Re: Appl. #2374-97—ABS Auction Group, Inc., 24 Jeffrey Street, I Zone.
Dear Sirs:
At the meeting of the South Windsor Zoning Board of Appeals held on October 9, 1997, the Board
approved your request for a use variance to Section 6.1.2 to allow auction use in an industrial zone, at 24
Jeffrey Street, I Zone.
The Board concluded the hardship on the property to be as follows:
1) Difficulty utilizing such a large building and parking area for industrial uses.
2) The regulations do not define any allowable zone where auctions can be held.
Any new building, or alterations/additions to existing building, require a building permit prior to start of
construction.
These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own
expense.
Very truly yours,

Re: ABS Auction Group
Denial of Used Car Dealer License
Dear Ms. Anthony:
I own the property at 24 Jeffrey Drive. I just received word from Mr. Art Scheer, President of ABS
Auction Group, that his request for a used car dealer license for the property was turned down by the town
of South Windsor.
When Mr. Scheer and I appeared before the South Windsor P&Z Board in October, we were granted a
variance to allow an auction service to operate on the property, which included the building at 24 Jeffrey
Drive and the surrounding 350-car, fenced-in parking lot. Mr. Scheer requested the used car dealer license
so that he can auction used and classic automobiles. He has assured me that he is not going to use the lot
for selling cars, as in a used car lot. The access to the property is through 20-ft. gates which are off
Pleasant Valley Road and will not impact the traffic on Jeffrey Drive in any way.
I think you should know that the building was originally constructed for McCullagh Leasing, Inc., who
owned and operated a car leasing company there for 12 years. GE Capital Fleet bought out McCullagh and
occupied the premises for another 3 years, doing the same business until November of 1996. At any given
time, there were 300 cars stored on that parking lot and several more were having mechanical work done
inside the building. Since the building is in close proximity to the Hockanum River, the environmental
requirements were very stringent. Therefore, the parking lot has a drainage system which empties into a
1,600-gallon oil/water separator tank, which is fully capable of handling any equipment which Mr. Scheer
might bring on the property. The tank was emptied and cleaned on March 6, 1997 by Connecticut Waste
Oil, Inc. of Wallingford, CT, (203)235-8889.
Allowing Mr. Scheer the full use of the property is imperative to the survival and growth of ABS Auction
Group. Mr. Scheer signed a five-year lease with me to rent the property, with the expectation that he
would be able to fully utilize the building and enclosed parking lot.. Not allowing Mr. Scheer to maximize
the use of the property creates a tremendous hardship for him and makes his business less viable. As the
property owner and a South Windsor taxpayer, I ask you to please reconsider Mr. Scheer's request.
If you have any questions, concerns, or need further information, please feel free to call me at 875-5651.

Re: Appl. #2390-98 - Arthur B. Scheer, ABS Auction Group, Inc., 24
Jeffrey Drive, I Zone
Dear Mr. Scheer:
At the meeting of the South Windsor Zoning Board of Appeals held on February
5, 1998, the Board denied your request for a variance to Section 6.1 to modify
the use variance granted on October 9, 1997 to include auctioning of
used/antique vehicles.
The reason for the denial of the variance is as follows:
The reason for the denial of the variance is as follows:
1. No hardship was demonstrated on the property.
2. There was an inability to agree on conditions & restrictions
(between the applicant and the Board), that would make the
variance acceptable to the Commission
The Board tabled your request for a State Hearing under Section 10-55 and
3.1.3 of the Zoning Regulations to allow a used car dealers license, on property
located at 24 Jeffrey Drive, I Zone.
The reason for tabling of the State Hearing is as follows:
1. To give the applicant an opportunity to apply to the.Planning &
Zoning Commission for a temporary and conditional permit for
auctioning of vehicles only.
2. To get in writing an opinion from the Town Attorney regarding what
type of restrictions and conditions, if any, the Zoning Board of
Appeals could place on a State Hearing application.
This application will be taken up after you receive action by the Planning &
Zoning Commission.
Very truly yours,
