Variance Application
Berman,Russo& Sulick
819 Clark Street
South Windsor, Connecticut
June 5,2006
Berman,Russo & Sulick previously converted the former Gustaves Grant homestead,
circa 1818 (which is one of the few remaining from that period in Wapping),to their law
offices. In order to accomplish the project, the process included securing a zone change to
the Restricted Commercial zone in January of 1990,the granting of variances in
November, 1989, February, 1990, and December 2005. The 1990 approval included
approval by the Town Council of restricted covenants (which are now on file in the office
of the Town Clerk). Finally, site plan approval was granted from the Planning&Zoning
Commission on June 26, 1990. The subject of this application is to modify the November
1989 ZBA variance approval that allowed a 19.7 feet front yard to now allow an 18.6 feet
front yard. The hardship that supports this application is:
1. The original ZBA variance was requested based on a map prepared by Design
Professionals, Inc. in August 1989. This map specifies that the existing building is
19.7 feet from the front property line. The building is in fact 18.6 feet from the
front property line. The 1989 map reflects a Scribner's error that was found when
Design Professionals, Inc. recently updated the boundary survey to A-2 standards.
Neither the location of the building nor the front property line have changed since
1989.
We appreciate your consideration of this application and of the factors related to it.
Thank you.

Re: Application #1513-89 - 819 Clark Street
Dear Mr. Berman & Mr. Russo:
At the meeting of the Zoning Board of Appeals held on November 2 ,
1989 , a variance was granted to Section 5.2 of the Zoning Regulations
to allow a front yard of 19. 7 feet on property located at 819
Clark Street, South Windsor, RR Zone.
Your request for a variance to Section 5. 4.1 to use a lot with
reduded buffer required on property located at 819 Clark Street,
South Windsor was denied. The board felt-".there was no hardship
because the requirement doesn' t exist yret.
The variance granted is effective upon your filing of the enclosed
form in the Town Clerk's office at your own expense.

RE. Application #2683-06—Jon D. Berman & Frank W. Russo, 819 Clark Street, RC
zone
Dear Mr. DeMallie:
At the meeting of the South Windsor Zoning Board of Appeals held on July 6, 2006, the Board
approved your request for a 46.5' variance to section 10.2 for an existing structure 18.5' from
the front property line, at 819 Clark Street, RC zone.
The Board concluded the hardship to be that the pre-existing structure of historic value was
built 18.5'from the property line. Previous variance granted in 1989 for the 19.7' had a
scribner's error.
Any new building, or alteration/additions to existing buildings, requires a building permit prior to
start of construction.
These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your
own expense.
Very truly yours,
Thomas Berstene, Chairperson
Zoning Board of Appeals
