Very truly yours, t . MarjoriAnthony. hairperson Zoning Board of Appeals MA:dr cc: Building Department I Appl #09-21P, Axle & Spindle Truck Repair LLC Site Plan Planning Department Report 1. Request for site plan approval for a 49ak" repairers license at 13 John Fitch Blvd, GC zone. Prior to 1994, this site was used for warehousing/trucking. In 1994, a site plan was approved for a repair garage/auto transport business. Since 1994, the Zoning Board of Appeals granted several public storage and general repairers licenses, the most recent in 1998. State statutes now require that PZC grant the dealers and repairers licenses instead of ZBA. 2. ZBA and PZC have continually included an approval condition that any vehicles stored outside must be within the fenced area. 3. There is a 25' buffer requirement along the upper west property boundary. If there was buffering in the past, it does not appear to be there now. This needs to be addressed by the owner. 4. The Fire Marshal reviewed the plans and had no comments. 5. The site is served by public sewer and a private well. The Town Sanitarian has reviewed this application and has no issues. If this application is approved, Planning Dept requests an approval modification addressing the buffer requirement. I s M E M O R A N D U M DATE: January 29, 1996 TO: Matthew Galligan, Town Manager,t' FROM: Marcia Banach, Director of Planning RE: Complaint re: 13 John Fitch Boulevard, received from Gregory Neary of East Hartford CC: Jeffrey Folger, Zoning Enforcement Officer Ralph Alexander, Town Attorney In response to correspondence received from Gregory C. Neary, 147 Burnham Street, East Hartford, regarding zoning violations at 13 John Fitch Boulevard(Caron Auto Works), following are the results of my investigation. Caron Auto Works applied to the Planning &Zoning Commission for site plan approval for operation of a repair garage and auto transport facility. The Planning&Zoning Commission approved the site plan on January 25, 1994,with some approval conditions, including: 1. Overhead doors on south side(Burnham Street side) shall remain closed with the exception of entering and exiting the building. 2. No outside diesel repair in the front of the building on the Burnham Street side. 3. Number of vehicles to be stored overnight outside limited to 75. 4. Exterior lighting on the Burnham Street side of the site is to be limited. The above four conditions are the only site-specific approval conditions attached to this approval. The site is screened with a slatted chain link fence. When the gate to the fence is open, ' there is some visibility into the site. When the gate is closed, visibility is limited to items that are taller than the fence. Mr. Neary's correspondence cites many issues to be addressed. Response to each item, in the order listed In Mr. Neary's correspondence, follows. 1. Removal of jersey barriers to allow truck traffic to tum in Caron Auto Works driveway. This area has a historical problem with trucks parking on Burnham Street to use the convenience store located at the comer of John Fitch Boulevard and Burnham Street. The tracks using the convenience store are unrelated to Caron Auto Works business, but appear to use this site to turn around after visiting the convenience store since Caron Auto Works is the first driveway encountered that is large enough for the trucks to turn around in. Caron Auto Works, as well as the w commercial property owner directly east of Caron Auto Works, have both posted their property with signs prohibiting vehicles from using their driveways as turn- around points; but it appears that convenience store customers continue to use these driveways as turn-around areas. Unfortunately, while this is definitely a problem, it is not a Caron Auto Works problem. It is also not a zoning violation for Caron Auto Works. The Planning&Zoning Commission did not include an approval condition requiring Caron Auto Works to allow unrelated trucks to use their driveway for a turn-around. 2. Landscaping. The Planning Department has not released the landscaping bond for this site as yet. That notwithstanding, it is difficult to characterize the proposed landscaping on the approved site plan as"elaborate shrubbery"as indicated by Mr. Neary. Virtually the entire frontage of this site Is pre-existing pavement. The approved site plan includes only three white pines and five dwarf alberta spruce in front of the building. Three additional white pines (5' height) are shown at the east side of the site, next to the driveway. (There is additional evergreen screening buffering this site from the residential property to the northeast, but this screening is not visible from Burnham Street.)A subsequent change order modifies the three white pines directly in front of the building to ornamental shrubs. The landscaping bond will not be released by the Planning Department until (1)the plantings are in accordance with the approved site plan and change orders, and{2) a growing season has demonstrated that the plantings are alive. 3. Dumpster screening, outdoor storage of part0junk. The site plan does not show plantings around the dumpster, but does depict it as screened (generally a stockade fence or screened chain link fence). Our on-site Investigation corroborates the presence of outdoor storage of various materials, Including truck parts, tires, junk vehicles, and trailer boxes being used for storage. A Notice of Zoning Violation has been Issued for the outdoor storage. The Notice of Violation requires compliance by February 6, but also has a provision for the owner to contact the Zoning Enforcement Officer to work out details of compliance In the event that the deadline is too short. If one of the above courses of action does not occur, the violation will be forwarded to the Town Attorney for action. It should be noted that our Zoning Enforcement Officer was unable to corroborate this part of the complaint without going Into the site itself, since the dumpster and outdoor storage are not visible from Burnham Street. 4. Oillgas leaks. The Zoning Enforcement Officer indicates that he was somewhat hampered by snow cover, however, he notes that he was unable to detect oil/gas leaks other than the routine signs of vehicles parked on pavement. 5. Closing of overhead doors, number of vehicles stored.. Two written complaints were received from Mr. Neary, one in October 1994 and one in April 1995. Both included complaints of excessive noise plus other issues(see attached). However, neither of the complaints references open overhead doors as the problem. It is my recollection that the overhead doors were discussed by our Zoning Enforcement Officer with both Mr. Neary and Mr. Caron of Caron Auto Works. Since the closing of the overhead doors was a condition of PZC approval, a Notice of Zoning Violation was issued by the Zoning Enforcement Officer on July 24, 1995. Our Zoning Enforcement Officer has observed open overhead doors on several occasions 2 r during the summer months and thus has cited it as a violation based on the complaints received. The issue of vehicles stored overnight is less straightforward. There is no limitation included in the Planning&Zoning Commission's approval letter that vehicles cannot remain stored for more than 24 hours. Mr. Neary's complaint form from April 1995 reflects, "We were told at the meeting that the vehicles were.not going to be parked more than a couple of days."One of the components of Caron Auto Works business is the storage of heavily damaged vehicles until the insurance claims are settled. This inevitably means that there will be vehicles that appear to be"junk" vehicles stored on site. The site is screened from Burnham Street, in accordance with the site plan approval. 6. Extedorlighfing on Bumham Street. This issue has arisen previously also, and was included In the complaints submitted by Mr. Neary in October 1994 and April 1995. Notes from the zoning file regarding the October complaint indicate that the Zoning Enforcement Officer investigated the complaint about lighting and found that the lights were indirect lighting and did not violate the zoning regulations. 7. Hours of operation. Caron Auto Works indicated to the Planning &Zoning Commission that, in addition to their normal working hours, they would also be bringing in vehicles late at night on occasions. it appears that Mr. Neary has selected the appropriate mechanism in contacting the police department for late- night noise infractions. Previous complaints to zoning enforcement officer As noted above, the Planning Department did receive complaints from Mr. Neary on two occasions. The first complaint in October 1994 resulted in at least four site visits by our Zoning Enforcement Officer(see attached documentation). The notes kept by the Zoning Enforcement Officer indicate that resolvable items were resolved (including completion of the screening fence). The second complaint in April 1995 resulted in a Notice of Zoning Violation Issued in July 1995. Some of the issues, while they may be problems for the residents, are not enforceable by the Zoning Enforcement Officer, as they are not violations of any zoning regulation or Planning&Zoning Commission approval condition. These unenforceable issues include work hours different from originally proposed, and convenience store customers turning around in Caron Auto Works driveway and on residents' lawns. The final item contained in Mr. Neary's correspondence concerns a tree on neighboring property that was cut down by Caron Auto Works. This issue is outside of the purview of zoning enforcement. The Zoning Enforcement Officer has and will continue to address the zoning enforcement issues at 13 John Fitch Boulevard.
