Indian Ridge. Condominium Site-Plan was approved with certain conditions and required modifications , the intent was expressed that the six and one-half acre parcel upon which no building is intended would be eliminated from the condominium when declared. In order to achieve that result and acknowledging that density requirements are safely met as a result of the reduction in permissable units without the parcel in question, I would like to have the final mylar for recording prepared in such a way as to exclude the six and one-half acre parcel entirely. Certain data in the data blocks on the plans would of course have to be redone to reflect this change. If you deem it appropriate, I would appreciate your Commission permitting us, by vote, to make the changes described in this letter. Box 559 South Windsor , Ct . 06074 Dear Wayne: Re : Indian Ridge Condominiums When the Indian Ridge zone change to MF-A and General Plan were approved , a 62 acre parcel near Ellington Road was included . The special exception and site plan have now been approved with a number of modifications , and the density was reduced from 284 units to 258 . No building will occur on the 62 acre parcel and the zoning requirements are being met without the 612 acres being included. Mr . Sbarge now- wishes to exclude the 62 acres , as you can see from the letter from him dated March loth. The Commission feels the zone should be changed back to RR. One of the Commissioners felt the parcel would automatically revert back to RR if the site plan excludes this parcel when it is filed . Others felt the applicant should file an application to change the zone back to RR, as well as another application to amend the special exception/site plan, and that another public hearing should be held. The applicant is anxious to proceed, and I would appreciate it if you would advise us of the proper procedure. to follow. I believe Mr Sbarge intends to file applications within the next week or so , so I would appreciate hearing from you as soon as possible . In front of Unit 202 , a section of bituminous curb must be repaired. 3 . At the parking lot just south of Building #2 , bituminous curb must be repaired. 4 . The parking lot just south and west of Building e has some ponded areas, especially adjacent to the catch basin. 5. In front of Building #4 , there are two lengths of bituminous curb that require repair. As these repairs are in Phases I & II, I will recommend that Phase III be allowed to go to a maintenance bond. Evans , Chairman Planning & Zoning Commission 1540 Sullivan Avenue South Windsor, CT 06074 Re: Strawbridge Condominiums Dear Louise: This will acknowledge receipt of your letter of April 3, 1987 which describes the discussions and decisions of the Planning & Zoning Commission at the Commission meeting of March 24, 1987. The only concern we have with regard to your letter relates to its final sentence which indicates it is the Commission' s intention that the restoration of the area behind Buildings 24 through 28 be completed before the issuance of Certificates of Occupancy for any of the units in Buildings 24 through 28 . The Owner expects to request CO' s for Building 28 within 30 days from today, for Building 24 within 45 days from today and for the other buildings at 15-day intervals . Although the Owner expects to have the restoration work you describe in your letter completed promptly, it may well be that it will not be complete prior to the Certificate of Occupancy schedule I have just described. I would suggest to you that the Town' s interest in insuring the restoration work is complete is amply covered by the substantial landscape bond which the Town has for the entire project. Please consider this letter to be the Owner' s representation to you that the restoration work you describe in your letter may be deemed to be part of the work covered by the landscape bond. r a +' 4 HARDING, SBARGE, SVONKIN & DRONEY, P.C. Page 2. April 13, 1987 Louise C. Evans, Chairman Planning & Zoning Commission In the light of the bond protection which the Town has, I request that the Commission reconsider its intention with regard to Certificates of Occupancy which your letter describes and confirm that the completion of the restoration work is not a precondition to the issuance of any CO' s with regard to Buildings 24 through 28 . Your consideration of this matter will be greatly appreciated. On November 26 , 1986, I provided a "punch list" of items to be completed. Items #1 and #4 are still outstanding. The Town Attorney ,has suggested that for these particular phases,. where the improvements are substantially complete, a maintenance bond plus the cost of improvements to be corrected can be established. Another question that has been raised by Andover Equities is: When does the maintenance bond go into effect, when the request is made or when Planning & Zoning acts on it? I feel that their request should be granted for the maintenance bond to be in effect as of last year. I feel that the circumstances behind their not getting all bonds re- duced in a timely manner would not set a precedent. Louise Evans - 2 - April 30 , 1987 Phase I: Can go to a maintenance bond with consideration of Items #1 and #4 of my November 26 , 1986 punch list. These items would add approximately 500 to the bond. Recreation - the pool and tennis courts are complete and should be reduced to their maintenance bonds (20o for two vears) . The ponding by the tennis courts has been corrected. Phase II: Go to a maintenance bond. Phase III: Go to a maintenance bond. Phase IV: All utilities have been installed; Road base and pavements are in place. Yet to be done is the wear- ing course on the principle roadway and concrete pads for the dumpsters . Phase V: Same as Phase IV. Phase VI : Completed: clearing and grubbing, approximately 2/3 of the required pavement, all of pavement base, all storm sewers , all sanitary sewers . We are hereby submitting for Planning and Zoning Commission approval, the modified site plan design for Phases 2, 3, and 4 to conform to the previous outstanding approval by Planning and Zoning Commission's con- dition of approval letter dated November 30, 1984. Phases 2, 3, and 4 will consist of 94 units broken down as follows: Phase 2: Building # Unit # 4 8 5 10 6 8 Phase 3: 7 8 8 10 9 10 10 10 Phase 4: 11 10 12 10 14 10 TOTAL 94 Please note that the modification plan reflects that each unit will be a Two-Bedroom Townhouse, and each and every unit will have a garage. There is a maximum -of ten (10) units per building. The total count for the development of 258 remains the same. There are three (3) different styles of units: Exeter, Coventry, and Dorchester. We have eliminated the one-bedroom units from these phases. With the addition of garages for each and every unit, we are increasing the parking spaces inasmuch as there is a 20 foot depth from the garage to the main drive which allows room for an additional car in front of garages. ' - 2 - Mr. Gaetano J. Bazzano, our Architect, has met with your Fire Marshall, Mr. William Lanning, to review the site design of Phases 2, 3, and 4. He had no objections to the site design. Mr. Bazzano has asked him to notify you accordingly, this date. We will continue with the landscaping theme for these phases which is in place for Phase lA and for work to be completed in Phase 1B now under construction which is of high quality and architecturally pleasing. These plans reflect the consensus of our meeting held on April 11, 1985 with yourself, Mr. Richard Martel, Bowen Davies, Gaetano Bazzano, Igor Vechesloff Terry Supple, and myself. We ask that you arrange to have us included in the Planning Commission's agenda and workshop sessions at the very earliest possible date. The proposed sanitary sewers meet all Town standards and specifications as shown. You and I had informally discussed the phasing relative to the installation of the proposed pump station. A potential problem could be caused by low flow conditions to the pump station during the initial occupancy of Phases IV and V. A cracked concrete slab on the west side of Building #1 must be replaced. 2 . In front of Unit 202 , a section of bituminous curb must be repaired. 3 . At the parking lot just south of Building #2 , bituminous curb must be repaired. 4 . The parking lot just south and west of Building #3 has some ponded areas, especially adjacent to the catch basin. 5 . In front of Building #4, there are two lengths of bituminous curb that require repair. As these repairs are in Phases I & II, I will recommend that Phase III be allowed to go to a maintenance bond. As soon as the above corrections have been completed, please notify me so that I can verify this information. Very truly yours, elchard P. arte Town Engineer RPM/jsv / CC: Ms . Evans: Please refer to my letter to the Planning & Zoning Conunission of June 25 , 1986 (copy attached) . No action has been taken on the request contained in that letter as of today. We did receive, however, a letter from Richard P. Martel, Town Engineer, dated November 26 , 1986, which letter refers to certain repairs (copy attached) . It had been our understanding that a reasonably prompt inspection would have been made of Phases I , II and III upon the receipt of my June 25, 1986 letter. The repair work referred to in Mr. Martel ' s November 26 letter is clearly the kind of work that a maintenance bond is designed for. We are concerned that, although the maintenance bond for Phases I , II and III should have been approved in the normal course of business shortly after your receipt of my June 25 , 1986 letter with the one year duration of the maintenance bond running from that date, we are now faced with a much extended period during which the maintenance bond would run. We would appreciate your placing the issue of a maintenance bond on Phases I, II and III on your agenda for the earliest possible meeting with the hope and expectation that the reduction of the existing performance bonds on those phases to maintenance bond status be approved as of a date in early July, 1986 . Very ruly yours ' Steven R. Krohn Vice President - Finance Strawbridge Condominiums Mrs. Rossi said she has walked this site with the Planning Director and it looks like the snow fence delineating the wooded areas to be preserved had been moved. Parts of the snow fence were down and trees that were left will not live since the roots were displaced. She said she would like to review the "old" plan and compare it to what has been done. It may be they followed the "old" plan rather than the revised approved plan. A general discussion ensued about enforcement of site plans and subdivision plans and the Commissioners agreed that there is aproblem with enforcement. There should be someone to enforce approved plans, and bars. Evans said the Town Council should consider this at buc'get time. She noted that between the Engineering and Planning Departments there is a gray area and there is need for a person to be out in the field inspecting these sites. Mr. Hallowell made a motion to continue the meeting past 10 :30 p. m. Vrs. Rossi seconded the motion and voting in favor were Commissioners Evans, Hallowell , Rossi, Castro, Montana and Klenke. Mr . Sorenson was opposed. The motion was duly carried by a six to one vote, and so ordered. • y ANDOVER EQUITIES, INC. 22D ANDOVER DRIVE WEST HARTFORD, CT. 06110 203 - 724-6330 ` lCOav 4: February 1, 1988 4` Mr. Raymond Hallowell, Chairperson Planning & Zoning Commission Town of South Windsor 1540 Sullivan Avenue South Windsor, ne t-ic-ut____Q4074 Re: ,` Strawbridge Condominium Bond Re du tions Dear Mr. Hallowell: In reference to the letter of September 15, 1987 by Richard Martel, Town Engineer, copy attached, all items in Phases IV through VIII have been completed. Section 4 .13 of the Zoning Regulations of the Town of South Windsor, entitled "Site Development Plan" , states, "No Certificate Of Occupancy shall be issued unless the requirements of these plans (ie. the approved site plans) haze been fulfilled.
