We have experience in the operation of nail salons at Twin Plaza.in South Windsor and in Windsor center. Our intention is to convert part of our residence to a nail salon use, as well as providing additional living space and a new attached garage. We will have only one non-resident employee and a maximum of 3 stations for servicing nails. We anticipate approximately 20 customers per day, on average. Hours of operation will be 9:30 am. to 7:30 p.m. Monday through Friday and 9:00 am. to 5:00 p.m. on Saturday. We will provide 5 parking spaces for customer use. The home occupation use will clearly be secondary to the use of the building as a residence. We believe this low-intensity use will be compatible with other permitted uses in the Rural Residential zone. Our building design has employed elements to maintain and preserve the residential character of the dwelling and the residential character of the lot. We know of no noise to be generated by the proposed use;traffic will be relatively small and sporadic;there are no anticipated nuisances, fire hazards, offensive odors or pollutants discernable to area residents. No more than 25% of the dwelling's floor area is proposed to be used for the home occupation use. The home occupation use shall be carried on wholly within the house. No vans or trucks associated with the business are proposed. Sight line measurements have been taken and they appear to be satisfactory. The existing curb cut on Ellington Road will be retained. Insofar as the residence fronts on Ellington Road,a state highway, all traffic entering the site will be coming from a state highway and not a residential street. There will be no storage within the garage that would affect adequate space for the storage of our car. We will install any landscaping deemed desirable by the Planning&Zoning Commission, if you feel the proposed four-foot high stockade fence is inadequate to screen the small parking area from the adjoining neighbor on our east side. There are no neighbors to the rear of the property. We appreciate your consideration of our application and look forward to working with Town staff to satisfy all requirements of the home occupation regulations. 165 South Satellite Road, South Windsor, Connecticut 06074 Tel: (860)291-8755 -Fax: (860)291-8757 Qy1N a f+ . -0 n 0 • 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CT 06074 OSoe.co TELEPHONE(860) 644-2511 August 29, 2001 CERTIFIED MAIL Ngan Thanh Nguyen &Yen Linh Thi Ngo-Nguyen 1430 Ellington Rd. Three spaces on right hand side, two in front of garage, four in front of salon, one space west side of lot. (ten parking spaces total.) Three large spotlight type lights on front of house, on newly constructed salon area. 2. Five nail (manicure) tables with chairs, along the east side of the room. 3. Four pedicure stations, along the northwest side of the room. 4. Four nail drying stations along front of salon. (south side of room) 5. Windowed exit door, in rear of salon, beyond the manicure tables. 6. There was a door in the northeast corner of the salon leading into another room, being used for storage. (garage?) 7. Rear of the salon, in northwest corner, there was a door leading to a small room with the furnace and storage. 8. Linh (owner) was there along with three "employees". 9. Linh spoke Chinese to the "employees" and one of them left the salon area (into the house). 10.Linh said that one employee lives with her and the other person, who left the salon area, was her friend. 11.One employee was with a client getting an under eye treatment done. 12.Two clients entered and went to the pedicure stations. DESIGN PROFESSIONALS, INC. civil engineers ♦ planners ♦ surveyors landscape architects ♦ gis ♦ gps June 22, 2006 Narrative Statement Home Occupation Renewal Application of Linh and Ngan Nguyen 1430 Ellington Road South Windsor, Connecticut DPI Project No. 1435 The 5 year permit to allow a home occupation for our nail salon, Linh Beauty Nails, is set to expire in August. We have been operational for approximately 16 months, as we opened in February of 2005. Construction of the building addition continues with completion expected in July. Throughout the construction process, modifications were made to the plans in response to code requirements and site conditions, including a change in windows within the second story addition to comply with building code requirements for egress, and relocation of the sanitary lateral out of the salon to avoid conflicts with existing vegetation. The parking area has been paved and striped. We have asked town staff to allow for a change in fence material, replacing the original approved 4' wooden stockade fence with a more decorative 4' vinyl screening fence. The change order submitted depicts the fencing we have on order and are expecting shipment within the next 2 weeks. Our initial application specified 3 stations maximum for servicing nails. We have a total of 4 nail stations and 4 pedicure stations. One nail station is dedicated solely to air- brush and special design techniques and would be used by one of the 3 nail technicians. We comply with Regulations that allow no more than one non-resident employee. We would like to take this opportunity to request a modification to our business hours currently approved at 9:30 am-7:30 pm weekdays, and 9:00 am-5:00 pm on weekends. With longer summer days,we would like to request an approval of hours ranging from 9:00 am-9:00 pm allowing for greater flexibility for appointments not only during summer months but also during the holidays. We feel this will not impact the surrounding properties due to the limited volume we currently experience. After submitting our renewal application,we have had the opportunity to meet on site with representatives from both the Planning and Engineering departments. An area of concern for both town staff and us has been the wet conditions to the east of our residence and new parking. In order to address this concern we also submit a request to provide additional pavement to the east of our residence to continue shedding water away from our house, and regrade the grass area to receive this runoff and direct it northerly on our site toward the wetlands. This additional pavement would also serve to park our private vehicles and relocate the dumpster farther from the residence. In order to conceal the additional parking area, we are proposing additional sections of decorative vinyl fencing. Another issue arose when we were asked to verify that the area dedicated for salon use was within the 25%maximum of available living space. Upon reviewing the approved plans, our engineer, Karen Isherwood informed us that the approved addition was deficient of the area required for the approved salon space. The living space available with the addition as approved and constructed offers a total of 2575 sf. As constructed,we have 941.6 sf of space dedicated as salon use. This does not include the 138 sf(5.75'x18.5') at the rear of the salon which was enclosed, one half is a mechanical room with a water-heater available to service the house and salon, and the other will remain unused. PO Box 1167,South Windsor,Connecticut 06074 Tel:(860)291-8755•Fax:(860)291-8757 www.designprofessionalsinc.com DESIGN PROFESSIONALS, INC. civil engineers ♦ planners ♦ surveyors landscape architects ♦ gis ♦ gps Our intention is to construct the additional living space by filling in the 23'x23' notch located at the north-west corner of our house, providing a total of 1058 sf over two stories (529 sf each story). We are providing a sketch which identifies this area in both the basement and the second story with additional pantry, master bathroom and enclosed sunroom. Upon completion, the total living space available will be 3633 sf, which would allow the salon to occupy 908.25 sf. Our salon use would be at 25.9%of the living space (approximately 33.35 sf excess area). As the original phase of construction is not complete, we believe that it is necessary to require that the new addition have a set completion date that we feel confident our contractor will be able to meet. Mr. Ed Crease has assured us that construction would be complete for this new addition within 1 year of our approval. As a good faith gesture, we would also offer the ability to temporarily decrease the size of our salon, at least until construction was completed and a certificate of occupancy acquired. The 148.75 sf area along the front of the salon(13.5'x10.5')with the bay window(7 A) (left side) could be recovered for family use bypartitioning this arm off and providing a media/play room for the children. We appreciate how helpful town staff have been in assisting us throughout the renewal process. We also understand that it is the commission's desire to maintain the residential character when permitting home occupations. The salon is doing very well and we wish to continue providing our services at home where we can be more readily available for our young children. In conclusion,we thank you for your patience and consideration of our application. Thank you. JStaff note that securing compliance with regulations and approval ,r e conditions has been a challenge, but town staff have met with the applicant and her representatives on site to address many of the issues in order to bring the applicant into compliance. For the past several weeks the applicant has been working diligently to try to complete the site in accordance with the original approval. 2. -The- ail along- pro se wbe-$-0 Ts to be eq 1 t approximately 25/q of tie, total square footage of the house based o t ditions the proposed,aft-ghat time. A door was added to the side of the house to accommodate access into the salon, and an interior door was to be added to provide access to other areas of the house. The parking requirement was proposed to be met with the addition of a parking area in front of the house. The applicant also proposed a 4-foot high stockade fence along the westerly boundary of the site. The original plan proposed a screened dumpster as well. waS 4. The nail salon itself completed on the interior and began operation in the summer of 2005, however there are several items related to the site work that are not complete and issues related to compliance with the original approval. These include: completion of the parking lot, dumpster screening 1 and stockade fencing, removal of unapproved floodlights, issuance of a certificate of occupancy, final as-builts, WPCA approval compliance, and completion of drainage improvements. It has also been determined that the salon occupies more than 25% of the floor area of the dwelling. Staff recommend that either the size of the salon be reduced or that the necessary addition be constructed to bring it into compliance with the 25% maximum requirement. 5. The applicant's revised narrative indicates that the applicant has 4 manicure stations and 4 pedicure stations. Meant rs alegestirrg approval for longer-operating hours as wel as- nafpavement f6r-the owner's-own 4, _voliieles. 6.Public sewer and water serve the existing house. The applicant had received WPCA approval in July of 2002, with an approval condition that a meter is required to measure flow for commercial use, the location of the meter must` be approved by the Superintendent of Pollution Control, with a log showing the amount of flow from the commercial business. To date that has not been accomplished. Fred Shaw, Sup't of Pollution Control has indicated that the applicant will need to return to the WPCA for approval and to pay for unbilled sewer user fees. 7. The reasons for requiring PZC approval are to ensure that: ♦ the home occupation is clearly secondary to the use of the building for dwelling purposes ♦ the home occupation is compatible with other permitted residential uses in the residential district ♦ the residential character of the dwelling and the neighborhood are preserved, and; ♦ all residents have freedom from excessive noise, excessive traffic, nuisances, fire hazards offensive odors and pollutants, and other possible effects of commercial uses being conducted in residential areas. 8. Performance criteria that must be met include: ♦ Maximum of 25% of the floor area can be used for the occupation; ♦ occupation cannot be visible from outside the dwelling unit; ♦ dwelling must contain the character of a single family dwelling; 2 ♦ no entrance or exit may be added solely for the occupation; ♦ no more than one non-resident employee allowed; ♦ the occupation can not create a volume of passenger or commercial traffic that is inconsistent with the normal level of traffic on the street; ♦ all parking needs must be met on-site; and ♦ the Commission may require screening of additional parking from the jstreet and from adjacent residential properties. 1 ._ `-4v1 'r ,p /1 r7 'L hGru%r-< /^' •, :. fi 9. If this application were approved, the applicant would be required to return again to this Commission for renewal upon expiration of the 5-year permit period.
