Pelletier In-Law Apartment Renewal PH 4/14/98
1. Request for renewal of a permit for an in-law apartment at 549 Ellington Road,
RR zone, on the second floor of an outbuilding. There is a major home
occupation on the first floor of the outbuilding, a hairdressing salon that was
approved by the Commission in November 1997.
2. The original PZC approval for the in-law apartment was granted in April 1996.
At that time, the PZC imposed the two standard approval conditions:
• When addition is no longer used as an apartment, the kitchen is to be
removed and the living area must be converted into other single family
living space
• This is a family situation and this approval does not make the property
income producing. If the family situation should change, the home will have
to be restored to a one-family condition.
3. The PZC adopted a new in-law apartment regulation on 1/28/98 including a
definition of an in-law apartment as well as specific criteria for the unit; and
providing for a 5-year permit period. These criteria include:
♦ The in-law apartment cannot be larger than 900 sq ft or 40% of the gfa
(whichever is smaller
♦ the entire structure must maintain the appearance of a single family
dwelling;
♦ off street parking for three vehicles must be accommodated;
♦ adequate water and sewage disposal must be provided; and
♦ the owner of the dwelling units must occupy either the in-law apartment or
the main dwelling unit
The Commission may waive one or more of the provisions above (except the
requirement that an owner live in the apartment or house) after determining:
♦ There will be minimum adverse impact on existing uses in the area;
♦ Surrounding property values will be conserved and the character of the
neighborhood will not be unduly disrupted;
♦ Due consideration to preservation of historic factors has been demonstrated.
4: This in-law apartment is 980 square feet, but was previously approved when
there were no criteria. If this renewal is approved, a waiver to the maximum
size restriction is needed.
D5. The Commission may want to discuss how they feel this existing apartment
meets the intent of remaining a single-family house in appearance, as this in-
law apartment is in a detached building. A waiver may be necessary to this
specific provision also.
If this application is approved, the Commission may grant approval for up to five
years. The applicant will be asked via letter to reaffirm ownership of the property
every two years. At the end of the permit period, if the family situation has not
changed, the applicant may request renewal by staff.

building permit prior to start of construction.
4. In accordance with Section 4.7.2.b, the Commission granted the following waivers:
