Dated this f A U u-s Year 200 f..o Applicant: (Signature) OWNER: (Signature) SECTIO ACTION OF THE BOARD Approved: Denied: DESIGN PROFESSIONALS, INC. civil engineers ♦ planners ♦ surveyors landscape architects ♦ gis ♦ gps Variance Application of MLB, LLC d/b/a Ful-Line Auto 1546 John Fitch Boulevard South Windsor, Connecticut August 17, 2006 DPI Project No. 1560 The variances requested are as follows: 1. Section 13.7.4.a to allow parking of display vehicles within 10 feet of a property line. 2. Section 13.4.a to allow parking without a five feet perimeter screening and no interior landscaping. 3. Section 3.10.5 to modify prior approvals in order to conform to the submitted plan. The peculiar circumstances and hardships in support of our application are as follows: 1. Our client is seeking approval pursuant to Section 3.10.5 to modify prior approvals in order to conform to the submitted plan and is requesting an amendment to an existing variance allowing parking of display vehicles per approved plan. We are seeking approval to change/modify an existing non-conforming use which will not be more objectionable in character. The areas to be used for vehicle display parking are existing paved areas, and thus there is no expansion of the existing use. The proposed parking of vehicles for sale within the leased State of CT Right of Way will be parked a minimum of 25 feet from the traveled portion of the highway per Section 13.7.4.d of the Zoning Regulations. Additionally, the current owner is not operating as a gas station as approved by this Board in 1975,thus bringing the site more nearly into conformity with allowed uses in the Industrial Zone. 2. The commercial property at 1546 John Fitch Boulevard has received multiple variances in the past and thus the Zoning Board of Appeals has identified hardships as outlined in previous appeals. Copies of the documentation associated with said variances are attached. A brief summary follows: a. Appeal No. 1047-75 Effective: February 19, 1975 Applicant: Donald J. Baltulonis, represented by Attorney Harold R. Cummings Variance to Section 4, Article 4.7.2 to allow a public garage and sale of gasoline in an Industrial zone; a State Hearing under 14-321 or 14-54 of the General Statutes for a general repairer's license and sale of used cars and gasoline on the premises. The following restrictions were applied: 1. There may be a total of ten vehicles parked on the outside of the building overnight. All must be in the rear with none parked in the front or on either side. 2. There should be no extended storage of wrecked cars on the property. b. Appeal No. 1151-77 Effective: March 16, 1977 PO Box 1167, South Windsor,Connecticut 06074 Tel: (860)291-8755 •Fax: (860)291-8757 www.designprofessionalsinc.com DESIGN PROFESSIONALS, INC. civil engineers ♦ planners ♦ surveyors landscape architects ♦ gis ♦ gps Applicant: Donald J. Baltulonis, represented by Attorney Harold R. Cummings Variance to Section 4,Article 4.7.2 to allow a public garage, sale of gasoline, sale of used automobiles and the parking of approximately fifty vehicles on the premises. c. Appeal No. 1455-81 Effective: December 16, 1981 Applicant: South Windsor Auto Body& Sales, Inc., represented by Attorney Harold R. Cummings Variance to Section 4.7.2 to allow storage &retail sales of pedal bicycles and motorized bikes. 3. Since the above appeals were granted, the current owner and applicant, MLB, LLC, has entered into a lease agreement with Atlantic Plywood giving the right for Atlantic Plywood to use the rear portion of the lot at 1546 John Fitch Boulevard to maneuver their vehicles and to store equipment and supplies. This agreement allows Atlantic Plywood to maneuver their trucks safely on site without accessing Route 5,thus conforming to the Town's desire to implement greater access management capabilities. The western limits of the leased area are indicated on the attached plan with a wooden fence. The majority of the previously approved parking spaces falls within this leased area, and thus presents a new hardship to the owner. 4. As depicted on the ZBA plan, the applicant has recently secured a lease agreement with the State of Connecticut's Department of Transportation covering 3,364 square feet of state land and allowing for the parking of motor vehicles. This area is in the vicinity of display spaces 1-20, and is an existing paved area. It essentially covers the area from the front curb to the parcel's westerly property line, and is approximately 18.5 feet wide and 182 feet long. 5. The property presently has two driveway entrances onto U.S. Route 5. Subject to ZBA approval, site plan approval from the Planning&Zoning Commission and securing of an encroachment from the State Department of Transportation, the applicant proposed to close the northerly driveway entrance and restore the area with landscaping(see ZBA plan). This is not only a safety improvement, but is also consistent with the principals and practices of access management which have been embraced by the PZC, Town Staff and State Department of Transportation. The site will thus be permanently reduced to one entrance. The State Department of Transportation has agreed to this closing, and it is depicted on the state-approved lease map. 6. Proposed display spaces 1-24 and 39-45 (31 spaces in total) require a ten feet variance to Section 13.7.4.a, in that they are not at least ten feet from a property line. This is necessitated by the need to access the rear of the property, where vehicles are parked and where damaged vehicles are repaired/restored(interior space access from east side of building), and to access the west side of the building(where offices and repair bays are located). 7. Spaces 1-28 and 37-45 are proposed motor vehicle display spaces (total of 37 spaces). 8. Spaces 29-36 and 45-55 are proposed customer and employee parking spaces (20 total, as required per zoning). PO Box 1167, South Windsor,Connecticut 06074 Tel: (860)291-8755 •Fax: (860)291-8757 www.designprofessionalsinc.com DESIGN PROFESSIONALS, INC. civil engineers ♦ planners ♦ surveyors landscape architects ♦ gis ♦ gps 9. Vehicles being serviced by the repair/restoration operation will be stored to the rear of the building, up to the existing wooden fence. This includes vehicles damaged in accidents. 10. The existing building is non-conforming to the front yard requirement(28.8 feet setback rather than 35 feet under zoning). 11. The existing property has been historically used as a gas station(former Texaco station), wrecker service, dirt bike sales and a dirt-bike track(in rear), used car dealership, and general motor vehicle repair facility(including general repairs and body shop repairs to vehicles damaged in accidents). It is substantially paved with bituminous concrete and gravel surfaces, and does not allow sufficient area for interior landscaping. 12. The building presently can service four vehicles in the repair garage and six vehicles in the body shop. There are approximately seven employees. 13. David Bombeto, a member of MLB, LLC (owner and applicant) started his business in East Hartford in 1985, and relocated to 1546 John Fitch Boulevard in 1986. In 2001, Mr. Bombeto acquired the property in the name of his limited liability company, MLB, LLC. 14. In 2003, Joy O'Connor, Zoning Enforcement Officer, issued an enforcement letter to the applicant, indicating that the subject property was not being operated in conformity with prior approvals. In order to correct this matter, Mr. Bombeto first needed to secure a lease agreement from the State Department of Transportation. Toward this end, he retained legal counsel, Harold R. Cummings, and also a consulting engineering firm, Design Professionals, Inc. (DPI). After a long process, in 2006 Mr. Bombeto (MLB, LLC) secured state approval of a lease map and a lease for the necessary area. DPI then completed a property survey, and then a ZBA Plan, to be used in furtherance of the subject ZBA variances application. Upon approval from the ZBA (if granted), the applicant will then seek approvals from the CT Department of Transportation for the northerly curb cut closure and related improvements, and from the PZC for the revised site plan. In summary, the subject property at 1546 John Fitch Boulevard has a long history of commercial, rather than industrial (its current zone) uses. The original use was a Texaco gas station, and it has also been used, often concurrently, as a used car dealership, bicycle and motorized bicycle sales and repair shop (with a bike tract in the rear), a body shop for damaged vehicles, a motor vehicle repair operation, and a wrecker service in support of the South Windsor police. It has always presented problems for the owners once it became a non-conforming use in the industrial zone. Its uses were more appropriate and conforming to the GC zone, but the PZC never changed it,presumably due to concerns about spot zoning. The ZBA has acknowledged this, and on at least three occasions has granted variances, including in 1981, when the board granted the variance"because it reasonably related to the current operation, will not change the use of the facility, nor will it change the character of the operation or impinge on neighboring properties." We believe the essence of that decision applies to the instant application, and will reasonably allow the owner and applicant to continue, with minor site modifications, his business, which is used car sales, vehicle repairs, and a body shop operation, and will further establish a reasonable benchmark for regulation of this property. We also believe the closure of the site's northerly entrance on U.S. Route 5 will further the principles and practices of access management. Thank you for your consideration of this application. Cummings; 1665 Ellington Road South Windsor, Connecticut 06074 Dear Attorney Cummings: RE Appeal No. 1151-77 Your application to the South Windsor ZoningBoard of Appeals a variance to Section 4, Article 4.7.2 to allw a requesting gasoline, sale of used automobiles and the public pie' sale of vehicles on premises known as 1546 John Fitch Boulevard,, Zone Zo tI.,has been approved.. The Board felt the operation has been a clean one and a hardship exists if Mr. Baltulonis is unable to expand his business, which will also bring increased tax dollars to the Town. The Board also felt the land could sustain the parking of approximately 50 vehicles as shown on the drawing . by Mr. Carrington. This approval is subject to site plan approval by the 1 Planning and Zoning Commission. This action is effective March 16, 1977, and upon filing in the Town Clerk's Office. 'Yery'truly_yours, Richard H. Eriksson, Chairman Zoning Board of Appeals RHE:bck Xppl?CATI0N NO. 1151-77 - DONALD J. BALTULONIS, c/o Harold R. Cummings, ngisq, on oa , reques s a variance to ection 4, Article 4. 7.2 to allow KA,aboa a public garage, sale of gasoline, sale of used automobiles and the parking of approxi- ut a nlately fifty vehicles on premises known as 1546 John Fitch Boulevard, Zone I. Attorney Cummings represented Mr. Baltulonis. In 1975, an appeal was granted for a public garage and general repairer's license, with parking allowed on the premises a : ` for ten cars. Using the regulations of Town and without any crowding, William J. ;ld be Carrington drew up a plan showing there was room for fifty-six vehicles on the property. Mr. Baltulonis is now in a position to purchase the building but cannot e it : = justify doing so without expanding his operation. He feels the parking of about forty ems cars would be necessary for the expansion of the*business. No one was present to speak in favor or in opposition. :use Mr. Eriksson noted at the hearingin1975 Mr. Baltulonis had been asked how many y' cars he would like to be able to park on the property and he replied ten to twelve. nm Thus, the restriction of ten cars was placed on the variance. , He. also asked what had i11 ow changed that he now needs to park forty cars on the premises. Mr. Cummings replied h wi Mr. Baltulonis is primarily an automotive repairman but would also like to sell used ved cars. He would like to be able to enlarge the site and to do so he needs the approval r for parking a greater number of vehicles. barn Mr. Eriksson inquired if the use of the property would change. Mr. Cummings loca replied they were not changing the primary use. Mrs. Murray asked about the size of the property and learned it was 1. 3 acres which i on narrows in the rear toward the railroad tracks. I . Mr. Eriksson continued to question Mr. Cummings and learned the increase in the At number of cars would be used cars and not an increase in wrecked cars waiting to `y. be repaired. .The cars will continue to be displayed behind the building line as and shown on the map. Many of the sales will be to dealers and, therefore, signs and latioa advertising will not'be necessary. Mr. Cummings said although they were conserva- wi tively asking:for forty cars, they really would like permission to park fifty-six cars. ants" WORK SESSION * : - • . :ers APPlication No. 1149-77 - Glen Schukei and Donald Muller of Mr. Cowles said he failed to see the hardship involved. He felt if the land had been e Purchased some time ago and the owner had wanted to develop it then there was a ' hardship. He did not see the hardship of buying land approved as one building lot and then deciding to make it two lots. The sale could have been made pending the in approval of the Board. in. _ - ine Mr. Eriksson said Attorney Cummings claimed the hardship was the 9. 6 acres of land with only 60 feet of frontage, which was the result of many years of the entire cues iaxcel being divided and deeded and the hardship was the same as when Dzen appealed lire to the Board and was given a variance. C S. Murray wondered if this could result in'a development and the Board felt it d. Mr. Vitiello felt if the Board granted two lots they could then come.back asking for r'ore lots. He was concerned about the ecology of the land and would not object if they were willing to go through the testing required to obtain approval. I am writing in support of the variance requested by David Bombeto, MLB, LLC for the property located at 1546 John Fitch Blvd in South Windsor, Connecticut. As you know, this is a commercial property and has been used for this purpose for over 30 years and will never be developed for residential use. On the south side there is Waybest Chicken, the north side is Atlantic Plywood and across the street is G&R Marine. This exemplifies the mix of industrial and commercial uses along Route 5. David Bombeto has always worked with his neighbors for the betterment of the community. Mr. Bombeto granted his neighbor to the east, Mr. David Caron, an easement along the entire north side of the subject property for storm drainage for the South Windsor Technologies Center. This enabled Mr. Caron's project to drain without requiring a new pump station for the town. Mr. Bombeto has also worked with Atlantic Plywood to allow them to use a portion of the subject parcel to turn their trucks around in the rear lot. This prevents the backing of trucks onto Route 5. Each of these examples clearly shows Mr. Bombeto's sincere interest in the betterment of his community on Route 5 and the overall Town of South Windsor. Improvements on this property will not have an effect on any residents or nearby businesses. The development will bring prosperity to the taxpayers in this community. Sincerely, ric Lang and/or David Beau Atlantic Plywood 1590 John Fitch Blvd South Windsor, CT ATLANTIC PLYWOOD, INC. Town of South Windsor, We at Atlantic Plywood Corporation would like to speak on behalf of our neighboring business, Full Line Auto. We have been neighbors with Full Line Auto for the last 24 years. The parking of his vehicles does not negatively impact our business operations next door. We would not have any objections to him being able to increase the number of cars he is allowed to park in the front of his property. We currently lease his back parking lot on a monthly basis. This is critical space for us to use for our distribution business. Not having the space available would create significant concerns on our part. They are as follows: 1. We have a very narrow parking lot, which would create the need for our trucks and carriers to back out of our parking lot onto rt. 5. This includes ten wheel delivery trucks, and forty-eight foot tractor trailer combinations. This in our eyes would create a significant safety hazard. 2. We also utilize this space for the parking of our delivery fleet, for staging trucks to be loaded, staging trucks to be received, along with additional parking for our warehouse and office employees. After recently considering moving our warehouse to Manchester Connecticut, last May we renewed our lease for the next three years. If we are not able to utilize the parking space we are currently leasing from Napa Auto Care, we will need to re-consider relocating our warehouse to Manchester, Connecticut again when the current lease is up. We fortunately have experienced steady growth over the past several years and loosing this workspace would largely impact our ability to operate efficiently out of our current building.
