampling
A total of eight post-blending soil samples(SS-21D through SS-28D)were obtained from the blended area
within the location of previously collected soil samples that contained either toxaphene or dieldrin in
exceedance of the RSR I/C DEC as shown in Figure 3—Confirmatory Soil Sample Location Map. Post-
blending soil samples(SS-21D through SS-28D)were collected from a depth of zero to twelve inches below
grade utilizing standard hand augaring techniques, placed in appropriate laboratory supplied glassware, and
put on ice for transport to the laboratory. All soil samples were analyzed for total dieldrin and toxaphene in
accordance with the USEPA method 8081. The soil samples were submitted to Con-Test Analytical
Laboratory(Con-Test),a State of Connecticut Certified Laboratory.

4.0 REGULATORY REQUIREMENTS
The CTDEP adopted RSRs(Regulations of Connecticut State Agencies,Sections 22a-133k-1 to 3 and 22a-
133q-1)as of January 31 1996 and"Approved Criteria for Additional Polluting Substances"dated April 30,
1999. The RSRs apply to:
A) Any site undergoing voluntary remediation under Public Acts 95-183 or 95-190;
B) A transfer of"establishment"under Public Act 95-183;or,
C) Any site as ordered by the CTDEP Commissioner. The RSRs establish the limits for testing of
soils from UST graves in addition to the functions listed above.
According to these definitions the RSRs do not apply to Site, however in order to meet the Town of South
Windsor's requirements for re-use of agricultural properties the RSR Criteria that is applicable to the Site
soils is:
1. Direct Exposure Criteria: The purpose of the Direct Exposure Criteria(DEC)is to protect human
health from risks associated with the direct contact or ingestion with various common soil
constituents. The DEC is applicable to soils within 15 feet of the ground surface. Concentrations of
contaminates are evaluated based upon mass-balance analyses and different criteria are established
for residential and commercial/industrial properties. The DEC is not applicable to inaccessible soils,
5

including soils more than four(4)feet below the ground surface,two(2)feet below pavement greater
than three(3) inches thick, or below an existing building, provided an EnvironmentalLand Use
Restriction(ELUR)is in place.
Groundwater in the area of the Site has been classified as"GA"by the CTDEP in the Adopted Water Quality
Classifications of the Connecticut River and Southcentral Coastal Basins, adopted April 8, 1997. The"GA"
classed groundwater is deemed suitable for direct human consumption without need for further treatment.
All of the post remedial excavation soil samples were found to contain total levels of dieldrin and toxaphene
below the applicable RSR criteria.
5.0 CONCLUSIONS
Based on information gathered during the remedial activities,ATC offers the following conclusions for the
Site:
• ATC utilized a bottom plow and disc harrow to"flip"Site soils to an approximate depth of 18 to 20
inches below grade throughout three acres of the Site previously identified as impacted by ATC.
• A total of eight(8)confirmatory soil samples were collected following the blending. Samples were
collected from locations previously identified as being impacted with levels oftoxaphene and dieldrin
above the RSR I/C DEC. The samples were sent to Con-Test to be analyzed for total dieldrin and
toxaphene in accordance with USEPA Method 8081.
• Soil analytical results indicate that concentrations of total dieldrin and toxaphene were below
applicable CTDEP RSR criteria and that the requirements of the Town of South Windsor's
agricultural land re-use criteria have been satisfied.
6.0 RECOMMENDATIONS
Based on the results of ATC's soil blending activities ATC recommends no further action at this time with
reference to the proper historic pesticide application at the Site. However, proper management of pesticide
impacted soil is required during on-Site construction activities
