Concrete sidewalks along Graham and Nevers Road . We need appropriate plans for review. 2 . Drainage and curbing on Abbe_ Road . We need plans and profile for review. 3 . The proposed underdrain along the Lot 24 sideline as shown on plot plan. It would assist in .the groundwater for the individual lot but not for the area. 4 . The storm drainage line on Lots 39 and 40. This has been shown on every set of drawings since 12-22-78 . There has been nothing submitted to justify its modification or elimination. 5 . The building permit plot plans submitted for Lots 27 and 28 . It would appear that the driveways come up 10 ' in 50 ' or about 20% slope. Your architect should review this situation. 6 . The building permit plot plans submitted for Lots 30 and 33 . There shall be staked hay bales at the top of slope behind the foundations for sedimentation and erosion control . Without appropriate plans , all the discussions are fruitless . Your attention to this matter would permit all of us to complete your subdivision improvements in a timely manner. Any other convenience drain should be shown on the as-built drawings . I am aware of at least two--there could be more. 5. I mentioned to Peter, that the portion of Old Farm Road- from Lot 13 through Lot 19 , does not conform to the standard cross section, as required, and cannot be brought up to grade with just a 1" top course. This road is unacceptable and should be removed and redone. July l5, IyId4 Page 2 6 . We are still waiting for the catch basin on Abbe Road, south of Old Farm Road to be installed. 7. We- are still waiting for the sidewalk plan along Graham and Nevers Roads to be submitted. 8 . The monumentation around the open space area is still not done. 9 . Trees. This 'list does not include everything still to be done but require some action. If you have any questions or wish to discuss this, I can be contacted at 644-2511, extension 244 . Attending the meeting were your representative, Mr. Mario Giroux, Messrs. Raymond Hallowell and Frank Castro of the Town of South Windsor Planning and Zoning Commission, Mr. Marc Goodin of Close, Jensen & Miller, consulting engineer for the Homeowners, and the Homeowners: Mr. Ronald Bell, Mr.' Adam Lopuszynski, Mr. William Johnson, Mr. James Cormier and Mr. Miles McCarthy. Another Homeowner, Mr. Frank Thyrring was unable to attend; his interests were repre- sented by the other Homeowners at his request. It should be noted that Messrs. Hallowell and Castro were present only in their capacity as members of the Planning and Zoning Commission to observe and facilitate an agreement between the Homeowners and Veilleux Enterprises. Neither they nor the Planning and Zoning Commission are parties to this agreement. Mr. Marc Goodin and his firm, Close, Jensen & Miller, acted only as consultant to the Homeowners; Mr. Goodin and his firm also are not parties to this agreement. It is expressly understood and agreed that the Homeowners enter into this common agreement solely for purposes of convenience and efficiency, individually and not as a group; in all respects they seek only to further their individual use and enjoyment of their respective proper- ties. In no wise does any individual Homeowner assume any obligation or duty to, or liability of, any other individual Homeowner or the group as a whole. Moreover, in no wise does any individual Homeowner act as any agent of, or in any other fiduciary capacity for, any other individual Homeowner or the group as a whole. As you know, from the completion of the first residence in Southridge Estates problems associated with the accumulation of surface and sub-surface waters have plagued the homeowners of Mr. Rene Veilleux April 7, 1986 Page 2 primarily the northerly and easterly lots, that is, Lots 24, 25, 26, 27, 28 and 30. Without enumerating these problems in their entirety, they include: seepage through basement floors and walls, seepage through window wells, seepage through cracks in hatchways, subsidence and upheaval of lawns, driveways and walkways, erosion of soil, etc. These various water-related problems are the direct and proximate result of inadequate planning and building at the time of construction. Over the course of the last 18 months, the Homeowners have made individual and concerted efforts to obtain relief from Veilleux Enterprises for these problems as they arose. Unfortunately, those remedial measures which were undertaken did not eliminate the underlying cause of continued water accumulation, but rather superficially treated only its developing effects. Thus, the primary problem remains unresolved and the Homeowners continue to be unable to use and enjoy their property to normal and reasonable expectations. Through the intervention and cooperation of the Planning and Zoning Commission, the parties met at the aforementioned date in a good faith effort to resolve this continuing controversy without resort to adversarial measures. Relying on Mr. Giroux 's representations that he was authorized to act for you individually and Veilleux Enterprises, a discussion was had and agreement was reached with the Homeowners for specific measures to be taken by Veilleux Enterprises to remedy the underlying problem and its known and visible manifestations in a compre- hensive manner. What follows is a general and specific (by lots) listing of the work to be performed by Veilleux Enterprises in conformity with the agreement by its representative Mr. Mario Giroux and the Homeowners. With the exception of the work pertaining to Lot 30, the property of Mr. and Mrs. Myles McCarthy, all work and materials is to be performed and provided at no charge to the Homeowners. As expressed by your representative, Mr. Giroux, during the course of the meeting, the work and materials for Lot 30 will be provided at nominal cost as an expression of goodwill on the part of Veilleux Enterprises and to reflect the significant savings which will be achieved by including the work at Lot 30 within the overall project. It is agreed that the work will start at the beginning of May, and all work will be concluded by the end of June. All materials used will be good quality, and all work will be performed in a good and work- manlike manner. The Homeowners will be given reasonable and adequate notice of all work to be performed on their respective lots. To facilitate such notice, the home telephone numbers and Mr. Rene Veilleux April 7, 1986 Page 3 available business telephone numbers of the Homeowners are provided below. Upon such notice, the Homeowners will cooperate with all reasonable requests for entry upon the premises and provision of necessary power supplies. While the Homeowners desire and fully anticipate that the work to be performed under this agreement will remedy the underlying problem and its effects, they reserve their rights of further action and do not waive nor relinquish any remedies available to them individually or collectively. However, in consideration of the willingness of Veilleux Enterprises and yourself individually to enter into this agreement, the Homeowners will forego any rights of action they may have if, within a reasonable time after the completion of the work, the Planning and Zoning Commission or its designated representative(s) determine in a fair and objective manner that the general and specific performances undertaken have accomplished the purposes of this agreement. Ronald Bell, Mr. Adam Lopuszynski, Mr. Giroux's representations that he was authorized to act for you individually and Veilleux Enterprises, a discussion was had and agreement was reached with the Homeowners for specific measures to be taken by Veilleux Enterprises to remedy the underlying problem and its known and visible manifestations in a compre- hensive manner. Upon such notice, the Homeowners will cooperate with all reasonable- requests for entry upon the premises and provision of necessary power supplies. While the Homeowners desire and fully anticipate that the work to be performed under this agreement will remedy the underlying problem and its effects, they reserve their rights of further action and do not waive nor relinquish any remedies available to them individually or collectively. However, in consideration of the willingness of Veilleux Enterprises and yourself individually to enter into this agreement, the Homeowners will forego any rights of action they may have if, within a reasonable time after the completion of the work, the Planning and Zoning Commission or its designated representative (s) determine in a fair and objective manner that the general and specific performances undertaken have accomplished the purposes of this agreement.
